<official-title display="yes">To amend the Public Health Service Act to authorize a program of death and hospitalization benefits for essential workers who die as a result of COVID–19 or related complications, and for other purposes.</official-title>

<section id="H8934BC3E90E3473C9B5A76D5D894F3A4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Essential Worker Pandemic Compensation Act of 2021</short-title></quote>.</text></section> <section id="HA97A7CF32F5A4E88B3B9B922ABEBB598"><enum>2.</enum><header>Pandemic Compensation Program</header><text display-inline="no-display-inline">Title II of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/43/202">43 U.S.C. 202</external-xref> et seq.) is amended by adding at the end the following new part:</text>

<part id="H066C785C5FCF4B028C4A03780E2C55F8"><enum>E</enum><header>Pandemic Compensation Program</header>
<section id="HF4C64B0FC6914BD49E0AF4168193C66C"><enum>275.</enum><header>Death and hospitalization benefits for essential workers</header>
<subsection id="H74A48F74046849E5BD86481BB10ECBD3"><enum>(a)</enum><header>In general</header><text>The Secretary shall carry out a compensation program under which the Secretary pays—</text> <paragraph id="H06A8FCB260CD477FB269F3BBB6D88E96"><enum>(1)</enum><text display-inline="yes-display-inline">death benefits in accordance with subsection (b) to the survivor or survivors in the same manner as death benefits are paid pursuant to the Public Safety Officers' Benefits Program under subpart 1 of part L of title I of the Omnibus Crime Control and Safe Streets Act of 1968 of each essential worker who dies as a result of COVID–19 or related complications; and</text></paragraph>
<paragraph id="H49E7D592DB0A4AB1B5CB67B1409C7139"><enum>(2)</enum><text display-inline="yes-display-inline">a hospitalization benefit in accordance with subsection (c) to each essential worker who is hospitalized, and does not die, as a result of COVID–19 or related complications.</text></paragraph></subsection> <subsection id="H5701B93D776440B588563A584DEC273A"><enum>(b)</enum><header>Death benefits</header> <paragraph id="H80BB77BEA48B4017A03589C3AB838391"><enum>(1)</enum><header>Base amount</header><text>The base amount of the death benefits paid with respect to an essential worker under subsection (a)(1) in a fiscal year shall be equal to the amount of the comparable benefit calculated under the Public Safety Officers' Benefits Program under subpart 1 of part L of title I of the Omnibus Crime Control and Safe Streets Act of 1968 in such fiscal year, without regard to any reduction attributable to a limitation on appropriations.</text></paragraph>
<paragraph id="H76DA5E383D3E4E4E932ECE8852550046"><enum>(2)</enum><header>Educational assistance to worker’s children and spouse</header>
<subparagraph id="H63E1272CD6A740F58282706BA558BAE6"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In addition to the base amount under paragraph (1), subject to subparagraphs (C) and (D), the death benefits paid with respect to an essential worker under subsection (a)(1) shall include payment of educational assistance—</text> <clause id="HC160CEF8429744C890710E1A6C119FB6"><enum>(i)</enum><text display-inline="yes-display-inline">to each child of the worker who, on or after the date of the worker’s death, is enrolled full-time or part-time at an institution of higher education; and</text></clause>
<clause id="H742CF90719B74EF0ACEAD3EB7B28E694"><enum>(ii)</enum><text display-inline="yes-display-inline">to the spouse of the worker who, on or after the date of the worker’s death, is so enrolled.</text></clause></subparagraph> <subparagraph id="H7F4D5172C61F4B2983685EE79825F94D"><enum>(B)</enum><header>Applicable provisions</header><text display-inline="yes-display-inline">The provisions of subpart 2 of part L of title I of the Omnibus Crime Control and Safe Streets Act of 1968 shall apply with respect to educational assistance provided by the Secretary to the child, children, or spouse of an essential worker under this paragraph to the same extent and in the same manner as such provisions apply with respect to educational assistance provided by the Attorney General to the child, children, or spouse of an eligible public safety worker.</text></subparagraph></paragraph></subsection>
<subsection id="H4D1B85261B174DE6AF49F03882949856"><enum>(c)</enum><header>Hospitalization benefit</header><text display-inline="yes-display-inline">The amount of the hospitalization benefit program paid with respect to an essential worker under subsection (a)(2) shall be half the base amount of the death benefit payable as described in subsection (b)(1).</text></subsection> <subsection id="H2C8902CF74AD41CA92E40ACFBC7588DF"><enum>(d)</enum><header>Treatment of benefits</header> <paragraph id="HA558C64F8AC64F56BE79E5E4CE1C559D"><enum>(1)</enum><header>Exclusion from gross income</header><text>For purposes of the Internal Revenue Code of 1986, gross income shall not include a payment under subsection (a).</text></paragraph>
<paragraph id="HDE2022CDDE6F41BB8EE803426B0C87C8"><enum>(2)</enum><header>No reduction because of payment from other source</header><text display-inline="yes-display-inline">The Secretary may not reduce a payment under subsection (a) on the basis of any amount paid, or obligated to be paid, pursuant to law or contract, from another source.</text></paragraph></subsection> <subsection id="H83AB451D6640490084C2C4E763E83B6F"><enum>(e)</enum><header>Administration</header> <paragraph id="HB07F30FA01F8471DA5C2F1B291626833"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, acting through a Special Master appointed by the Secretary, shall—</text>
<subparagraph id="HB72F8ECD6800427397D6190875B366A2"><enum>(A)</enum><text>administer the compensation program under this section;</text></subparagraph> <subparagraph id="H07F9EA23A51E495DB75BF39FBD9CD69A"><enum>(B)</enum><text>promulgate all procedural and substantive rules (which may be issued by regulation) for the administration of this section; and</text></subparagraph>
<subparagraph id="HDF8A8030EDA242B5BA79CE542BAC5E08"><enum>(C)</enum><text>employ and supervise hearing officers and other administrative personnel to perform the duties of the Special Master under this section.</text></subparagraph></paragraph> <paragraph id="H3DCFFC96AACC4D11B8F8434FA30A6434"><enum>(2)</enum><header>Determination of eligibility for compensation</header> <subparagraph id="H0083E286C88046DC9F20A9A6EB1E162C"><enum>(A)</enum><header>Filing of claim</header><text>A claimant may file a claim for compensation under this section with the Special Master. The claim—</text>
<clause id="HA2E31ACA0A2D435DBDDE440CADE8F73A"><enum>(i)</enum><text>shall be on the form developed under subparagraph (B); and</text></clause> <clause id="HF0B491BA6DF34084BCF2B3BE2C6301D0"><enum>(ii)</enum><text>shall state the factual basis for eligibility for compensation and the amount of compensation sought, including by demonstrating—</text>
<subclause id="H958A8F6986BB4237AC477054D250923A"><enum>(I)</enum><text>employment as an essential worker;</text></subclause> <subclause id="HDC088FCCC0D44F48B80D2C8BB8B98E04"><enum>(II)</enum><text>death or hospitalization as described in subsection (a); and</text></subclause>
<subclause id="HC700F7A817A045749F78D66258226A56"><enum>(III)</enum><text>the deceased or hospitalized essential worker became infected with SARS–CoV–2 during the period of employment as an essential worker.</text></subclause></clause></subparagraph> <subparagraph id="HC016DAE1637F4E47B3094A65A4B6FDF3"><enum>(B)</enum><header>Claim form</header><text>The Special Master shall develop a claim form that claimants shall use when submitting claims under subparagraph (A). The Special Master shall ensure that such form can be filed electronically, if determined to be practicable.</text></subparagraph>
<subparagraph id="HD86F4CE786C843CA8C4980A39BA6BD41"><enum>(C)</enum><header>Deadline</header><text display-inline="yes-display-inline">No claim for compensation under this section may be filed after July 1, 2022.</text></subparagraph></paragraph> <paragraph id="HD7D9B717BCBD4E4786BB0D89C01D8D71"><enum>(3)</enum><header>Appointment</header><text>The Secretary may appoint the Special Master without regard to the provisions of title 5, United States Code, governing appointments in the competitive service. Any such employee shall serve at the pleasure of the Secretary. The Secretary shall fix the annual salary of the Special Master.</text></paragraph></subsection>
<subsection id="HEEACD36E41E14A9DB9F74A268B85A697"><enum>(f)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> <paragraph id="H6FFEA75BC2F141B1AB0A35EB639C7B6C"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>child</term> has the meaning given to the term <term>child</term> in section 1204 of the Omnibus Crime Control and Safe Streets Act of 1968, except that the reference in section 1204(3) of such Act to <quote>a deceased or permanently and totally disabled public safety officer who, at the time of the public safety officer's fatal or catastrophic injury</quote> shall be treated as reference to <quote>a deceased or hospitalized essential worker who, at the time of the worker’s death or hospitalization</quote>.</text></paragraph>
<paragraph id="HFC6AB911F4534F3A9EDF259C870ABE69"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>essential worker</term> means—</text> <subparagraph id="H7DACDACCE5434E7CA51849A7BA356681"><enum>(A)</enum><text>a worker identified as an essential critical infrastructure worker in version 3.0 of the guidance titled <quote>Guidance on the Essential Critical Infrastructure Workforce: Ensuring Community and National Resilience in COVID–19 Response</quote> issued by the Department of Homeland Security on April 17, 2020; and</text></subparagraph>
<subparagraph id="HFC066600B6024E3684FDDE8C1BA1742F"><enum>(B)</enum><text>any other worker identified by the Special Master as an essential worker for purposes of this section.</text></subparagraph></paragraph> <paragraph id="H68B2401CB42743AEB1FEE18A7FF974B2"><enum>(3)</enum><text>The term <term>hospitalized</term> means furnished inpatient services (as defined in section 1861(b) of the Social Security Act).</text></paragraph>
<paragraph id="HB73E34A5AB574B82BA650DAF8D4F99DE"><enum>(4)</enum><text>The term <term>institution of higher education</term> has the meaning given to that term in section 102(a) of the Higher Education Act of 1965.</text></paragraph> <paragraph id="H3B691BA86B864E31BC88E23FB861A2E2"><enum>(5)</enum><text>The term <term>Special Master</term> means the Special Master appointed under subsection (e)(3).</text></paragraph>
<paragraph id="HB6227DA3C53F4EB48E9DA5A7758F4716"><enum>(6)</enum><text>The term <term>spouse of the worker</term> means the spouse of the essential worker on the date of the worker’s death.</text></paragraph></subsection> <subsection id="H91B4DD0B165A49C99602D10727FE8B60"><enum>(g)</enum><header>Funding</header> <paragraph id="HEA19A7A9408C472895CBAF7F98B69C5A"><enum>(1)</enum><header>Appropriations for benefits</header><text>There are appropriated, out of monies in the Treasury not otherwise obligated, such sums as may be necessary to pay all death and hospitalization benefits under subsection (a) that are sought by claimants who qualify for such benefits and apply in accordance with this section.</text></paragraph>
<paragraph id="H354B8EF290E7404299448C04473FB52A"><enum>(2)</enum><header>Authorization of appropriations for administrative expenses</header><text>There are authorized to be appropriated such sums as may be necessary to pay the administrative costs of the Secretary and the Special Master in carrying out this section.</text></paragraph></subsection> <subsection id="HB14E2D04D47C4945A5BE5F303AE2BE57"><enum>(h)</enum><header>Sunset date</header><text>At the end of calendar year 2022, the Secretary shall terminate the program under this section except to the extent necessary to carry out the scholarship program under subsection (b)(2).</text></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block></section>
