which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Secretary of the Treasury to mint coins in commemoration of the health care professionals, first responders, scientists, researchers, all essential workers, and individuals who provided care and services during the coronavirus pandemic.</official-title></form><legis-body id="HF8D1DC3DEAE74D75A7E12047BA23041C" style="OLC"><section id="HF63E732AEC7F4B1CB371F5FE4AFE2AEB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Coronavirus Front-Line Responders Commemorative Coin Act</short-title></quote>.</text></section><section id="HF0DB6F6FC7AF431D8BA709A15DA9E455"><enum>2.</enum><header>Findings; purpose</header><subsection id="HFEA536557EC040838A395CD00325D7F2"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text><paragraph id="H503636A267F545E9AF8087B30B493545"><enum>(1)</enum><text>Health care professionals working with patients in person and via telehealth made incredible sacrifices, including to their own personal wellbeing, to save lives during the coronavirus pandemic.</text></paragraph><paragraph id="H34D088910FF44508B3E33147E7A0300C"><enum>(2)</enum><text>First responders and law enforcement upheld their responsibilities at great personal risk to keep our national and local communities safe and slow the spread of the coronavirus.</text></paragraph><paragraph id="HC54FAEEDD59340AC8CDBE964C4CC52F9"><enum>(3)</enum><text display-inline="yes-display-inline">Scientists and researchers, including at our Nation’s research universities, worked tirelessly and in innovative ways to understand, prevent, and treat the coronavirus.</text></paragraph><paragraph id="H991B66AB8C554553B003F29A672D9559"><enum>(4)</enum><text>Individuals and families bravely took on new burdens to care for loved ones impacted by the coronavirus.</text></paragraph><paragraph id="H0CDFBC8B77304CC29EFBD2D7CFCAF381"><enum>(5)</enum><text>The dedication of countless workers in essential professions made possible the nationwide effort to combat the coronavirus pandemic.</text></paragraph><paragraph id="H0EDA22E82169429E8D14A109BCCE2030"><enum>(6)</enum><text>In the face of an unprecedented public health crisis, the citizens of the United States of America came together and supported the dedicated health care professionals and others on the front lines of the coronavirus pandemic.</text></paragraph></subsection><subsection id="H7039D8655F08466CB78BCD5441BED109"><enum>(b)</enum><header>Purpose</header><text>The purpose of this Act is to honor and commemorate the work of the coronavirus pandemic front-line responders.</text></subsection></section><section id="H14EEABEE9C0240919E58B6EDC53033EF"><enum>3.</enum><header>Coin specifications</header><subsection id="H8D8E51D3BEA24F84B26EF4BAF01DE1A4"><enum>(a)</enum><header>Denominations</header><text>The Secretary of the Treasury (hereafter in this Act referred to as the <quote>Secretary</quote>) shall mint and issue the following coins:</text><paragraph id="HC5DC6BDC51E245A697088E61943B6239"><enum>(1)</enum><header>$5 gold coins</header><text>Not more than 50,000 $5 coins, which shall—</text><subparagraph id="HF43B75795FE34D71A3ED88E7DDA213C7"><enum>(A)</enum><text>weigh 8.359 grams;</text></subparagraph><subparagraph id="H364E76AD9B914F15ADD8FAABE546CC73"><enum>(B)</enum><text>have a diameter of 0.850 inches; and</text></subparagraph><subparagraph id="H659C01A822884FD498477AF4260E71EB"><enum>(C)</enum><text>contain 90 percent gold and 10 percent alloy.</text></subparagraph></paragraph><paragraph id="H00CB0957A89848DDBD825B43BBE358C0"><enum>(2)</enum><header>$1 silver coins</header><text>Not more than 400,000 $1 coins, which shall—</text><subparagraph id="HAED71BA8D53C481F997F8B7FE7CD3971"><enum>(A)</enum><text>weigh 26.73 grams;</text></subparagraph><subparagraph id="H40C89B37C9FD4796B679FF3313F8CF50"><enum>(B)</enum><text>have a diameter of 1.500 inches; and</text></subparagraph><subparagraph id="H869AEE5E784F4539AE5B7833AC97E83C"><enum>(C)</enum><text>contain at least 90 percent silver.</text></subparagraph></paragraph><paragraph id="HB5964F83A4A94755B26378480BBE6141"><enum>(3)</enum><header>Half dollar clad coins</header><text>Not more than 300,000 half dollar coins, which shall—</text><subparagraph id="HDA14481CDDF94F139F178EDA90CD9348"><enum>(A)</enum><text>weigh 11.34 grams;</text></subparagraph><subparagraph id="HF6320AD1DC104D8A867F398C1E4EF8DD"><enum>(B)</enum><text>have a diameter of 1.205 inches; and</text></subparagraph><subparagraph id="HC9CDC3EF95294F328BA0E7DE08FB52F0"><enum>(C)</enum><text>be minted to the specifications for half dollar coins, contained in section 5112(b) of title 31, United States Code.</text></subparagraph></paragraph></subsection><subsection id="HBC57BE5DA4984C5DBDB43B1F50380478"><enum>(b)</enum><header>Legal tender</header><text>The coins minted under this Act shall be legal tender, as provided in section 5103 of title 31, United States Code.</text></subsection><subsection id="H40E92B8842BA44668E361E6D6A5A91F1"><enum>(c)</enum><header>Numismatic items</header><text>For purposes of sections 5134 and 5136 of title 31, United States Code, all coins minted under this Act shall be considered to be numismatic items.</text></subsection><subsection id="HB9A81CC34A514503A21C74636176DE4C"><enum>(d)</enum><header>Mintage limit exception</header><text display-inline="yes-display-inline">If the Secretary determines, based on independent market-based research conducted by the designated recipient organization identified in section 7(b), that the mintage levels described in subsections (a), (b), and (c) are not adequate to meet public demand, the Secretary may increase the mintage levels as the Secretary determines is necessary to meet public demand.</text></subsection></section><section id="HE50258F4780347C48ECB06076155047B"><enum>4.</enum><header>Designs of coins</header><subsection id="H5179D4C3DA6F4C63B6D03EC49364A7E5"><enum>(a)</enum><header>Design requirements</header><paragraph id="H71E6EE0C77FE43B48FD0D551ECDF360E"><enum>(1)</enum><header>In general</header><text>The designs of the coins minted under this Act shall be emblematic of the sacrifices made by health care workers and first responders during the coronavirus pandemic.</text></paragraph><paragraph id="H5E4F269952BB4A7DAC1C4C6B5D9D4647"><enum>(2)</enum><header>Designations and inscriptions</header><text>On each coin minted under this Act, there shall be—</text><subparagraph id="HC78F3DE0FE6C45378D3B9F9A489BD386"><enum>(A)</enum><text>a designation of the value of the coin;</text></subparagraph><subparagraph id="H64C413B9D03A4A6C9DE9EF91163CCBBC"><enum>(B)</enum><text>an inscription of the year <quote>2022</quote>; and</text></subparagraph><subparagraph id="H08B5432A839F4230AB5A3E6B884449DE"><enum>(C)</enum><text>inscriptions of the words <quote>Liberty</quote>, <quote>In God We Trust</quote>, <quote>United States of America</quote>, and <quote>E Pluribus Unum</quote>.</text></subparagraph></paragraph></subsection><subsection id="HCD8CE136BE174459AF8C95806503EA3D"><enum>(b)</enum><header>Selection</header><text>The designs for the coins minted under this Act shall—</text><paragraph id="H38470C61F3A74FDDBC7B38F3BE560140"><enum>(1)</enum><text>honor the sacrifices made by health care professionals, first responders, scientists, and researchers during the coronavirus pandemic;</text></paragraph><paragraph id="H1E62F9D95AC843909ECDD4BC7B20DAD1"><enum>(2)</enum><text>be selected by the Secretary, after consultation with the Secretary of Health and Human Services and the Commission of Fine Arts; and</text></paragraph><paragraph id="H08AE3A816D554D4DB01C5270C570C070"><enum>(3)</enum><text>be reviewed by the Citizens Coinage Advisory Committee.</text></paragraph></subsection></section><section id="HA09E65879FCA4D5A9ABCAB374F597DF8"><enum>5.</enum><header>Issuance of coins</header><subsection id="H7D86EB840E38419692D9C74F7A214F69"><enum>(a)</enum><header>Quality of coins</header><text>Coins minted under this Act shall be issued in uncirculated and proof qualities.</text></subsection><subsection id="HB7598F1912B04944A378C55FCAD9C01D"><enum>(b)</enum><header>Mint facilities</header><text>Only one facility of the United States Mint may be used to strike any particular quality of the coins minted under this Act.</text></subsection><subsection id="HAFEB0516F35649838EA4EE5732B62DB6"><enum>(c)</enum><header>Period for issuance</header><text>The Secretary may issue coins minted under this Act only during the 1-year period beginning on January 1, 2022.</text></subsection></section><section id="HD5E75766570C48AD9CFDA3161E5B0C3C"><enum>6.</enum><header>Sale of coins</header><subsection id="H14DBE35DD3414DCEA02431FA094A4BF7"><enum>(a)</enum><header>Sale price</header><text>The coins issued under this Act shall be sold by the Secretary at a price equal to the sum of—</text><paragraph id="H5AB09CCA7D154D4AAB6CE037003670D5"><enum>(1)</enum><text>the face value of the coins;</text></paragraph><paragraph id="HB3F0F464AF9C459EB1CDA8235B1B9F30"><enum>(2)</enum><text>the surcharge provided in section 7(a) with respect to such coins; and</text></paragraph><paragraph id="HBDBEBD7EEFD349AAAD42391244B135B4"><enum>(3)</enum><text>the cost of designing and issuing the coins (including labor, materials, dies, use of machinery, overhead expenses, marketing, and shipping).</text></paragraph></subsection><subsection id="H9B5B4C30627F41D1A5DB02C952A23156"><enum>(b)</enum><header>Bulk sales</header><text>The Secretary shall make bulk sales of the coins issued under this Act at a reasonable discount.</text></subsection><subsection id="HF76CFD50E4E2447D8B6E36CA5F799CA1"><enum>(c)</enum><header>Prepaid orders</header><paragraph id="H8917A0A1D7A34A60AEA5142353289077"><enum>(1)</enum><header>In general</header><text>The Secretary shall accept prepaid orders for the coins minted under this Act before the issuance of such coins.</text></paragraph><paragraph id="HFBB816E562CE4A128954601A59940ACE"><enum>(2)</enum><header>Discount</header><text>Sale prices with respect to prepaid orders under paragraph (1) shall be at a reasonable discount.</text></paragraph></subsection></section><section id="H5698CA09AC644754B537D356643FA34C"><enum>7.</enum><header>Surcharges</header><subsection id="H129597E5E02E469DA69D019EE0CD0647"><enum>(a)</enum><header>In general</header><text>All sales of coins minted under this Act shall include a surcharge as follows:</text><paragraph id="H7D022D2A2E414833BBCA4309C24A606B"><enum>(1)</enum><text>A surcharge of $35 per coin for the $5 coin.</text></paragraph><paragraph id="H6091AA56E11C4EAEB3CFE81FB6C2F6CC"><enum>(2)</enum><text>A surcharge of $10 per coin for the $1 coin.</text></paragraph><paragraph id="HDDEEA8C42BA64D97AD69016A8B839031"><enum>(3)</enum><text>A surcharge of $5 per coin for the half dollar coin.</text></paragraph></subsection><subsection id="H6C311C287A1940A795260E2FB7A54403"><enum>(b)</enum><header>Distribution</header><text>Subject to section 5134(f) of title 31, United States Code, all surcharges received by the Secretary from the sale of coins issued under this Act shall be promptly paid by the Secretary to the CDC Foundation to support the health care response to infectious diseases and pandemics.</text></subsection><subsection id="H706F8020DAE74C09B9642118888C179F"><enum>(c)</enum><header>Audits</header><text>The CDC Foundation shall be subject to the audit requirements of section 5134(f)(2) of title 31, United States Code, with regard to the amounts received under subsection (b).</text></subsection><subsection id="H9005B9A287CA4996BEACB559EBCD3CD9"><enum>(d)</enum><header>Limitation</header><text>Notwithstanding subsection (a), no surcharge may be included with respect to the issuance under this Act of any coin during a calendar year if, as of the time of such issuance, the issuance of such coin would result in the number of commemorative coin programs issued during such year to exceed the annual 2 commemorative coin program issuance limitation under section 5112(m)(1) of title 31, United States Code. The Secretary may issue guidance to carry out this subsection.</text></subsection></section><section id="H05428A00E98F4E88A401D59A2425DE07"><enum>8.</enum><header>Financial assurances</header><text display-inline="no-display-inline">The Secretary shall take such actions as may be necessary to ensure that—</text><paragraph id="H1181C0770EF64E23B5804D483B3E5B31"><enum>(1)</enum><text>minting and issuing coins under this Act will not result in any net cost to the United States Government; and</text></paragraph><paragraph id="HCD97602CBD204702905E86FCEE9BA622"><enum>(2)</enum><text>no funds, including applicable surcharges, shall be disbursed to any recipient designated in section 7 until the total cost of designing and issuing all of the coins authorized by this Act (including labor, materials, dies, use of machinery, overhead expenses, marketing, and shipping) is recovered by the United States Treasury, consistent with sections 5112(m) and 5134(f) of title 31, United States Code.</text></paragraph></section><section id="H1D228AF8847C48B4A809E3D746E9ACF0"><enum>9.</enum><header>Marketing and educational campaign</header><text display-inline="no-display-inline">The Secretary is encouraged to develop and execute a marketing and educational program, including appropriate cooperative marketing opportunities, to promote and sell the coins authorized in section 3. </text></section></legis-body></bill>
