which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Consumer Credit Protection Act to address restrictions on the garnishment of wages, prohibitions on debt collection practices relating to imprisonment of debtors, and for other purposes.</official-title></form><legis-body id="H4DB3B3EBC9B04189B61E243C7245DBCF" style="OLC"><section id="HCFA5DBF156C94C2FBD9BBA57A5E8B6D3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Wages of Essential Workers Act of 2022</short-title></quote>.</text></section><section id="H3BDD90ECEB5D4665BC3EFCF31B47739B"><enum>2.</enum><header>Restriction on garnishment</header><text display-inline="no-display-inline">Title III of the Consumer Credit Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1671">15 U.S.C. 1671 et seq.</external-xref>) is amended—</text><paragraph id="HD5BE0003834B46AFA219758AC04ECC7C"><enum>(1)</enum><text>in section 303 (<external-xref legal-doc="usc" parsable-cite="usc/15/1673">15 U.S.C. 1673</external-xref>)—</text><subparagraph id="HB377378251B745CE89E1F07AAE2ECEE1"><enum>(A)</enum><text>by striking subsection (a) and inserting the following:</text><quoted-block id="HF90A58C6D46641B09F4E8A4D53575EAD" style="OLC"><subsection id="H8BF73D762D8C4824B1679AE1C263AE53"><enum>(a)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HD15F1449561B4CB38B59EAA8BE19954B"><enum>(1)</enum><text>Except as provided in subsection (b) and in section 305, the maximum part of the aggregate disposable earnings of an individual for any workweek which is subjected to garnishment may not exceed the lesser of—</text><subparagraph id="H5243410DCFF443E28C47F0C10AB0E863" indent="up1"><enum>(A)</enum><text>25 per centum of the disposable earnings of the individual for that week; or</text></subparagraph><subparagraph id="HD092BE30659445E099F1B319907E06A8" indent="up1"><enum>(B)</enum><text>the amount by which the disposable earnings of the individual for that week exceed—</text><clause id="H3641A1B5EB9B46D0B7135C91C779C7E2"><enum>(i)</enum><text>beginning on the date of enactment of this subsection, $1000; and</text></clause><clause id="H9E0352F0287A410C8F0083F9BC4193F2"><enum>(ii)</enum><text>for fiscal year 2023, and each fiscal year thereafter, the amount determined under paragraph (3).</text></clause></subparagraph></paragraph><paragraph id="H0539C80CAB48485CBBC767D3276D5281" indent="up1"><enum>(2)</enum><text>In the case of earnings for any pay period other than a week, the Secretary of Labor shall, for purposes of paragraph (1)(B), prescribe an amount that is proportional to the amount under paragraph (1)(B)(i), which, beginning for fiscal year 2023, shall be adjusted in accordance with paragraph (3).</text></paragraph><paragraph id="H8067A6B76FE544E09CCE458BF2E7AFAA" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H4BAD5FF6524D4DA981A33646B2C56C6D"><enum>(A)</enum><text display-inline="yes-display-inline">On September 4, 2023, and annually thereafter, the Secretary shall adjust the dollar amounts described in paragraphs (1)(B)(ii) and (2) by the annual percentage increase in the Consumer Price Index, rounded to the nearest multiple of $100, as applicable.</text></subparagraph><subparagraph id="HA6CBA21EF8774DBFB70FB219C285AF8E" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Not later than Labor Day (as specified in section 6103 of title 5, United States Code) of each fiscal year, the Secretary of Labor shall publish in the Federal Register the percentage change in the Consumer Price Index published for June of the preceding fiscal year from June of the fiscal year in which that publication is made.</text></subparagraph><subparagraph id="H8181B7DCA6624BBEB31D5B0195EB2792" indent="up1"><enum>(C)</enum><text>In this paragraph, the term <quote>Consumer Price Index</quote> means the Consumer Price Index for All Urban Consumers (all items, U.S. city average), published monthly by the Bureau of Labor Statistics.</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H0538889B591041A58E651AC17D4D2E5D"><enum>(B)</enum><text>in subsection (b)(2)(A), by striking <quote>his spouse or dependent child</quote> and inserting <quote>the spouse or dependent child of the individual</quote>;</text></subparagraph></paragraph><paragraph id="HBAD319C982DE4E09B87C30211441180F"><enum>(2)</enum><text>in section 304 (<external-xref legal-doc="usc" parsable-cite="usc/15/1674">15 U.S.C. 1674</external-xref>), by striking subsection (a) and inserting the following:</text><quoted-block id="HC15E2BD524FE482AB39FD4F31133A8EA" style="OLC"><subsection id="HE23203EDA04B451EABA01CA4929BA196"><enum>(a)</enum><text>No employer may discharge, or take any other adverse action against, any employee by reason of the fact that the earnings of the employee have been subjected to garnishment.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H0803621396444424AAB3D9A494DFAD18"><enum>(3)</enum><text>in section 305 (<external-xref legal-doc="usc" parsable-cite="usc/15/1675">15 U.S.C. 1675</external-xref>), by striking <quote>he determines</quote> and inserting <quote>the Secretary determines</quote>; and</text></paragraph><paragraph id="HCE20405E079F46C18D55F1FCD7925EDB"><enum>(4)</enum><text>in section 307 (<external-xref legal-doc="usc" parsable-cite="usc/15/1677">15 U.S.C. 1677</external-xref>)—</text><subparagraph id="H1467DBBF24A64FEE91B83D49F23D5D72"><enum>(A)</enum><text>in the matter preceding paragraph (1), by striking <quote>State</quote> and inserting <quote>State—</quote>; and</text></subparagraph><subparagraph id="H0AB6CC71234E4EB395AFCBD1AE6F25C9"><enum>(B)</enum><text>by striking paragraph (2) and inserting the following:</text><quoted-block id="H8CB90C46718345B6B9D5FADF77130B77" style="OLC"><paragraph id="H6F4B3A134A844E658C6489808F3A76C9"><enum>(2)</enum><text>prohibiting the discharge, or the taking of any other adverse action against, any employee by reason of the fact that the earnings of the employee have been subjected to garnishment.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="H7B95D05019DC447781F63229E43FB77E"><enum>3.</enum><header>Prohibition on debt collection practices relating to imprisonment of debtors</header><text display-inline="no-display-inline">Section 808 of the Fair Debt Collection Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692f">15 U.S.C. 1692f</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H84D6CA29BECF4A06BB6D220A83428518" display-inline="no-display-inline"><paragraph id="HED05C9BAE67747FF9B0894300BBFD1F1"><enum>(9)</enum><text display-inline="yes-display-inline">Taking or threatening to take any action in connection with the collection of a debt to cause the arrest or imprisonment of any person, including taking or threatening to take any action to seek the issuance or service of a civil arrest warrant in State court.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
