<enactingFormula style="-uslm-lc:I650120">  Be it enacted by the Senate and House of Representa­tives of the United States of America in Congress assembled,</enactingFormula>
<section id="d26052e62" identifier="/us/bill/117/hr/8982/s1" style="-uslm-lc:I650146"><num value="1">SECTION 1. </num><heading>SHORT TITLE.</heading><content style="-uslm-lc:I650120">  This Act may be cited as the “<shortTitle role="act">Bulk Infant Formula to Retail Shelves Act</shortTitle>”.</content></section>
<section id="d26052e72" identifier="/us/bill/117/hr/8982/s2" style="-uslm-lc:I650141"><num value="2">SEC. 2. </num><heading>TEMPORARY DUTY SUSPENSIONS FOR INFANT FORMULA BASE POWDER.</heading><subsection class="indentUp0 firstIndent1 fontsize10" id="d26052e76" identifier="/us/bill/117/hr/8982/s2/a" role="instruction" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="a">(a) </num><heading><inline class="smallCaps">In General</inline>.—</heading><content>Subchapter III of chapter 99 of the Harmonized Tariff Schedule of the United States (in the section referred to as the “HTS”) <amendingAction type="amend">is amended</amendingAction> by <amendingAction type="insert">inserting</amendingAction> the following new subheading in numerical sequence:<?GPOvSpace 04?>

</xhtml:tbody></xhtml:table></quotedContent><?GPOvSpace 04?></content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d26052e151" identifier="/us/bill/117/hr/8982/s2/b" role="instruction" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="b">(b) </num><heading><inline class="smallCaps">Definition and Applicability</inline>.—</heading><content>The U.S. Notes to subchapter III of chapter 99 of the HTS are amended by <amendingAction type="add">adding</amendingAction> at the end following:<quotedContent><p class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122">  “21.(a) For purposes of subheading 9903.19.23, the term ‘<term>infant formula base powder</term>’ means a dry mixture of protein, fat, and carbohydrates that requires only the addition of vitamins and minerals in order to meet the definition of the term ‘<term>infant formula</term>’ in section 201(z) of the Federal Food, Drug, and Cosmetic Act (<ref href="/us/usc/t21/s321/z">21 U.S.C. 321(z)</ref>).</p><subsection class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="b">“(b) </num><content>The necessary proof that an import is a qualifying infant formula base powder under subheading 9903.19.23 shall be established by a written notice from the Food and Drug Administration that the base powder shipment qualifies for importation under such subheading.</content></subsection><subsection class="indentUp1 firstIndent1 fontsize10" style="-uslm-lc:I650122"><num style="-uslm-lc:emspace2" value="c">“(c) </num><content>The duty-free treatment of infant formula base powder set forth in subheading 9903.19.23 shall apply only with respect to the importation of an aggregate quantity not exceeding 2,600 metric tons of such infant formula base powder.”</content></subsection></quotedContent>.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d26052e178" identifier="/us/bill/117/hr/8982/s2/c" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="c">(c) </num><heading><inline class="smallCaps">Effective Date</inline>.—</heading><content>The amendments made by subsections (a) and (b) shall apply with respect to goods entered, or withdrawn from warehouse for consumption, during the period beginning on the third day after the date of enactment of this Act and ending at the close of December 31, 2022.</content></subsection><subsection class="indentUp0 firstIndent1 fontsize10" id="d26052e186" identifier="/us/bill/117/hr/8982/s2/d" style="-uslm-lc:I650120"><num style="-uslm-lc:emspace2" value="d">(d) </num><heading><inline class="smallCaps">Waiver of Other Duties or Safeguards</inline>.—</heading><content> Notwithstanding any other provision of law, during the period described in subsection (c), articles of infant formula base powder that are classifiable under subheading 9903.19.23 of the HTS, as added by the amendment made by subsection (a), shall not be subject to any additional safeguard duties that may be imposed under subchapter IV of chapter 99 of the HTS.</content></subsection></section>
