which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Immigration and Nationality Act to facilitate the removal of aliens identified in the terrorist screening database, and for other purposes.</official-title></form><legis-body id="H37A316658D5049DD999C88C4BE09BBA8" style="OLC"><section id="HB910A69C49A547249307771E4C9C2635" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Terrorist Deportation Act of 2021</short-title></quote>.</text></section><section id="HB8170DB803A74B679F9F135DDFFBD226" section-type="subsequent-section"><enum>2.</enum><header>Inadmissibility of aliens identified in terrorist screening database</header><text display-inline="no-display-inline">Section 212(a)(3)(B)(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(3)(B)(i)</external-xref>) is amended—</text><paragraph id="H367A2075A90344A4AAB0E6E75B114D29"><enum>(1)</enum><text>in subclause (VIII), by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="HFE096FFBD42344389BCF731E1D85B082"><enum>(2)</enum><text>by redesignating subclause (IX) as subclause (X); and</text></paragraph><paragraph id="H8019E1D71E9C437A87CE08C72A62A58C"><enum>(3)</enum><text>by inserting after subclause (VIII) the following:</text><quoted-block display-inline="no-display-inline" id="H29E122A20BDE4E6B9C2D5EAA8D7CE1B7" style="OLC"><subclause id="HEC2DFEF3A1CD43A982FCCF15B1B6815E"><enum>(IX)</enum><text display-inline="yes-display-inline">is identified in the terrorist screening database (as such term is defined in section 2101(10) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/621">6 U.S.C. 621(10)</external-xref>)), except for an alien lawfully admitted for permanent residence (as defined in section 101(a)(20)); or</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H73523B1989864474ACB85D77AC81587A"><enum>3.</enum><header>Deportability of aliens identified in terrorist screening database</header><text display-inline="no-display-inline">Section 237(a)(4)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(4)(B)</external-xref>) is amended by inserting before the period at the end the following <quote>, except that an alien lawfully admitted for permanent residence (as defined in section 101(a)(20)) is not deportable for being described in subparagraph (B)(i)(IX) of section 212(a)(3)</quote>.</text></section><section id="HF3D598B2906D459F843F6FC538C222A9"><enum>4.</enum><header>Waivers of ground of inadmissibility for aliens identified in terrorist screening database</header><text display-inline="no-display-inline">Section 212(d)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(d)(3)</external-xref>) is amended—</text><paragraph id="H883FDCDE978A4A17A2DFE67581F2F9B6"><enum>(1)</enum><text>in each of clauses (i) and (ii) of subparagraph (A), by inserting <quote>and other than paragraph (3)(B)(i)(IX) of such subsection except as provided in subparagraph (C)</quote> after <quote>of such subsection</quote>;</text></paragraph><paragraph id="H8B28271A527C4632A20B57980E082DFF"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (B)(i), by inserting <quote>or who is within the scope of subsection (a)(3)(B)(i)(IX) except as provided in subparagraph (C),</quote> after <quote>(a)(3)(B)(i)(II),</quote>; and</text></paragraph><paragraph id="HA3742681A23445FE91B5AB03F5A278EF"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H9F0630A640C849FDAEAF41DFD0060AD4" style="traditional"><subparagraph id="H693A9F4825EF4DA68D8391E1768C569E" indent="up2"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="H21411460B4CF46689FC7A1C911326847"><enum>(i)</enum><text display-inline="yes-display-inline">Subject to clause (ii) and only on an individual case-by-case basis, if the Secretary of Homeland Security determines in the Secretary’s unreviewable discretion that it is in the national security interests of the United States, an alien—</text><subclause id="HB75B5B4D26B94677A54E164FF737AA64" indent="up1"><enum>(I)</enum><text display-inline="yes-display-inline">may be granted a nonimmigrant visa and be admitted into the United States temporarily as a nonimmigrant under subparagraph (A)(i);</text></subclause><subclause id="HA7323777ACD94EC4983676C0D06E7AE0" indent="up1"><enum>(II)</enum><text>may be admitted into the United States temporarily as a nonimmigrant under subparagraph (A)(ii); and</text></subclause><subclause id="HA5E6BFEFCEC94758B8957FCEB179FB35" indent="up1"><enum>(III)</enum><text>shall not be subject to subsection (a)(3)(B)(i)(IX).</text></subclause></clause><clause id="H2E40294924E34CD583849A1CC297FD36" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">The Secretary of Homeland Security may grant a waiver under clause (i) with respect to an alien only with the unanimous concurrence of the Attorney General, the Director of the Federal Bureau of Investigation, the Director of National Intelligence, and the Secretary of State.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HD68C41DE61784646B6EFE16D184475FA"><enum>5.</enum><header>Unavailability of certain immigration benefits to aliens identified in terrorist screening database</header><subsection id="H0D1FAA91DF7E4F08B3B07BBCE82E2E05"><enum>(a)</enum><header>Asylum</header><text display-inline="yes-display-inline">Section 208(b)(2)(A)(v) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158(b)(2)(A)(v)</external-xref>) is amended by striking <quote>or (VI)</quote> and inserting <quote>(VI), or (IX)</quote>.</text></subsection><subsection commented="no" id="HE14ACBFE73324420960105573010BE1B"><enum>(b)</enum><header>Withholding of removal</header><text display-inline="yes-display-inline">Section 241(b)(3)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1231">8 U.S.C. 1231(b)(3)(B)</external-xref>) is amended, in the matter preceding clause (i), by inserting <quote>inadmissible under section 212(a)(3)(B)(i)(IX) or deportable under section 237(a)(4)(B) as a consequence of being described in section 212(a)(3)(B)(i)(IX), or</quote> after <quote>does not apply to an alien</quote>.</text></subsection><subsection id="H8C90BD23F56F42FE9C9C73B5CB6B1670"><enum>(c)</enum><header>Cancellation of removal</header><paragraph id="H6B86889C1E774EB9A8CF44D9F9BEB06B"><enum>(1)</enum><header>Cancellation of removal for certain permanent residents</header><text display-inline="yes-display-inline">Section 240A(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229b">8 U.S.C. 1229b(a)</external-xref>) is amended, in the matter preceding paragraph (1), by striking <quote>inadmissible or deportable</quote> and inserting <quote>inadmissible (except an alien who is inadmissible under section 212(a)(3)(B)(i)(IX)) or deportable (except an alien who is deportable under section 237(a)(4)(B) as a consequence of being described in section 212(a)(3)(B)(i)(IX))</quote>.</text></paragraph><paragraph id="H68F1BB3388C44D919FDC5500A853020E"><enum>(2)</enum><header>Cancellation of removal for certain nonpermanent residents</header><text display-inline="yes-display-inline">Section 240A(b)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229b">8 U.S.C. 1229b(b)(1)</external-xref>) is amended, in the matter preceding subparagraph (A), by striking <quote>inadmissible or deportable</quote> and inserting <quote>inadmissible (except an alien who is inadmissible under section 212(a)(3)(B)(i)(IX)) or deportable (except an alien who is deportable under section 237(a)(4)(B) as a consequence of being described in section 212(a)(3)(B)(i)(IX))</quote>.</text></paragraph></subsection><subsection id="H5DFC0EFB35404932942F0B5C785DEA67"><enum>(d)</enum><header>Voluntary departure</header><text display-inline="yes-display-inline">Section 240B(c) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229c">8 U.S.C. 1229c(c)</external-xref>) is amended to read as follows:</text><quoted-block display-inline="no-display-inline" id="HD2D8AFA368B4475C8DE48ECF793E304B" style="OLC"><subsection id="H1ABDF7E4FCC1472BBC3EAC9043C3C390"><enum>(c)</enum><header>Aliens ineligible</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall not permit an alien to depart voluntarily under this section if the alien—</text><paragraph id="H9970356160234A9FA8FEC48AB5F44568"><enum>(1)</enum><text display-inline="yes-display-inline">was previously permitted to so depart after having been found inadmissible under section 212(a)(6)(A); or</text></paragraph><paragraph id="H7915F32A50F14BCCBF5F578483124934"><enum>(2)</enum><text display-inline="yes-display-inline">is inadmissible under section 212(a)(3)(B)(i)(IX) or deportable under section 237(a)(4)(B) as a consequence of being described in section 212(a)(3)(B)(i)(IX).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HFD7EE29BB4114D44BF2D34599FDAA9A8"><enum>(e)</enum><header>Adjustment of status</header><text>Section 245 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255</external-xref>) is amended—</text><paragraph id="HCEAA25B7BB924FDFA09F1B63F17BF943"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c), by striking item (6) and inserting <quote>(6) an alien who is inadmissible under section 212(a)(3)(B)(i)(IX) or deportable under section 237(a)(4)(B);</quote>; and</text></paragraph><paragraph id="H6627196A94D54C6BBD3C87D4373325CC"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (m)(1), in the matter preceding subparagraph (A), by striking <quote>212(a)(3)(E),</quote> and inserting <quote>subparagraph (B)(i)(IX) or (E) of section 212(a)(3) or section 237(a)(4)(B) as a consequence of being described in section 212(a)(3)(B)(i)(IX),</quote>.</text></paragraph></subsection><subsection id="HF78E8C359CBE45118B8E72793E8ED9A5"><enum>(f)</enum><header>Registry</header><text display-inline="yes-display-inline">Section 249 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1259">8 U.S.C. 1259</external-xref>) is amended—</text><paragraph id="H1138C9F525914359B5A6160B20E08E55"><enum>(1)</enum><text>by striking <quote>Attorney General</quote> each place such term appears and inserting <quote>Secretary of Homeland Security</quote>; and</text></paragraph><paragraph id="H0077E86581654F44830FAEDCFC917802"><enum>(2)</enum><text>by striking <quote>inadmissible under section 212(a)(3)(E) or under</quote> and inserting <quote>inadmissible under section 212(a)(3)(B)(i)(IX) or (E) or deportable from the United States under section 237(a)(4)(B) as a consequence of being described in section 212(a)(3)(B)(i)(IX) or under</quote>.</text></paragraph></subsection><subsection id="HBB31D437ECEF46CFA1BD94B44AA6815E"><enum>(g)</enum><header>Convention Against Torture</header><text display-inline="yes-display-inline">Not later than 120 days after the date of the enactment of this Act, the Secretary of Homeland Security shall revise the regulations found at sections 208.16 through 208.18 of title 8, Code of Federal Regulations, implementing the United Nations Convention Against Torture and Other Forms of Cruel, Inhuman or Degrading Treatment or Punishment, done at New York on December 10, 1984. The revised regulations—</text><paragraph id="HE503E26D43BC48E4BE56EED3054B3593"><enum>(1)</enum><text>shall exclude from the protection of such regulations aliens described in section 212(a)(3)(B)(i)(IX) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(3)(B)(i)(IX)</external-xref>) and make such aliens ineligible for withholding or deferral of removal under the immigration laws (as defined in section 101(a)(17) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(17)</external-xref>)); and</text></paragraph><paragraph id="HDE8EDB4572FF498A8F4AB4781DF8574C"><enum>(2)</enum><text>shall ensure that the revised regulations operate so as to allow for the reopening and readjudication of determinations made under the regulations before the effective date of the revision and apply to acts and conditions constituting grounds of ineligibility for the protection of such regulations (including ineligibility for withholding or deferral of removal) as revised, regardless of when such acts or conditions occurred.</text></paragraph></subsection></section><section id="HB97E6F50F10647B6BC3CBC951ED0EDC6"><enum>6.</enum><header>Expedited removal of aliens inadmissible or deportable on security and related grounds</header><text display-inline="no-display-inline">Section 238 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1228">8 U.S.C. 1228</external-xref>) is amended—</text><paragraph commented="no" id="HE8AB5757913F40C8835FB44B3A6D370A"><enum>(1)</enum><text>in the section heading, by adding at the end the following: <quote><header-in-text level="section" style="traditional">or inadmissible or deportable on security or related grounds</header-in-text></quote>;</text></paragraph><paragraph id="HE76EE68529B14AC4988AEAEA90E5E365"><enum>(2)</enum><text>by redesignating the subsections succeeding subsection (b) as subsections (d) and (e), respectively; and</text></paragraph><paragraph id="H5DF4B1F8002644A99331E2369F6F7391"><enum>(3)</enum><text>by inserting after subsection (b) the following:</text><quoted-block display-inline="no-display-inline" id="HDAC2C3CA375F4BAAA4EA7EEE9287DB10" style="OLC"><subsection id="H64D02AD5D4B14510A87BBC331E1BA521"><enum>(c)</enum><header>Removal of aliens who are not permanent residents and who are inadmissible or deportable on security or related grounds</header><paragraph id="H0E4BF684A3404F3897AC148EA5428367"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Homeland Security, in accordance with paragraph (3)—</text><subparagraph id="H28ED89C48B82452CAFCEA46AF07150C2"><enum>(A)</enum><text display-inline="yes-display-inline">notwithstanding section 240, in the case of every alien described in paragraph (2), shall determine the inadmissibility of such alien under section 212(a)(3)(B)(i)(IX) or the deportability of such alien under section 237(a)(4)(B) as a consequence of being described in section 212(a)(3)(B)(i)(IX) and issue an order of removal pursuant to the procedures set forth in this subsection to every such alien determined to be inadmissible under section 212(a)(3)(B)(i)(IX) or deportable under section 237(a)(4)(B) as a consequence of being described in section 212(a)(3)(B)(i)(IX); and</text></subparagraph><subparagraph id="HB5BA1763DE074DD2A92FAC7F7E9D0476"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of an alien described in paragraph (2) who is not issued an order under subparagraph (A), may determine the inadmissibility of such alien under section 212(a)(3)(B) (other than subparagraph (B)(i)(IX)) or the deportability of such alien under section 237(a)(4)(B) (other than as a consequence of being described in section 212(a)(3)(B)(i)(IX)) and issue an order of removal pursuant to the procedures set forth in this subsection or section 240.</text></subparagraph></paragraph><paragraph id="H41AB9193DDB84DB69E2C88060A48A16D"><enum>(2)</enum><header>Aliens described</header><text display-inline="yes-display-inline">An alien is described in this paragraph if—</text><subparagraph id="HAF4AD250C1074A78A1B45AF16E07661A"><enum>(A)</enum><text>the alien has not been granted a waiver under section 212(d)(3)(C); and</text></subparagraph><subparagraph id="HF39CCB8948FB4236BDCAC47FFFC7850D"><enum>(B)</enum><text>the alien—</text><clause id="H6441668D84F34E3A90F8FAFB92371FDA"><enum>(i)</enum><text>was not lawfully admitted for permanent residence at the time at which proceedings under this subsection commenced; or</text></clause><clause id="H1165A91081CD41C3B9021641DEB45265"><enum>(ii)</enum><text>had permanent resident status on a conditional basis (as described in section 216) at the time that proceedings under this subsection commenced.</text></clause></subparagraph></paragraph><paragraph id="HF055DA1AEBE14A268B6DEF038BCCD0DC"><enum>(3)</enum><header>Expedited proceedings</header><text display-inline="yes-display-inline">Proceedings under this subsection shall be in accordance with such regulations as the Secretary of Homeland Security shall prescribe. The Secretary shall ensure that—</text><subparagraph id="H73EA3A3DF7574968A4AE6E9CCBC7D030"><enum>(A)</enum><text>the alien is given reasonable notice of the charges and of the opportunity described in subparagraph (C);</text></subparagraph><subparagraph id="H9159B9886012459F85C0407EF93E5312"><enum>(B)</enum><text>the alien shall have the privilege of being represented (at no expense to the government) by such counsel, authorized to practice in such proceedings, as the alien shall choose;</text></subparagraph><subparagraph id="HED0BC93C208441379F599F62806F677F"><enum>(C)</enum><text>the alien has a reasonable opportunity to inspect the evidence and rebut the charges;</text></subparagraph><subparagraph id="H2D1FA164323F4EA9B12FCFE35E5A4512"><enum>(D)</enum><text display-inline="yes-display-inline">a determination is made for the record that the individual upon whom the notice for the proceeding under this section is served (either in person or by mail) is, in fact, the alien named in such notice;</text></subparagraph><subparagraph id="H913BE7224DFE44FF9BB42ED1FECA831C"><enum>(E)</enum><text>a record is maintained for judicial review; and</text></subparagraph><subparagraph id="HB7DFAC8595D44F23B26B41419CDD99B7"><enum>(F)</enum><text>the final order of removal is not adjudicated by the same person who issues the charges.</text></subparagraph></paragraph><paragraph id="HE6E9371789A44BCB885980D4D02BE5A8"><enum>(4)</enum><header>Judicial review</header><text display-inline="yes-display-inline">The Secretary of Homeland Security may not execute any order described in paragraph (1) until 14 calendar days have passed from the date that such order was issued, unless waived by the alien, in order that the alien has an opportunity to apply for judicial review under section 242.</text></paragraph><paragraph id="HC938DF8E0ED145CDA2FEBE8065FA8BC4"><enum>(5)</enum><header>Ineligibility for discretionary relief from removal</header><text display-inline="yes-display-inline">No alien adjudicated inadmissible or deportable in a proceeding under this subsection shall be eligible for any relief from removal that the Secretary of Homeland Security may grant in the Secretary’s discretion.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HE7ABA88D221349448A4C4FD7A5E17E14"><enum>7.</enum><header>Effective date; applicability</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall take effect on the date of the enactment of this Act and shall apply to all aliens identified in the terrorist screening database (as such term is defined in section 2101(10) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/621">6 U.S.C. 621(10)</external-xref>)) on or after such date.</text></section></legis-body></bill>
