R. 9077</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220929">September 29, 2022</action-date><action-desc><sponsor name-id="S001208">Ms. Slotkin</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 10, United States Code, to provide for certain requirements relating to the retirement, adoption, and recognition of military working dogs, and for other purposes.</official-title></form><legis-body id="H4DCDF428166E450A8E4F9D88D49DFB15" style="OLC"><section id="H257995281DF04759B79A66927D557CCF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Canine Members of the Armed Forces Act</short-title></quote>.</text></section><section id="H5F6DE30D2E7F412E9B4012123EB4A473"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text><paragraph id="H1DEFA79EE48841B781576BE1D6BE04EF"><enum>(1)</enum><text display-inline="yes-display-inline">Each of the Armed Forces and other Government agencies, including the Secret Service, the Central Intelligence Agency, and the Transportation Security Administration, use military working dogs in service to the country.</text></paragraph><paragraph id="H714F1DB9972540BB93CF4D61E734923E"><enum>(2)</enum><text>Since September 11, 2011, military working dogs have served in Iraq and Afghanistan and have been trained in explosive detection, narcotic detection, sentry, patrol, tracking, and other specific duties.</text></paragraph><paragraph id="H54A53D8DB02040E783443A70C9BDBA4E"><enum>(3)</enum><text>Military working dogs, through their training, have prevented injuries and saved the lives of thousands of United States citizens.</text></paragraph><paragraph id="H1C061DEF6E2D47DB89388AE85421FFFF"><enum>(4)</enum><text>Military working dogs perform critical and varied roles that go far beyond their current designation as <quote>equipment</quote>.</text></paragraph></section><section id="HC493B89175BC428BB9C75552D6998822"><enum>3.</enum><header>Retirement and adoption of military working dogs</header><subsection id="H809C839AA278493C82979EAC332CFBC0"><enum>(a)</enum><header>Retirement and reclassification of military working dogs</header><text display-inline="yes-display-inline">Section 2583 of title 10, United States Code, is amended—</text><paragraph id="H36FE8CAB585A471797963018AFCFD53E"><enum>(1)</enum><text>by redesignating subsections (f), (g), (h), and (i) as subsections (h), (i), (j), and (k), respectively; and</text></paragraph><paragraph id="HBE53DA0F95164AAF95EC822CB20FAB08"><enum>(2)</enum><text>by inserting after subsection (e) the following new subsections:</text><quoted-block display-inline="no-display-inline" id="H6581A07D5608474090F0B23FBF3DD198" style="USC"><subsection id="HA03062F6C67B4AE4AF235E29786E4C42"><enum>(f)</enum><header>Classification of military working dogs</header><text>The Secretary of Defense shall classify military working dogs as canine members of the Armed Forces. Such dogs shall not be classified as equipment.</text></subsection><subsection id="HA63EFF1BAF8A49F3B372A1D777D676F6"><enum>(g)</enum><header>Transfer of retired military working dogs</header><text display-inline="yes-display-inline">If the Secretary of the military department concerned determines that a military working dog should be retired, and no suitable adoption is available at the military facility where the dog is located, the Secretary may transfer the dog—</text><paragraph id="HE96021F3991243BBAFFFF57D25DAF145"><enum>(1)</enum><text>to the 341st Training Squadron; or</text></paragraph><paragraph id="H5AA24A367CF1440983FE0F7EA806FCC4"><enum>(2)</enum><text>to another location for adoption under this section.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H3DE865A7CBF44692A8FDD5D8811BC3BF"><enum>(b)</enum><header>Acceptance of frequent traveler miles</header><text>Section 2613(d) of such title is amended—</text><paragraph id="HB4BE76A3FCAB4563ABB0465C269A9AEF"><enum>(1)</enum><text>in paragraph (1)(B), by striking <quote>; or</quote> and inserting a semicolon;</text></paragraph><paragraph id="H6D8668C6F830457BBDE4A3C6A3212918"><enum>(2)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="H4AB1E6D630ED42C19E0D6FBDF68048B5"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text><quoted-block display-inline="no-display-inline" id="HB763C521AC1D4E69A6EC6ED2E694B083" style="USC"><paragraph id="HA4385300FF554C99BA8D7CE2824F7CB2"><enum>(3)</enum><text display-inline="yes-display-inline">facilitating the adoption of a military working dog under section 2583 of this title.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section display-inline="no-display-inline" id="HDF7C1E1BE2D4403A9E41E64760C1A836" section-type="subsequent-section"><enum>4.</enum><header>Recognition of service of military working dogs</header><text display-inline="no-display-inline">Section 1125 of title 10, United States Code, is amended—</text><paragraph id="HA904377E47854AA785894D804D800580"><enum>(1)</enum><text>by inserting <quote>(a) <header-in-text level="subsection" style="OLC">General authority</header-in-text>.—</quote> before <quote>The Secretary of Defense</quote>; and</text></paragraph><paragraph id="H1131E36D6D2E4F7288DAB69A27FF475B"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block display-inline="no-display-inline" id="HB35F43FE9B474DD4A78F23D3596C6783" style="OLC"><subsection id="HB881414D9C72417D94C7F4DDE8153423"><enum>(b)</enum><header>Recognition of service of military working dogs</header><text display-inline="yes-display-inline">The Secretary of Defense shall create a decoration or other appropriate recognition to recognize military working dogs under the jurisdiction of the Secretary that are killed in action or perform an exceptionally meritorious or courageous act in service to the United States.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
