R. 9122</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220930">September 30, 2022</action-date><action-desc><sponsor name-id="S001175">Ms. Speier</sponsor> (for herself and <cosponsor name-id="M000194">Ms. Mace</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 5, United States Code, to provide employees of the Federal Bureau of Investigation whistleblower appeal rights to the Merit Systems Protection Board, and for other purposes.</official-title></form><legis-body id="H6C55EDAF08DC47AE8D08AF1BFB26643A" style="OLC"><section id="HA0B000585DCA47F9BE13C790E539C0AB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>FBI Whistleblower Protection Enhancement Act</short-title></quote>.</text></section><section id="HE2DFEEE0F8E64A7BA66EF5D1C7E5D6E4" section-type="subsequent-section"><enum>2.</enum><header>Appeals to Merit Systems Protection Board relating to FBI reprisal allegations; salary of Special Counsel</header><text display-inline="no-display-inline">Section 2303 of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB826CE8B6B8242F29C77D763269421C1"><subsection id="H870607C7819949D2839FBFBBC39D7DC7"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H89CDA62C23C74230BB706C534D5189C7"><enum>(1)</enum><text>An employee of the Federal Bureau of Investigation who makes an allegation of a reprisal under regulations promulgated under this section may appeal a final determination or corrective action order by the Bureau under those regulations to the Merit Systems Protection Board pursuant to section 1221.</text></paragraph><paragraph id="H86F336DAB276481C9CD842A6FF90AEE9" indent="up1"><enum>(2)</enum><text>If no final determination or corrective action order has been made or issued for an allegation described in paragraph (1) before the expiration of the 180-day period beginning on the date on which the allegation is received by the Federal Bureau of Investigation, the employee described in that paragraph may seek corrective action directly from the Merit Systems Protection Board pursuant to section 1221.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
