which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To give the Secretary of Homeland Security the authority to contain migration surges, and for other purposes.</official-title></form><legis-body id="H106DAFE760074493955623C9D87142EA" style="OLC"><section id="H4344A065C2214C5D837D6AAAAFE747C8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Justified Action for Securing Our Nation Act</short-title></quote> or the <quote><short-title>JASON Act</short-title></quote>.</text></section><section id="H012E0B59B939468FA2B016A628F3070E"><enum>2.</enum><header>Migration surges</header><text display-inline="no-display-inline">Section 212(f) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(f)</external-xref>) is amended—</text><paragraph id="H6E9BED4B95C04ADF97BED816B3BB04B7"><enum>(1)</enum><text>in the subsection heading, by inserting <quote><header-in-text level="section" style="OLC">or the Secretary of Homeland Security</header-in-text></quote> after <quote><header-in-text level="section" style="OLC">by the President</header-in-text></quote>;</text></paragraph><paragraph id="HDB1530A4249E4E9ABF857B83173B5218"><enum>(2)</enum><text>by striking <quote>Whenever</quote> and inserting <quote><header-in-text level="subsection" style="OLC"><enum-in-header>(a)</enum-in-header> Presidential suspension.—</header-in-text>Whenever</quote>;</text></paragraph><paragraph id="HDC23B7684134478880616293BA55E9A7"><enum>(3)</enum><text>by striking <quote>Attorney General</quote> and inserting <quote>Secretary of Homeland Security</quote> each place it appears; and</text></paragraph><paragraph id="HDFA26C37D86A492CB9F24AC80A194BD4"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H31FA925255FC408E8E1015D71BE7E267" display-inline="no-display-inline"><subsection id="HADF85045F62240C3BEEF625EBCEA79AE"><enum>(b)</enum><header>Secretary suspension</header><paragraph id="H2C2271D9AF0C4A99AD40F0AF1491815E"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, in the case that the Secretary of Homeland Security finds that the entry of any alien or any class of aliens would be detrimental to the interests of the United States, the Secretary may, after submitting a notice in accordance with paragraph (2), suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants for not more than 60 days.</text></paragraph><paragraph id="H6DE68CCF87964563A3AFDCBF16822C81"><enum>(2)</enum><header>Notification</header><text display-inline="yes-display-inline">Not less than 5 days before the suspension under paragraph (1) takes effect, the Secretary of Homeland Security shall, by classified communication, submit written notice of the intent to suspend entry under this subsection and the factual basis for such suspension to—</text><subparagraph id="H55D72E9975AE409DAAE372822D3F8B93"><enum>(A)</enum><text>the Speaker and Minority Leader of the House of Representatives, the President pro tempore, Majority Leader, and Minority Leader of the Senate;</text></subparagraph><subparagraph id="H42180F0DC04F4AAE8C0F3F138A8432B0"><enum>(B)</enum><text>the Committees on the Judiciary of the House of Representatives and the Senate; and</text></subparagraph><subparagraph id="H65CCF062E4C74C92904A1F1BA6E3A683"><enum>(C)</enum><text>the Committee on Homeland Security of the House of Representatives and the Committee on Homeland Security and Governmental Affairs of the Senate.</text></subparagraph></paragraph><paragraph id="H8B764C9D821B4099AF67461A14E1FF48"><enum>(3)</enum><header>Presumption established</header><text display-inline="yes-display-inline">For purposes of this subsection, the entry of any alien into the United States shall be presumed to be detrimental to the interests of the United States—</text><subparagraph id="H6C7BBB53DA534CC5B345D3B4AD8CD9FB"><enum>(A)</enum><text>during—</text><clause id="H8E5A9EBC2D664EB6A96570621A8309BA"><enum>(i)</enum><text>a month following any month in which the total recorded number of apprehensions of aliens by the Department of Homeland Security at the land borders of the United States exceeds by twenty-five percent or more the total recorded number of apprehensions in the previous month; or</text></clause><clause id="HC80C41FE424F4187BC839CB0C17E4308"><enum>(ii)</enum><text>a week following any week where the total recorded number of apprehensions of aliens by the Department of Homeland Security at the land borders of the United States exceeds by twenty-five percent or more the total number of recorded apprehensions in the previous week;</text></clause></subparagraph><subparagraph id="H754B724491354A0FA129A7A559955790"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a public health emergency, as declared by the Secretary of Health and Human Services pursuant to section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>), due to any outbreak in the world that can be characterized as a pandemic;</text></subparagraph><subparagraph id="H25D5729E268D4977A2FF2729D6DF9433"><enum>(C)</enum><text>a national government within the Western Hemisphere fails or otherwise dissolves; or</text></subparagraph><subparagraph id="H76DBF16AB4B8414EB441C5747590D8B5"><enum>(D)</enum><text>the Secretary of Homeland Security, in consultation with the Attorney General and the Secretary of State, finds that there is an imminent foreign terror threat to the security of the United States.</text></subparagraph></paragraph><paragraph id="H06B1EEAA2C9946D7BBA82291BD287939"><enum>(4)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this subsection, the Secretary of Homeland Security shall issue a rule implementing this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
