which was referred to the <committee-name committee-id="HFA00">Committee on Foreign Affairs</committee-name>, and in addition to the Committees on <committee-name committee-id="HIF00">Energy and Commerce</committee-name>, <committee-name committee-id="HSY00">Science, Space, and Technology</committee-name>, and <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for civil nuclear coordination and strategy, and for other purposes.</official-title></form><legis-body id="H6A54E7E16339495C84EDF80FF8C9FE21" style="OLC"><section id="HE906CDD189BB4F2FBA8F012B9B13A296" section-type="section-one"><enum>1. </enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>International Nuclear Energy Act of 2022</short-title></quote>. </text></section><section id="HD7FD6D2E826C4D11A54F727449A74F7C"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H37A7299D9338408D8D3F97AFBA0D33E8" commented="no"><enum>(1)</enum><header>Advanced nuclear reactor</header><text>The term <term>advanced nuclear reactor</term> has the meaning given the term in section 951(b) of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16271">42 U.S.C. 16271(b)</external-xref>).</text></paragraph><paragraph id="H079190FD764B457493E0936D8FF80C81"><enum>(2)</enum><header>Ally or partner nation</header><text>The term <term>ally or partner nation</term> means—</text><subparagraph id="H2DAB7EDA267E481C84DB5579BC2C01B2"><enum>(A)</enum><text>the government of any country that is a member of the Organisation for Economic Co-operation and Development;</text></subparagraph><subparagraph id="HB7E2EDAAADF240AB8634581D67728538"><enum>(B)</enum><text>the Government of the Republic of India; and</text></subparagraph><subparagraph id="HE057F3FE42AC493581D75E0FB7B28902"><enum>(C)</enum><text>the government of any country designated as an ally or partner nation by the Secretary of State for purposes of this Act.</text></subparagraph></paragraph><paragraph id="H2655E40EC78E460386B15DC831F6868F"><enum>(3)</enum><header>Assistant</header><text>The term <term>Assistant</term> means the Assistant to the President and Director for International Nuclear Energy Policy described in section 3(a)(1)(D).</text></paragraph><paragraph id="H946388825362453AA5145048B54208A9" commented="no"><enum>(4)</enum><header>Associated entity</header><text>The term <term>associated entity</term> means an entity that—</text><subparagraph id="HCAF2577F920C42B19DE0C67A3B6DECAA" commented="no"><enum>(A)</enum><text>is owned, controlled, or operated by—</text><clause id="HF121229D681C43E09504CDE3B962D5F8" commented="no"><enum>(i)</enum><text>an ally or partner nation; or</text></clause><clause id="H2D5020DC63EA472395D64AA868FCCBF7" commented="no"><enum>(ii)</enum><text>an associated individual; or</text></clause></subparagraph><subparagraph id="HD3414AE172734AF686FA62280B477FCB" commented="no"><enum>(B)</enum><text>is organized under the laws of, or otherwise subject to the jurisdiction of, a country described in paragraph (2), including a corporation that is incorporated in a country described in that paragraph.</text></subparagraph></paragraph><paragraph id="H1DBB7C23B6474EE0A31F0F5B6883BE4B"><enum>(5)</enum><header>Associated individual</header><text>The term <term>associated individual</term> means a foreign national who is a national of a country described in paragraph (2).</text></paragraph><paragraph id="HC2CA2EA3C8FF4C8D8F466EEB289762E4"><enum>(6)</enum><header>Civil nuclear</header><text>The term <term>civil nuclear</term> means activities relating to—</text><subparagraph id="HACD09EDB918841498B7AE29788939763"><enum>(A)</enum><text>nuclear plant construction; </text></subparagraph><subparagraph id="HDD50FA47ABDD4091B6D7058C5AF17604"><enum>(B)</enum><text>nuclear fuel services; </text></subparagraph><subparagraph id="HA2E3BFC104EB435892CDF93273F42DA2"><enum>(C)</enum><text>nuclear energy financing;</text></subparagraph><subparagraph id="H95F87E054AB74F8D955D1A437990D74F"><enum>(D)</enum><text>nuclear plant operations;</text></subparagraph><subparagraph id="H59E26A1F813F4070853EE48813764A9A"><enum>(E)</enum><text>nuclear plant regulation;</text></subparagraph><subparagraph id="HAC3EB9C8930349F5BBD9A1F2559687E8"><enum>(F)</enum><text>nuclear medicine;</text></subparagraph><subparagraph id="H01A3B7AE71D242AF8095149CC71B9D2D"><enum>(G)</enum><text>nuclear safety;</text></subparagraph><subparagraph id="HE3FEDDCB696346A8A0117C94C9C6BB93"><enum>(H)</enum><text>community engagement in areas in reasonable proximity to nuclear sites;</text></subparagraph><subparagraph id="H20A5FE7462EC4172BFF8D12A67BF93F1"><enum>(I)</enum><text>infrastructure support for nuclear energy;</text></subparagraph><subparagraph id="HB87072884888437DA4126687695A8196"><enum>(J)</enum><text>nuclear plant decommissioning;</text></subparagraph><subparagraph id="H0605613AE9854B9DBA82475F46DBEEFE"><enum>(K)</enum><text>nuclear liability;</text></subparagraph><subparagraph id="HEAD425CF2DB44AEB82B679AB3C5DBE2B"><enum>(L)</enum><text>safe storage and safe disposal of spent nuclear fuel;</text></subparagraph><subparagraph id="HC0F48AF9419E4621A7EB15D0F344C28F"><enum>(M)</enum><text>environmental safeguards;</text></subparagraph><subparagraph id="HA70EDB8A838E4BC09DDB575083803AE8"><enum>(N)</enum><text>nuclear nonproliferation and security; and</text></subparagraph><subparagraph id="H6615FDA790BA467A954713733FCADFD3"><enum>(O)</enum><text>technology related to the matters described in subparagraphs (A) through (N). </text></subparagraph></paragraph><paragraph id="H2F15BA2CEF84469986466B927D096189"><enum>(7)</enum><header>Embarking civil nuclear energy nation</header><subparagraph id="H4272C787112D4DF8AF00286BA95A2FCF"><enum>(A)</enum><header>In general</header><text>The term <term>embarking civil nuclear energy nation</term> means a country that—</text><clause id="HD5F6A314F07E43E78BFED146C19B0B55"><enum>(i)</enum><text>does not have a civil nuclear program;</text></clause><clause id="H619F017EC3F54125B819D9959FF24390"><enum>(ii)</enum><text>is in the process of developing or expanding a civil nuclear program, including safeguards and a legal and regulatory framework, for—</text><subclause id="H4890484CD2434D5894EBBA2C6C6C2E5E"><enum>(I)</enum><text>nuclear safety; </text></subclause><subclause id="HD20583ADF737415AA3AFD0A7F591C869"><enum>(II)</enum><text>nuclear security; </text></subclause><subclause id="H0E9F27B849A8402B8E167547A463F9C2"><enum>(III)</enum><text>radioactive waste management; </text></subclause><subclause id="H4CEEA955CAE74C2E9C5DE84359E69D8C"><enum>(IV)</enum><text>civil nuclear energy;</text></subclause><subclause id="H6FA8F3763A704332964CE7223E44A46B"><enum>(V)</enum><text>environmental safeguards;</text></subclause><subclause id="HCD281B0EA5E5406DB6ADC29BB1B65E2A"><enum>(VI)</enum><text>community engagement in areas in reasonable proximity to nuclear sites;</text></subclause><subclause id="H0829C7A5480B4060850E8518F2823668"><enum>(VII)</enum><text>nuclear liability; or</text></subclause><subclause id="H078E28FD43AF4471BAC2F8E42F3C5F70"><enum>(VIII)</enum><text>advanced nuclear reactor licensing;</text></subclause></clause><clause id="H34CD5F1A4BB448FAA4BCA4B462055C6B"><enum>(iii)</enum><text>is in the process of selecting, developing, constructing, or utilizing advanced light water reactors, advanced nuclear reactors, or advanced civil nuclear technologies; or</text></clause><clause id="HC6D2BDF73A624C7C9E88350C6CEACF3E"><enum>(iv)</enum><text>is eligible to receive development lending from the World Bank.</text></clause></subparagraph><subparagraph id="H1CF580E191A64AADB2D59C45839CF9F2"><enum>(B)</enum><header>Exclusions</header><text>The term <term>embarking civil nuclear energy nation</term> does not include—</text><clause id="H833DF4B3A70747888C10DBA4A157214A"><enum>(i)</enum><text>the People’s Republic of China;</text></clause><clause id="H79312E7E2DE04B508A13BF09AAD01A7B"><enum>(ii)</enum><text>the Russian Federation;</text></clause><clause id="HE18D1C4CD881476690B55AD49842C4F1"><enum>(iii)</enum><text>the Republic of Belarus;</text></clause><clause id="HAEB40E3CBE88446682AEC8C2DA3DDD43"><enum>(iv)</enum><text>the Islamic Republic of Iran;</text></clause><clause id="H214EB0AB964447979C5A400F937ACC7E"><enum>(v)</enum><text>the Democratic People’s Republic of Korea;</text></clause><clause id="H3D8FE64394AE42AAACDADFC7BF57F5AD"><enum>(vi)</enum><text>the Republic of Cuba;</text></clause><clause id="H2AF0FED14E71441F94BB724E78F608EF"><enum>(vii)</enum><text>the Bolivarian Republic of Venezuela;</text></clause><clause id="HCE421F92E5274746995EEC890C138D95"><enum>(viii)</enum><text>the Syrian Arab Republic; or</text></clause><clause id="HA4D154F2D9F94E939A67EB41ACD5CF50"><enum>(ix)</enum><text>any other country—</text><subclause id="HF315A54D91CF414A939BABC2C02973A7"><enum>(I)</enum><text>the property or interests in property of the government of which are blocked pursuant to the International Emergency Economic Powers Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1701">50 U.S.C. 1701 et seq.</external-xref>); or </text></subclause><subclause id="HA111411D7F9A4755AA98745D72EAB005"><enum>(II)</enum><text>the government of which the Secretary of State has determined has repeatedly provided support for acts of international terrorism for purposes of—</text><item id="HF36FA6C92F5F47A1900B85D95914288D" commented="no"><enum>(aa)</enum><text>section 620A(a) of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2371">22 U.S.C. 2371(a)</external-xref>);</text></item><item id="H0F15916951104EAF8F642CA4E97E4660" commented="no"><enum>(bb)</enum><text>section 40(d) of the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2780">22 U.S.C. 2780(d)</external-xref>);</text></item><item id="HCAFC4CD8006F40CBB9D9CDBBA53D3A52" commented="no"><enum>(cc)</enum><text>section 1754(c)(1)(A)(i) of the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4813">50 U.S.C. 4813(c)(1)(A)(i)</external-xref>); or</text></item><item id="HB96E27AFF744417096A372026961B8EC" commented="no"><enum>(dd)</enum><text>any other relevant provision of law.</text></item></subclause></clause></subparagraph></paragraph><paragraph id="H244B81EA878D4769A9485B361ED11842"><enum>(8)</enum><header>Nuclear safety</header><text>The term <term>nuclear safety</term> means issues relating to the design, construction, operation, or decommissioning of nuclear facilities in a manner that ensures adequate protection of workers, the public, and the environment, including—</text><subparagraph id="H39CCEBC3DBF2407A9806997D43EE9BAB"><enum>(A)</enum><text>the safe operation of nuclear reactors and other nuclear facilities;</text></subparagraph><subparagraph id="H38D6F4A9552245859C156C0BFAF4DD0B"><enum>(B)</enum><text>radiological protection of—</text><clause id="HD758F940BDB14AA5BBBB1CE8770215F8"><enum>(i)</enum><text>members of the public; </text></clause><clause id="HBD148F352C75463D8169CF5E325DA9A8"><enum>(ii)</enum><text>workers; and </text></clause><clause id="HB72C0D1C9AD24FD8AC07ADD418F42E3B"><enum>(iii)</enum><text>the environment;</text></clause></subparagraph><subparagraph id="H5417B48067BB46BFA3CF33801EDC9D78"><enum>(C)</enum><text>nuclear waste management; </text></subparagraph><subparagraph id="H33D7CDCB02D94DB896DB065BD7A4773E"><enum>(D)</enum><text>emergency preparedness;</text></subparagraph><subparagraph id="H6BE285AF42634F4FAD00ECC1ABD67360"><enum>(E)</enum><text>nuclear liability; and</text></subparagraph><subparagraph id="H5F26100BD211460F86299E618753F6F5"><enum>(F)</enum><text>the safe transportation of nuclear materials.</text></subparagraph></paragraph><paragraph id="H08BEB46875164166A012CFCD376573E5"><enum>(9)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph><paragraph id="H3BE851B15B4C42A1B8487EE7660A15EB" commented="no"><enum>(10)</enum><header>Spent nuclear fuel</header><text>The term <term>spent nuclear fuel</term> has the meaning given the term in section 2 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref>).</text></paragraph><paragraph id="HA854D0EA074D4D159FB858BF215260C3" commented="no"><enum>(11)</enum><header>U.S. nuclear energy company</header><text>The term <term>U.S. nuclear energy company</term> means a company that—</text><subparagraph commented="no" id="H0397FE048475490CABEFD168780F30E1"><enum>(A)</enum><text>is organized under the laws of, or otherwise subject to the jurisdiction of, the United States; and</text></subparagraph><subparagraph id="H8AA4A03083754248A2ADC2A028AE50C6" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>is involved in the nuclear energy industry.</text></subparagraph></paragraph></section><section id="H6898CE14A05340EE821D628C737CB13F"><enum>3.</enum><header>Civil nuclear coordination and strategy</header><subsection id="H8F955835DB2C4204B4C8E8EF4912E8D3"><enum>(a)</enum><header>White House focal point on coordination</header><paragraph id="HD90B065EE3CC4A478EAA354FE5C45F4B"><enum>(1)</enum><header>Sense of Congress</header><text>Given the critical importance of developing and implementing, with input from various agencies throughout the executive branch, a cohesive policy with respect to international efforts related to civil nuclear energy, it is the sense of Congress that—</text><subparagraph id="HB8293100237D4A4FA757E19B6395F13E"><enum>(A)</enum><text>there should be a focal point within the White House, which may, if determined to be appropriate, report to the National Security Council, for coordination on issues relating to those efforts;</text></subparagraph><subparagraph id="HDB6DE3134DF3480CBFB1FA50EAEEACB2"><enum>(B)</enum><text>to provide that focal point, the President should establish, within the Executive Office of the President, an office, to be known as the <quote>Office of the Assistant to the President and Director for International Nuclear Energy Policy</quote> (referred to in this subsection as the <term>Office</term>);</text></subparagraph><subparagraph id="HD8FBEFB96A844BED9F91872A498B09E0"><enum>(C)</enum><text>the Office should act as a coordinating office for—</text><clause id="H7AC328126D7348EC802FD72700E83C4A"><enum>(i)</enum><text>international civil nuclear cooperation; and </text></clause><clause id="H7000DDA407894072AE6A815FD3F7F663"><enum>(ii)</enum><text>civil nuclear export strategy;</text></clause></subparagraph><subparagraph id="HD945FD4D77314191A3A8A1130BF5C6C0"><enum>(D)</enum><text>the Office should be headed by an individual appointed as an Assistant to the President with the title of <quote>Director for International Nuclear Energy Policy</quote>; and</text></subparagraph><subparagraph id="H64BCFE668C3A471F99F9849A72808066"><enum>(E)</enum><text>the Office should—</text><clause id="H94D25997A1024AEF8EFB54CF6F4B8853"><enum>(i)</enum><text>coordinate civil nuclear export policies for the United States;</text></clause><clause id="H33987445A61A4970A0AFFA40D5B47F91"><enum>(ii)</enum><text>develop, in coordination with the officials described in paragraph (2), a cohesive Federal strategy for engagement with foreign governments (including ally or partner nations and the governments of embarking civil nuclear energy nations), associated entities, and associated individuals with respect to civil nuclear exports; </text></clause><clause id="H2345A02CA5584D14896B63186B983094"><enum>(iii)</enum><text>coordinate with the officials described in paragraph (2) to ensure that necessary framework agreements and trade controls relating to civil nuclear materials and technologies are in place for key markets; and</text></clause><clause id="HDFBFF3989EF4433FA0CEEF9E2CA0892B"><enum>(iv)</enum><text>develop—</text><subclause id="HF3B2F927D5084CB08EF72C6EA60272B2"><enum>(I)</enum><text>a whole-of-government coordinating strategy for civil nuclear cooperation;</text></subclause><subclause id="H9C65A5E44BC64BB4994C83F8AD621365"><enum>(II)</enum><text>a whole-of-government strategy for civil nuclear exports; and</text></subclause><subclause id="HD5E23E904AD14182BF7DAF83D9B24029" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text>a whole-of-government approach to support appropriate foreign investment in civil nuclear energy projects supported by the United States in embarking civil nuclear energy nations.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H51F436F715B14770BCB339B0B36465C5"><enum>(2)</enum><header>Officials described</header><text>The officials referred to in paragraph (1)(E) are—</text><subparagraph commented="no" display-inline="no-display-inline" id="H8C5155E559924BDCAA57BBF4B28CE26A"><enum>(A)</enum><text>the appropriate officials of—</text><clause commented="no" display-inline="no-display-inline" id="H599145E2DBC34B6A9BBAAC3FA67C443D"><enum>(i)</enum><text>the Department of State;</text></clause><clause display-inline="no-display-inline" commented="no" id="H305F601777344C21B98CC31F8128D375"><enum>(ii)</enum><text>the Department of Energy;</text></clause><clause display-inline="no-display-inline" commented="no" id="HD5BA8659011541CD92088E2088454472"><enum>(iii)</enum><text>the Department of Commerce;</text></clause><clause display-inline="no-display-inline" commented="no" id="HCBF82EAB75834A5FB8DFF10CC29E84EA"><enum>(iv)</enum><text>the Department of Transportation;</text></clause><clause display-inline="no-display-inline" commented="no" id="H1ECC8BB7D6C44C009C1D0BB06D50873B"><enum>(v)</enum><text>the Nuclear Regulatory Commission;</text></clause><clause display-inline="no-display-inline" commented="no" id="HC6F9DC56D5CB483EB1CE1C1B3E6D3D30"><enum>(vi)</enum><text>the Department of Defense;</text></clause><clause display-inline="no-display-inline" commented="no" id="HA0437AB94E9A4C09BEEE3E37D98CEEFC"><enum>(vii)</enum><text>the National Security Council;</text></clause><clause display-inline="no-display-inline" commented="no" id="H84A64026B21C456FACDB544F33722B6F"><enum>(viii)</enum><text>the National Economic Council;</text></clause><clause display-inline="no-display-inline" commented="no" id="H91A2A8019A0F47509FC5F10F3CFB4275"><enum>(ix)</enum><text>the Office of the United States Trade Representative;</text></clause><clause display-inline="no-display-inline" commented="no" id="H79716866DF79402E9BF47D2E94AFE147"><enum>(x)</enum><text>the Office of Management and Budget;</text></clause><clause display-inline="no-display-inline" commented="no" id="HADE2AB6540044930B4103757720FEC0C"><enum>(xi)</enum><text>the Office of the Director of National Intelligence;</text></clause><clause display-inline="no-display-inline" commented="no" id="H3BE7A2B740A34C719C1BB2F936D0C407"><enum>(xii)</enum><text>the Export-Import Bank of the United States;</text></clause><clause display-inline="no-display-inline" commented="no" id="H374AE15F750A4A17B42F08EA293AE239"><enum>(xiii)</enum><text>the United States International Development Finance Corporation;</text></clause><clause display-inline="no-display-inline" commented="no" id="HEC682E2103A44996A33CEDCF838BD6DB"><enum>(xiv)</enum><text>the United States Agency for International Development;</text></clause><clause display-inline="no-display-inline" commented="no" id="H751CAEE0328248B4B40F201AA456075A"><enum>(xv)</enum><text>the United States Trade and Development Agency;</text></clause><clause display-inline="no-display-inline" commented="no" id="HCCC2AF4009EC42B0AB21E32E6A9801BF"><enum>(xvi)</enum><text>the Office of Science and Technology Policy; and</text></clause><clause display-inline="no-display-inline" commented="no" id="H20CADA6405CF4BBD89F78DB7F7A31030"><enum>(xvii)</enum><text>any other Federal agency that the President determines to be appropriate; and</text></clause></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="HBBF807A456804674B85EA08AB6AF27DE"><enum>(B)</enum><text>appropriate officials representing foreign countries and governments, including—</text><clause display-inline="no-display-inline" commented="no" id="HDE7A6169F2C84CE7981B91967CF5B6F8"><enum>(i)</enum><text>ally or partner nations;</text></clause><clause display-inline="no-display-inline" commented="no" id="HB4B2378355F14392A7C4684B80BF4697"><enum>(ii)</enum><text>embarking civil nuclear energy nations; and</text></clause><clause display-inline="no-display-inline" commented="no" id="H65975E4FB8874E64A0EC6485ADC4FD0E"><enum>(iii)</enum><text>any other country or government that the Assistant (if appointed) and the officials described in subparagraph (A) jointly determine to be appropriate.</text></clause></subparagraph></paragraph></subsection><subsection id="H8973AAA520FB4403A949FDDCB84F4D5D"><enum>(b)</enum><header>Nuclear Exports Working Group</header><paragraph id="H1F8D4F1472EF429381B7972D137AA3A3"><enum>(1)</enum><header>Establishment</header><text>There is established a working group, to be known as the <quote>Nuclear Exports Working Group</quote> (referred to in this subsection as the <term>working group</term>).</text></paragraph><paragraph id="H72FA90F15654436BA8E2BC23FD6ABF70"><enum>(2)</enum><header>Composition</header><text>The working group shall be composed of—</text><subparagraph id="H9C7B7E0584074E0FB8839995DCB7AC19"><enum>(A)</enum><text>senior-level Federal officials, selected internally by the applicable Federal agency or organization, from—</text><clause id="H30EAD6AE5F3548D1BCFEFD2D87048444"><enum>(i)</enum><text>the Department of State; </text></clause><clause id="HA4AFF96756134F3AACFC0C117DACBDAF"><enum>(ii)</enum><text>the Department of Commerce;</text></clause><clause id="H2C1FE66563324518A667C55D9D2C816D"><enum>(iii)</enum><text>the Department of Energy;</text></clause><clause id="H7AC56A39ACB341CD85832EE70C4C4360"><enum>(iv)</enum><text>the Department of the Treasury;</text></clause><clause id="HF63A6F288B2A4018AA0D30AF52F614D3"><enum>(v)</enum><text>the Export-Import Bank of the United States;</text></clause><clause id="H44DE0E5FDC4648B180A1D2A95279A215"><enum>(vi)</enum><text>the United States International Development Finance Corporation; </text></clause><clause id="HDE89F3F8E9E24620A94255420E6EA8C9"><enum>(vii)</enum><text>the Nuclear Regulatory Commission;</text></clause><clause id="H34A208B1F870411EA1FED848E61B77ED"><enum>(viii)</enum><text>the Office of the United States Trade Representative; and</text></clause><clause id="H2040460459214F2BA45D7BF9963B0CF8"><enum>(ix)</enum><text>the United States Trade and Development Agency; and</text></clause></subparagraph><subparagraph id="HAA8AA66984AB4589ACCBBEC51E1666A4"><enum>(B)</enum><text>other senior-level Federal officials, selected internally by the applicable Federal agency or organization, from any other Federal agency or organization that the Secretary determines to be appropriate.</text></subparagraph></paragraph><paragraph id="H3F78AA0F94634299B6844E270CBEEB11"><enum>(3)</enum><header>Reporting</header><text>The working group shall report to the appropriate White House official, which may be the Assistant (if appointed).</text></paragraph><paragraph id="H0B0411FA6C0F49FEB41E40BE2A600A98"><enum>(4)</enum><header>Duties</header><text>The working group shall submit to the Civil Nuclear Trade Advisory Committee of the Department of Commerce and the Nuclear Energy Advisory Committee of the Department of Energy quarterly reports on the standing of civil nuclear exports from the United States, including with respect to meeting the targets established as part of the 5-year civil nuclear trade strategy described in paragraph (5)(A).</text></paragraph><paragraph id="HB9B6F319BEDA4A299FD894261455D6C7"><enum>(5)</enum><header>Strategy</header><subparagraph id="H149EBB88B4D94CA8A42BB414AB7838CD"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the working group shall establish a 10-year civil nuclear trade strategy, including biennial targets for the export of civil nuclear technologies, including light water and non-light water reactors and associated equipment and technologies, civil nuclear materials, and nuclear fuel that align with meeting international energy demand while seeking to avoid or reduce emissions.</text></subparagraph><subparagraph id="H7767583757AC47709B89B04ACD870067"><enum>(B)</enum><header>Collaboration required</header><text display-inline="yes-display-inline">In establishing the strategy under subparagraph (A), the working group shall collaborate with—</text><clause id="H2639B233E201484EAE0234AF26CCE315"><enum>(i)</enum><text display-inline="yes-display-inline">the Secretary;</text></clause><clause id="H65CC5B1E5AC44529A5580779C8C612BB"><enum>(ii)</enum><text display-inline="yes-display-inline">the Secretary of Commerce;</text></clause><clause id="H20BA39C4F1014D5E9F8CAE9800933C6D"><enum>(iii)</enum><text display-inline="yes-display-inline">the Secretary of State;</text></clause><clause id="H1C7AFC8E13B5439F81EBFDBD0462F30A"><enum>(iv)</enum><text>the Secretary of the Treasury;</text></clause><clause id="HB0F2EE7150B448D2B20AF1BDC51D67C3"><enum>(v)</enum><text>the Nuclear Regulatory Commission;</text></clause><clause id="H896792F09B8140328DB973D60A2B9EB2"><enum>(vi)</enum><text display-inline="yes-display-inline">the President of the Export-Import Bank of the United States;</text></clause><clause id="H3E87A73562984A21BD47A26822890961"><enum>(vii)</enum><text display-inline="yes-display-inline">the Chief Executive Officer of the United States International Development Finance Corporation;</text></clause><clause id="H7188B0B8D35C4F9C8F2C13A8E7A65F5F"><enum>(viii)</enum><text display-inline="yes-display-inline">the United States Trade Representative; and</text></clause><clause id="H54A6D6FBB6FB4384A28CCBA537FBA917" commented="no" display-inline="no-display-inline"><enum>(ix)</enum><text display-inline="yes-display-inline">representatives of private industry.</text></clause></subparagraph></paragraph></subsection></section><section id="H55CAE3ABFF624E34BADC936C7D767C25"><enum>4.</enum><header>Engagement with ally or partner nations</header><subsection id="H96BD45EFBA68404C9F6A76E928EAEE45"><enum>(a)</enum><header>In general</header><text>The President shall launch, in accordance with applicable nuclear technology export laws (including regulations), an international initiative to modernize the civil nuclear outreach to embarking civil nuclear energy nations.</text></subsection><subsection id="H7713BBB9ED224AE693AADAEE15F00E96"><enum>(b)</enum><header>Financing</header><text>In carrying out the initiative described in subsection (a), the President, acting through an appropriate Federal official, who may be the Assistant (if appointed) or the Chief Executive Officer of the International Development Finance Corporation, if determined to be appropriate, and in coordination with the officials described in section 3(a)(2), may, if the President determines to be appropriate, seek to establish cooperative financing relationships for the export of civil nuclear technology, components, materials, and infrastructure to embarking civil nuclear energy nations.</text></subsection><subsection id="HDC5C48F50E884E93A8194370CC048869"><enum>(c)</enum><header>Activities</header><text>In carrying out the initiative described in subsection (a), the President shall—</text><paragraph id="H9E4EE6C0DEA34B96AE3A31D3A462B6A3"><enum>(1)</enum><text>assist nongovernmental organizations and appropriate offices, administrations, agencies, laboratories, and programs of the Department of Energy and other relevant Federal agencies and offices in providing education and training to foreign governments in nuclear safety, security, and safeguards—</text><subparagraph id="H2B526DA948FE45B18254E07B6F48DCDE"><enum>(A)</enum><text>through engagement with the International Atomic Energy Agency; or</text></subparagraph><subparagraph id="HF0F60D24FD794B789E4073BBB1EBB584"><enum>(B)</enum><text>independently, if the applicable entity determines that it would be more advantageous under the circumstances to provide the applicable education and training independently;</text></subparagraph></paragraph><paragraph id="HDA9DCC90A3734B4BA3A169E4F43395CE"><enum>(2)</enum><text>assist the efforts of the International Atomic Energy Agency to expand the support provided by the International Atomic Energy Agency to embarking civil nuclear energy nations for nuclear safety, security, and safeguards;</text></paragraph><paragraph id="H347C90038A8B4476A4320703DFDABA87"><enum>(3)</enum><text>coordinate the work of the Chief Executive Officer of the United States International Development Finance Corporation to expand outreach to the private investment community to create public-private financing relationships to assist in the export of civil nuclear technology to embarking civil nuclear energy nations;</text></paragraph><paragraph id="HC955E940ACC54416886317BC6113FDD8"><enum>(4)</enum><text>seek to better coordinate, to the maximum extent practicable, the work carried out by each of—</text><subparagraph id="H3B18B72CCD694A5BBA33BF55079E14C0"><enum>(A)</enum><text>the Nuclear Regulatory Commission;</text></subparagraph><subparagraph id="H8DCE009AB1A14D17A2163D1BB269FF63"><enum>(B)</enum><text>the Department of Energy; </text></subparagraph><subparagraph id="H0E02D26FBBD44113AA3077FBB54883C3"><enum>(C)</enum><text>the Department of Commerce; </text></subparagraph><subparagraph id="H3264E61A4F314C1A84E489B74CDF1FCB"><enum>(D)</enum><text>the Nuclear Energy Agency;</text></subparagraph><subparagraph id="H8748ED5362A942F184EAEEBE46854791"><enum>(E)</enum><text>the International Atomic Energy Agency; and</text></subparagraph><subparagraph id="H0665B243CD7B403FB8E62AC935C7006B"><enum>(F)</enum><text>the nuclear regulatory agencies and organizations of embarking civil nuclear energy nations and ally or partner nations; and </text></subparagraph></paragraph><paragraph id="H2897704A9E854D08869B7D564FA29200" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text>improve the efficient and effective exporting and importing of civil nuclear technologies and materials. </text></paragraph></subsection></section><section id="H599526A4DC3A4FAE870EF9BFDF9A76C2"><enum>5.</enum><header>Cooperative financing relationships with ally or partner nations and embarking civil nuclear energy nations</header><subsection id="HC851363DFEB2470FB5AD051C972A30DB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The President shall designate an appropriate White House official, who may be the Assistant (if appointed), and the Chief Executive Officer of the United States International Development Finance Corporation to coordinate with the officials described in section 3(a)(2) to develop, as the President determines to be appropriate, financing relationships with ally or partner nations to advance civil nuclear exports from the United States or ally or partner nations to embarking civil nuclear energy nations.</text></subsection><subsection id="H5AB8B54ABC3B45E3B216B5CF2CB7B950"><enum>(b)</enum><header>United States competitiveness clauses</header><paragraph id="H69F37C6532234CA5912B7F7857DBB84E" commented="no"><enum>(1)</enum><header>Definition of United States competitiveness clause</header><text>In this subsection, the term <term>United States competitiveness clause</term> means any United States competitiveness provision in any agreement entered into by the Department of Energy, including—</text><subparagraph id="HE79B4C1D956B40EEAB98331A05D75F4F" commented="no"><enum>(A)</enum><text>a cooperative agreement;</text></subparagraph><subparagraph id="HD44774A4D0324FF6B5DB5F3AD028558C" commented="no"><enum>(B)</enum><text>a cooperative research and development agreement; and</text></subparagraph><subparagraph id="H295F00F589A745E193E9DB2496BD078C" commented="no"><enum>(C)</enum><text>a patent waiver.</text></subparagraph></paragraph><paragraph id="HAD1DA23EA3614F18B2CA11DF36FD8E79"><enum>(2)</enum><header>Consideration</header><text>In carrying out subsection (a), the relevant officials described in that subsection shall consider the impact of United States competitiveness clauses on any financing relationships entered into or proposed to be entered into under that subsection.</text></paragraph><paragraph id="HA68E3B244B8D465EAE93F7630ECE475F" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Waiver</header><text>The Secretary shall facilitate waivers of United States competitiveness clauses as necessary to facilitate financing relationships with ally or partner nations under subsection (a).</text></paragraph></subsection></section><section id="H80C82965D20342F6BD0118EEB955A0BE"><enum>6.</enum><header>Cooperation with ally or partner nations on advanced nuclear reactor demonstration and cooperative research facilities for civil nuclear energy</header><subsection id="HD45591A11CD64EFC97BCE80878644E44"><enum>(a)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary of State, in coordination with the Secretary and the Secretary of Commerce, shall conduct bilateral and multilateral meetings with not fewer than 5 ally or partner nations, with the aim of enhancing nuclear energy cooperation among those ally or partner nations and the United States, for the purpose of developing collaborative relationships with respect to research, development, licensing, and deployment of advanced nuclear reactor technologies for civil nuclear energy.</text></subsection><subsection id="H477B09A541B94691B8D8B9BF0CF4B92D"><enum>(b)</enum><header>Requirement</header><text>The meetings described in subsection (a) shall include—</text><paragraph id="HF9B8314AA3A247D39D345A6C5774B804"><enum>(1)</enum><text>a focus on cooperation to demonstrate and deploy advanced nuclear reactors, with an emphasis on U.S. nuclear energy companies, during the 10-year period beginning on the date of enactment of this Act to provide options for addressing climate change by 2050; and</text></paragraph><paragraph id="HC275D040EA4448A688AC680AF3490930"><enum>(2)</enum><text>a focus on developing a memorandum of understanding or any other appropriate agreement between the United States and ally or partner nations with respect to—</text><subparagraph id="HA075CF5B718F4B9AA854733CEC0BBB5D"><enum>(A)</enum><text>the demonstration and deployment of advanced nuclear reactors; and </text></subparagraph><subparagraph id="H0C0792CECAD74B6AA20BE274547FBB56"><enum>(B)</enum><text>the development of cooperative research facilities.</text></subparagraph></paragraph></subsection><subsection id="H5782C118DDBB450E8F81516DA67D067F"><enum>(c)</enum><header>Financing arrangements</header><text>In conducting the meetings described in subsection (a), the Secretary of State, in coordination with the Secretary and the Secretary of Commerce, shall seek to develop financing arrangements to share the costs of the demonstration and deployment of advanced nuclear reactors and the development of cooperative research facilities with the ally or partner nations participating in those meetings.</text></subsection><subsection id="H7F92D6022DF44EADB47455238CC5FBCB"><enum>(d)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary, the Secretary of State, and the Secretary of Commerce shall jointly submit to Congress a report highlighting potential partners—</text><paragraph id="H0C67241F98CD46CD9397D7883AFF5568"><enum>(1)</enum><text>for the establishment of cost-share arrangements described in subsection (c); or </text></paragraph><paragraph id="HBE4DB1851A0B4730B999E88EA5068DB6"><enum>(2)</enum><text>with which the United States may enter into agreements with respect to—</text><subparagraph id="H430349BFCE4B4996ACE2AB348F5E6632" commented="no"><enum>(A)</enum><text>the demonstration of advanced nuclear reactors; or</text></subparagraph><subparagraph id="HDCD787D3BDDA445684A0BB459616D878" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>cooperative research facilities. </text></subparagraph></paragraph></subsection></section><section id="HC3399D1FA70742D29084A10A0BBCF678"><enum>7.</enum><header>International civil nuclear energy cooperation</header><text display-inline="no-display-inline">Section 959B of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16279b">42 U.S.C. 16279b</external-xref>) is amended—</text><paragraph id="H3CE92665C51347F8B375E2A52A302427"><enum>(1)</enum><text>in the matter preceding paragraph (1), by striking <quote>The Secretary</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H1A36365ABA684D5E857DCB29DC20E2C3"><subsection id="H2EC1A10B2EED4B8CA4813951E1F44C52"><enum>(a)</enum><header>In general</header><text>The Secretary</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HBCB23C5BE5324D37BB72AB038FC1548D"><enum>(2)</enum><text>in subsection (a) (as so designated)—</text><subparagraph id="HF7C8279DF5DD4EB7B54084364A3F2672"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H4307B2CFCB9847B188D031F21113A179"><enum>(i)</enum><text>by striking <quote>financing,</quote>; and</text></clause><clause id="HB29B162599D84619B8E04D4F5457C251"><enum>(ii)</enum><text>by striking <quote>and</quote> after the semicolon at the end;</text></clause></subparagraph><subparagraph id="HF39A3A3CCF214482BE20B1D2EBB99620"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="H8C401578A6E24E979D0AE19A63DD490E"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>preparations for</quote>; and</text></clause><clause id="HF50485E539654A3FAD588AF05C54FCD1"><enum>(ii)</enum><text>in subparagraph (C)(v), by striking the period at the end and inserting a semicolon; and</text></clause></subparagraph><subparagraph id="HAB9F10F8F983442795342243ECE09258"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H043AC2BB06204B189B5BEA6EBD6AA020"><paragraph id="HF999747491D346D0A598CAEB18A501B0"><enum>(3)</enum><text>to support, in consultation with the Secretary of State, the safe, secure, and peaceful use of civil nuclear technology in countries developing nuclear energy programs, with a focus on countries that have increased civil nuclear cooperation with the Russian Federation or the People’s Republic of China; and</text></paragraph><paragraph id="H82E311213CF64BB0B09766CD79BB2DD8"><enum>(4)</enum><text display-inline="yes-display-inline">to promote the fullest utilization of the reactors, fuel, equipment, services, and technology of U.S. nuclear energy companies (as defined in section 2 of the International Nuclear Energy Act of 2022) in civil nuclear energy programs outside the United States through—</text><subparagraph id="H0112268F216142749348683AE49C4807"><enum>(A)</enum><text>bilateral and multilateral arrangements developed and executed in coordination with the Secretary of State that contain commitments for the utilization of the reactors, fuel, equipment, services, and technology of U.S. nuclear energy companies (as defined in that section);</text></subparagraph><subparagraph id="H4FF4C7DC41AD4733B93D8564922DDFC0"><enum>(B)</enum><text>the designation of 1 or more U.S. nuclear energy companies (as defined in that section) to implement an arrangement under subparagraph (A) if the Secretary determines that the designation is necessary and appropriate to achieve the objectives of this section;</text></subparagraph><subparagraph id="H230C5278E43C4C21AA51268035393B66"><enum>(C)</enum><text>the waiver of any provision of law relating to competition with respect to any activity related to an arrangement under subparagraph (A) if the Secretary, in consultation with the Attorney General and the Secretary of Commerce, determines that a waiver is necessary and appropriate to achieve the objectives of this section; and</text></subparagraph><subparagraph id="H90B9ECB4D53F40B9ACE6884068120FEF"><enum>(D)</enum><text>the issuance of loans, loan guarantees, other financial assistance, or assistance in the form of an equity interest to carry out activities related to an arrangement under subparagraph (A), to the extent appropriated funds are available.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HF541E31CDC7C46128ABC8DE4A6D275B4"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block id="H6333B390562642AE92FC243FF2437692" display-inline="no-display-inline" style="OLC"><subsection id="H443C799E8F874FE38151DC7B5015E834"><enum>(b)</enum><header>Requirements</header><text>The program under subsection (a) shall—</text><paragraph id="H4AFB7D5EFCED4B88B4C61E7FFBB3579D"><enum>(1)</enum><text>with respect to the function described in subsection (a)(3), be modeled after the International Military Education and Training program of the Department of State; and</text></paragraph><paragraph id="HD85E0107A41C44E583698AC21A2A65B0"><enum>(2)</enum><text>be authorized and directed by the Secretary of State and implemented by the Secretary—</text><subparagraph id="HDC163C7A02E94491ADC6D486FBB04C42"><enum>(A)</enum><text>to facilitate, to the maximum extent practicable, workshops and expert-based exchanges to engage industry, stakeholders, and foreign governments with respect to international civil nuclear issues, such as—</text><clause id="H9F69B976BB844623863A70B46ECBB8D4"><enum>(i)</enum><text>training; </text></clause><clause id="HCE5761AE16B646029D45A5E48D3BCD35"><enum>(ii)</enum><text>financing; </text></clause><clause id="HF81209BCBFDA4C4E972D770EDE4697A9"><enum>(iii)</enum><text>safety;</text></clause><clause id="H950044B8F85149BC8B2B6C4CD19E2B9C"><enum>(iv)</enum><text>security;</text></clause><clause id="H96CDB2D8062043B2BEF54645E7413263"><enum>(v)</enum><text>safeguards;</text></clause><clause id="H3CB60672A2C34F23B5A69C0F08D971AD"><enum>(vi)</enum><text>liability;</text></clause><clause id="H49447D6DD570432BA4928265F983A7C0"><enum>(vii)</enum><text>advanced fuels;</text></clause><clause id="H6744B186C9104AB0AFEE285E9EFDA008"><enum>(viii)</enum><text>operations; and</text></clause><clause id="H3DA255FE0F3C400D8A1AABF5C69F799E"><enum>(ix)</enum><text>options for multinational cooperation with respect to the disposal of spent nuclear fuel (as defined in section 2 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref>)); and</text></clause></subparagraph><subparagraph id="H7ED217987F0E4090B255BAA47C2D3E8E"><enum>(B)</enum><text>in coordination with—</text><clause id="HD0675FFC336F4E29AC82149C3E6394F0"><enum>(i)</enum><text>the National Security Council;</text></clause><clause id="HC34A0CACB44C4471815A3D7A7A95B091"><enum>(ii)</enum><text>the Secretary of State;</text></clause><clause id="H0F77288739044B968BAF39A00DAADC31"><enum>(iii)</enum><text>the Secretary of Commerce; and</text></clause><clause id="H018957C2F5044CBD9F5C4C7BBA8CDB38"><enum>(iv)</enum><text>the Nuclear Regulatory Commission.</text></clause></subparagraph></paragraph></subsection><subsection id="H04EDEE5E26B74522B24770345DDD0C42" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out subsection (a)(3) $15,500,000 for each of fiscal years 2023 through 2027.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H10EFB1FA5EE843DA8258A0DC2B235612"><enum>8.</enum><header>International civil nuclear program support</header><subsection id="HE2B14CCD76434A8CAC8C6FBE08DB78C0"><enum>(a)</enum><header>In general</header><text>Not later than 120 days after the date of enactment of this Act, the Secretary of State, in coordination with the Secretary and the Assistant (if appointed), shall launch an international initiative (referred to in this section as the <term>initiative</term>) to provide financial assistance to, and facilitate the building of technical capacities by, in accordance with this section, embarking civil nuclear energy nations for activities relating to the development of civil nuclear energy programs.</text></subsection><subsection id="H93F37A27FB3A41E4B2CB212099CC0AC1"><enum>(b)</enum><header>Financial assistance</header><paragraph id="HCE4CCD4028BE49DAA3B5B048FDF5661D"><enum>(1)</enum><header>In general</header><text>In carrying out the initiative, the Secretary of State, in coordination with the Secretary and the Assistant (if appointed), may award grants of financial assistance to embarking civil nuclear energy nations in accordance with this subsection—</text><subparagraph id="H2FF328531EDE4E9DAB1FE86BCC248A48"><enum>(A)</enum><text>for activities relating to the development of civil nuclear energy programs; and</text></subparagraph><subparagraph id="H0C2CAEFFC8F84F748F6C5A5CFA464A41"><enum>(B)</enum><text>to facilitate the building of technical capacities for those activities.</text></subparagraph></paragraph><paragraph id="HA7090AB1AE0F4C18A291E986B136BB91"><enum>(2)</enum><header>Amount</header><text>The amount of a grant of financial assistance under paragraph (1) shall be not more than $5,500,000.</text></paragraph><paragraph id="H6287653D18474C87A8A37ACF8148ADE7"><enum>(3)</enum><header>Limitations</header><text>The Secretary of State, in coordination with the Secretary and the Assistant (if appointed), may award—</text><subparagraph id="H29507760C2C44A5CB728F72C8631817C"><enum>(A)</enum><text>not more than 1 grant of financial assistance under paragraph (1) to any 1 embarking civil nuclear energy nation each fiscal year; and</text></subparagraph><subparagraph id="HBAB28C1537174C218741943B67545AB6"><enum>(B)</enum><text>not more than a total of 5 grants of financial assistance under paragraph (1) to any 1 embarking civil nuclear energy nation.</text></subparagraph></paragraph></subsection><subsection id="H3B1ED603558D47B592095169267BEB17"><enum>(c)</enum><header>Senior advisors</header><paragraph id="H8AF73A89601A40F8911A8F704C87D91D"><enum>(1)</enum><header>In general</header><text>In carrying out the initiative, the Secretary of State, in coordination with the Secretary and the Assistant (if appointed), may provide financial assistance to an embarking civil nuclear energy nation for the purpose of contracting with a U.S. nuclear energy company to hire 1 or more senior advisors to assist the embarking civil nuclear energy nation in establishing a civil nuclear program.</text></paragraph><paragraph id="H2B88C427691449679039989411B892D2"><enum>(2)</enum><header>Requirement</header><text>A senior advisor described in paragraph (1) shall have relevant experience and qualifications to advise the embarking civil nuclear energy nation on, and facilitate on behalf of the embarking civil nuclear energy nation, 1 or more of the following activities:</text><subparagraph id="H5B44480299174D01BF327CB7D2066292"><enum>(A)</enum><text>The development of financing relationships.</text></subparagraph><subparagraph id="H10FE73CF962C44A0BDE8864764F146FF"><enum>(B)</enum><text>The development of a standardized financing and project management framework for the construction of nuclear power plants.</text></subparagraph><subparagraph id="H722D70AE8F8B41868EA6ACEE3A7F5518"><enum>(C)</enum><text>The development of a standardized licensing framework for—</text><clause id="H0141DFC95AC44205B8CC50D9EC8AA611"><enum>(i)</enum><text>light water civil nuclear technologies; and</text></subparagraph><subparagraph id="H57CE485ACA7E47FDB9BFDE9AAC267211"><enum>(C)</enum><text>local community engagement in areas in reasonable proximity to nuclear sites; and</text></subparagraph></paragraph><paragraph id="H7E0E1FAFCF954EB5B000FCFAEC768B64"><enum>(2)</enum><text>facilitate—</text><subparagraph id="H325CB7AC4D59429FBD2BDBCD2151A4A5"><enum>(A)</enum><text>the development of—</text><clause id="H3B751989F405464C93DD2F1592FDB3EB"><enum>(i)</enum><text>joint commitments and goals to improve—</text><subclause id="H1F7145A5FFDF4CF0AD72C31995B34053"><enum>(I)</enum><text>nuclear safety, security, safeguards, and sustainability;</text></subclause><subclause id="HFF7F4D5758FF4120AEDF79489EB7319B"><enum>(II)</enum><text>environmental safeguards; and</text></subclause><subclause id="H85EA6677D5CA43F2A5A7E76F060C6686"><enum>(III)</enum><text>local community engagement in areas in reasonable proximity to nuclear sites;</text></subclause></clause><clause id="H2F8A07550A034AE3B21C55D47D274A6F"><enum>(ii)</enum><text>stronger international institutions that support nuclear safety, security, safeguards, and sustainability;</text></clause><clause id="H17C5E4DCAFFD4D16972FE3ACC585D7A7"><enum>(iii)</enum><text>cooperative financing relationships to promote competitive alternatives to Chinese and Russian financing;</text></clause><clause id="H315885CB79354C67A980EF6F8C336E7D"><enum>(iv)</enum><text>a standardized financing and project management framework for the construction of civil nuclear power plants;</text></clause><clause id="HB7CE46E8D98046568683641BE67341C7"><enum>(v)</enum><text>a standardized licensing framework for civil nuclear technologies;</text></clause><clause id="H83C01D54982840E3A070279288D1C346"><enum>(vi)</enum><text>a strategy to change internal policies of multinational development banks, such as the World Bank, to support the financing of civil nuclear projects;</text></clause><clause id="H1C20B2CA1FA5448B96FF476BA28C4F17"><enum>(vii)</enum><text>a document containing any lessons learned from countries that have partnered with the Russian Federation or the People’s Republic of China with respect to civil nuclear power, including any detrimental outcomes resulting from that partnership; and</text></clause><clause id="HC231E6561C8B4FF090B4AFB61EA78C0D"><enum>(viii)</enum><text>a global civil nuclear liability regime;</text></clause></subparagraph><subparagraph id="H8A487947EE92404694EDF48C7B1A3F48"><enum>(B)</enum><text>cooperation for enhancing the overall aspects of civil nuclear power, such as—</text><clause id="H96BDC2A18153420FA3930C6B5A6B74C8"><enum>(i)</enum><text>nuclear safety, security, safeguards, and sustainability;</text></clause><clause id="HD8033CF6E4F34A44BD8A881AA80A15D6"><enum>(ii)</enum><text>nuclear laws (including regulations);</text></clause><clause id="H8824A2DB9C0249AC98D6752D59BD00E9"><enum>(iii)</enum><text>waste management;</text></clause><clause id="H272C766E9C4B42FF952B239408E95ED0"><enum>(iv)</enum><text>quality management systems;</text></clause><clause id="H2E0D696C540A40058AB25F5184A16838"><enum>(v)</enum><text>technology transfer;</text></clause><clause id="HEC4E6C46512246DEAB97F194785A5A87"><enum>(vi)</enum><text>human resources development;</text></clause><clause id="HC24CFB2C2FE5401AB71B4685792CA16E"><enum>(vii)</enum><text>localization;</text></clause><clause id="HF8A3DD2C71EB48A5ACE7F5CE0DAE2E98"><enum>(viii)</enum><text>reactor operations;</text></clause><clause id="H236D750E2719454DA06EDBB8F1E435EA"><enum>(ix)</enum><text>nuclear liability; and</text></clause><clause id="HD3C567D5F5B642B0ABC5F99E3C70DE18"><enum>(x)</enum><text>decommissioning; and</text></clause></subparagraph><subparagraph id="H2E930032CE5242F19C6D84A07E918E9C" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text>the development and determination of the mechanisms described in paragraphs (7) and (8) of section 10(a), if the President intends to establish an Advanced Reactor Coordination and Resource Center as described in that section. </text></subparagraph></paragraph></subsection><subsection id="H122CC5A1418744AEB209520E98F5E472"><enum>(c)</enum><header>Input from industry and government</header><text>It is the sense of Congress that each conference should include a meeting that convenes nuclear industry leaders and leaders of government agencies with expertise relating to nuclear safety, security, safeguards, or sustainability to discuss best practices relating to—</text><paragraph id="H4E82CC3ABB854FA39B0638BA4847D1E7"><enum>(1)</enum><text>the safe and secure use, storage, and transport of nuclear and radiological materials;</text></paragraph><paragraph id="H2DDDA95A4CCB4FA5BCC7CB42D1D736DC"><enum>(2)</enum><text>managing the evolving cyber threat to nuclear and radiological security; and</text></paragraph><paragraph id="HC6E26B29B5E44663A29E4AF1552D2ACF"><enum>(3)</enum><text>the role that the nuclear industry should play in nuclear and radiological safety, security, and safeguards, including with respect to the safe and secure use, storage, and transport of nuclear and radiological materials, including spent nuclear fuel and nuclear waste.</text></paragraph></subsection></section><section id="H22F010275FCE435AADFC882A2BA3F02D"><enum>10.</enum><header>Advanced Reactor Coordination and Resource Center</header><subsection id="HA40A96CC7A2644E4AC3FD738F7D30AE6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The President shall consider the feasibility of establishing a center, to be known as the <quote>Advanced Reactor Coordination and Resource Center</quote> (referred to in this section as the <term>Center</term>), for the purposes of—</text><paragraph id="H6295FAA0D34A46F19D3ED36C1D40A281"><enum>(1)</enum><text>identifying qualified organizations and service providers—</text><subparagraph id="H36F2D743D386471AB926865661524707"><enum>(A)</enum><text>for embarking civil nuclear energy nations;</text></subparagraph><subparagraph id="H38FBCA50769D4ED49902065961C206DF"><enum>(B)</enum><text>to develop and assemble documents, contracts, and related items required to establish a civil nuclear program; and</text></subparagraph><subparagraph id="HB964CACCBC5041B9AEAB2542B7284B35"><enum>(C)</enum><text>to develop a standardized model for the establishment of a civil nuclear program that can be used by the International Atomic Energy Agency;</text></subparagraph></paragraph><paragraph id="H3164A134D6604A54B5E66CFDE006D18A"><enum>(2)</enum><text>coordinating with countries participating in the Center and with the Nuclear Exports Working Group established under section 3(b)—</text><subparagraph id="HA19E4D778EBD403793383CD9EFCDE4EC"><enum>(A)</enum><text>to identify funds to support payment for services required to develop a civil nuclear program;</text></subparagraph><subparagraph id="H70FE45FEC4B245B5925F287B002C6FC7"><enum>(B)</enum><text>to provide market analysis; and</text></subparagraph><subparagraph id="H4D1E2C49B2544EF49E128C247E4C407F"><enum>(C)</enum><text>to create—</text><clause id="H3D91A34F25FE427283F7F482F926DACF"><enum>(i)</enum><text>project structure models; </text></clause><clause id="H33B3DDB1F81946B3B2262BEE03DA6FCE"><enum>(ii)</enum><text>models for electricity market analysis; </text></clause><clause id="H8BE705A475904C1289D7F5C7167B78CF"><enum>(iii)</enum><text>models for nonelectric applications market analysis; and </text></clause><clause id="H22E6DAED4FE14684BC9FE1685228DAC2"><enum>(iv)</enum><text>financial models;</text></clause></subparagraph></paragraph><paragraph id="HCF9F74FF2BB84198A2B3BBDAA4869E8B"><enum>(3)</enum><text>identifying and developing the safety, security, safeguards, and nuclear governance required for a civil nuclear program;</text></paragraph><paragraph id="HB2103CBBF8C84FC99487F3A39FFA4A24"><enum>(4)</enum><text>supporting multinational regulatory standards to be developed by countries with civil nuclear programs and experience;</text></paragraph><paragraph id="H92E768536B374E99BB625D4A6E410706"><enum>(5)</enum><text>developing and strengthening communications, engagement, and consensus-building;</text></paragraph><paragraph id="HFE82187A647740E4B35C11FD899A71E6"><enum>(6)</enum><text>carrying out any other major activities to support export, financing, education, construction, training, and education requirements relating to the establishment of a civil nuclear program;</text></paragraph><paragraph id="H4155E9AC5783432EAFF1542EEF2F12F5"><enum>(7)</enum><text>developing mechanisms for how to fund and staff the Center; and</text></paragraph><paragraph id="H42B48687BEE2493EA99B456D7E747EC5"><enum>(8)</enum><text>determining mechanisms for the selection of the location or locations of the Center.</text></paragraph></subsection><subsection id="HBF6DB323930348A6AB68E0DBC4D40662"><enum>(b)</enum><header>Objective</header><text>The President shall carry out subsection (a) with the objective of establishing the Center if the President determines that it is feasible to do so.</text></subsection></section><section id="H6B9C47C047D3472FADF0629FA23A8A29"><enum>11.</enum><header>Investment by allies and partners of the United States</header><subsection id="H518C297CD0774AAFAD70269E213CB017"><enum>(a)</enum><header>Commercial licenses</header><text>Section 103 d. of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2133">42 U.S.C. 2133(d)</external-xref>) is amended, in the second sentence—</text><paragraph id="HC3A719C7EE474E15978842DE52EF86D7"><enum>(1)</enum><text>by inserting <quote>for a production facility</quote> after <quote>No license</quote>; and</text></paragraph><paragraph id="HE872D7C157284AE5858AA0C076AB8A6B"><enum>(2)</enum><text>by striking <quote>any any</quote> and inserting <quote>any</quote>.</text></paragraph></subsection><subsection id="HC8008734D2C1432296380B193AA3FE46" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header>Medical therapy and research development licenses</header><text>Section 104 d. of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2134">42 U.S.C. 2134(d)</external-xref>) is amended, in the second sentence, by inserting <quote>for a production facility</quote> after <quote>No license</quote>. </text></subsection></section><section id="H517B0E8D521345A0BC1D5A826974DA93"><enum>12.</enum><header>Strategic Infrastructure Fund Working Group</header><subsection id="H2C31C8D5507F4304947CE0BACE9B9119"><enum>(a)</enum><header>Establishment</header><text>There is established a working group, to be known as the <quote>Strategic Infrastructure Fund Working Group</quote> (referred to in this section as the <term>working group</term>).</text></subsection><subsection id="H3CA644355FF843CBBB4D464EE021DF26"><enum>(b)</enum><header>Composition</header><text>The working group shall be—</text><paragraph id="HA548511B27034E58BB6245C43F57F840"><enum>(1)</enum><text>led by a White House official, who may be the Assistant (if appointed), who shall serve as the White House focal point with respect to matters relating to the working group; and</text></paragraph><paragraph id="HE0BD4F42F5624AA096A0C024EB34DBE0"><enum>(2)</enum><text>composed of—</text><subparagraph id="HD70AC2129EE34D0E964F1A4F23D6CD02"><enum>(A)</enum><text>senior-level Federal officials, selected by the head of the applicable Federal agency or organization, from—</text><clause id="H3647B40371FF4D0A8F06E24F382E3B1A"><enum>(i)</enum><text>the Department of State;</text></clause><clause id="HEF07D6D705074798B63421B4AC68F8CE"><enum>(ii)</enum><text>the Department of the Treasury;</text></clause><clause id="H3C6E7B6D3E104B998D4717D753E12D0A"><enum>(iii)</enum><text>the Department of Commerce;</text></clause><clause id="HDD551B8E70BD43B989F49DA19B3FF4D8"><enum>(iv)</enum><text>the Department of Energy;</text></clause><clause id="H4186ECE79675444092381DD12F3F1241"><enum>(v)</enum><text>the Export-Import Bank of the United States;</text></clause><clause id="H257C981F8E754CCD8B7533D9070D8A8E"><enum>(vi)</enum><text>the United States International Development Finance Corporation; and</text></subparagraph><subparagraph id="HEA4E534ED8D448EC8D2E4F1A54D6BDB6" commented="no"><enum>(C)</enum><text>any senior-level Federal official selected by the White House official described in paragraph (1) from any Federal agency or organization.</text></subparagraph></paragraph></subsection><subsection id="H7E27108BEAF5460AB7AD486C479D5B16"><enum>(c)</enum><header>Reporting</header><text>The working group shall report to the National Security Council.</text></subsection><subsection id="HF2F99D64B9AE43188CBA738A41AD480E"><enum>(d)</enum><header>Duties</header><text>The working group shall—</text><paragraph id="H9F91948D0BC445C8818854D8D7ED66EF"><enum>(1)</enum><text>provide direction and advice to the officials described in section 3(a)(2)(A) and appropriate Federal agencies, as determined by the working group, with respect to the establishment of a Strategic Infrastructure Fund (referred to in this subsection as the <term>Fund</term>) to be used—</text><subparagraph id="H06D5230EDD79497989A73F67CB309AFE"><enum>(A)</enum><text>to support those aspects of projects relating to—</text><clause id="H65C77C44841646B79E006FC116AD05D1"><enum>(i)</enum><text>civil nuclear technologies; </text></clause><clause id="HD0592E6F6C994F128B7C996CF24A9C1B"><enum>(ii)</enum><text>rare earth elements and critical minerals (as defined in section 7002(a) of the Energy Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/30/1606">30 U.S.C. 1606(a)</external-xref>)); and</text></clause><clause id="HB94F15B8DD9D4904B5A25231608B9205"><enum>(iii)</enum><text>microprocessors; and</text></clause></subparagraph><subparagraph id="HD0CB82541CD441A08BDCBBE800D5BCE4" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>for strategic investments identified by the working group; and</text></subparagraph></paragraph><paragraph id="HA045A8288B4A4FC8A719C4DAE6C78767"><enum>(2)</enum><text>address critical areas in determining the appropriate design for the Fund, including—</text><subparagraph id="H8C43C7826E0F4C58B5F8FB81C3F2D593"><enum>(A)</enum><text>transfer of assets to the Fund;</text></subparagraph><subparagraph id="H498C1C665FC5483D8D6BBC2C05787B63"><enum>(B)</enum><text>transfer of assets from the Fund;</text></subparagraph><subparagraph id="HCDE27C6386A949E6902AAD6B1708D971"><enum>(C)</enum><text>how assets in the Fund should be invested; and</text></subparagraph><subparagraph id="H09D1EE416E3342F4841B7BA41AAD1F44"><enum>(D)</enum><text>governance and implementation of the Fund.</text></subparagraph></paragraph></subsection><subsection id="HEFA797DE73C8465299BCD171ABCF9038"><enum>(e)</enum><header>Report required</header><paragraph id="H8F024D5C56414E2D87B1574070784648"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of the enactment of this Act, the working group shall submit to the committees described in paragraph (2) a report on the findings of the working group that includes suggested legislative text for how to establish and structure a Strategic Infrastructure Fund.</text></paragraph><paragraph id="HD501E2D3B50F4F01BDAEEB665797CF92"><enum>(2)</enum><header>Committees described</header><text>The committees referred to in paragraph (1) are—</text><subparagraph id="HE9A820D6150244D3854BDB74028F6746"><enum>(A)</enum><text>the Committee on Foreign Relations, the Committee on Commerce, Science, and Transportation, the Committee on Armed Services, the Committee on Energy and Natural Resources, the Committee on Environment and Public Works, and the Committee on Finance of the Senate; and</text></subparagraph><subparagraph id="HD67B88E253ED492AA8F9BA0E3229C8AC" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>the Committee on Foreign Affairs, the Committee on Energy and Commerce, the Committee on Armed Services, the Committee on Science, Space, and Technology, and the Committee on Ways and Means of the House of Representatives.</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" commented="no" id="HC0E4A5DAEF544B76A9CF69E3AA9F93CC"><enum>(3)</enum><header>Administration of the Fund</header><text>The report submitted under paragraph (1) shall include suggested legislative language requiring all expenditures from a Strategic Infrastructure Fund established in accordance with this section to be administered by the Secretary of State (or a designee of the Secretary of State).</text></paragraph></subsection></section><section id="H2DAF00A5D221431CADE939736CBB6D98"><enum>13.</enum><header>United States small modular reactor initiative to increase competitiveness and export of United States nuclear reactor technologies</header><subsection id="HC60CE27CE0A4403FBD30CB642C4F8F55"><enum>(a)</enum><header>Objectives</header><text>The objectives of this section are—</text><paragraph id="HB943D4178EDD44B0AA80AA6D56EC3A07"><enum>(1)</enum><text>to expeditiously demonstrate domestic origin small modular reactor technology that is competitive in international markets against designs offered by the Russian Federation and the People’s Republic of China;</text></paragraph><paragraph id="H8EC4823FB9624DF99A5AD221F1C52E23"><enum>(2)</enum><text>expeditiously promote and develop a domestic nuclear supply chain to support near-term international export of small modular reactors; and</text></paragraph><paragraph id="HAECA24D9CAFE4D9D983B2BD9773F44ED"><enum>(3)</enum><text>expeditiously develop and demonstrate small modular reactor technology that utilizes reactor fuels derived from low-enriched uranium.</text></paragraph></subsection><subsection id="H0005B7FCBA234A9B95C174C811CE7012"><enum>(b)</enum><header>Authorization of appropriations</header><text>In addition to amounts otherwise available, there are authorized to be appropriated to the Secretary pursuant to the funding opportunity announcements of the Department numbered DE–NE0008935 and DE–NE0008928, $1,439,000,000 for fiscal year 2023, to remain available until September 30, 2031, for ongoing work to support regulatory development, design, and deployment activities.</text></subsection></section><section id="H6856CDE0AFBD474BB587514E80019107"><enum>14.</enum><header>U.S. nuclear fuels security initiative to reduce reliance on nuclear fuels from Russia and China</header><subsection id="H21B166BFF8AF4D129E7C97ADE9CD2695"><enum>(a)</enum><header>Sense of Congress</header><text>It is the sense of Congress that—</text><paragraph id="H57B2446465DE44FC9AA7C9DA68F7EEDC"><enum>(1)</enum><text>the United States and the allies of the United States need to eliminate reliance on the Russian Federation for energy fuels, including all forms of uranium;</text></paragraph><paragraph id="HAB11394E2A294403A398981D3A84CA6A"><enum>(2)</enum><text>the Department should—</text><subparagraph id="H81C04B535FA4404896F0B82DE09A3EB7"><enum>(A)</enum><text>prioritize activities to increase domestic production of low-enriched uranium; and </text></subparagraph><subparagraph id="HA6467B926C0D405DA78173DCF0CDD134"><enum>(B)</enum><text>accelerate efforts to establish a domestic high-assay, low-enriched uranium enrichment capability; and</text></subparagraph></paragraph><paragraph id="H8F8C3C2025784835877CB4B5453BEC60"><enum>(3)</enum><text>if domestic enrichment of high-assay, low-enriched uranium will not be commercially available at the scale needed in time to meet the needs of the advanced nuclear reactor demonstration projects of the Department, the Secretary shall consider and implement, as necessary—</text><subparagraph id="HB99D7A5977164647851E2FB58E92C7BB"><enum>(A)</enum><text>all viable options to make high-assay, low-enriched uranium produced from inventories owned by the Department available in a manner that is sufficient to maximize the potential for the Department to meet the needs and schedules of advanced nuclear reactor developers, without impacting existing Department missions, until such time that commercial enrichment and deconversion capability for high-assay, low-enriched uranium exists at a scale sufficient to meet future needs; and</text></subparagraph><subparagraph id="H397FF7B2628C418EB540C629E43B0DDD"><enum>(B)</enum><text>all viable options for partnering with ally or partner nations to meet those needs and schedules until that time.</text></subparagraph></paragraph></subsection><subsection id="H2C6DDF7487094916B3E35647B46A2998"><enum>(b)</enum><header>Objectives</header><text>The objectives of this section are—</text><paragraph id="HA70499C6A8C24A719F7E7D514DCAFB57"><enum>(1)</enum><text>to expeditiously increase domestic production of low-enriched uranium to prevent the reliance of the United States and, to the maximum extent practicable, ally or partner nations on nuclear fuels from—</text><subparagraph id="HB69FE3B7AFC24EF09019EF1A12F9100D"><enum>(A)</enum><text>the Russian Federation;</text></subparagraph><subparagraph id="HD3E0A964FC4747B7B2347F270567E814" commented="no"><enum>(B)</enum><text>the People’s Republic of China; and</text></subparagraph><subparagraph commented="no" id="H2FB870CE45444892B924082CA9F3F0A2"><enum>(C)</enum><text>other countries determined by the Secretary to be insecure supply sources with respect to low-enriched uranium;</text></subparagraph></paragraph><paragraph id="HC98E8542B3A34A13B1FDFCE46178E9F5"><enum>(2)</enum><text>to expeditiously increase domestic production of high-assay, low-enriched uranium by an annual quantity, and in such form, determined by the Secretary to be sufficient to meet the needs of—</text><subparagraph id="H416F220DA76947F4A0970D40A400B2D9"><enum>(A)</enum><text>advanced nuclear reactor developers; and</text></subparagraph><subparagraph id="H785059BE211D46BBA6EEB98301111689"><enum>(B)</enum><text>the consortium;</text></subparagraph></paragraph><paragraph id="H757C4CD52D55421997D91229DD071FC3"><enum>(3)</enum><text>to ensure the availability of domestically produced, converted, and enriched uranium in a quantity determined by the Secretary, in consultation with U.S. nuclear energy companies, to be sufficient to address a reasonably anticipated supply disruption;</text></paragraph><paragraph id="H5576CA730B814488ADE291195774B562"><enum>(4)</enum><text>to address gaps and deficiencies in the domestic production, conversion, enrichment, deconversion, and reduction of uranium by partnering with ally or partner nations if domestic options are not practicable;</text></paragraph><paragraph id="H11C094985421488F989A0DA20633ED31"><enum>(5)</enum><text>to ensure that, in the event of a supply disruption in the nuclear fuel market, a reserve of nuclear fuels is available to serve as a backup supply to support the nuclear nonproliferation and civil nuclear energy objectives of the Department;</text></paragraph><paragraph id="H7FDCA7EB8421457C922991F997DAFADB"><enum>(6)</enum><text>to support enrichment, deconversion, and reduction technology deployed in the United States; and</text></paragraph><paragraph id="H0CEF931994744750893E98936ACD6EC9"><enum>(7)</enum><text>to ensure that, until such time that domestic enrichment and deconversion of high-assay, low-enriched uranium is commercially available at the scale needed to meet the needs of advanced nuclear reactor developers, the Secretary considers and implements, as necessary—</text><subparagraph id="H629626F6BB23468BA82F5EBC847BF8BA"><enum>(A)</enum><text>all viable options to make high-assay, low-enriched uranium produced from inventories owned by the Department available in a manner that is sufficient to maximize the potential for the Department to meet the needs and schedules of advanced nuclear reactor developers; and</text></subparagraph><subparagraph id="H39F68C345E8B4E7E9D164649479584B0"><enum>(B)</enum><text>all viable options for partnering with ally or partner nations to meet those needs and schedules. </text></subparagraph></paragraph></subsection><subsection id="HB5F467AFB186413E8E2E887867645F17"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H0A26610E56D541D68A1937570EAA81FD"><enum>(1)</enum><header>Advanced nuclear reactor</header><text>The term <term>advanced nuclear reactor</term> has the meaning given the term in section 951(b) of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16271">42 U.S.C. 16271(b)</external-xref>).</text></paragraph><paragraph id="H733F28CA92FE456E9FBA0459DA935C83"><enum>(2)</enum><header>Ally or partner nation</header><text>The term <term>ally or partner nation</term> means—</text><subparagraph id="H0D0BBBA29CDE479EB83FD1354A8DDBB2"><enum>(A)</enum><text>the government of any country that is a member of the Organisation for Economic Co-operation and Development;</text></subparagraph><subparagraph id="HE1DD1841B5814D3BA4E177F8FB7D68F7"><enum>(B)</enum><text>the Government of the Republic of India; and</text></subparagraph><subparagraph id="H4268C63954674FBDB7A65556EE9D5A29"><enum>(C)</enum><text>the government of any country designated as an ally or partner nation by the Secretary for purposes of this section.</text></subparagraph></paragraph><paragraph id="HE451612346C0455D973862AD03A6F703"><enum>(3)</enum><header>Associated entity</header><text>The term <term>associated entity</term> means an entity that—</text><subparagraph id="H5E62B05C8134480E8C3190DC5D7A3351"><enum>(A)</enum><text>is owned, controlled, or dominated by—</text><clause id="H2900AD3803C244D9A8023CB5A7AA2084"><enum>(i)</enum><text>an ally or partner nation; or</text></clause><clause id="H150B7BBA09BD4A4CB46511198B3ECF53" commented="no"><enum>(ii)</enum><text>an associated individual; or</text></clause></subparagraph><subparagraph id="H1D0FF2DE0EA845FBA9567CE5657C1F78" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>is organized under the laws of, or otherwise subject to the jurisdiction of, a country described in any of subparagraphs (A) through (C) of paragraph (2), including a corporation that is incorporated in a country described in any of those subparagraphs. </text></subparagraph></paragraph><paragraph id="H411D7B609359448F99FBF0BA702730B7"><enum>(4)</enum><header>Associated individual</header><text>The term <term>associated individual</term> means an alien who is a national of a country described in any of subparagraphs (A) through (C) of paragraph (2).</text></paragraph><paragraph id="HC00E56825EDA46DD86EF5890EBCCFC28"><enum>(5)</enum><header>Consortium</header><text>The term <term>consortium</term> means the consortium established under section 2001(a)(2)(F) of the Energy Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/42/16281">42 U.S.C. 16281(a)(2)(F)</external-xref>).</text></paragraph><paragraph id="H850145620D2B4493986F75B4AF65123F"><enum>(6)</enum><header>Department</header><text>The term <term>Department</term> means the Department of Energy.</text></paragraph><paragraph id="H1ABFDE9CEC23487D85C92337A9943D7A" commented="no"><enum>(7)</enum><header>High-assay, low-enriched uranium; HALEU</header><text>The term <term>high-assay, low-enriched uranium</term> or <term>HALEU</term> means high-assay low-enriched uranium (as defined in section 2001(d) of the Energy Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/42/16281">42 U.S.C. 16281(d)</external-xref>)). </text></paragraph><paragraph commented="no" id="H5D39B4B75A2A4672BCA1F9B082481E9C"><enum>(8)</enum><header>Low-enriched uranium; LEU</header><text>The term <term>low-enriched uranium</term> or <term>LEU</term> means each of—</text><subparagraph commented="no" id="H6B27A7A496AB41C385FD75B44CF554BB"><enum>(A)</enum><text>low-enriched uranium (as defined in section 3102 of the USEC Privatization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2297h">42 U.S.C. 2297h</external-xref>)); and</text></subparagraph><subparagraph id="H3CCCB5E866774FBD98F2C76773D6623A" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>low-enriched uranium (as defined in section 3112A(a) of that Act (42 U.S.C. 2297h–10a(a))). </text></subparagraph></paragraph><paragraph id="HE506E4B9A6374E08A71DC91A7BD91AB9"><enum>(9)</enum><header>Programs</header><text>The term <term>Programs</term> means—</text><subparagraph id="H927B89477EBC43269E7E827CF42D6E1D"><enum>(A)</enum><text>the Nuclear Fuel Security Program established under subsection (d)(1);</text></subparagraph><subparagraph id="H6EDDA42D5F0D41598FE7B87F7D8A55A3"><enum>(B)</enum><text>the American Assured Fuel Supply Program of the Department; and</text></subparagraph><subparagraph id="H307D0C86849C4CBAAC1C611787CBB09C"><enum>(C)</enum><text>the HALEU for Advanced Nuclear Reactor Demonstration Projects Program established under subsection (d)(3).</text></subparagraph></paragraph><paragraph id="HEEF5EA640ECF4AE7A512D4FA6465D6B6"><enum>(10)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph><paragraph id="H0A74E50B1B1D477B925DE9DBC4E826A6" commented="no"><enum>(11)</enum><header>U.S. nuclear energy company</header><text>The term <term>U.S. nuclear energy company</term> means a company that—</text><subparagraph commented="no" id="H52110EFFB6EC45AC8B4950264BDE1CA6"><enum>(A)</enum><text>is organized under the laws of, or otherwise subject to the jurisdiction of, the United States; and</text></subparagraph><subparagraph id="HD510CD7A1A794EAB8B3CA2163341C3FB" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>is involved in the nuclear energy industry. </text></subparagraph></paragraph></subsection><subsection id="HF3DC8CF94053400AADDEC7E0D2514E62"><enum>(d)</enum><header>Establishment and expansion of programs</header><text>The Secretary, consistent with the objectives described in subsection (b), shall—</text><paragraph id="HA50A2980326C438E805862BCAEC9321C"><enum>(1)</enum><text>establish a program, to be known as the <quote>Nuclear Fuel Security Program</quote>, to prevent the reliance of the United States and, to the maximum extent practicable, ally or partner nations on LEU and HALEU from the Russian Federation and the People’s Republic of China by increasing the quantity of LEU and HALEU produced by U.S. nuclear energy companies;</text></paragraph><paragraph id="H5A7834B8B0664ABEBF70EF5E1A70D5A2"><enum>(2)</enum><text>expand the American Assured Fuel Supply Program of the Department to ensure the availability of domestically produced, converted, and enriched uranium in the event of a supply disruption; and</text></paragraph><paragraph id="HA93AB574CBA34844B8A0F8F40F2D8B58"><enum>(3)</enum><text>establish a program, to be known as the <quote>HALEU for Advanced Nuclear Reactor Demonstration Projects Program</quote>—</text><subparagraph id="HA4EC4B7E8897436CB24345DAAF9D5184"><enum>(A)</enum><text>to maximize the potential for the Department to meet the needs and schedules of advanced nuclear reactor developers until such time that commercial enrichment and deconversion capability for HALEU exists in the United States at a scale sufficient to meet future needs; and</text></subparagraph><subparagraph id="H637F18E2C72140878AE9385D30D77FF0"><enum>(B)</enum><text>where practicable, to partner with ally or partner nations to meet those needs and schedules until that time.</text></subparagraph></paragraph></subsection><subsection id="HE7BB0D48C5D74E9997F165ACA8CEB138"><enum>(e)</enum><header>Nuclear Fuel Security Program</header><paragraph id="H4D2DEF3B6F0A4695B6429FC1E2018913"><enum>(1)</enum><header>In general</header><text>In carrying out the Nuclear Fuel Security Program, the Secretary shall—</text><subparagraph id="H613E06C539C541D0AA99B399C8EE385C"><enum>(A)</enum><text>not later than 180 days after the date of enactment of this Act, enter into 2 or more contracts to begin acquiring not less than 100 metric tons per year of LEU by December 31, 2026 (or the earliest operationally feasible date thereafter), to ensure diverse domestic uranium mining, conversion, enrichment, deconversion, and reduction capacity and technologies, including new capacity, among U.S. nuclear energy companies;</text></subparagraph><subparagraph id="H44A959B66F9B4EAEA66441BD0E96E150"><enum>(B)</enum><text>not later than 180 days after the date of enactment of this Act, enter into 2 or more contracts with members of the consortium to begin acquiring not less than 20 metric tons per year of HALEU by December 31, 2027 (or the earliest operationally feasible date thereafter), from U.S. nuclear energy companies;</text></subparagraph><subparagraph id="HB31AD70F56A44A4BBE2E3D6BCDEA18E3"><enum>(C)</enum><text>utilize only uranium produced, converted, and enriched in—</text><clause id="H9872B7336D974EEB94435CF8EF81DAA3"><enum>(i)</enum><text>the United States; or </text></clause><clause id="H673D26523DEA498F84C7AACD0CBDDC91"><enum>(ii)</enum><text>if domestic options are not practicable, a country described in any of subparagraphs (A) through (C) of subsection (c)(2);</text></clause></subparagraph><subparagraph id="HDD541E31A7754637A01386E7349EC56E"><enum>(D)</enum><text>to the maximum extent practicable, ensure that the use of domestic uranium utilized as a result of that program does not negatively affect the economic operation of nuclear reactors in the United States; and</text></subparagraph><subparagraph id="HB6E2F106979E4C0A892A370E094F214B"><enum>(E)</enum><text>take other actions that the Secretary determines to be necessary or appropriate to prevent the reliance of the United States and ally or partner nations on nuclear fuels from the Russian Federation and the People’s Republic of China. </text></subparagraph></paragraph><paragraph id="HED5F21D295034E9A9D069CA73D178D12"><enum>(2)</enum><header>Considerations</header><text>In carrying out paragraph (1)(B), the Secretary shall consider and, if appropriate, implement—</text><subparagraph id="H48FE7AD63CA64D1880D5452D32955712"><enum>(A)</enum><text>options to ensure the quickest availability of commercially enriched HALEU, including—</text><clause id="H606131643DCB435CB735B34A55AE13DC"><enum>(i)</enum><text>partnerships between 2 or more commercial enrichers; and</text></clause><clause id="H1B4C40FB611541C2BAB4E6B913F5C8BF"><enum>(ii)</enum><text>utilization of up to 10-percent enriched uranium as feedstock in demonstration-scale or commercial HALEU enrichment facilities;</text></clause></subparagraph><subparagraph id="H4DF2820E68FC4BFEAE997CDF48109320"><enum>(B)</enum><text>options to partner with ally or partner nations to provide LEU and HALEU for commercial purposes;</text></subparagraph><subparagraph id="H376E0F20C17F4BA1ADAF28F5805B5B5F"><enum>(C)</enum><text>options that provide for an array of HALEU—</text><clause id="H031CFA971D1D4FC8B346134758ACBAF8"><enum>(i)</enum><text>enrichment levels;</text></clause><clause id="HB3B1EE6E8FFF413A8D48AECBCBD4D2BE"><enum>(ii)</enum><text>output levels to meet demand; and</text></clause><clause id="H06A5700476DA47C7B93A80CA0876BF8E"><enum>(iii)</enum><text>fuel forms, including uranium metal and oxide; and</text></clause></subparagraph><subparagraph id="HB152FA8DD30247D1A7B407CE73C9F319"><enum>(D)</enum><text>options—</text><clause id="H06D9FA43CDE944CBA21D67BD46290B0F"><enum>(i)</enum><text>to replenish, as necessary, Department stockpiles of uranium that was intended to be downblended for other purposes, but was instead used in carrying out activities under the HALEU for Advanced Nuclear Reactor Demonstration Projects Program;</text></clause><clause id="H14780E44E7C2452A98034F635E592A0D"><enum>(ii)</enum><text>to continue supplying HALEU to meet the needs of the recipients of an award made pursuant to the funding opportunity announcement of the Department numbered DE–FOA–0002271 for Pathway 1, Advanced Reactor Demonstrations; and</text></clause><clause id="H7241A3BBA71040418322ACCE17813D48"><enum>(iii)</enum><text>to make HALEU available to other advanced nuclear reactor developers and other end-users.</text></clause></subparagraph></paragraph><paragraph id="H3B9729590EDE4042990BE7249C613A28"><enum>(3)</enum><header>Avoidance of market disruptions</header><text>In carrying out the Nuclear Fuel Security Program, the Secretary, to the extent practicable and consistent with the purposes of that program, shall not disrupt or replace market mechanisms by competing with U.S. nuclear energy companies.</text></paragraph></subsection><subsection id="H84A6CE457B3840658A0E6B0F14F8558F"><enum>(f)</enum><header>Expansion of the American Assured Fuel Supply Program</header><text>The Secretary, in consultation with U.S. nuclear energy companies, shall—</text><paragraph id="H3003298EB60D402FBE13EB1135B37C8C"><enum>(1)</enum><text>expand the American Assured Fuel Supply Program of the Department by merging the operations of the Uranium Reserve Program of the Department with the American Assured Fuel Supply Program; and</text></paragraph><paragraph id="H287F3D7D812744AFBBE0A76E37AB3438"><enum>(2)</enum><text>in carrying out the American Assured Fuel Supply Program of the Department, as expanded under paragraph (1)—</text><subparagraph id="H00282583FF294C0DA03D9687D26C68A7"><enum>(A)</enum><text>maintain, replenish, diversify, or increase the quantity of uranium made available by that program in a manner determined by the Secretary to be consistent with the purposes of that program and the objectives described in subsection (b);</text></subparagraph><subparagraph id="HBCDEAED8E4B047B9A7441561A89CB02D"><enum>(B)</enum><text>utilize only uranium produced, converted, and enriched in—</text><clause id="H799E94196E7A492EAB1900683805DB44"><enum>(i)</enum><text>the United States; or</text></clause><clause id="HABC8A3EE159B49B7B6B82ED94708F808"><enum>(ii)</enum><text>if domestic options are not practicable, a country described in any of subparagraphs (A) through (C) of subsection (c)(2);</text></clause></subparagraph><subparagraph id="H1BDEC55CECC0409F94616215A73A50B4"><enum>(C)</enum><text>make uranium available from the American Assured Fuel Supply, subject to terms and conditions determined by the Secretary to be reasonable and appropriate;</text></subparagraph><subparagraph id="H8FD046A044EC46A38B3CD8E061A3C8CF"><enum>(D)</enum><text>refill and expand the supply of uranium in the American Assured Fuel Supply, including by maintaining a limited reserve of uranium to address a potential event in which a domestic or foreign recipient of uranium experiences a supply disruption for which uranium cannot be obtained through normal market mechanisms or under normal market conditions; and</text></subparagraph><subparagraph id="H20AF7F6B14AF4B59A3F3E4B383FF6B0F"><enum>(E)</enum><text>take other actions that the Secretary determines to be necessary or appropriate to address the purposes of that program and the objectives described in subsection (b).</text></subparagraph></paragraph></subsection><subsection id="HC41270436A0F4112B1F58CDF2ED71930"><enum>(g)</enum><header>HALEU for Advanced Nuclear Reactor Demonstration Projects Program</header><paragraph id="H71B4817F8E45475C89BC0A0E48007889"><enum>(1)</enum><header>Activities</header><text>On enactment of this Act, the Secretary shall immediately accelerate and, as necessary, initiate activities to make available from inventories or stockpiles owned by the Department and made available to the consortium, HALEU for use in advanced nuclear reactors that cannot operate on uranium with lower enrichment levels or on alternate fuels, with priority given to the awards made pursuant to the funding opportunity announcement of the Department numbered DE–FOA–0002271 for Pathway 1, Advanced Reactor Demonstrations, with additional HALEU to be made available to other advanced nuclear reactor developers, as the Secretary determines to be appropriate.</text></paragraph><paragraph id="H470719E0A39541EF964C03A35B860B70"><enum>(2)</enum><header>Quantity</header><text>In carrying out activities under this subsection, the Secretary shall consider and implement, as necessary, all viable options to make HALEU available in quantities sufficient to maximize the potential for the Department to meet the needs and schedules of advanced nuclear reactor developers, including by seeking to make available—</text><subparagraph id="H0419262BA303410AB276D9408D4D03B9"><enum>(A)</enum><text>by September 30, 2024, not less than 3 metric tons of HALEU;</text></subparagraph><subparagraph id="HAB8C759D3F7F47E191CBD2688B2480DA"><enum>(B)</enum><text>by December 31, 2025, not less than an additional 8 metric tons of HALEU; and</text></subparagraph><subparagraph id="HCB6A7983487C4C9BA488F51FF23FAB80"><enum>(C)</enum><text>by June 30, 2026, not less than an additional 10 metric tons of HALEU.</text></subparagraph></paragraph><paragraph id="HAC955D432AA3438DB4EA9E8BB0CBB4C2"><enum>(3)</enum><header>Factors for consideration</header><text>In carrying out activities under this subsection, the Secretary shall take into consideration—</text><subparagraph id="H908545C8814142D78361A62157CE5228"><enum>(A)</enum><text>options for providing HALEU from a stockpile of uranium owned by the Department (including the National Nuclear Security Administration), including—</text><clause id="HA90277D4E4D44557949469B843A825A0"><enum>(i)</enum><text>uranium that has been declared excess to national security needs;</text></clause><clause id="H044DB6D918BC4D87908050A478D9A490"><enum>(ii)</enum><text>uranium that—</text><subclause id="H6A6E8A8989724C5F88F8FAD3EA1C6D22"><enum>(I)</enum><text>directly meets the needs of advanced nuclear reactor developers; but</text></subclause><subclause id="H077E0C5308714D1E9F925F8C880D3519"><enum>(II)</enum><text>has been previously used or fabricated for another purpose;</text></subclause></clause><clause id="H00F40A02E3B74B0FB28B802E4E00123D"><enum>(iii)</enum><text>uranium that can meet the needs of advanced nuclear reactor developers after removing radioactive or other contaminants that resulted from previous use or fabrication of the fuel for research, development, demonstration, or deployment activities of the Department, including activities that reduce the environmental liability of the Department by accelerating the processing of uranium from stockpiles designated as waste;</text></clause><clause id="H8A23F69275954D98AD59D29735019C82"><enum>(iv)</enum><text>uranium from a high-enriched uranium stockpile, which can be blended with lower assay uranium to become HALEU to meet the needs of advanced nuclear reactor developers; and</text></clause><clause id="H6451ECE1A16747AC937DEF1044C0AEAA"><enum>(v)</enum><text>uranium from stockpiles intended for other purposes, but for which uranium could be swapped or replaced in time in such a manner that would not negatively impact the missions of the Department;</text></clause></subparagraph><subparagraph id="HF64DF21B9B2F40C79CFA89C0B5DC7611"><enum>(B)</enum><text>options for expanding, or establishing new, capabilities or infrastructure to support the processing of uranium from Department inventories, including options that may be mutually beneficial to the Department and to U.S. nuclear energy companies;</text></subparagraph><subparagraph id="HF9B9912B04164AD286A17141F285B998"><enum>(C)</enum><text>options for accelerating the availability of HALEU from HALEU enrichment demonstration projects of the Department;</text></subparagraph><subparagraph id="HCCB54B73595F42E1B87170FAC8872184"><enum>(D)</enum><text>options for providing HALEU from domestically enriched HALEU procured by the Department through a competitive process pursuant to the Nuclear Fuel Security Program established under subsection (d)(1);</text></subparagraph><subparagraph id="HDE2493AC899B454A8E63C0C8B01C72DA"><enum>(E)</enum><text>options to replenish, as needed, Department stockpiles of uranium made available pursuant to subparagraph (A) with domestically enriched HALEU procured by the Department through a competitive process pursuant to the Nuclear Fuel Security Program established under subsection (d)(1); and</text></subparagraph><subparagraph id="H4C142EF2390849BFAF2DFADED7C86438"><enum>(F)</enum><text>options that combine 1 or more of the approaches described in subparagraphs (A) through (E) to meet the deadlines described in paragraph (2).</text></subparagraph></paragraph><paragraph id="H2AC2F04C54534CCAB96ECA0A87BD4595"><enum>(4)</enum><header>Limitation</header><text>The Secretary shall not barter or otherwise sell or transfer uranium in any form in exchange for services relating to—</text><subparagraph id="H42CEF9F0BF124D7ABC8FCA028F0528FA"><enum>(A)</enum><text>the final disposition of radioactive waste from uranium that is the subject of a contract for sale, resale, transfer, or lease under this subsection; or</text></subparagraph><subparagraph id="HCC55D680B1F54772894DED9786856A52"><enum>(B)</enum><text>environmental cleanup activities.</text></subparagraph></paragraph><paragraph id="HA30EA32592EB42E385AF80F954EF14C5"><enum>(5)</enum><header>Sunset</header><text>The authority of the Secretary to carry out activities under this subsection shall terminate on the date on which the Secretary notifies Congress that the HALEU needs of advanced nuclear reactor developers can be fully met by commercial HALEU suppliers in the United States, as determined by the Secretary, in consultation with U.S. nuclear energy companies.</text></paragraph></subsection><subsection id="H8125961277484C6194451485BB273B11"><enum>(h)</enum><header>Authority</header><text>In carrying out the Programs, the Secretary, in coordination with the Secretary of State (where applicable)—</text><paragraph id="H84DF31FB7A3E43C8B4303CB85DD726AF"><enum>(1)</enum><text>may—</text><subparagraph id="HE2DD451EE4C846C6B256430E9B41322B"><enum>(A)</enum><text>in addition to exercising the authority granted to the Secretary under any other provision of law, enter into transactions (other than contracts, cooperative agreements, financial assistance agreements, or the provision of any other financial assistance) with an ally or partner nation, a U.S. nuclear energy company, or any other domestic or foreign entity for any activity to carry out the Programs, including the acquisition or provision of uranium, conversion services, enrichment services, LEU, HALEU, and related goods and services;</text></subparagraph><subparagraph id="HFA22DAFF9D0341AA9B62309D9F44DCE8"><enum>(B)</enum><text>notwithstanding section 161 u. of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2201">42 U.S.C. 2201(u)</external-xref>), enter into contracts and other arrangements of such duration as the Secretary determines to be necessary;</text></subparagraph><subparagraph id="H1504195023DC4B0AA25FA2F8D1BC9F67"><enum>(C)</enum><text>make acquisitions for the Programs through the use of competitive selection processes that the Secretary determines to be appropriate to achieve the objectives described in subsection (b) in an expeditious manner;</text></subparagraph><subparagraph id="HBD6249771B5842ABB0B40E5D5AC08B2F"><enum>(D)</enum><clause commented="no" display-inline="yes-display-inline" id="H8B303FCF2AE74550BCACEDCDB5A81D6D"><enum>(i)</enum><text>establish milestones for achieving specified objectives, including the production of LEU and HALEU in quantities and timeframes described in this section; and </text></clause><clause id="H7FA173AA7241435D8D722D6930257EF2" indent="up1"><enum>(ii)</enum><text>provide awards and other forms of incentives for meeting those milestones; and</text></clause></subparagraph><subparagraph id="H8E2F35127E784B47822E36362ACFE728"><enum>(E)</enum><text>provide loan guarantees, other financial assistance, or assistance in the form of revenue guarantees or similar mechanisms; and</text></subparagraph></paragraph><paragraph id="H26FE2E8676F64FAE8BABAEB407F3F5C7"><enum>(2)</enum><text>shall ensure that amounts charged to the Secretary for the acquisition or provision of uranium, conversion services, enrichment services, LEU, HALEU, and other goods and services under the Programs provide, in the opinion of the Secretary, in consultation with U.S. nuclear energy companies, reasonable compensation, taking into account—</text><subparagraph id="HC5E03BB3B2C2404D8228DB9557B1F482"><enum>(A)</enum><text>the fair market value of the good or service acquired or provided;</text></subparagraph><subparagraph id="H4BE01A9EE15A49628CA9AF6ABB944B4F"><enum>(B)</enum><text>the cost recovery requirements of the consortium; and </text></subparagraph><subparagraph id="HCD7D8D1D207E4160A55D2328E0E0E8B4"><enum>(C)</enum><text>the objectives described in subsection (b).</text></subparagraph></paragraph></subsection><subsection id="HB610634D0C2848BB84903DD35E8559CC"><enum>(i)</enum><header>Domestic sourcing considerations</header><paragraph id="H60F3291B06644DA4A2F2C82A041A8185"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the Secretary may only carry out an activity in connection with 1 or more of the Programs if—</text><subparagraph id="H2DDBA071D06C42A49515625AD0C6ECD2"><enum>(A)</enum><text>the activity promotes manufacturing in the United States associated with uranium supply chains; or</text></subparagraph><subparagraph id="HD4400B1D05CE4673A82EC7C0317067BB"><enum>(B)</enum><text>the activity relies on resources, materials, or equipment developed or produced—</text><clause id="HB7D03FFC815C471F9B44884C132CAFE4"><enum>(i)</enum><text>in the United States; or</text></clause><clause id="H33A2C7EF8CA544499C434333F81C276F" commented="no"><enum>(ii)</enum><text>in a country described in any of subparagraphs (A) through (C) of subsection (c)(2) by—</text><subclause id="HB548E2D1EFFD4D71A2EE57ACB996AA7F"><enum>(I)</enum><text>an ally or partner nation;</text></subclause><subclause id="H96D260C34C494DEB96646AFDA7222F3C" commented="no"><enum>(II)</enum><text>an associated entity; or</text></subclause><subclause commented="no" id="H33647AED75A04EBE94818E75955020EF"><enum>(III)</enum><text>a U.S. nuclear energy company.</text></subclause></clause></subparagraph></paragraph><paragraph id="H5FB2A3E04372485FBFAFC630521E3340"><enum>(2)</enum><header>Waiver</header><text>The Secretary may waive the requirements of paragraph (1) with respect to an activity if the Secretary determines a waiver to be necessary to achieve 1 or more of the objectives described in subsection (b). </text></paragraph></subsection><subsection id="HE755F288EB844B4180CF2C488D7C63E5"><enum>(j)</enum><header>Reasonable compensation</header><paragraph id="H35D1500AF11241FC81E86596A4A1CF03"><enum>(1)</enum><header>In general</header><text>In carrying out activities under this section, the Secretary shall ensure that any LEU and HALEU made available by the Secretary under 1 or more of the Programs is subject to reasonable compensation, taking into account the fair market value of the LEU or HALEU and the purposes of this section.</text></paragraph><paragraph id="H3F767D9A13874D77953017791BC2E304"><enum>(2)</enum><header>Availability of certain funds</header><text>Notwithstanding section 3302 of title 31, United States Code, revenues received from the sale or transfer of fuel feed material and other activities related to making LEU and HALEU available pursuant to this section—</text><subparagraph id="HAFE01972229C4094AF18F0AB3152C6FA"><enum>(A)</enum><text>shall be available to the Department for carrying out the purposes of this section, to reduce the need for further appropriations for those purposes; and</text></subparagraph><subparagraph id="H9855B60E82CF4880B822F21E6AC411DB"><enum>(B)</enum><text>shall remain available until expended.</text></subparagraph></paragraph></subsection><subsection id="HB10A1C17B4B640EABFBEEF1A7E8BD06E"><enum>(k)</enum><header>Exclusions</header><text>The Secretary may not carry out an activity in connection with the Programs with an entity that is—</text><paragraph id="H5A1B073B7B4A4A37AF3EB16474756669"><enum>(1)</enum><text>owned or controlled by the Government of the Russian Federation or the Government of the People’s Republic of China; or</text></paragraph><paragraph id="H8EBBD9B704274E32857C07CFBB99345E"><enum>(2)</enum><text>organized under the laws of, or otherwise subject to the jurisdiction of, the Russian Federation or the People’s Republic of China. </text></paragraph></subsection><subsection id="H969514FC5F47486EAF5B8548D9301EB3"><enum>(l)</enum><header>Nuclear regulatory commission</header><text>The Nuclear Regulatory Commission shall prioritize and expedite consideration of any action related to the Programs to the extent permitted under the <act-name parsable-cite="AEA54">Atomic Energy Act of 1954</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/2011">42 U.S.C. 2011 et seq.</external-xref>) and related statutes.</text></subsection><subsection id="H365155812FB143E69988468C038891D4"><enum>(m)</enum><header>USEC Privatization Act</header><paragraph id="H56CAC1B19DB64F039BDCF4F4C4981F98"><enum>(1)</enum><header>In general</header><text>The requirements of section 3112 of the USEC Privatization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2297h-10">42 U.S.C. 2297h–10</external-xref>) shall not apply to activities related to the Programs.</text></paragraph><paragraph id="HD5FBE3F0770E4CCEADA6EB21697F758F"><enum>(2)</enum><header>Amendment</header><text>Section 3112A(c)(2)(A) of the USEC Privatization Act (42 U.S.C. 2297h–10a(c)(2)(A)) is amended—</text><subparagraph id="H569099B26E9A4BC5B890BC5919D40CE5"><enum>(A)</enum><text>in clause (xii), by inserting <quote>and</quote> after the semicolon at the end;</text></subparagraph><subparagraph id="H4B961F66F85D496DB1028044209B8446"><enum>(B)</enum><text>by striking clauses (xiii) through (xxvii); and</text></subparagraph><subparagraph id="H278C25255C23412E93C91E78AF324CF7"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H931655B963294618A1CBE8628833C292"><clause id="H66509AF96EA94FB198AE20A10BF7F2B5"><enum>(xiii)</enum><text>in calendar year 2026 and each calendar year thereafter, 0 kilograms.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H05F36FB3C1DE4294BDAFC66F7A0B1A94"><enum>(n)</enum><header>Prohibition on Importation of Uranium from the Russian Federation and the People’s Republic of China</header><paragraph id="HA8113E2B400B4CA997EF61B144E6471E"><enum>(1)</enum><header>In general</header><text>Notwithstanding section 3112A of the USEC Privatization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2297h-10a">42 U.S.C. 2297h–10a</external-xref>) or any other provision of law, the importation of articles of the Russian Federation or the People’s Republic of China classifiable under subheading 2612.10, 2844.10, 2844.20, 2844.30.20, or 2844.30.50 of the Harmonized Tariff Schedule of the United States is prohibited.</text></paragraph><paragraph id="H93D4F24E2D9E44AAAE7FF75FDDC7DA85"><enum>(2)</enum><header>Waiver of prohibition</header><subparagraph id="HB29F01EFD8034637864ECED5A1F3D2C6"><enum>(A)</enum><header>In general</header><text>The Secretary may waive the prohibition under paragraph (1) with respect to an article if the Secretary, in consultation with the Secretary of State and the Secretary of Commerce, determines that—</text><clause id="H387A17C47EAD4DD488563179E68A4BEE"><enum>(i)</enum><text>no viable source of alternative supply of the article is available to sustain continued operation of a nuclear reactor in the United States; or</text></clause><clause id="HA72E1E5EFBF544D1B42A1816D500E9E9"><enum>(ii)</enum><text>importation of the article from a country other than the Russian Federation or the People’s Republic of China is in the interest of national security.</text></clause></subparagraph><subparagraph id="HCC39C64C7BF64F83AE1CB6541FC94C4D"><enum>(B)</enum><header>Notification to congress</header><text>Not later than 60 days before issuing a waiver under subparagraph (A), the Secretary shall notify the Committee on Energy and Natural Resources of the Senate and the Committee on Energy and Commerce of the House of Representatives of the intent to issue the waiver, including a justification for the waiver.</text></subparagraph><subparagraph id="HCF5E1C4FA39F450BA722D98667587977"><enum>(C)</enum><header>Expiration of waiver authority</header><text>The authority provided to the Secretary under subparagraph (A) expires on December 31, 2025.</text></subparagraph></paragraph><paragraph id="HE473D07ED184486C811EF158EE527A60"><enum>(3)</enum><header>Effective date</header><text>Paragraph (1) applies with respect to articles entered, or withdrawn from warehouse for consumption, on or after the date that is 45 days after the date of enactment of this Act. </text></paragraph></subsection><subsection id="HB5592AB201124C449812C9277EA31214"><enum>(o)</enum><header>Authorization of appropriations</header><text>In addition to amounts otherwise available, there are authorized to be appropriated to the Secretary—</text><paragraph id="H8CC715F4C2BA4804BEEB40B562C83DA1"><enum>(1)</enum><text>for the Nuclear Fuel Security Program, $3,500,000,000 for fiscal year 2023, to remain available until September 30, 2031, of which the Secretary may use $1,000,000,000 by September 30, 2028, to carry out the HALEU for Advanced Nuclear Reactor Demonstration Projects Program; and</text></paragraph><paragraph id="HE65C2F777326493EBDDE621D4CE6F247" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>for the American Assured Fuel Supply Program of the Department, as expanded under this section, such sums as are necessary for the period of fiscal years 2023 through 2030, to remain available until September 30, 2031.</text></paragraph></subsection></section><section id="H6B8E4278760A421581E3B6C246926914"><enum>15.</enum><header>Isotope demonstration and advanced nuclear research infrastructure enhancement</header><subsection id="H7C52DE975CD24852A2127E4B995D7B8B"><enum>(a)</enum><header>Evaluation and establishment of isotope demonstration program</header><text>Section 952(a)(2)(A) of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16272">42 U.S.C. 16272(a)(2)(A)</external-xref>) is amended by striking <quote>shall evaluate the technical and economic feasibility of the establishment of</quote> and inserting <quote>shall evaluate the technical and economic feasibility of, and, if feasible, is authorized to establish,</quote>.</text></subsection><subsection id="H6BFAFDDBDCD94ADDB3E8AA7E5EA432C7"><enum>(b)</enum><header>Advanced nuclear research infrastructure enhancement</header><text>Section 954(a)(5) of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16274">42 U.S.C. 16274(a)(5)</external-xref>) is amended—</text><paragraph id="HB9667074EF654B359C5DC368E9088BD0"><enum>(1)</enum><text>by redesignating subparagraph (E) as subparagraph (F); and</text></paragraph><paragraph id="H76964AEE9A5D424CA71FA7AD55D52BC7"><enum>(2)</enum><text>by inserting after subparagraph (D) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H3BCCDA760F114A25AFDD733A5DFDFCF1"><subparagraph id="HA3F1603C2AF244A6A66C8F457AE7D87E"><enum>(E)</enum><header>Fuel services</header><text>The Secretary shall expand the Research Reactor Infrastructure subprogram of the Radiological Facilities Management program of the Department carried out under paragraph (6) to provide fuel services to research reactors established under this paragraph.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H6CAB6BC283094F2D81C8A43C455A410C"><enum>16.</enum><header>Report on civil nuclear credit program</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of Energy shall submit to the appropriate committees of Congress a report that identifies the anticipated funding requirements for the civil nuclear credit program described in section 40323 of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18753">42 U.S.C. 18753</external-xref>), taking into account—</text><paragraph id="HA48A846344F64157938A81A10AF8E6E1"><enum>(1)</enum><text display-inline="yes-display-inline">the zero-emission nuclear power production credit authorized by <external-xref legal-doc="usc" parsable-cite="usc/26/45U">section 45U</external-xref> of the Internal Revenue Code of 1986; and </text></paragraph><paragraph id="H97885713BBE94E32BE05A38F13895ACF"><enum>(2)</enum><text display-inline="yes-display-inline">any increased fuel costs associated with the use of domestic fuel that may arise from the implementation of that program.</text></paragraph></section></legis-body></bill>
