which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name>, and in addition to the Committee on <committee-name committee-id="HAG00">Agriculture</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish deadlines for the Secretary of the Interior and the Secretary of Agriculture to complete certain environmental reviews, to establish notification rules for receipt of onshore right-of-way applications, and for other purposes.</official-title></form><legis-body id="H0C9327CC31B44C36A5F145C819CAF282" style="OLC"><section id="HBFEF251564844714941F9CB3151C1A2A" section-type="section-one"><enum>1.</enum><header>National Environmental Policy Act review deadlines</header><subsection id="H7A4CB582C08442BB8E8645D40C46DA63"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to major Federal actions carried out by the Secretary of the Interior or the Secretary of Agriculture, the Secretary concerned shall complete—</text><paragraph id="H9E15FC6548E0435BAD525EAC8F06670D"><enum>(1)</enum><text display-inline="yes-display-inline">any environmental assessment required under section 102(2)(C) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)(C)</external-xref>) relating to the major Federal action by not later than 1 year after the sooner of, as applicable—</text><subparagraph id="H8BC7D26A3BB944B69DA0BC29C9B4CF86"><enum>(A)</enum><text>the date on which the Secretary concerned notifies the applicant under section 2 that the application to establish a right-of-way for the major Federal action is complete; and</text></subparagraph><subparagraph id="H4575FA6D7A104F58891B8A7F60EC807A"><enum>(B)</enum><text>the date on which the Secretary concerned begins the scoping for the major Federal action; and</text></subparagraph></paragraph><paragraph id="HE1F62A8447BD460BB134E6E416E622DE"><enum>(2)</enum><text>any environmental impact statement required section 102(2)(C) of the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4332">42 U.S.C. 4332(2)(C)</external-xref>) relating to the major Federal action by not later than 2 years after the sooner of, as applicable—</text><subparagraph id="H632ACF619119453794F8451D4EEA0228"><enum>(A)</enum><text>the date on which the Secretary concerned notifies the applicant under section 2 that the application to establish a right-of-way for the major Federal action is complete; and</text></subparagraph><subparagraph id="H92DC06929B22476E86FFB82736ED30F7"><enum>(B)</enum><text>the date on which the Secretary concerned issues a notice of intent to prepare the environmental impact statement for the major Federal action.</text></subparagraph></paragraph></subsection><subsection id="H3F3E5AC466B642209CFEC3C370D491FD"><enum>(b)</enum><header>Extension</header><text display-inline="yes-display-inline">The Secretary concerned may extend a deadline described in subsection (a) with the approval of the applicant.</text></subsection><subsection id="H6C8877E66612476DA06A25220E6413E0"><enum>(c)</enum><header>Report</header><paragraph id="HF021D911BEDA424EAB1DC9B4B1612580"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary concerned shall each annually submit to the Committee on Natural Resources of the House of Representatives and the Committee on Energy and Natural Resources of the Senate a report that—</text><subparagraph id="H34FAB43162184529A79F949F8C6AF253"><enum>(A)</enum><text>identifies any environmental assessment and environmental impact statement that is not completed by the appropriate deadline described in subsection (a) or the deadline extended under subsection (b), as applicable; and</text></subparagraph><subparagraph id="H75FD191887FE4CD783C172C6B2C2F954"><enum>(B)</enum><text>provides an explanation for any failure to meet such deadline.</text></subparagraph></paragraph><paragraph id="HC4082FABB25C464C9D835C8FBC018D31"><enum>(2)</enum><header>Inclusions</header><text display-inline="yes-display-inline">Each report submitted under paragraph (1) shall identify—</text><subparagraph id="H1A0689A833DC4D0D8FDE9712CE13FAA5"><enum>(A)</enum><text>the respective field office, ranger district, or region office, as applicable, responsible for each such environmental assessment and environmental impact statement;</text></subparagraph><subparagraph id="HA59C0D1271264D8CACAAC9DF8CCE7F31"><enum>(B)</enum><text>as applicable, the date on which—</text><clause id="HE36046BCD0014B0B902D5E81791629C9"><enum>(i)</enum><text>the Secretary concerned notifies the applicant under section 2 that the application to establish a right-of-way for the major Federal action is complete;</text></clause><clause id="HA2012BCD64824F84B6134BCF11C4DF69"><enum>(ii)</enum><text>the Secretary concerned begins the scoping for the major Federal action; or</text></clause><clause id="HCE50ECB0D9414F7585DD60918FD2B613"><enum>(iii)</enum><text>the Secretary concerned issues a notice of intent to prepare the environmental impact statement for the major Federal action; and</text></clause></subparagraph><subparagraph id="HC3563D59837A4E5482AD48721C3F95A6"><enum>(C)</enum><text>when such environmental assessment and environmental impact statement is expected to be complete.</text></subparagraph></paragraph></subsection></section><section id="H2D6C09296FC642958AEF87A9E6E7D43E"><enum>2.</enum><header>Determination regarding right-of-way</header><text display-inline="no-display-inline">Not later than 60 days after the Secretary concerned receives an application to establish a right-of-way, the Secretary concerned shall notify the applicant as to whether the application is complete or deficient. If the Secretary concerned determines the application is complete, the Secretary concerned may not consider any other application to establish a right-of-way on the same or any overlapping parcels of land while such application is pending.</text></section><section id="H7FD1F02FA0CC46ADB3DDE9F29C37ADA5"><enum>3.</enum><header>Terms of rights-of-way</header><subsection id="HBD7748560EF947B09694E70D5C88BB77"><enum>(a)</enum><header>Federal land policy and management act of 1976</header><text display-inline="yes-display-inline">Section 501 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1761">43 U.S.C. 1761</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H8934262AF02D40EB8100613B90056798" display-inline="no-display-inline"><subsection id="H2B0ACEF77411427984FF571AF8AC2F65"><enum>(e)</enum><text display-inline="yes-display-inline">Any right-of-way granted, issued, amended, or renewed under subsection (a)(4) may be limited to a term of not more than 50 years before such right-of-way is subject to renewal or amendment.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H111E29C5BE194135AA2858F5975738E9"><enum>(b)</enum><header>Mineral Leasing Act</header><text display-inline="yes-display-inline">Section 28(n) of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/185">30 U.S.C. 185(n)</external-xref>) is amended by striking <quote>thirty</quote> and inserting <quote>50</quote>.</text></subsection></section><section id="H002FE2ECE20D45459331D822596F2AAB"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H325F5D64A6F2464F9FD4362129CCF548"><enum>(1)</enum><header>Right-of-way</header><text display-inline="yes-display-inline">The term <term>right-of-way</term> means—</text><subparagraph id="HD9B563BBE89C430286D6F8EB4248FD32"><enum>(A)</enum><text>a right-of-way issued, granted, or renewed under section 501 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1761">43 U.S.C. 1761</external-xref>); or</text></subparagraph><subparagraph id="H80834E4244B447B78F40DF1175D26FBA"><enum>(B)</enum><text>a right-of-way granted under section 28 of the Mineral Leasing Act (<external-xref legal-doc="usc" parsable-cite="usc/30/185">30 U.S.C. 185</external-xref>).</text></subparagraph></paragraph><paragraph id="H5706AA19D53C4A3D8FC91DB1A11A8491"><enum>(2)</enum><header>Secretary concerned</header><text display-inline="yes-display-inline">The term <term>Secretary concerned</term> means—</text><subparagraph id="H6BECB270E2B346E2B28BED27CF64EDBF"><enum>(A)</enum><text>with respect to public lands, the Secretary of the Interior; and</text></subparagraph><subparagraph id="H406BA1A4833F4E258DC85EB1E59BD822"><enum>(B)</enum><text>with respect to National Forest System Lands, the Secretary of Agriculture.</text></subparagraph></paragraph></section></legis-body></bill>
