which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name>, and in addition to the Committee on <committee-name committee-id="HAG00">Agriculture</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a categorical exclusion for electric utility rights-of-way, and for other purposes.</official-title></form><legis-body id="H57F36631924F4F1FA685DA9ED1E2C20D" style="OLC"><section id="HA59C3A838DE04D6388D0CE6E72CFDDE1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Clearing Lines along Electrical At-Risk Zones Act</short-title></quote>.</text></section><section id="HAF52F5F92BC941AD8173BEFA3FAC7D8C"><enum>2.</enum><header>Vegetation management, facility inspection, and operation and maintenance relating to electric transmission and distribution facility rights of way</header><subsection id="HA80CC678B70B44C88148E421297EFC5A"><enum>(a)</enum><header>Hazard trees within 50 feet of electric power line</header><text display-inline="yes-display-inline">Section 512(a)(1)(B)(ii) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1772">43 U.S.C. 1772(a)(1)(B)(ii)</external-xref>) is amended by striking <quote>10</quote> and inserting <quote>50</quote>.</text></subsection><subsection id="HA5717E1D3C3A4765882032271E21A409"><enum>(b)</enum><header>Consultation with private landowners</header><text display-inline="yes-display-inline">Section 512(c)(3)(E) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1772">43 U.S.C. 1772(c)(3)(E)</external-xref>) is amended—</text><paragraph id="HCCDA04CD530148E48FD96D16D38A11E0"><enum>(1)</enum><text>in clause (i), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H97193124FC17477D9622E53841125480"><enum>(2)</enum><text>in clause (ii), by striking the period and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HD13CCF83AB7D4EB1B8FBF0AF7D05A8CE"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HF4FDD828AFDD4A60AE75301B0EF32816" style="OLC"><clause id="HCCB24B6464954BE7B1314874E588F988"><enum>(iii)</enum><text display-inline="yes-display-inline">consulting with private landowners with respect to any hazard trees identified for removal from land owned by such private landowners.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H5C5BA2EA435A4EA8B81C0DB9FB98AC88"><enum>(c)</enum><header>Review and approval process</header><text display-inline="yes-display-inline">Clause (iv) of section 512(c)(4)(A) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1772">43 U.S.C. 1772(c)(4)(A)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="H9AD495C31CD8495B856078A450514550" style="OLC"><clause id="H9AEA378E02B041858464A7A462193477"><enum>(iv)</enum><text display-inline="yes-display-inline">ensures that—</text><subclause id="H391763753A7C45A9B053ABF053F005CD"><enum>(I)</enum><text>a plan submitted without a modification under clause (iii) shall be automatically approved 60 days after review; and</text></subclause><subclause id="H89D25044BCB84967A7E32E869363C037"><enum>(II)</enum><text>a plan submitted with a modification under clause (iii) shall be automatically approved 67 days after review.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H0303B8E6F1AA4EC29F5A680DB8C48C03"><enum>3.</enum><header>Categorical exclusion for electric utility lines rights-of-way</header><subsection id="H57418C0B766E4F28A43371F3BA89D846"><enum>(a)</enum><header>Secretary concerned defined</header><text>The term <term>Secretary concerned</term> means—</text><paragraph id="HDBAC834AA8B8490CAC50097819645AE6"><enum>(1)</enum><text>the Secretary of Agriculture, with respect to National Forest System lands; and</text></paragraph><paragraph id="H0F6F8E6D0A0043F9A51A2A52225C1340"><enum>(2)</enum><text>the Secretary of the Interior, with respect to public lands.</text></paragraph></subsection><subsection id="HB23C93E2288C4E4C8A13C8E88E5FF52C"><enum>(b)</enum><header>Categorical exclusion established</header><text>Forest management activities described in subsection (c) are a category of activities designated as being categorically excluded from the preparation of an environmental assessment or an environmental impact statement under section 102 of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332</external-xref>).</text></subsection><subsection id="H00D4205AC3814CD981F4B78DFF73A7F9"><enum>(c)</enum><header>Forest management activities designated for categorical exclusion</header><text>The forest management activities designated as being categorically excluded under subsection (b) are—</text><paragraph id="H0D342CC49C1C48A6A39D9D628F89E06B"><enum>(1)</enum><text>the development and approval of a vegetation management, facility inspection, and operation and maintenance plan submitted under section 512(c)(1) of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1772">43 U.S.C. 1772(c)(1)</external-xref>) by the Secretary concerned; and</text></paragraph><paragraph id="HE4EB2ADA15AA4506AB1CC3F8721F4751"><enum>(2)</enum><text>the implementation of routine activities conducted under the plan referred to in paragraph (1).</text></paragraph></subsection><subsection id="HA5FB683F3FF84EE7B111767328E4B2BA"><enum>(d)</enum><header>Availability of categorical exclusion</header><text>On and after the date of the enactment of this Act, the Secretary concerned may use the categorical exclusion established under subsection (b) in accordance with this section.</text></subsection><subsection id="HEAC767F2982C46509FBDA8A763DB1B5B"><enum>(e)</enum><header>Extraordinary circumstances</header><text>Use of the categorical exclusion established under subsection (b) shall not be subject to the extraordinary circumstances procedures in section 220.6, title 36, Code of Federal Regulations, or section 1508.4, title 40, Code of Federal Regulations.</text></subsection><subsection id="H8C20A6BD976D46F5B3C5F68D9181CA1F"><enum>(f)</enum><header>Exclusion of certain areas</header><text>The categorical exclusion established under subsection (b) shall not apply to any forest management activity conducted—</text><paragraph id="H965B5750344F440CB6FE0C61CDDA8979"><enum>(1)</enum><text>in a component of the National Wilderness Preservation System; or</text></paragraph><paragraph id="H814B3ADCD94D4ABA946E4B68E09B7BAF"><enum>(2)</enum><text>on National Forest System lands on which, by Act of Congress, the removal of vegetation is restricted or prohibited.</text></paragraph></subsection><subsection id="HECFA51976C134822A4D94072855B4E43"><enum>(g)</enum><header>Permanent roads</header><paragraph id="H6240CC760E8A44BEB87EB9DAAD1974F9"><enum>(1)</enum><header>Prohibition on establishment</header><text>A forest management activity designated under subsection (c) shall not include the establishment of a permanent road.</text></paragraph><paragraph id="H9DFD33F9388C46109FECB4626BF14BA7"><enum>(2)</enum><header>Existing roads</header><text>The Secretary concerned may carry out necessary maintenance and repair on an existing permanent road for the purposes of conducting a forest management activity designated under subsection (c).</text></paragraph><paragraph id="H1855915067124E8E99CFC458B0B8B405"><enum>(3)</enum><header>Temporary roads</header><text>The Secretary concerned shall decommission any temporary road constructed for a forest management activity designated under subsection (c) not later than 3 years after the date on which the action is completed.</text></paragraph></subsection><subsection id="H8EB04BFADD0746C882C614A43C7D6114"><enum>(h)</enum><header>Applicable laws</header><text>A forest management activity designated under subsection (c) shall not be subject to section 7 of the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1536">16 U.S.C. 1536</external-xref>), section 106 of the National Historic Preservation Act, or any other applicable law.</text></subsection></section></legis-body></bill>
