which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Public Health Service Act to authorize a loan repayment program to encourage specialty medicine physicians to serve in rural communities experiencing a shortage of specialty medicine physicians, and for other purposes.</official-title></form><legis-body id="HCA971A44CACB49AFA197B709C6B4F88D" style="OLC"><section id="HFE207789C9504D998C1ACC4DBCDAF470" section-type="section-one"><enum>1.</enum><header>Specialty workforce in rural communities</header><text display-inline="no-display-inline">Title VII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/292">42 U.S.C. 292</external-xref> et seq.) is amended—</text><paragraph id="HAACD3F91BB9243E3AAADB8D78237D6DF"><enum>(1)</enum><text>by redesignating part G (<external-xref legal-doc="usc" parsable-cite="usc/42/795j">42 U.S.C. 795j</external-xref> et seq.) as part H; and</text></paragraph><paragraph id="HCABE73EF2812472584BB17181BB13526"><enum>(2)</enum><text>by inserting after part F (<external-xref legal-doc="usc" parsable-cite="usc/42/295h">42 U.S.C. 295h</external-xref>) the following new part:</text><quoted-block style="OLC" id="H66ECD16B27404CA9A8B1F6727D828753" display-inline="no-display-inline"><part id="HC094E724032C415D89A82C1A467C2DDC"><enum>G</enum><header>Specialty Medicine Workforce in Rural Communities</header><section id="HF1CD5038ACE14E5787C1BA7B89E47472"><enum>782.</enum><header>Loan repayment program</header><subsection id="H9C51FC18F9EF4A3797BA0D0E42D2C5D6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Administrator of the Health Resources and Services Administration, shall carry out a program under which—</text><paragraph id="HDB121C457BE0491196548C250129CD47"><enum>(1)</enum><text>the Secretary enters into agreements with specialty medicine physicians to make payments in accordance with subsection (b) on the principal of and interest on any eligible loans described in subsection (c); and</text></paragraph><paragraph id="H70AE21591AE84334B94C22629CFE9504"><enum>(2)</enum><text>the specialty medicine physicians each agree to complete a period of obligated service described in subsection (d) as a specialty medicine physician in the United States in a rural community experiencing a shortage of specialty medicine physicians.</text></paragraph></subsection><subsection id="H9E980251080143A4BD2136EDE0755028"><enum>(b)</enum><header>Payments</header><text display-inline="yes-display-inline">For each year of obligated service by a specialty medicine physician pursuant to an agreement under subsection (a), the Secretary shall make a payment to such physician as follows:</text><paragraph id="H11FC681DF8BE4AF6B4196C928522EC34"><enum>(1)</enum><header>Service in shortage area</header><text>The Secretary shall pay—</text><subparagraph id="H6EB1FCCB17D842D68B0574112BE66ABC"><enum>(A)</enum><text>for each year of obligated service by a specialty medicine physician pursuant to an agreement under subsection (a), <fraction>1/6</fraction> of the principal of and interest on each eligible loan of the physician which is outstanding on the date the physician began service pursuant to the agreement; and</text></subparagraph><subparagraph id="H57EBAADEFC784F148ACF2333A7EB23C7"><enum>(B)</enum><text display-inline="yes-display-inline">for completion of the sixth and final year of such service, the remainder of such principal and interest.</text></subparagraph></paragraph><paragraph id="H3168AEC7F90449FFB82C1F8B5CB83108"><enum>(2)</enum><header>Maximum amount</header><text display-inline="yes-display-inline">The total amount of payments under this section to any specialty medicine physician shall not exceed $250,000.</text></paragraph></subsection><subsection id="H7AE1F9D25A2D490A92264A2CDB3D3D81"><enum>(c)</enum><header>Eligible loans</header><text>The loans eligible for repayment under this section are each of the following:</text><paragraph id="H90ECE2AE771849E4A90214DCCE8C34C7"><enum>(1)</enum><text>Any loan for education in specialty medicine.</text></paragraph><paragraph id="H77F58A789F36421C97D97B311781CA2C"><enum>(2)</enum><text>Any Federal Direct Stafford Loan, Federal Direct PLUS Loan, Federal Direct Unsubsidized Stafford Loan, or Federal Direct Consolidation Loan (as such terms are used in section 455 of the Higher Education Act of 1965).</text></paragraph><paragraph id="H637A30ED8EF241AD8F765CCEE5941835"><enum>(3)</enum><text>Any Federal Perkins Loan under part E of title I of the Higher Education Act of 1965.</text></paragraph><paragraph id="H85851692775E433EA49950FB27CBA5F2"><enum>(4)</enum><text>Any other Federal loan as determined appropriate by the Secretary.</text></paragraph></subsection><subsection id="H9DA254A944BA4EEE8C4F2BF3AE2C453D"><enum>(d)</enum><header>Period of obligated service</header><text display-inline="yes-display-inline">Any specialty medicine physician receiving payments under this section as required by an agreement under subsection (a) shall agree to a 6-year commitment to full-time employment, with no more than 1 year passing between any 2 years of covered employment, as a specialty medicine physician in the United States in a rural community experiencing a shortage of specialty medicine physicians.</text></subsection><subsection id="H66CC90360E4743A8B193A1005D990F24"><enum>(e)</enum><header>Ineligibility for double benefits</header><text display-inline="yes-display-inline">No borrower may, for the same service, receive a reduction of loan obligations or a loan repayment under both—</text><paragraph id="H39547F55B8654156AE93CC16E73123DB"><enum>(1)</enum><text>this section; and</text></paragraph><paragraph id="H261D82F252594D9BA9769E1B7E87B32B"><enum>(2)</enum><text display-inline="yes-display-inline">any Federally supported loan forgiveness program, including under section 338B, 338I, or 846 of this Act, or section 428J, 428L, 455(m), or 460 of the Higher Education Act of 1965.</text></paragraph></subsection><subsection id="H3E64BF121B014E789E98504B890A2FDF"><enum>(f)</enum><header>Breach</header><paragraph id="HE52CEF37CA154E738010E9BAC55F09C8"><enum>(1)</enum><header>Liquidated damages formula</header><text display-inline="yes-display-inline">The Secretary may establish a liquidated damages formula to be used in the event of a breach of an agreement entered into under subsection (a).</text></paragraph><paragraph id="H5DE66C735C674423B687AD9025164093"><enum>(2)</enum><header>Limitation</header><text>The failure by a specialty medicine physician to complete the full period of service obligated pursuant to such an agreement, taken alone, shall not constitute a breach of the agreement, so long as the physician completed in good faith the years of service for which payments were made to the physician under this section.</text></paragraph></subsection><subsection id="HB4A7B18AB8CE4F7DAD0F957502A4E719"><enum>(g)</enum><header>Reports to Congress</header><text>Not later than 5 years after the date of enactment of this section, and not less than every other year thereafter through fiscal year 2030, the Secretary shall report to Congress on—</text><paragraph id="H8B0CCD51366F4F7FBB0BBC9C7C4ABFD5"><enum>(1)</enum><text>the practice location of physicians participating, or who have participated, in the loan repayment program under this section; and</text></paragraph><paragraph id="H6DA1D21CC16E4C58AB77AF56DCC72079"><enum>(2)</enum><text display-inline="yes-display-inline">the impact of the loan repayment program under this section on the availability of specialty medicine services in the United States in rural communities experiencing a shortage of specialty medicine physicians.</text></paragraph></subsection><subsection id="H98AEF0FCB1C641DBA1F0F4C28F6B6575"><enum>(h)</enum><header>Definition</header><text>In this section, the term specialty medicine physician means a physician practicing in a specialty identified in the December 2008 report of the Health Resources and Services Administration entitled <quote>The Physician Workforce: Projections and Research into Current Issues Affecting Supply and Demand</quote> as a specialty whose baseline projected demand exceeds its projected supply for the period of 2005 through 2020.</text></subsection><subsection id="H0A22D6D670AE4F418257223ED3F278D0"><enum>(i)</enum><header>Authorization of appropriations</header><text>To carry out this section, there are authorized to be appropriated such sums as may be necessary for fiscal years 2022 through 2031.</text></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
