which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide payment for patient navigator services under title XIX of the Social Security Act, and for other purposes.</official-title></form><legis-body id="HDB4211F3AF974FDC93D8969D10D7783A" style="OLC"><section id="HE7096216F47B4A759EDECA7D24D65BA6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Patient Navigation Assistance Act</short-title></quote>.</text></section><section id="H15F36680A02442789FE897FE88F2B195"><enum>2.</enum><header>Medicaid coverage for patient navigator services</header><subsection id="H89CA13E0D4A944E9BD044F75D3883569"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1902(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)</external-xref>) is amended—</text><paragraph id="HAA6A57BB4D91459C904CFD284518F43D"><enum>(1)</enum><text>in paragraph (86), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="HC42ABEB89AE0456EA6DF528D39E0E993"><enum>(2)</enum><text>in paragraph (87), by striking at the end the period and inserting <quote>; and</quote>;</text></paragraph><paragraph id="HEAE9F2702E9A4912BB93BBC7C065D68B"><enum>(3)</enum><text>by inserting after paragraph (87) the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="H44D8FDFD2CE743C8A6C30C74C770E45A" style="traditional"><paragraph id="H132AED66A7544D28851D4BD61564C24D"><enum>(88)</enum><text>provide that the State shall reimburse an eligible entity (as defined in subsection (tt)(1)) for any patient navigator service (as defined in subsection (tt)(3)) that is provided—</text><subparagraph id="H780EFFC9CCA64846852FBA9661261D32"><enum>(A)</enum><text>to an individual who is eligible for medical assistance under the State plan; and</text></subparagraph><subparagraph id="HAC26460FAF634DFD8C893399184481AF"><enum>(B)</enum><text>by a patient navigator (as defined in subsection (tt)(2)) through the eligible entity.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HC1F9AE5E50CC4C1EB64F8570D7A69002"><enum>(4)</enum><text>by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="HD340CB63F1E5404F9E428A7FA497FB1B" style="OLC"><subsection id="HAFCBFBC1CE814D8BB53E29423706A469"><enum>(tt)</enum><header>Patient navigator services definitions</header><text display-inline="yes-display-inline">For purposes of this section:</text><paragraph id="H17C958FAFE354F30AA5E85D363B2F9B8"><enum>(1)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means an entity that—</text><subparagraph id="HD5F13925105742F7B02A65D38183971C"><enum>(A)</enum><text>is an eligible entity (as defined in subsection (l)(1) of section 340A of the Public Health Service Act); and</text></subparagraph><subparagraph id="H19631BA88E834C59A1BC2896AE8743F1"><enum>(B)</enum><text>complies with the following requirements of such section (insofar as they apply to a grant recipient under such section):</text><clause commented="no" id="HA29D9C10CD2B4306B31E6DA1E7E6ACD3"><enum>(i)</enum><text display-inline="yes-display-inline">Subsection (b) (relating to patient navigator duties and community knowledge).</text></clause><clause commented="no" id="HBD9B90B2F23D4D20A4AF07DFD56FBF4A"><enum>(ii)</enum><text>Subsection (c) (relating to prohibitions).</text></clause><clause commented="no" id="H1C4F39F375C84B7783AC4EFCBC11DF62"><enum>(iii)</enum><text>Subsection (e) (relating to applications).</text></clause><clause id="H4E8BEC66C4624A18BE2CD53475B046DA"><enum>(iv)</enum><text>Subsection (j)(3) (relating to reports).</text></clause></subparagraph></paragraph><paragraph id="H58862D202F874FD681EA45DC9407AB51"><enum>(2)</enum><header>Patient navigator</header><subparagraph id="H3D101737C1834632AE612E919D289C14"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The term <term>patient navigator</term> means an individual who—</text><clause id="HFDD254285BC344BAB9D814B3496ACC6B"><enum>(i)</enum><text display-inline="yes-display-inline">is employed by a health care or community-based organization and provides individualized education and resources to facilitate informed decision-making and timely access to quality health and psychosocial care; and</text></clause><clause id="H973995AAB0D34B6B80A81AF9D4A18527"><enum>(ii)</enum><text display-inline="yes-display-inline">has obtained and complies with education, licensure, or certification, including at least—</text><subclause id="H50D15D41592A4FC990EB75BF8DB63DBE"><enum>(I)</enum><text>a bachelor’s degree in nursing from an accredited university, master’s degree in social work from an accredited university, or bachelor’s degree in a health-related field from an accredited university; </text></subclause><subclause id="H5EEB3EEA8CB846B5B8AE8320EF9298DC"><enum>(II)</enum><text display-inline="yes-display-inline">licensing and certification requirements for a registered nurse, social work, or clinical practitioner, as applicable, and scope of practice requirements, as defined by the State or jurisdiction in which the individual is licensed or certified;</text></subclause><subclause id="H54167778EDDC4C4192EF8D3D64C71A63"><enum>(III)</enum><text>completion of competency-based navigation training sessions or courses for clinical or non-clinical professionals, as applicable; or</text></subclause><subclause id="H2F5C72DFE17246C180F13B9323983E73"><enum>(IV)</enum><text display-inline="yes-display-inline">subject to subparagraph (B), completion of a training program approved by the Secretary for purposes of section 340A(l)(3) of the Public Health Service Act.</text></subclause></clause></subparagraph><subparagraph id="H4FA4298F9F9347FCAD4BFD62F43956C0"><enum>(B)</enum><header>Transitional limitation</header><text>The training described in subclause (IV) of subparagraph (A)(ii) shall not satisfy the requirement of subparagraph (A)(ii) after the date that is 3 years after the date on which the provisions of this subsection apply to patient navigator services pursuant to section 2(c) of the Patient Navigator Assistance Act.</text></subparagraph></paragraph><paragraph id="H2AF688D06710479FB3D731762B001280"><enum>(3)</enum><header>Patient navigator services</header><text display-inline="yes-display-inline">The term <term>patient navigator service</term> means a service provided by a patient navigator to an individual, including—</text><subparagraph id="HE261C70697ED4FC3B65411802E88CB5A"><enum>(A)</enum><text display-inline="yes-display-inline">referrals and related activities to help the individual obtain needed services, including activities that help link the individual with medical, social, logistical, financial, or other programs or services to address identified or specified needs of the individual;</text></subparagraph><subparagraph id="H90ADC3AD0CEE41918E2C2EDCACE9ACAB"><enum>(B)</enum><text>services specified under paragraphs (1) through (6) of subsection (b) of section 340A of the Public Health Service Act; and</text></subparagraph><subparagraph id="HDBCFCD39A92C4C879E58181DF30A5AFB"><enum>(C)</enum><text>other services specified by the Secretary.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H7EF69AAF5B9D400496C7AE51F32F904C"><enum>(b)</enum><header>Treatment as medical assistance for purposes of FMAP</header><text display-inline="yes-display-inline">Section 1905(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(a)</external-xref>) is amended—</text><paragraph id="HA769A37D1AC549C58911A96F082F36AD"><enum>(1)</enum><text>in paragraph (30), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="HEA437F6D78DE4665A9E224E96026309D"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraph (31) as paragraph (32); and</text></paragraph><paragraph id="H13E1D66E0A054F49B28EADD6BC21FB1C"><enum>(3)</enum><text>by inserting after paragraph (30) the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="HC40EEB51B22E40A5B928CCAEFE671BA4" style="OLC"><paragraph id="H013FAFB0447A4965B6EDF784ACEC7FB1"><enum>(31)</enum><text display-inline="yes-display-inline">patient navigator services (as defined in section 1902(tt)(3)) that are provided in a manner that meets the requirements of section 1902(a)(88); and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H7F18CDA833DE440084E324229E455CF0"><enum>(c)</enum><header>Effective date</header><paragraph id="HC2F9680C0BC24BA5BDF3A9D32C107441"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to <internal-xref idref="HF03D094BFF244B38976E262896A41F44" legis-path="1.(d)(2)">paragraph (2)</internal-xref>, the amendments made by this section shall apply to patient navigator services provided after the first day of the first calendar year that begins after the date of enactment of this Act.</text></paragraph><paragraph id="HF03D094BFF244B38976E262896A41F44"><enum>(2)</enum><header>Exception for State legislation</header><text>In the case of a State plan under title XIX of the Social Security Act, which the Secretary of Health and Human Services determines requires State legislation in order for the respective plan to meet any requirement imposed by amendments made by this Act, the respective plan shall not be regarded as failing to comply with the requirements of such title solely on the basis of its failure to meet such an additional requirement before the first day of the first calendar quarter beginning after the close of the first regular session of the State legislature that begins after the date of enactment of this Act. For purposes of the previous sentence, in the case of a State that has a 2-year legislative session, each year of the session shall be considered to be a separate regular session of the State legislature.</text></paragraph></subsection></section></legis-body></bill>
