which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Elementary and Secondary Education Act of 1965 to improve the academic achievement of English learners and immigrant children and youth, and for other purposes.</official-title></form><legis-body id="H33E4890ABB8F4AC997DC140258557759" style="OLC"><section id="H437C7876C63E4E1AAB8415A40E95B35C" section-type="section-one"><enum>1.</enum><header>Annual State report cards</header><text display-inline="no-display-inline">Section 1111(h)(1)(C) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(h)(1)(C)</external-xref>) is amended—</text><paragraph id="HA2B8B641554444CD9080E449D83DDC1E"><enum>(1)</enum><text>by redesignating clause (xiv) as clause (xv); and</text></paragraph><paragraph id="H7487256764C64250B5B95B1124A36E05"><enum>(2)</enum><text>by inserting after clause (xiii) the following:</text><quoted-block style="OLC" id="H0653CEBDABC244DEBD7281113AA77CA6" display-inline="no-display-inline"><clause id="HCACC64CE3DB74D708A1142DA00D6DD13"><enum>(xiv)</enum><text display-inline="yes-display-inline">Information on the diversity of teachers in the State at the pre-kindergarten through grade 12 levels, including information with respect to—</text><subclause id="H9F8D6B9F490C4D15835D5EE0588169B1"><enum>(I)</enum><text>ethnicity;</text></subclause><subclause id="H49D43E6E2BD5484DBD92C8F902BB5334"><enum>(II)</enum><text>race;</text></subclause><subclause id="H766AA69CD126410AAAC94436E145338B"><enum>(III)</enum><text>gender; and</text></subclause><subclause id="H14DB7E9FE6D347AA928065E17A1E6259"><enum>(IV)</enum><text display-inline="yes-display-inline">fluency in a language other than English, including how such fluency was acquired.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H493A90DDB5174ABF919105864C529149"><enum>2.</enum><header>Support for academic achievement of English learners and immigrant children and youth</header><subsection id="H9D36A0D87EAB42EC9BCCAB50AB8DF77C"><enum>(a)</enum><header>Purposes</header><text display-inline="yes-display-inline">Section 3102 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6812">20 U.S.C. 6812</external-xref>) is amended—</text><paragraph id="H653BFC9AFB23410D9714D59119535052"><enum>(1)</enum><text>by redesignating paragraphs (3) through (5) as paragraphs (4) through (6), respectively; and</text></paragraph><paragraph id="HF06DB1FD20F94A15B8F867F8BAEC0384"><enum>(2)</enum><text>by inserting after paragraph (2) the following:</text><quoted-block style="OLC" id="HBDC4BE47049D4F20B59E363A6A28F1CF" display-inline="no-display-inline"><paragraph id="H6CE6545D96624C5BB6A7551B8F272281"><enum>(3)</enum><text display-inline="yes-display-inline">to ensure, to the maximum extent possible, that English learners are taught alongside non-English learners;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HF26D8FD494C54525ABF3F1343A85A8B8"><enum>(b)</enum><header>Subgrants to eligible entities</header><text display-inline="yes-display-inline">Section 3115(d) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6825">20 U.S.C. 6825(d)</external-xref>) is amended—</text><paragraph id="H26963BBF45904E17A7ADDA7F560F71F0"><enum>(1)</enum><text>in paragraph (6)—</text><subparagraph id="H5DE6362CA2C94816AF10A5CEDE780626"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="HF060CE1EDEE942A98F2A431C56F5E641"><enum>(B)</enum><text>in subparagraph (B), by striking the period and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H385DD3C8B89E422BAEA2307C71271EA4"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H4AAA3663E2C74B29BCE21EBCF193898B" display-inline="no-display-inline"><subparagraph id="H462521C0C77D4D2D9900373F66D9ED5B"><enum>(C)</enum><text display-inline="yes-display-inline">to increase the access of immigrant children and youth, and the parents of immigrant children and youth, to legal, financial, and social services resources.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H394614BA1B3D43EF86013C2206FCED68"><enum>(2)</enum><text>by redesignating paragraph (9) as paragraph (11); and</text></paragraph><paragraph id="HF4158A5757D14041827017B95093B47C"><enum>(3)</enum><text>by inserting after paragraph (8) the following:</text><quoted-block style="OLC" id="HE656EDD5AB33420CBC4A4B3DC47D8E31" display-inline="no-display-inline"><paragraph id="H22FA9D31A9214368951C4A5B372DC4BC"><enum>(9)</enum><text display-inline="yes-display-inline">Carrying out projects that provide educators, school administrators, counselors, social workers, and psychologists with culturally competent and culturally responsive training to better support English learners and immigrant children and youth.</text></paragraph><paragraph id="HD5D4CC443962411F87087FBFF7DBB2DC"><enum>(10)</enum><text display-inline="yes-display-inline">Carrying out projects that—</text><subparagraph id="HB92A0481EF0E431C9E82F69558799274"><enum>(A)</enum><text display-inline="yes-display-inline">assess local laws, including local immigration policies and State education laws, that impact educational outcomes for English learners and immigrant children and youth;</text></subparagraph><subparagraph id="HFA0E90946C8A4D7C9C8844D32DCE8B74"><enum>(B)</enum><text>implement best practices aligned with evidence-based research to improve educational outcomes for English learners and immigrant children and youth; and</text></subparagraph><subparagraph id="H7B647DDC96E341968FB409E3409DA5F1"><enum>(C)</enum><text>facilitate engagement with members of local school boards on strategies to improve educational outcomes for English learners and immigrant children and youth, regardless of immigration status.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HE116D5BF8FF84D33B14036340397BE4A"><enum>(c)</enum><header>Reporting</header><text display-inline="yes-display-inline">Section 3121(a) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6841">20 U.S.C. 6841(a)</external-xref>) is amended—</text><paragraph id="HBF920A3E1E4B47EA98DC3ADDEE30C583"><enum>(1)</enum><text>in paragraph (2), by striking <quote>at a minimum, by</quote> and inserting <quote>at a minimum, by ethnicity, race, native language, and</quote>;</text></paragraph><paragraph id="HEF7301D94CA84ED4A614CE43720A8ADF"><enum>(2)</enum><text>in paragraph (3), by striking the semicolon and inserting <quote>, in the aggregate and disaggregated, at a minimum, by ethnicity, race, native language, and English learners with a disability;</quote>;</text></paragraph><paragraph id="HF835442967D44911A0BD5668B4A2CA8E"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (4), by striking the semicolon and inserting <quote>, in the aggregate and disaggregated, at a minimum, by ethnicity, race, native language, and English learners with a disability;</quote>;</text></paragraph><paragraph id="H0188FA228E56418E92397DC9A694881A"><enum>(4)</enum><text display-inline="yes-display-inline">in paragraph (5), by striking <quote>at a minimum, by</quote> and inserting <quote>at a minimum, by ethnicity, race, native language, and</quote>; and</text></paragraph><paragraph id="H2E65241B8B1C4AB3B6CC9F350990E82B"><enum>(5)</enum><text>in paragraph (6), by striking <quote>educational agency; and</quote> and inserting <quote>educational agency, in the aggregate and disaggregated, at a minimum, by ethnicity, race, native language, and English learners with a disability;
