<section id="HF3F2AF2888B648CBAA692216F2843CE0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Free Speech Protection Act</short-title></quote>.</text></section> <section id="H3012A0E669A845EEA097E1D69E33A549"><enum>2.</enum><header>Speech proceedings</header> <subsection id="H059C4CB8F2114843A93BC03156945617"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Part VI of title 28, United States Code, is amended by inserting after chapter 181 the following:</text>

<section id="H054F14F9DA824A0AB41E439FDDD457A9"><enum>4201.</enum><header>Treatment of covered speech</header> 
<subsection id="H5CB5F9477BAD49E48B6E4D116B205773"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A natural person may not be held civilly liable in a court of competent jurisdiction for defamation on the basis of covered speech, unless—</text> <paragraph id="HD520C54207C0405E99C7E09FE6BD0C5D"><enum>(1)</enum><text>such covered speech was known by the natural person to be false, or the natural person acted negligently with disregard to the falsity of the covered speech; or</text></paragraph> 
<paragraph id="HF6897EBE71AF4E16A72A465C7D128E4B"><enum>(2)</enum><text>in the case that the covered speech is related to a public figure, the covered speech was made with actual malice.</text></paragraph></subsection> <subsection id="HB077B6779A0945E0BEA0A06906FEC6C2"><enum>(b)</enum><header>Liability for frivolous, malicious, or bad faith claims</header> <paragraph id="HF4A9B791C0F84F7D8B4A1FE8F5217950"><enum>(1)</enum><header>Cause of action</header> <subparagraph id="H86CF43D1F5114A839EDD8C5A84CB8295"><enum>(A)</enum><header>In general</header><text>A natural person may bring a civil action against an individual or entity that files a defamation claim described in paragraph (2) against such natural person in a court of competent jurisdiction to obtain the relief described in subparagraph (B).</text></subparagraph>
<subparagraph id="H3F2B581008EE4F0B96939F121B29078D"><enum>(B)</enum><header>Relief</header><text>A court may award as relief to a plaintiff bringing a civil action under this paragraph—</text> <clause id="H6906290FEB004C3A81227FBAC36454DA"><enum>(i)</enum><text>actual damages; or</text></clause>
<clause id="HA66705F56EF141C1923787BCA334512A"><enum>(ii)</enum><text>statutory damages of $50,000,</text></clause><continuation-text continuation-text-level="subparagraph">whichever is greater.</continuation-text></subparagraph> <subparagraph id="HE710552498304758BBAB7055EBB836AF"><enum>(C)</enum><header>Attorney’s fees</header><text>A plaintiff prevailing in a civil action under this paragraph may be awarded reasonable attorney’s fees.</text></subparagraph></paragraph> 
<paragraph id="HBA58660C1B5E4778A73B882A7B91EF03"><enum>(2)</enum><header>Claim described</header><text>A defamation claim described in this paragraph is a claim—</text> <subparagraph id="HA8CF8FED957B492C8FD47D6FBBABF073"><enum>(A)</enum><text>for which a court determines that liability is precluded under subsection (a); and</text></subparagraph> 
<subparagraph id="HF6DB7694D63940BC8A340587D2ECD2BF"><enum>(B)</enum><text>that is shown, by a preponderance of the evidence, to be filed for the purpose of harassing, intimidating, or otherwise suppressing covered speech related to a matter of legitimate public concern.</text></subparagraph></paragraph></subsection></section> <section id="H323389B1FC1D434AA7811581C6ADF606"><enum>4202.</enum><header>Rule modification</header> <subsection id="H12F8BFA52B3D4BADAF29BB3F42E30582"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 3 years after the date of enactment of this chapter, the Supreme Court shall, in accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/131">chapter 131</external-xref> of title 28, United States Code (commonly known as the <quote>Rules Enabling Act</quote>), review the Federal Rules of Civil Procedure and prescribe and modify such rules as may be appropriate to create expedited procedures for the disposition of claims brought in violation of section 4201(a).</text></subsection> 
<subsection id="HF8909010042A48DB877A31E39D79A908"><enum>(b)</enum><header>Declaratory judgment</header><text>The rules that are prescribed or modified in accordance with subsection (a) shall provide that after the pleadings are filed and before discovery commences, a defendant may move for a declaratory judgment regarding whether the relevant conduct constitutes, prima facie, covered speech. Upon such a determination by a court and a showing by the movant that discovery is unlikely to reveal any material fact, the court shall proceed to judgment on the pleadings. </text> </subsection></section> <section id="H271771259A9D4F26B49935440ED8739A"><enum>4203.</enum><header>No preemption</header><text display-inline="no-display-inline">Nothing in this chapter may be construed to preempt any State law that—</text> 
<paragraph id="H5BC922AF134241E3A283E332ECB100AB"><enum>(1)</enum><text display-inline="yes-display-inline">provides for an expedited review or procedure for dismissal of suits designed to suppress free speech; or</text></paragraph> <paragraph id="H7DAE8FF821CB4063974ECF8BAA6BED70"><enum>(2)</enum><text display-inline="yes-display-inline">requires greater intent than negligence for a successful defamation claim regarding natural persons who are not public figures.</text></paragraph></section> 
<section id="H5EF875AA52764864913DA50F09A58941"><enum>4204.</enum><header>Definitions</header><text display-inline="no-display-inline">In this chapter:</text> <paragraph id="HACC0CDE071214667B6504E6F63240CD7"><enum>(1)</enum><header>Speech</header><text display-inline="yes-display-inline">The term <quote>speech</quote> means—</text> 
<subparagraph id="H8292B90D94B8407F9421A8D22BD0ABD7"><enum>(A)</enum><text display-inline="yes-display-inline">oral, written, or visual communication or expressive conduct that is intended to convey a particular idea; and</text></subparagraph> <subparagraph id="H77481DB655A746C88B5C0864BCFB714A"><enum>(B)</enum><text display-inline="yes-display-inline">communication or conduct that would be reasonably understood by the intended audience to convey that particular idea.</text></subparagraph></paragraph> 
<paragraph id="HF9DDBFF98D754C868394DF9FF565D8AC"><enum>(2)</enum><header>Covered speech</header><text>The term <quote>covered speech</quote> means speech, in or affecting interstate commerce, that is—</text> <subparagraph id="H03C164ED1CE5475AB19C25C678BA0371"><enum>(A)</enum><text display-inline="yes-display-inline">understood by the general public to have artistic, educational, social, political, or scientific value regarding a legitimate matter of public concern;</text></subparagraph> 
<subparagraph id="HFC1A35333CBB47F1BC0940923F534454"><enum>(B)</enum><text display-inline="yes-display-inline">intended for broad consumption; and</text></subparagraph> <subparagraph id="HED7ACC4E9F944E79976C7F5F62452848"><enum>(C)</enum><text display-inline="yes-display-inline">made in a public forum or is otherwise disseminated to the general public or a large relevant audience.</text></subparagraph></paragraph> 
<paragraph id="H5DDDF95619B34F2F9DF27BFA6C0D20B2"><enum>(3)</enum><header>Legitimate public concern</header><text display-inline="yes-display-inline">The term <quote>legitimate matter of public concern</quote> means a subject that is of interest to the general public or a large relevant audience, including any of the following:</text> <subparagraph id="H641AEF3383484DA8B0FCF3E3A4B72DF4"><enum>(A)</enum><text>Governmental actions or decisions making, including legislative activity, judicial proceedings, or executive conduct or actions.</text></subparagraph> 
<subparagraph id="HC5DC6C3441224C0CA2351F1E1FCC3233"><enum>(B)</enum><text>Public or official conduct of a public figure.</text></subparagraph> <subparagraph id="H361212E612DC49A2AC44EBE0DDD85D42"><enum>(C)</enum><text>General newsworthiness and current events.</text></subparagraph> 
<subparagraph id="H9C22035C98D345D2887BAC301F03F200"><enum>(D)</enum><text>Public health and safety.</text></subparagraph></paragraph> <paragraph id="HB6B1B021E8854174806C90D2DA418DCA"><enum>(4)</enum><header>Public figure</header><text display-inline="yes-display-inline">The term <quote>public figure</quote> means a person who—</text> 
<subparagraph id="H6F2B7C82FE0E46F18390C9707720A5C5"><enum>(A)</enum><text>holds a public office and engages in official actions that are of interest;</text></subparagraph> <subparagraph id="H15A9529B56DC4CD2842F82848D512844"><enum>(B)</enum><text>assumes a role of especial prominence in the affairs of society;</text></subparagraph> 
<subparagraph id="HF5605618B796433996A227F9D405B183"><enum>(C)</enum><text>occupies a position of persuasive power and influence; or</text></subparagraph> <subparagraph id="H8A4A8F80C5594B45ABDE2FB8A0C81005"><enum>(D)</enum><text>thrusts oneself to the forefront of particular controversies in order to influence the resolution of the issues involved.</text></subparagraph></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
