<section id="H5FCF19D495E24EF29428C607E85489D1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rebuilding the United States-Flag International Fleet Act</short-title></quote>.</text></section> <section id="HD3FAAC139901481CBE43535D492C1996"><enum>2.</enum><header>Reinstatements of minimum tonnage and transportation costs reimbursement</header> <subsection id="H0AFAAE3C51154E92880AA98C0D081763"><enum>(a)</enum><header>Repeal under MAP–21</header><text display-inline="yes-display-inline">Section 100124 of the Moving Ahead for Progress in the 21st Century Act (<external-xref legal-doc="public-law" parsable-cite="pl/112/141">Public Law 112–141</external-xref>) is repealed, and any provision of law amended or repealed by such section is restored or revived as if such section were not enacted into law.</text></subsection>
<subsection id="H50C33FF29F5140CC92B1DCF751ADD490"><enum>(b)</enum><header>Repeal under Bipartisan Budget Act of 2013</header><text display-inline="yes-display-inline">Section 602 of the Bipartisan Budget Act of 2013 (<external-xref legal-doc="public-law" parsable-cite="pl/113/67">Public Law 113–67</external-xref>) is repealed, and any provision of law amended or repealed by such section is restored or revived as if such section were not enacted into law.</text></subsection> <subsection id="H2985984B75F24EFE8D62217D3D55F2A8"><enum>(c)</enum><header>Report on administration of programs</header> <paragraph id="H957F3D6B170548A580D8E6DD043A20ED"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/553">Chapter 553</external-xref> of title 46, United States Code, is amended by inserting before section 55302 the following: </text>

<section id="H712827A5D4F4492584BDBF577BAFFAF6"><enum>55301.</enum><header>Report on administration of programs</header>
<subsection id="H1BCCB561BA724D6093BEA3696A1E7717"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator of the Maritime Administration shall annually submit to Congress a report on the administration by other Federal departments and agencies of programs subject to section 2631 of title 10, United States Code, and that the Administrator determines subject to section 55305 of title 46, United States Code.</text></subsection> <subsection id="H9E76D48148DD41348BD65097081CB238"><enum>(b)</enum><header>Contents</header><text display-inline="yes-display-inline">The report under paragraph (1) shall include—</text>
<paragraph id="H87A83B5201644159A9C37DFE22238904"><enum>(1)</enum><text>gross tonnage by department or agency of cargo (equipment, materials, or agricultural products) and by cargo type transported on United States flag vessels versus foreign vessels; and</text></paragraph> <paragraph id="H13B6BC65B1C94DD2AD9928A577A01507"><enum>(2)</enum><text>the total number of United States flag vessels versus foreign vessels contracted by each department or agency. </text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>
<paragraph id="H4594ADD74251471CADD9DE755666B547"><enum>(2)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/553">chapter 553</external-xref> of title 46, United States Code, is amended by inserting before the item relating to section 55302 the following new item: </text> <quoted-block style="USC" id="HBD5713D759764A7BA779714335B8B0A2" display-inline="no-display-inline"> <toc regeneration="no-regeneration"> <toc-entry level="section">55301. Report on administration of programs. </toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> <section id="H43AECB5B38D6434B870153F8B7AA3829" section-type="subsequent-section" display-inline="no-display-inline"><enum>3.</enum><header>Cargoes procured, furnished, or financed by the United States Government</header> <subsection id="H65F0F4AE79E649CA9717079727662A6C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 55305 of title 46, United States Code, is amended—</text>
<paragraph id="HA977550ABEF14032B991E1F5DBAC2C98"><enum>(1)</enum><text>by striking subsection (a);</text></paragraph> <paragraph id="H99CEB257964741E4AAD07FBB2B30B6EC"><enum>(2)</enum><text>in subsection (b) by striking <quote>50</quote> and inserting <quote>75</quote>; </text></paragraph>
<paragraph id="H5B9F6EA413FD455197EE8A463DB3EBF5"><enum>(3)</enum><text>by redesignating subsection (b) as subsection (a);</text></paragraph> <paragraph id="H0FBF8C4A04D043D48C116C9D729919FC"><enum>(4)</enum><text>by striking subsection (c) and inserting the following: </text>
<quoted-block style="USC" id="H7504CCFFA2E84B0C94B95C05F8A94BD7" display-inline="no-display-inline">
<subsection id="H43CCD526F3874CB7A8320420E6D4246E"><enum>(c)</enum><header>Waivers</header>
<paragraph id="H1378E1918E2748DB99B56EC12DC203DB"><enum>(1)</enum><header>In general</header><text>Notwithstanding any other provision of law, when the President, the Secretary of Defense, or the Secretary of Transportation declares the existence of an emergency justifying a temporary waiver of this section or section 55314, the President, the Secretary of Defense, or the Secretary of Transportation, following a determination by the Maritime Administrator, acting in the Administrator’s capacity as Director, National Shipping Authority, of the non-availability of qualified United States flag capacity at fair and reasonable rates for commercial vessels of the United States to meet the requirements of this section or section 55314, may waive compliance with such section to the extent, in the manner, and on the terms the Maritime Administrator, acting in such capacity, prescribes, and no other waivers of the requirements of this section or section 55314 shall be authorized.</text></paragraph> <paragraph id="HEBF0839E6EE647ECA2557BD7327B4841"><enum>(2)</enum><header>Duration of waiver</header> <subparagraph id="H8F12E704BA85461EA0681B07AC9E0A95"><enum>(A)</enum><header>In general</header><text>Subject to subparagraphs (B) and (C), a waiver issued under this subsection shall be for a period of not more than 60 days.</text></subparagraph>
<subparagraph id="HFAAEBB96CEEA4080A51FF066980D9BF2"><enum>(B)</enum><header>Waiver extension</header><text>Upon termination of the period of a waiver issued under this subsection, the Maritime Administrator may extend the waiver for an additional period of not more than 30 days, if the Maritime Administrator makes the determinations described in paragraph (1).</text></subparagraph> <subparagraph id="HAE76F241D6A340AB8E9DFCEF6A067550"><enum>(C)</enum><header>Aggregate duration</header><text>The aggregate duration of the period of all waivers and extensions of waivers under this subsection with respect to any one set of events shall not exceed 3 months in a fiscal year.</text></subparagraph></paragraph>
<paragraph id="HA03A798A818040F4B142A0E04E59991F"><enum>(3)</enum><header>Determinations</header><text>The Maritime Administrator shall—</text> <subparagraph id="H177524F34BF1457AA66A9D59779C955D"><enum>(A)</enum><text>for each determination referred to in paragraph (1), identify any actions that could be taken to enable qualified United States flag capacity to meet the requirements of this section or section 55314 at fair and reasonable rates for commercial vessels of the United States;</text></subparagraph>
<subparagraph id="H72F368A66BEF46D8B88D28644D23F4F1"><enum>(B)</enum><text display-inline="yes-display-inline">provide notice of each determination referred to in paragraph (1) to the Secretary of Transportation and, as applicable, the President or the Secretary of Defense; and</text></subparagraph> <subparagraph id="HFE65CF5412DB47299AFE246DEB69DFDD"><enum>(C)</enum><text display-inline="yes-display-inline">publish each determination referred to in paragraph (1)—</text>
<clause id="H425AE23DFD934172BB4A7ABBD4939B67"><enum>(i)</enum><text>on the website of the Maritime Administration not later than 24 hours after notice of the determination is provided to the Secretary of Transportation; and</text></clause> <clause id="H5C0EA9C5C2E8428C8CD97FA6E2DDF163"><enum>(ii)</enum><text>in the Federal Register. </text></clause></subparagraph></paragraph>
<paragraph id="H68EA5DE01F0145E3843D7B3746177501"><enum>(4)</enum><header>Notice to congress</header><text>The Maritime Administrator shall notify—</text> <subparagraph id="HF76B313E99B74A56B7B458834966CC60"><enum>(A)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives of—</text>
<clause id="H472EE332B4904D95B806B7FC6CB1AEB7"><enum>(i)</enum><text display-inline="yes-display-inline">any request for a waiver (or an extension thereof) made by the Secretary of Transportation of this section or section 55314(a) not later than 72 hours after receiving such a request; and</text></clause> <clause id="H938C2107D4154417929F726FAB559ACB"><enum>(ii)</enum><text display-inline="yes-display-inline">the issuance of any such waiver (or an extension thereof), and why such waiver or extension was necessary, not later than 72 hours after such issuance; and </text></clause></subparagraph>
<subparagraph id="H232ECB8DF0504B9088C02F465917F567"><enum>(B)</enum><text>the Committee on Commerce, Science, and Transportation and the Committee on Armed Services of the Senate and the Committee on Transportation and Infrastructure and the Committee on Armed Services of the House of Representatives of—</text> <clause id="H534B645E7881451E8B3D91871EC59601"><enum>(i)</enum><text>any request for a waiver (or an extension thereof) made by the Secretary of Defense of this section or section 55314(a) not later than 72 hours after receiving such a request; and</text></clause>
<clause id="H251C8303009547B4AF7B342A754CCCE5"><enum>(ii)</enum><text>the issuance of any such waiver (or an extension thereof), and why such waiver or extension was necessary, not later than 72 hours after such issuance.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>; </after-quoted-block></quoted-block></paragraph> <paragraph id="H32FC937C2DC04CA48B9B4E573F295155"><enum>(5)</enum><text>by redesignating subsections (c) through (e) as subsections (d) through (f), respectively; </text></paragraph>
<paragraph id="HBB71643DF22845B99A2939D513CB439C"><enum>(6)</enum><text>by inserting after subsection (a) the following: </text> <quoted-block style="USC" display-inline="no-display-inline" id="H96848FD5977F4FD0976D63A5104CD18F"> <subsection id="H72D4E46D53CD40DEB9C28A1677454578"><enum>(b)</enum><header>Eligible vessels</header><text display-inline="yes-display-inline">To be eligible to carry cargo under this section, a privately-owned commercial vessel—</text>
<paragraph id="H27F516B4352F40F28B8B310CD8ADA9E5"><enum>(1)</enum><text>shall be documented under the laws of the United States for at least 3 years; or</text></paragraph> <paragraph id="H1480D1695F564BDFAC1F13E1BE6F3644"><enum>(2)</enum><text display-inline="yes-display-inline">may be documented under the laws of the United States for less than 3 years if—</text>
<subparagraph id="HD760CC94981747CA9BBC60F2CFE1DFF8"><enum>(A)</enum><text>the vessel owner signs an agreement with the Secretary providing that—</text> <clause id="H2E915E19C1B24EE1BD4C60E1170058DB"><enum>(i)</enum><text display-inline="yes-display-inline">the vessel shall remain documented under the laws of the United States for at least 3 years; and</text></clause>
<clause id="HA9AFDFDD3CF1477DB45E3087C62EC457"><enum>(ii)</enum><text display-inline="yes-display-inline">the vessel owner shall, upon request of the Secretary, agree to enroll the vessel in an Emergency Preparedness Program under chapter 531 or voluntary agreement authorize under section 708 of the Defense Production Act of 1950 (<external-xref legal-doc="usc" parsable-cite="usc/50/4558">50 U.S.C. 4558</external-xref>) and shall remain so enrolled until the vessel ceases to be documented under the laws of the United States; </text></clause></subparagraph> <subparagraph id="H01792638350B4CF89660E6E65AFC1AFC"><enum>(B)</enum><text>the vessel—</text>
<clause id="H31D3E213726840DBB6BC87843A052862"><enum>(i)</enum><text display-inline="yes-display-inline">is a tank vessel that is 10 years of age or less on the date the vessel is documented under the laws of the United States; or</text></clause> <clause id="HA2DB469DBA624870B9AD057B7B6CB94E"><enum>(ii)</enum><text display-inline="yes-display-inline">is any other type of vessel that is 15 years of age or less on the date the vessel is documented under the laws of the United States; and</text></clause></subparagraph>
<subparagraph id="HE0C2F1E2CFE04BF5A937AE97E93AD192"><enum>(C)</enum><text display-inline="yes-display-inline">the vessel was not originally built in a country which is a proscribed country listed pursuant to part 126 of title 22, Code of Federal Regulations, or successor regulations (commonly known as the <quote>International Traffic in Arms Regulations</quote>).</text></subparagraph></paragraph></subsection> <subsection id="H90EAAD2D3E67414ABAE1D056688E1157"><enum>(c)</enum><header>Violation of agreement</header> <paragraph id="H4C3A7A8E32CB4E95851F941C8B209868"><enum>(1)</enum><header>In general</header><text>A vessel under an agreement described in subsection (b)(2) may be seized by and forfeited to the United States if, in violation of such agreement—</text>
<subparagraph id="H5AEB59C4A1144A47B9C42D130CB2E434"><enum>(A)</enum><text>the vessel owner places the vessel under foreign registry; or</text></subparagraph> <subparagraph id="H88E71C70EB434319B1AF57805DDD1C0A"><enum>(B)</enum><text>a person operates the vessel under the authority of a foreign country.</text></subparagraph></paragraph>
<paragraph id="H8F172A636B204A74B01DAB2E7E97D14A"><enum>(2)</enum><header>Inapplicability of other law</header><text>Section 12112 of title 46, United States Code, shall not apply to the seizure and forfeiture of a vessel pursuant to paragraph (1). </text></paragraph></subsection><after-quoted-block>; and </after-quoted-block></quoted-block></paragraph> <paragraph id="H843B1CCAA31E46DD98EADDAC33B93B39"><enum>(7)</enum><text>by adding at the end the following: </text>
<quoted-block style="USC" display-inline="no-display-inline" id="H170ADB9F761C4F26AE457DE1204DAA2D">
<subsection id="H6D5DB80EF1F74B3797847760FE485C06"><enum>(g)</enum><header>Audit and report</header><text display-inline="yes-display-inline">In carrying out this section, the Secretary shall annually—</text> <paragraph id="H4C25F1A1C7984F568FD28D62E0E2CB1E"><enum>(1)</enum><text>audit the list of vessels that are operating under an agreement described in subsection (b)(2); and</text></paragraph>
<paragraph id="H9E9DF4F3F77745BF892EFE4B22755857"><enum>(2)</enum><text>submit to Congress a report describing—</text> <subparagraph id="H7E13768FF6FA4F0A82033A3E6F134154"><enum>(A)</enum><text>each of the vessels operating under paragraph (2) of section 55305(b) and each agreement signed by the Secretary pursuant to such paragraph; </text></subparagraph>
<subparagraph id="H1D0CC10AA111416A8E972D48114EEA8C"><enum>(B)</enum><text>the results of any audit described in paragraph (1); and</text></subparagraph> <subparagraph id="H7FDD6C4386634F5893489FEAB8404F2E"><enum>(C)</enum><text>any other pertinent information that the Secretary determines to be of interest to Congress. </text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H5C1CB5513853433F9006B383CB9DEAA3"><enum>(b)</enum><header>Technical amendment</header>
<paragraph id="HC49DBC18D406478C806A32FC2CA19D08"><enum>(1)</enum><header>Chapter analysis</header><text display-inline="yes-display-inline">The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/553">chapter 553</external-xref> of title 46, United States Code, is amended by striking the item relating to subchapter I and inserting the following: </text> <quoted-block style="USC" display-inline="no-display-inline" id="HFEBEAC85ADCE46CCAB36455CF99A686E"> <toc regeneration="no-regeneration"> <toc-entry level="subchapter">SUBCHAPTER I—GOVERNMENT IMPELLED TRANSPORTATION</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> <paragraph id="H122854A161234219A9C717CEC8A1A9E4"><enum>(2)</enum><header>Cargoes procured, furnished, or financed by the United States Government</header><text display-inline="yes-display-inline">Section 55305(d)(2)(D) of title 46, United States Code, is amended by striking <quote>section 25(c)(1) of the Office of Federal Procurement Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/41/1303">41 U.S.C. 1303(a)(1)</external-xref>)</quote> and inserting <quote>section 1303(a)(1) of title 41, United States Code,</quote>. </text></paragraph></subsection></section>
<section id="HCC5D82C0B8044A8DAEBB59AA9AD6C109" section-type="subsequent-section"><enum>4.</enum><header>Transportation requirements for certain exports sponsored by the Secretary of Agriculture</header><text display-inline="no-display-inline">Section 55314 of title 46, United States Code, is amended—</text> <paragraph id="HEDB902078FBC4621B66368BB6A8C7864"><enum>(1)</enum><text>in subsection (b)—</text>
<subparagraph id="H43AEBE9C5B2C49E9B8250D242CDA6ACD"><enum>(A)</enum><text>in paragraph (1) by inserting <quote>titles I, II, or III of</quote> after <quote>carried out under</quote>;</text></subparagraph> <subparagraph id="HE1FF76F6C9634DEE9F7C8D207AAEC2D4"><enum>(B)</enum><text>in paragraph (4) by striking <quote>agricultural commodities or their products</quote> and inserting <quote>agricultural products</quote>;</text></subparagraph>
<subparagraph id="H08EA36BC92544ECB967BE2FB6A1B9581"><enum>(C)</enum><text display-inline="yes-display-inline">in paragraph (5) by striking <quote>agricultural commodities or their products</quote> and inserting <quote>agricultural products</quote>;</text></subparagraph> <subparagraph id="H2116859557E243A696DB028A3C876D2D"><enum>(D)</enum><text display-inline="yes-display-inline">in paragraph (6) by striking <quote>agricultural commodities or their products</quote> and inserting <quote>agricultural products</quote>;</text></subparagraph>
<subparagraph id="H35F6CF37C48B453CB5BD2E8F3CCA5981"><enum>(E)</enum><text>in paragraph (7) by striking <quote>agricultural commodities</quote> and inserting <quote>agricultural products</quote>; </text></subparagraph> <subparagraph id="HA33E6A34A5A24AE4A21CDE19C163D770"><enum>(F)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (4), (5), (6), and (7) as paragraphs (6), (7), (8), and (9), respectively; and</text></subparagraph>
<subparagraph id="H0D034B5AA6A645FEAACC8B22FF0E546A"><enum>(G)</enum><text>by inserting after paragraph (3) the following: </text> <quoted-block style="USC" id="H71D46F5A089C408880EAFBDC2787EC90" display-inline="no-display-inline"> <paragraph id="HD5A3A3B8A9854D3E9F3BCF078919B13D"><enum>(4)</enum><text display-inline="yes-display-inline">carried out under the Food for Progress Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/7/1736o">7 U.S.C. 1736o</external-xref>);</text></paragraph>
<paragraph id="HCA0A9F95992C4B239540F548D3B0B342" commented="no"><enum>(5)</enum><text display-inline="yes-display-inline">carried out under the McGovern-Dole International Food for Education and Child Nutrition Program under section 3107 of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/1736o-1">7 U.S.C. 1736o–1</external-xref>); </text></paragraph><after-quoted-block>; and </after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H21499ACAA0BA480FB3586214DB59CB4D"><enum>(2)</enum><text>by adding at the end the following: </text>
<quoted-block style="USC" id="H81662F6FFD5F4C39957E68A8AC0BD5D9" display-inline="no-display-inline">
<subsection id="HEF49B55FF2134F8A893F230394E2C059"><enum>(d)</enum><header>Submission to Congress</header><text display-inline="yes-display-inline">At least once each fiscal year, the Secretary of Agriculture or the Administrator of the United States Agency for International Development, as applicable, shall submit to the appropriate congressional committees, in writing, a notice of any waiver of the requirements of this section and the reasons for granting such waiver. </text></subsection> <subsection id="HF774068D7BB140A59CBE332751E38138"><enum>(e)</enum><header>Agricultural product defined</header><text display-inline="yes-display-inline">In this section, the term <quote>agricultural product</quote> means any food product, including an agricultural commodity (as such term is defined in section 402 of the Food for Peace Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1732">7 U.S.C. 1732(2)</external-xref>)), specialty crop (as such term is defined in section 3(1) of the Specialty Crops Competitiveness Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/7/1621">7 U.S.C. 1621</external-xref> note)), or processed food product, exported from the United States.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="HE80170C8ABF04DACA9650066A997DC5A"><enum>5.</enum><header>Report on implementation</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of Defense shall submit to Congress a report on the implementation by the Department of Defense of the amendments to section 2631 of title 10, United States Code, made by section 1024 of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>).</text></section> <section id="H3A1215BA385C4804A7AD291D2A333E6D"><enum>6.</enum><header>Regulations and guidance</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator of the Maritime Administration shall—</text>
<paragraph id="H79211FFCDE1B44159642BD7E123F9859"><enum>(1)</enum><text display-inline="yes-display-inline">promulgate regulations under subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code, to fully implement and ensure compliance with section 2631 of title 10, United States Code, and section 55305 of title 46, United States Code; and </text></paragraph> <paragraph id="H6E06125904C14C1C898F0BDD67FE605A"><enum>(2)</enum><text display-inline="yes-display-inline">issue interagency guidance to other Federal departments and agencies on how to administer the programs in accordance with such Acts and the amendments made by the this Act, which shall include publication in the Federal Register and on the website of the Maritime Administration.</text></paragraph></section>
