which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend part B of title IV of the Social Security Act to require States to comply with Federal standards established under the Indian Child Welfare Act of 1978.</official-title></form><legis-body id="HD94D754DD88047A3AB12802CEA1694BF" style="OLC"><section id="HE3AE315203BE4EAAA59CEEAA444D07F4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strengthening Tribal Families Act of 2022</short-title></quote>.</text></section><section id="H4EF1AAAAE2504577BF0D960365C42017"><enum>2.</enum><header>State plan requirements</header><subsection id="HD3684E5E0ED24F38875C60B51BDE1742"><enum>(a)</enum><header>State plan requirement relating to child welfare services</header><text display-inline="yes-display-inline">Section 422(b)(9) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/622">42 U.S.C. 622(b)(9)</external-xref>) is amended—</text><paragraph id="H158690BD0A8F4FCD9688BD1675598B5E"><enum>(1)</enum><text>by inserting <quote>(A)</quote> after <quote>(9)</quote>;</text></paragraph><paragraph id="HCFB186D7182D41E4844601B024CA33D6"><enum>(2)</enum><text>by striking <quote>Act;</quote> and inserting <quote>Act of 1978; and</quote>; and</text></paragraph><paragraph id="H4B58B77034524DD79B1556359B94DEE6"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H7BA76DA310834635B800DEB81A49480E" display-inline="no-display-inline"><subparagraph id="HA50669806A764D14A24387B6A3644BBA" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">provide that the State shall comply with all Federal standards established under the Indian Child Welfare Act of 1978;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HED7EC7945B0B4A4C8F5DD6F7628EE361"><enum>(b)</enum><header>State plan requirement relating to promoting safe and stable families</header><text display-inline="yes-display-inline">Section 432(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/629b">42 U.S.C. 629b(a)</external-xref>) is amended—</text><paragraph id="H4A9AA55F7334422886191C9B67A65F95"><enum>(1)</enum><text>in paragraph (9), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H0279D4FE3F474891A5BFB99F87779F3D"><enum>(2)</enum><text>in paragraph (10), by striking the period and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H66CFF3A7142047539ECA10BDAFD13E40"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H9F21116D36A84D5BA2525F4BF3EF5666" display-inline="no-display-inline"><paragraph id="HD443DC34469A4298958E13E787D3F73B"><enum>(11)</enum><text display-inline="yes-display-inline">provides that the State shall comply with all Federal standards established under the Indian Child Welfare Act of 1978.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H25A4EB065F5F40AABD04D96EA4781C2C"><enum>(c)</enum><header>Biennial reports to the Congress</header><text>Section 422 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/622">42 U.S.C. 622</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H27211536A1D3481C8539B388BBEFB772" display-inline="no-display-inline"><subsection id="H7CD31AA9C64D426FB0650D4F5380FC10"><enum>(d)</enum><header>Biennial reports to the Congress</header><text display-inline="yes-display-inline">The Secretary shall biennially submit to the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate a written report on the reviews of child and family service programs under section 1123A, which shall include a detailed summary of the ways in which States are addressing the requirement in subsection (b)(9)(B) of this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H1454EE8B34364C15860F8550C1392228"><enum>3.</enum><header>Effective date</header><subsection id="H5E06A6D66C574F23800B55FAF370124A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided in subsection (b), the amendments made by this Act shall take effect on the 1st day of the 1st calendar quarter that begins on or after the date of enactment of this Act.</text></subsection><subsection id="H3190F68C423C442A8E1C8DB1E0072978"><enum>(b)</enum><header>Delay permitted if state legislation required</header><text display-inline="yes-display-inline">If the Secretary of Health and Human Services determines that State legislation (other than legislation appropriating funds) is required in order for a State plan developed pursuant to part B of title IV of the Social Security Act to meet the additional requirements imposed by the amendments made by this Act, the plan shall not be regarded as failing to meet any of the additional requirements before the 1st day of the 1st calendar quarter beginning after the first regular session of the State legislature that begins after the date of the enactment of this Act. For purposes of the preceding sentence, if the State has a 2-year legislative session, each year of the session is deemed to be a separate regular session of the State legislature.</text></subsection></section></legis-body></bill>
