<section id="HC22A95C6BA5B4814AFE51495BFFEEBDD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Humane Retirement Act</short-title></quote>.</text></section> <section id="HE1EC4BC01BF6493CAD701B4494F2FF62"><enum>2.</enum><header>Establishment of adoption policy for public health service agencies with respect to retired common companion animals</header><text display-inline="no-display-inline">Section 495 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/289d">42 U.S.C. 289d</external-xref>) is amended by adding at the end the following: </text> 
<quoted-block style="traditional" id="HFEFCD9554250492185CA1269F4E1B03F" display-inline="no-display-inline"> 
<subsection id="HFBC8F2FA9C6B4D2986789AE2562B8C99"><enum>(f)</enum> 
<paragraph id="HC7214C9765BB4D9F8FD6955FBAB1BACC" display-inline="yes-display-inline"><enum>(1)</enum><text>Beginning one year after the date of the enactment of this subsection, guidelines of the Secretary under subsection (a)(3) shall require animal care committees described in such subsection that conduct biomedical and behavioral research at Public Health Service funded Federal agencies to, after the completion of any testing or research involving a common companion animal and prior to euthanizing such common companion animal, make a reasonable effort to offer such common companion animal for adoption, if suitable, in accordance with the following:</text> <subparagraph id="H91E7E4837E984151938A622E952B29EB" indent="up1"><enum>(A)</enum><text>Such an animal care committee shall, after the completion of such testing or research involving a common companion animal and prior to euthanizing such common companion animal, assess the health and temperament of the common companion animal and determine whether it is suitable for adoption.</text></subparagraph> 
<subparagraph id="HC3F3DFA6EB2141C58C307C79953A3459" indent="up1"><enum>(B)</enum><text>If found to be suitable for adoption, such an animal care committee shall make reasonable efforts to offer for adoption the common companion animal to an adopting party.</text></subparagraph> <subparagraph id="HE779884489FB463D992176B2E8EFE07C" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">An animal care committee shall ensure that any adopting party described in any of clauses (ii) through (vi) of paragraph (6)(A) provides a written assurance that the common companion animal will be placed in a home and not with a breeder, exhibitor, or research facility.</text></subparagraph></paragraph> 
<paragraph id="HD3D9D186086E4C1995A7849DD6BCA89E" indent="up1"><enum>(2)</enum><text>Nothing in this subsection shall be construed as—</text> <subparagraph id="HA8E4A3975E25452FA9DA02E24256ABD8"><enum>(A)</enum><text>creating a duty upon an adopting party to accept a common companion animal offered by an animal care committee described in paragraph (1); or</text></subparagraph> 
<subparagraph id="H2A26DB7F30DD4D679EFC5EB2EF0AEF77"><enum>(B)</enum><text>prohibiting such committee from euthanizing a common companion animal if the requirements of this subsection are otherwise met.</text></subparagraph></paragraph> <paragraph id="HED45A24D33704E26905ABBF923E2DACB" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">An animal care committee described in paragraph (1) and any officer, director, employee, or agent of such committee are immune from civil liability for any act or omission relating to the adoption of a common companion animal pursuant to this subsection. </text></paragraph> 
<paragraph id="H6D2C0D7957DE471FB5615ED18C0050DE" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">Beginning not later than 1 year after the date of the enactment of this Act, and each year thereafter, an animal care committee described in paragraph (1) shall submit to the Secretary a report on adoptions that occurred as a result of the requirement specified in such paragraph. Each such report shall include the following:</text> <subparagraph id="H3944B6D4E73E44CC94F55EFA66A997B0"><enum>(A)</enum><text display-inline="yes-display-inline"><italic></italic>The number and species of common companion animals eligible for adoption at the research entity for which the animal care committee was established.</text></subparagraph> 
<subparagraph id="H06E65B772FD6405CBD533569299E19FE"><enum>(B)</enum><text>The number of common companion animals adopted.</text></subparagraph> <subparagraph id="H9154E94730FD493D95FDD3AB44407919"><enum>(C)</enum><text>The types of adopting parties that adopted such animals, disaggregated according to the categories of adopting parties listed in paragraph (6)(A).</text></subparagraph></paragraph> 
<paragraph id="H7B1C777D8DA14AA789F95E0E666F5990" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">An animal care committee described in paragraph (1), may, in offering a common companion animal for adoption pursuant to paragraph (1), charge the adopting party a fee for that adoption (including for any services necessary to prepare the common companion animal for that adoption).</text></paragraph> <paragraph id="H4D44948DCC74420B89022BB30A36345A" indent="up1"><enum>(6)</enum><text>For purposes of this subsection:</text> 
<subparagraph id="H1AB1F87C42BA42E9A56B1B72EB0C27AC" indent="up1"><enum>(A)</enum><text>The term <term>adopting party</term> means—</text> <clause id="H18D62EE5E6EE464FBC4D4102D96AE32B" display-inline="no-display-inline"><enum>(i)</enum><text>an individual adopting a common companion animal through private placement;</text></clause> 
<clause id="H421A266653D3434895BDF0CA0604E953"><enum>(ii)</enum><text>a bona fide animal rescue organization;</text></clause> <clause id="HEB24FA32BE314BE087EF320D0BC000FA"><enum>(iii)</enum><text>a bona fide animal shelter organization;</text></clause> 
<clause id="H83668B5EE71F41898284774E5179ADD9"><enum>(iv)</enum><text>a bona fide society for the prevention of cruelty to animals;</text></clause> <clause id="HBE3E90CECCFB48CEBEADAB761CC7424C"><enum>(v)</enum><text>a bona fide humane society; or</text></clause> 
<clause id="H7213577634E348C3AFE7E9FBD8B5B2B6"><enum>(vi)</enum><text>a bona fide animal protective association that operates physical animal sheltering facilities and offers households pets to the public for adoption by way of an established adoption program.</text></clause></subparagraph> <subparagraph id="HD1BF2DC060644A4D9E6EE135FE1C62D2" indent="up1"><enum>(B)</enum><text>The term <term>common companion animal</term> means a dog, cat, rabbit, or guinea pig.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
