which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Wild Free-Roaming Horses and Burros Act to protect horses and burros from slaughter and ensure their humane management, and for other purposes.</official-title></form><legis-body id="H6C74364A6FFF41A8A82D0A35C4A89130" style="OLC"><section id="HB423B39D43B248FFA8BC16A21CE069F3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Wild Free-Roaming Horses and Burros Protection Act of 2022</short-title></quote>. </text></section><section id="HD916013C03234356990DED0F5BBC7379"><enum>2.</enum><header>Amendments to the Wild Free-Roaming Horses and Burros Act</header><subsection id="H8298D396DE44451B8EFA7ECD0087C1F8"><enum>(a)</enum><header>Congressional findings and declaration of policy</header><text display-inline="yes-display-inline">Section 1 of the Wild Free-Roaming Horses and Burros Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1331">16 U.S.C. 1331</external-xref>) is amended by striking <quote>in the area where presently found, as</quote>.</text></subsection><subsection id="H8A78F8D66AE444258C0F49F7D155FAFB"><enum>(b)</enum><header>Definitions</header><text>Section 2 of the Wild Free-Roaming Horses and Burros Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1332">16 U.S.C. 1332</external-xref>) is amended—</text><paragraph id="HDE09CE18161D43378BC26CA6A3A05FD1"><enum>(1)</enum><text>in subsection (a), by striking <quote>by him</quote> in each place it occurs;</text></paragraph><paragraph id="H6B6799122C784701B488BAEBD561B414" commented="no"><enum>(2)</enum><text>in subsection (b), by striking <quote><quote>wild free-roaming horses and burros</quote></quote> and inserting <quote><quote>wild free-roaming horses and burros</quote> or <quote>wild free-roaming horses or burros</quote></quote>; </text></paragraph><paragraph id="HF69F17913D084C1B874C3D8CFAB97B93"><enum>(3)</enum><text>by amending subsection (d) to read as follows:</text><quoted-block style="OLC" id="H5C9DF7218C7744C7A45F6F605324B100" display-inline="no-display-inline"><subsection id="H0EC5922F45AD474BB1871B9284D393EA"><enum>(d)</enum><text display-inline="yes-display-inline"><quote>population</quote> means all wild free-roaming horses and burros existing within the boundaries of a herd management area or range;</text></subsection><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="H7ADD6FBDDBCC4B6C810F976314E843EF"><enum>(4)</enum><text>in subsection (e), by striking <quote>Service.</quote> and inserting <quote>Service;</quote></text></paragraph><paragraph id="HC33C3EAC62244CA9904965DD98724141"><enum>(5)</enum><text>in subsection (f)—</text><subparagraph id="HAB0A14B4C4224FC1B47A4C89AAB4FB47"><enum>(A)</enum><text>by striking <quote>or burros</quote> and all that follows through <quote>must be removed</quote> and inserting <quote>and burros that must be removed</quote>; and</text></subparagraph><subparagraph id="HD8359D0CD8554C7B96FC4FA3806196A7"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>in that area.</quote> and inserting <quote>in that area;</quote>; and </text></subparagraph></paragraph><paragraph id="HAE8EF61679B641A3B989B787F2573059"><enum>(6)</enum><text display-inline="yes-display-inline">by adding at the end the following: </text><quoted-block style="OLC" id="H8968E4A652044B338A7772DB9E7D575C" display-inline="no-display-inline"><subsection id="H5B037D29D64344B9B2F68679269B6834"><enum>(g)</enum><text display-inline="yes-display-inline"><quote>minimal feasible level</quote> means a level that is least invasive and disruptive to the natural behaviors of wild free-roaming horses and burros and their ability to live on public lands;</text></subsection><subsection id="H2553075899A0418B908540436ACE27A9"><enum>(h)</enum><text display-inline="yes-display-inline"><quote>surgically sterilize</quote> means to make an animal permanently incapable of producing offspring as a result of a procedure involving an incision and either—</text><paragraph id="H11025BEF6E814FC0A873BA193AE15F76"><enum>(1)</enum><text display-inline="yes-display-inline">the removal of reproductive organ(s); or</text></paragraph><paragraph id="H0CFD8214DE31411291E361870FE32999"><enum>(2)</enum><text display-inline="yes-display-inline">the alteration of reproductive organ(s) or surrounding tissue;</text></paragraph></subsection><subsection id="H6AF4E3C3EF74420FA7C9D6FD97705516"><enum>(i)</enum><text display-inline="yes-display-inline"><quote>fatally injured or terminally ill</quote> means exhibiting an acute or chronic illness, injury, physical condition, or lameness that, as determined by a licensed veterinarian—</text><paragraph id="HABBA3715344B49A297925510130AF60D"><enum>(1)</enum><text display-inline="yes-display-inline">precludes an acceptable quality of life due to pain or suffering; or</text></paragraph><paragraph id="H52BACF0A4C4F4E95B66932ACAD89F29C"><enum>(2)</enum><text display-inline="yes-display-inline">has a minimal chance of recovery;</text></paragraph></subsection><subsection id="HBDD244B47C514AF387D4D3E292BC5B80"><enum>(j)</enum><text display-inline="yes-display-inline"><quote>appropriate management level</quote> means the level at which the number of wild free-roaming horses and burros in a population are able to—</text><paragraph id="H3932D5FE8A9843BDB99A3B0F7052424F"><enum>(1)</enum><text>sustain themselves in a healthy condition;</text></paragraph><paragraph id="H13232043B15844B1BA5C93C8F63F9812"><enum>(2)</enum><text>produce healthy foals;</text></paragraph><paragraph id="H5E8C460687944B0D8CD03F50C30438A5"><enum>(3)</enum><text>maintain healthy genetic diversity; and</text></paragraph><paragraph id="HE461A32393EC46D789289BB91437FF70"><enum>(4)</enum><text>sustain a thriving natural ecological balance;</text></paragraph></subsection><subsection id="HAE701C66EED14548A4F1DE24576EAE7E"><enum>(k)</enum><text display-inline="yes-display-inline"><quote>animal welfare or wild horse organization</quote> means an organization—</text><paragraph id="HD2EBB88F13454CD28FD887CFBB3B027C"><enum>(1)</enum><text>described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/26/501">26 U.S.C. 501(c)(3)</external-xref>);</text></paragraph><paragraph id="HE40A1903A30941B6945F92FBBEC2133A"><enum>(2)</enum><text>exempt from taxation under section 501(a) of such Code; and</text></paragraph><paragraph id="H55C7E817E66645788A56ABA152B1D1F5"><enum>(3)</enum><text>the mission and practice of which includes the humane treatment of wild horses and burros; and</text></paragraph></subsection><subsection id="H0376F14D198A4800A88F19A76E5531DD"><enum>(l)</enum><text display-inline="yes-display-inline"><quote>herd management area</quote> means a designated area of public lands established for the maintenance and preservation of wild free-roaming horse and burro populations.</text></subsection><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></subsection><subsection id="H40F6FE9E2D31460CABD9D83A44895B26"><enum>(c)</enum><header>Powers and duties of Secretary</header><text>Section 3 of the Wild Free-Roaming Horses and Burros Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1333">16 U.S.C. 1333</external-xref>) is amended—</text><paragraph id="HA1B0C9C190214DEFAB35B67FA59B72D9"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="HFD106C887CDD421DAA07EFD7759E13A7"><enum>(A)</enum><text>by striking <quote>All wild free-roaming horses and burros are hereby</quote> and inserting the following: </text><quoted-block style="OLC" id="HB7EBE8B02D3147AA9491A07C4DC5B09D" display-inline="no-display-inline"><paragraph id="H0B0ACE21D8274F56AA7D04CF64E6A1D0"><enum>(1)</enum><text display-inline="yes-display-inline">All wild free-roaming horses and burros are hereby</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph><subparagraph id="HEF34491CACBF48458E11A2701D21A7E0"><enum>(B)</enum><text>by striking <quote>he may designate and maintain specific ranges on public lands as sanctuaries for their protection and preservation, where the Secretary after consultation</quote> and inserting <quote>the Secretary may designate and maintain specific ranges on public lands as sanctuaries for the protection and preservation of wild free-roaming horses and burros, after consultation</quote>;</text></subparagraph><subparagraph id="H6A2054DEA59545DF917578898DE6B7C5"><enum>(C)</enum><text>by striking <quote>He shall consider</quote> and inserting <quote>The Secretary shall consider</quote>; </text></subparagraph><subparagraph id="H0B4F3262FA744D46B0D7894767295F1D"><enum>(D)</enum><text>by inserting <quote>wild free-roaming horses and burros as well as</quote> before <quote>the natural ecological balance</quote>;</text></subparagraph><subparagraph id="H21EE43400E784E6D96054F44583705E7"><enum>(E)</enum><text>by inserting <quote>wild free-roaming horses and burros and</quote> before <quote>other wildlife species</quote>; and</text></subparagraph><subparagraph id="H2061921B597B4D40A0C399AC9C70900D"><enum>(F)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" id="HB87F73ABA4C24397B300D5553F660576" display-inline="no-display-inline"><paragraph id="H71531ECED7AA4C66BDC10617523B3CFA" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary shall provide for the welfare of wild free-roaming horses and burros during handling, management activities, removals, euthanasia, short-term holding, long-term holding, and all other activities conducted under this Act by—</text><subparagraph id="H32F638E681694E55BA4AE3C2E3F17E54" commented="no"><enum>(A)</enum><text>establishing regulations, consistent with this Act, that—</text><clause id="H8DA05EED721B44F981E05582D1785C2A" commented="no"><enum>(i)</enum><text>require, and describe conditions for, humane treatment of the animals during such activities; and </text></clause><clause id="H34542CC38A8041A69E0D9229F9878B7E" commented="no"><enum>(ii)</enum><text>ensure measures are in place for violations of the requirements or conditions under clause (i) to be corrected as expeditiously as practicable; and</text></clause></subparagraph><subparagraph id="H1DC2D7D712604605AF9224B5C65BB44F" commented="no"><enum>(B)</enum><text>taking action as expeditiously as practicable to correct, prevent the recurrence of, and record violations of such regulations.</text></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H999B1386B2174D6F89C111154E0EB4A9"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="H81831BB510E3493E94F1DB4804CE63C6"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="HA90C86C324844DE08AECC8F0FCD731DB"><enum>(i)</enum><text>by striking <quote>should be taken to remove excess animals</quote> and inserting <quote>should be taken to manage excess animals</quote>;</text></clause><clause id="HA90FFB4DA12A48E3A0D97A9F37A08E13"><enum>(ii)</enum><text display-inline="yes-display-inline">by striking <quote>determine whether appropriate management levels should be achieved by the removal or destruction of excess animals, or other options (such as sterilization, or natural controls on population levels)</quote> and inserting <quote>determine how the Secretary can achieve appropriate management levels using the most humane approaches available</quote>; and</text></clause><clause id="HC8AA5CD78E88472A9C8FBA0741C0E045"><enum>(iii)</enum><text>by striking <quote>whom he determines</quote> and inserting <quote>whom the Secretary determines</quote>; </text></clause></subparagraph><subparagraph id="H177387BA36A14B94B2BD2BBF56D19B98"><enum>(B)</enum><text>by redesignating paragraphs (2) and (3) as paragraphs (3) and (4), respectively;</text></subparagraph><subparagraph id="HAFF6064F0335485EA1E41F05921CAA91"><enum>(C)</enum><text>by inserting after paragraph (1) the following: </text><quoted-block style="OLC" id="H59A0E31D5D4A4982A45728C670E273A7" display-inline="no-display-inline"><paragraph id="H5902728C5C85496282138CDCAFD9A6E9"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HE912A0F532B24DA586E93B4D684BB140"><enum>(A)</enum><text>In order to better manage and protect wild free-roaming horses and burros, and to achieve and maintain a thriving natural ecological balance, the Secretary shall implement the most humane, minimally invasive, scientifically proven fertility control methods, such as reversible immunocontraception vaccines, to achieve on-range management goals.</text></subparagraph><subparagraph id="HA0DF9B86A1BE44C6AC4483F044B86274" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">In carrying out this paragraph, the Secretary may contract with or enter into partnerships with nonprofit organizations (with preference given to veterans organizations and animal welfare or wild horse organizations trained or otherwise certified in the humane management or population control of wild horses and burros).</text></subparagraph><subparagraph id="HC70BB31A613949B59B92F0B2704EF0A7" indent="up1"><enum>(C)</enum><text>Nothing in this Act authorizes the Secretary to surgically sterilize any wild free-roaming horse or burro for the purposes of on-range population management.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="HDDBB78EE93E24640958E87000E531EE3"><enum>(D)</enum><text>by amending paragraph (3), as so redesignated, to read as follows: </text><quoted-block style="OLC" id="HAF386087EAB648119DB4A4C58356F439" display-inline="no-display-inline"><paragraph id="HB957CD12D6B1473B9BAC48750737E7FC"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HB0C8F2B384CE4E5F8A879F3481CD47E5"><enum>(A)</enum><text>The Secretary shall exhaust all practicable options for maintaining a thriving natural ecological balance on public lands before removing wild free-roaming horses and burros, including reallocating forage within the herd management area or range, the use of reversible immunocontraceptives, or relocating excess animals to herd management areas or ranges.</text></subparagraph><subparagraph id="HA88D3E40F2464B66960C6D2E9789FE6A" indent="up1"><enum>(B)</enum><text>A determination to remove excess animals from public lands must be made on the basis of—</text><clause id="H04852F94CEE94E3DB2F02D3748AEABAF"><enum>(i)</enum><text>the current inventory of lands under the jurisdiction of the Secretary;</text></clause><clause id="H3883C6A2C5424AA6BF743364C405B333"><enum>(ii)</enum><text>information contained in any land use planning completed pursuant to section 202 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1712">43 U.S.C. 1712</external-xref>);</text></clause><clause id="HAF288685EC0F426089E1EADB960C95CD"><enum>(iii)</enum><text>information contained in court-ordered environmental impact statements, as defined in section 3 of the Public Rangelands Improvement Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/43/1902">43 U.S.C. 1902</external-xref>);</text></clause><clause id="H2E13559E2829472C9B4A244B68A01674"><enum>(iv)</enum><text>the best available science; and</text></clause><clause id="H63EC27625F4E49A9A016AEDBB2B02491"><enum>(v)</enum><text>such additional information as becomes available to the Secretary from time to time, including that information developed in the research study mandated by this section.</text></clause></subparagraph><subparagraph id="HCC43288C8AEF4E4184620FEEFE66F887" indent="up1"><enum>(C)</enum><text>In the absence of the information contained in clauses (i) through (v) of subparagraph (B), a determination to remove excess animals from public lands must be made on the basis of all information currently available to the Secretary that such removal is necessary.</text></subparagraph><subparagraph id="HCF14F018AD3C48EBBCEC3AA4978DA230" indent="up1"><enum>(D)</enum><text>After publishing in the Federal Register a determination to remove excess animals from public land, the Secretary may cause excess animals to be humanely captured and removed for private maintenance and care for which the Secretary determines an adoption demand exists by qualified individuals prior to removal, except in the case of a removal pursuant to subsection (j).</text></subparagraph><subparagraph id="HB630AA1850F74FD1AA7D2578D10F2524" indent="up1"><enum>(E)</enum><text>The Secretary must ensure humane treatment and care of the animals (including proper transportation, feeding, and handling), including by requiring that—</text><clause id="HE9B1103E08B546BDB8A656A31FA13284"><enum>(i)</enum><text>not more than four animals may be adopted per year by any individual; and</text></clause><clause id="HAEF1A3F4723D4CF59D97E23C01475EA2"><enum>(ii)</enum><text>each individual adopter execute an appropriate attestation, pursuant to section 1001 of title 18, United States Code, affirming that the adopter will not cause or allow an adopted animal or its remains to be processed into a commercial product, including by any action described in section 8(a)(4).</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H75B00A4DE6BE49078721F960834DF55F"><enum>(E)</enum><text>in paragraph (4), as so redesignated, by striking <quote>assisting him in making his</quote> and inserting <quote>assisting the Secretary in making a</quote>;</text></subparagraph></paragraph><paragraph id="H2946BBC8283F43AA910DE7A6A1A79BF0"><enum>(3)</enum><text>in subsection (c)—</text><subparagraph id="H75E5F0D68B6140A79E9F9199913EBE08"><enum>(A)</enum><text>by striking <quote>Where excess animals have</quote> and inserting <quote>When a wild free-roaming horse or burro has</quote>; and</text></subparagraph><subparagraph id="HEEE7057F213D4D6F902CCF1714DF0A8C"><enum>(B)</enum><text>by striking <quote>one-year period</quote> and inserting <quote>one-year period only after the Secretary or a trained representative completes a compliance inspection and it is determined that there are no violations of applicable laws, regulations, or contract terms</quote>;</text></subparagraph></paragraph><paragraph id="H52B7CFD7AE5140658AD97325BDBB45BE"><enum>(4)</enum><text>in subsection (d)—</text><subparagraph id="H1131BFBFF09545CAAAFA980C2F9DEC87"><enum>(A)</enum><text>in paragraph (1), by striking <quote>except for the limitation of subsection (c)(1)</quote>;</text></subparagraph><subparagraph id="H1C3C13914CF345989D5B694D1BEA17F0"><enum>(B)</enum><text>by amending paragraph (3) to read as follows:</text><quoted-block style="OLC" id="H71BDB23DB19243519E88FFDD0A793CF1" display-inline="no-display-inline"><paragraph id="HD48EF9EF14094C498F877F2F7C5A5838"><enum>(3)</enum><text display-inline="yes-display-inline">upon destruction by the Secretary or a designee of the Secretary pursuant to subsection (h) of this section. </text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HAB9797528B9F40A9BC84D4E3B44E44B3"><enum>(C)</enum><text>by striking paragraphs (4) and (5);</text></subparagraph></paragraph><paragraph id="H5D471EF6B3254656BA772F5380191F2A"><enum>(5)</enum><text>by amending subsection (e) to read as follows: </text><quoted-block style="OLC" id="HCCA7C950326A40D5ACDBC481976E2661" display-inline="no-display-inline"><subsection id="H98B9FE62880242E9904AC508E1EAC716"><enum>(e)</enum><text display-inline="yes-display-inline">Funds generated from the adoption of excess animals under this subsection shall be—</text><paragraph id="HE3BD44E06521467B836CF8CC4E76F920"><enum>(1)</enum><text display-inline="yes-display-inline">credited as an offsetting collection to the Management of Lands and Resources appropriation for the Bureau of Land Management; and</text></paragraph><paragraph id="H7CE02E968D18405EA4CF0A8DB6BE3B31"><enum>(2)</enum><text display-inline="yes-display-inline">used for the costs relating to the adoption of wild free-roaming horses and burros, including the costs of marketing such adoption.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H0CF2DCBDD60C4F509D56454C40A5369E"><enum>(6)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" id="H4F054899EDCB4E0CBB2A71AE74AA9F81" display-inline="no-display-inline"><subsection id="HA61D1DBFF62142EE86AF6EC2E25A0DEC"><enum>(f)</enum><text display-inline="yes-display-inline">For the purposes of carrying out a successful wild free-roaming horse and burro adoption program, the Secretary shall—</text><paragraph id="HE9F72BAEF39E4DA38DB0C3C4E1B6D66D"><enum>(1)</enum><text display-inline="yes-display-inline">work with animal welfare or wild horse organizations to secure safe placement of wild free-roaming horses and burros;</text></paragraph><paragraph id="H380BE672420E44AB98D7867A329F5082"><enum>(2)</enum><text display-inline="yes-display-inline">screen potential adopters;</text></paragraph><paragraph id="HEE69A0EBCDC84135861179418E16981D"><enum>(3)</enum><text>educate adopters in humane care;</text></paragraph><paragraph id="H4E7EC286361A4BE9B12442E3A8821D98"><enum>(4)</enum><text>maintain adoption records, including records of violations, in a centralized database system; and</text></paragraph><paragraph id="HC64F01761BA248ACB5EA48FE367A52E2"><enum>(5)</enum><text display-inline="yes-display-inline">pursue agreements with organizations that use horses for rehabilitation, therapy, prison training, or veteran programs.</text></paragraph></subsection><subsection id="H1CA15E89018348279C9F70BD6E35D766"><enum>(g)</enum><text display-inline="yes-display-inline">The Secretary may not administer a program through which potential adopters may be offered a cash or monetary incentive for successful completion of the adoption process.</text></subsection><subsection id="H8EEB6F70817246CF92832BB9E312B7DB"><enum>(h)</enum><text display-inline="yes-display-inline">The Secretary may not destroy or authorize the destruction of wild free-roaming horses or burros unless the Secretary—</text><paragraph id="HBAB7502DDE104235B0BFDBE7D60C7818"><enum>(1)</enum><text display-inline="yes-display-inline">determines, based on the evaluation of a licensed veterinarian, that the wild free-roaming horse or burro is fatally injured or terminally ill; and</text></paragraph><paragraph id="H99361BAB3D974344B44E3E5414C6CE72"><enum>(2)</enum><text display-inline="yes-display-inline">ensures that the wild free-roaming horse or burro is euthanized in the most humane manner available.</text></paragraph></subsection><subsection id="HD918278EB6F04E93B2FF3A3ECF832057"><enum>(i)</enum><text display-inline="yes-display-inline">The Secretary may not—</text><paragraph id="H51E56DB140DF40E08045EBAF8BD8DF56"><enum>(1)</enum><text>process, authorize to be processed, or ship, move, deliver, receive, possess, purchase, sell, donate, or transport for processing any animal that is or was at any point during its life a wild free-roaming horse or burro, or the remains thereof, into commercial products; or</text></paragraph><paragraph id="H2D5DACBC80864C578D5F8592D2DF296B"><enum>(2)</enum><text>carry out any activity described in paragraph (1) if the Secretary has reason to believe the animal will be processed into commercial products as a result.</text></paragraph></subsection><subsection id="HA4CEAEE217954093BD0CFB81B0F38E3F"><enum>(j)</enum><text display-inline="yes-display-inline">The Secretary may temporarily remove wild free-roaming horses and burros from public lands if the immediate health or safety of those wild free-roaming horses or burros is threatened.</text></subsection><subsection id="H890A55AE37F14D92A3CFEA10CB80C916"><enum>(k)</enum><text display-inline="yes-display-inline">Except in cases of removal under subsection (j), if the Secretary removes wild free-roaming horses or burros, the Secretary shall provide a public notice on a public website of the Secretary’s department at least 30 days before the planned removal.</text></subsection><subsection id="H61F57E368C30436797F1F52ADDB7B878"><enum>(l)</enum><text>The Secretary shall—</text><paragraph id="H693363A8EB4648FABC062373B6794021"><enum>(1)</enum><text display-inline="yes-display-inline">track the number of wild free-roaming horses and burros injured or killed during gathering and holding, along with a brief description of the injury or cause of death, in a centralized database system; and</text></paragraph><paragraph id="HAC4450F0E33440718870ED88A135BA7B"><enum>(2)</enum><text display-inline="yes-display-inline">publish such information on a public website of the Secretary’s department.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HFDD9AB011D0A4531979E16ADCF67C276"><enum>(d)</enum><header>Private maintenance; Numerical approximation; Strays on private lands; Removal; Destruction by agents</header><text>Section 4 of the Wild Free-Roaming Horses and Burros Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1334">16 U.S.C. 1334</external-xref>) is amended—</text><paragraph id="H533D8074ABC24E248E8E0E68A5CFE503"><enum>(1)</enum><text>by inserting <quote>or returned to public lands</quote> after <quote>arrange to have the animals removed</quote>; </text></paragraph><paragraph id="H7E677EF129554F8FADB3FFA369B50643"><enum>(2)</enum><text>by inserting <quote>pursuant to section 3(h)</quote> after <quote>by the agents of the Secretary</quote>;</text></paragraph><paragraph id="H103ECAED94984CB48A7977AAA19FB8BB"><enum>(3)</enum><text>by striking <quote>his private lands</quote> and inserting <quote>the landowner’s private lands</quote>;</text></paragraph><paragraph id="H0A10D43776D04FDD8A9D80A09C33BBD6"><enum>(4)</enum><text>by striking <quote>if he does so</quote> and inserting <quote>if the private landowner does so</quote>;</text></paragraph><paragraph id="H91F206F8BBF847FC85FD9057A47FFBE8"><enum>(5)</enum><text display-inline="yes-display-inline">by striking <quote>removed or enticed from the public lands</quote> and inserting <quote>caused to leave public lands for the purpose of converting the animals into private property (including by removal or enticement)</quote>; and</text></paragraph><paragraph id="H4F97C5EF1CD94262BB193E51F6C487F6"><enum>(6)</enum><text>by striking <quote>and supply him</quote> and inserting <quote>and supply the Secretary</quote>. </text></paragraph></subsection><subsection id="HAEB30A60C86F42AF989B483DFFCC4DF6"><enum>(e)</enum><header>Cooperative agreements; regulations</header><text>Section 6 of the Wild Free-Roaming Horses and Burros Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1336">16 U.S.C. 1336</external-xref>) is amended—</text><paragraph id="H62346E4AC4C24E409384A55AEDF898CF"><enum>(1)</enum><text>by inserting <quote>, nonprofit organizations, private entities,</quote> after <quote>landowners</quote>; and</text></paragraph><paragraph id="H32F23F98A32C44E182C006FA6380FFBA"><enum>(2)</enum><text>by striking <quote>he deems</quote> and inserting <quote>the Secretary deems</quote>.</text></paragraph></subsection><subsection id="H785C7A78F9444AECACA411DE2BA98F71"><enum>(f)</enum><header>Criminal provisions</header><text>Section 8 of the Wild Free-Roaming Horses and Burros Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1338">16 U.S.C. 1338</external-xref>) is amended—</text><paragraph id="H556B7B0148F140EFB3402D1FECC43D5E"><enum>(1)</enum><text>by striking <quote>Any person who</quote> and inserting the following: </text><quoted-block style="OLC" id="H93A5E25205054F88A81F1B36B7EFFEF2" display-inline="no-display-inline"><subsection id="HEA1CAD1EBFD341499B9312723C49A7A3"><enum>(a)</enum><text display-inline="yes-display-inline">Any person who</text></subsection><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="H6DE3EAC22C5A46DD8AB154CFF9759D56"><enum>(2)</enum><text>by amending paragraph (4) of subsection (a), as so redesignated, to read as follows: </text><quoted-block style="OLC" id="H4F1F1F5EED3B4F91802CFCF245BE6022" display-inline="no-display-inline"><paragraph id="H84A3847EB2D94339A7DDD42AF4A8D8AB"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H6F539141376E4FCCA24FAA25B820DDD7"><enum>(A)</enum><text>processes, authorizes to be processed, or ships, moves, delivers, receives, possesses, purchases, sells, donates, or transports for processing any animal that is or was at any point during its life a wild free-roaming horse or burro, or the remains thereof, into commercial products, or</text></subparagraph><subparagraph id="HB1A195C29AF9403299600BCA43BD3166" indent="up1"><enum>(B)</enum><text>carries out any activity described in paragraph (1) if the person has reason to believe the animal will be processed into commercial products as a result, or</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HF0929674F9514133B7992895B0908CC2"><enum>(3)</enum><text>in paragraph (6) of subsection (a), as so redesignated—</text><subparagraph id="HE208B2AA48944B5B8FAB402E8B76B8CC"><enum>(A)</enum><text>by inserting <quote>, and shall not be allowed to adopt or purchase any animal that is or was at any point during its life a wild free-roaming horse or burro</quote> after <quote>or both</quote>; and</text></subparagraph><subparagraph id="H16E8552124B94BF48CE14B2E4CFFC173"><enum>(B)</enum><text>by striking <quote>he was appointed</quote> and inserting <quote>such judge was appointed</quote>.</text></subparagraph></paragraph></subsection><subsection id="H346B8E35E4084928878E794FB903D568"><enum>(g)</enum><header>Transportation of captured animals; Procedures and prohibitions applicable</header><text>Section 9 of the Wild Free-Roaming Horses and Burros Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1338a">16 U.S.C. 1338a</external-xref>) is amended—</text><paragraph id="HBEC863CD0158459FAC7599202D1E72F6"><enum>(1)</enum><text>by striking <quote>may use or contract for the use of helicopters or, for the purpose of transporting captured animals, motor vehicles. Such use</quote> and inserting <quote>shall prioritize use of the most humane, passive techniques, such as bait-and-trap techniques, for any capture of wild free-roaming horses and burros. The use of non-passive techniques with respect to the capture of wild free-roaming horses and burros</quote>; and</text></paragraph><paragraph id="HA1958F431057482584B1F6D00C543726"><enum>(2)</enum><text>by striking <quote>fixed-wing aircraft, or helicopters, or to</quote> and inserting <quote>or</quote>.</text></paragraph></subsection><subsection id="H192FE04BBF204850A88D41A312129C0C"><enum>(h)</enum><header>Limitation of authority</header><text>Section 10 of the Wild Free-Roaming Horses and Burros Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1339">16 U.S.C. 1339</external-xref>) is repealed.</text></subsection><subsection id="H92EA64C17CF14EA8AF9D85DA5EA3CFD6"><enum>(i)</enum><header>Joint report to Congress; Consultation and coordination of implementation, enforcement, and departmental activities; Studies</header><text>Section 11 of the Wild Free-Roaming Horses and Burros Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1340">16 U.S.C. 1340</external-xref>) is amended by striking <quote>he might</quote> and inserting <quote>the Secretary might</quote>.</text></subsection></section><section id="H75AEBCFF38D940D1AB7D4C7AB2AC0439"><enum>3.</enum><header>GAO report</header><text display-inline="no-display-inline">Not later than 1 year after the date of the enactment of this Act, the Comptroller General shall submit, to the Committee on Natural Resources of the House of Representatives and the Committee on Energy and Natural Resources of the Senate, a report that describes—</text><paragraph id="H13C2A55A12124964A2ADB0C12A02A870"><enum>(1)</enum><text display-inline="yes-display-inline">humane alternatives to the use of helicopters and fixed-wing aircraft in managing wild free-roaming horse and burro populations;</text></paragraph><paragraph id="HB3C1CB63ECBE47479417C60CDCEE35D5"><enum>(2)</enum><text display-inline="yes-display-inline">job creation opportunities presented by the use of such humane alternatives; and</text></paragraph><paragraph id="H64F8F3D1BBA349999E729F688BE8F152"><enum>(3)</enum><text display-inline="yes-display-inline">the effects of aircraft, including unmanned aircraft systems, on wild free-roaming horse and burro populations.</text></paragraph></section></legis-body></bill>
