which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Food and Nutrition Act of 2008 to provide for the reissuance to households supplemental nutrition assistance program benefits to replace benefits stolen by identity theft or typical skimming practices, and for other purposes.</official-title></form><legis-body id="H474FDD48251440CFAA2CA3CCB4651CC9" style="OLC"><section id="H579E38EBFA7B4FC4994788E255C1653E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>SNAP Theft Protection Act of 2022</short-title></quote>.</text></section><section id="H065BF45ED35248A8825A8EBE731843B1" section-type="subsequent-section"><enum>2. </enum><header>Amendments</header><text display-inline="no-display-inline">Section 7 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2016">7 U.S.C. 2016</external-xref>) is amended—</text><paragraph id="HFE8C87528AD84CF0AFD6024308CB420A"><enum>(1)</enum><text>in subsection (e) by inserting <quote>or from the reissuance of benefits stolen by identity theft or typical skimming practices,</quote> after <quote>mail</quote>, and </text></paragraph><paragraph id="H2F86C620517B44DB90AD1B18B7DF4C17"><enum>(2)</enum><text>in subsection (h)(7)—</text><subparagraph id="H73C8E81C223C45E6ADF6A4B0BEEAB096"><enum>(A)</enum><text>by striking <quote>Regulations</quote> and inserting the following:</text><quoted-block style="OLC" id="HEADC4BD379004457968DECA030315721" display-inline="no-display-inline"><subparagraph id="HAEAA6FD1B5074FB1A493A767DAEAE710"><enum>(A)</enum><header>Replacement of benefits</header><text display-inline="yes-display-inline">Regulations</text></subparagraph><after-quoted-block>, and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H7C8D4D057A8E4B76B84700B0F4ADC16C"><enum>(B)</enum><text>by adding at end the following:</text><quoted-block style="OLC" id="H01BD4CAA79F74C57B81DEFA91AD69443" display-inline="no-display-inline"><subparagraph id="H82BE7CBD80F34319BF62EAA33BC8CC5D"><enum>(B)</enum><header>Reissuance of stolen benefits</header><clause id="HE0305BD9593345C5803EBCF74E5AE780"><enum>(i) </enum><header>Issuance of regulations</header><text display-inline="yes-display-inline">Secretary shall issue regulations—</text><subclause id="H29E6CCB4445C4B8EBEAEA9BEC96AE024"><enum>(I)</enum><text display-inline="yes-display-inline">to establish criteria for State agencies to identify supplemental nutrition assistance program benefits stolen by identity theft or typical skimming practices; and</text></subclause><subclause id="HF3C5DBC5C8E0482C9CB03C1A7E0553F5"><enum>(II)</enum><text>to provide for the reissuance to households of benefits stolen by identity theft, or typical skimming practices, that meet such criteria.</text></subclause></clause><clause id="HBC00CAC795BD4D18BDB546D0CF0DD2A0"><enum>(ii)</enum><header>Status report</header><text display-inline="yes-display-inline">Not later than 240 days after the Secretary issues regulations under clause (i), the Secretary shall submit to the Congress a report on the status of benefits reissued under such regulations that includes—</text><subclause id="H54512F47BE8C4265AFE0ACF42224816E"><enum>(I)</enum><text display-inline="yes-display-inline">a detailed description of the prevalence of stolen benefits for which benefits are reissued under such regulations;</text></subclause><subclause id="H57B579FA6F4947C897E58DD1DE94C21A"><enum>(II) </enum><text display-inline="yes-display-inline">an examination of current barriers, feasibility, and impact on participant access and ease of use in developing an electronic benefit transfer card that contains innovative technologies such as an embedded microchip along with the traditional magnetic stripe; and</text></subclause><subclause id="H0DFECAD1ED81444A9A0F651FCD0228D3"><enum>(III)</enum><text>such other information as by the Secretary considers to be appropriate.</text></subclause></clause><clause id="HE70CB1FC28484964BD15989FD4AC8ABB"><enum>(iii)</enum><header>Stolen benefit reissuance report</header><text display-inline="yes-display-inline">Not later than 120 days after end of each fiscal year that begins after the Secretary issues regulations under clause (i), the Secretary shall submit to the Congress a report for such fiscal year with respect to each State that includes the aggregate value of supplemental nutrition assistance program benefits reissued under such regulations and the number of households to which such benefits were reissued.</text></clause><clause id="H7F85E2FF5E4B49BDA9849298AB1CA8C6"><enum>(iv)</enum><header>Evaluation</header><text>To maximize the accessibility and security of electronic benefit transfer cards, the Secretary shall periodically review and modify such regulations to take into account evolving technology and the threat landscape to better protect against benefit theft.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
