which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name>, and in addition to the Committee on <committee-name committee-id="HJU00">the Judiciary</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To exempt from the Lacey Act and the Lacey Act Amendments of 1981 certain water transfers between any of the States of Texas, Arkansas, and Louisiana, and for other purposes.</official-title></form><legis-body><section id="id28FCADD600804247877F1FE40EF5DD42" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Public Water Supply Invasive Species Compliance Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="idB02052E39C4542D9BE2144E524211157"><enum>2.</enum><header>Exemption of certain water transfers from the Lacey Act and the Lacey Act Amendments of 1981</header><subsection id="id37FEC6886FC642F6BBB3847816454419"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id0AF53CD43E574DBF98EE80BD215FBD84"><enum>(1)</enum><header>Covered water transfer</header><text>The term <term>covered water transfer</term> means a transfer of water containing a prohibited species between public water supplies located on, along, or across the State boundaries between any of the States of Texas, Arkansas, and Louisiana.</text></paragraph><paragraph id="id83D7A942A7FC4444A4B93950D95B43C2"><enum>(2)</enum><header>Prohibited species</header><text>The term <term>prohibited species</term> means any species—</text><subparagraph id="idAE58E35B37A94A578441C68D06FEFF5A"><enum>(A)</enum><text>the shipment of which is otherwise prohibited by section 42 of title 18, United States Code (commonly known as the <quote>Lacey Act</quote>); or</text></subparagraph><subparagraph id="idE2DE793ACFFF463A9FB27FFD2262C27D"><enum>(B)</enum><text>the transfer of which is otherwise prohibited by the Lacey Act Amendments of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3371">16 U.S.C. 3371</external-xref> et seq.).</text></subparagraph></paragraph><paragraph id="id6C1583768F7B44949EA4554FFDCF88F1"><enum>(3)</enum><header>Public water supply</header><text>The term <term>public water supply</term> means any body of water, including any river, lake, or stream, the water of which is available or made available to the public.</text></paragraph></subsection><subsection id="id519F80155DC94329BBDAE28E6C1A0B49"><enum>(b)</enum><header>Exemption</header><text>Section 42 of title 18, United States Code (commonly known as the <quote>Lacey Act</quote>), and the Lacey Act Amendments of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3371">16 U.S.C. 3371</external-xref> et seq.) shall not apply with respect to any covered water transfer, if—</text><paragraph id="id2b30cc1a33b849f68948e44a98eefc56"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idc289aa73800a49ac8c4aaff549a65307"><enum>(A)</enum><text>all prohibited species in the water transferred are located in both of the public water supplies between which the water is transferred;</text></subparagraph><subparagraph id="id6834C2EE873F47579250C8CD96B32B21" indent="up1"><enum>(B)</enum><text>the water is transferred directly between those public water supplies; and</text></subparagraph><subparagraph indent="up1" id="idB255D5F8FC9C4847922987FE095607FE"><enum>(C)</enum><text>the water is subject to mitigation measures that are reviewed and approved by the appropriate State agency of the State to which the water is being transferred, including—</text><clause id="idF9B669EE4B5B48168B6C4E6A4B057CAE"><enum>(i)</enum><text>chemically treating the water for suspected or known prohibited species;</text></clause><clause id="id91E8D7B964924DC5A58F9C87108FEACA"><enum>(ii)</enum><text>limiting transfers to certain times;</text></clause><clause id="id00A3CCD6D6EF4A27B1CC3AA394097001"><enum>(iii)</enum><text>withdrawing water only from certain depths;</text></clause><clause id="id94222EF7BDFE4D87B35340876AA300FF"><enum>(iv)</enum><text>filtration; and</text></clause><clause id="idC97B253E3A4D480F80C0A2A716C56BA1"><enum>(v)</enum><text>enhanced monitoring; or</text></clause></subparagraph></paragraph><paragraph id="id0F36CBF85D6745B5AB2ED021B7912A86"><enum>(2)</enum><text>the water is transferred in a closed conveyance system directly to treatment facilities where all prohibited species contained in the water transferred will be extirpated.</text></paragraph></subsection><subsection id="id766F1F67236A4198A39FDA0F4034C323"><enum>(c)</enum><header>Notification</header><paragraph id="id2D1F077476E74E95BFD7DC05C3DF8D52"><enum>(1)</enum><header>In general</header><text>Before the first covered water transfer described in subsection (b)(1) occurs in a calendar year and subject to paragraph (2), the controlling authority of the public water supply from which the water is to be transferred (referred to in this subsection as the <term>donor public water supply</term>) shall submit to the controlling authority of the public water supply to which the water is to be transferred (referred to in this subsection as the <term>recipient public water supply</term>) a written notification that includes—</text><subparagraph id="id2F62F4EFF8BF4A23A55BED99F67B50AA"><enum>(A)</enum><text>the expected dates of the covered water transfer;</text></subparagraph><subparagraph id="id03BD0C99BFF649AA91C052B6D68F6799"><enum>(B)</enum><text>the volume of water to be transferred, which may include a range of possible volumes of water that may be transferred;</text></subparagraph><subparagraph id="idC14AEB8E44F945719F2369EF5FD01D6D"><enum>(C)</enum><text>a list of known prohibited species that are contained in the donor public water supply;</text></subparagraph><subparagraph id="idCC4ECFDB16304C14A77523585698F7BF"><enum>(D)</enum><text>a certification that the known prohibited species described in subparagraph (C) are present in both the donor public water supply and the recipient public water supply; and</text></subparagraph><subparagraph id="id4B7A765665AD47DBB8E577049A4AFAE0"><enum>(E)</enum><text>a notice of other known species present in the donor public water supply that may be of concern to the controlling authority of the recipient public water supply, including species that are not prohibited by the laws referred to in subsection (b).</text></subparagraph></paragraph><paragraph id="id9F925A66C6C44E718B76D40F18B9EA45"><enum>(2)</enum><header>Additional notification</header><text>In addition to the notification required under paragraph (1), the controlling authority of the donor public water supply shall provide to the controlling authority of the recipient public water supply a notification described in that paragraph if the controlling authority of the donor public water supply discovers a new prohibited species in the donor public water supply.</text></paragraph></subsection><subsection id="idDA0948A5778E4AC2BCD1B09531C1EF18"><enum>(d)</enum><header>Costs of mitigation measures</header><text>The costs of the mitigation measures described in subparagraph (C) of subsection (b)(1) for water subject to a covered water transfer described in that subsection shall be borne by the entity that sells the water for financial gain.</text></subsection></section></legis-body></bill>
