R. 8951</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220922">September 22, 2022</action-date><action-desc><sponsor name-id="B001302">Mr. Biggs</sponsor> (for himself, <cosponsor name-id="P000605">Mr. Perry</cosponsor>, <cosponsor name-id="G000565">Mr. Gosar</cosponsor>, <cosponsor name-id="H001052">Mr. Harris</cosponsor>, <cosponsor name-id="S001214">Mr. Steube</cosponsor>, <cosponsor name-id="W000814">Mr. Weber of Texas</cosponsor>, <cosponsor name-id="L000564">Mr. Lamborn</cosponsor>, <cosponsor name-id="G000595">Mr. Good of Virginia</cosponsor>, <cosponsor name-id="M001211">Mrs. Miller of Illinois</cosponsor>, <cosponsor name-id="H001071">Mr. Hice of Georgia</cosponsor>, <cosponsor name-id="C001115">Mr. Cloud</cosponsor>, <cosponsor name-id="B000825">Mrs. Boebert</cosponsor>, <cosponsor name-id="N000190">Mr. Norman</cosponsor>, and <cosponsor name-id="T000165">Mr. Tiffany</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Immigration and Nationality Act with respect to the parole or release of an asylum applicant, and for other purposes.</official-title></form><legis-body id="HF70F3DBDC2764BB896CB398EEF08A5D0" style="OLC"><section id="HFE65D7593F8D4E278B511FA34B8EF1B9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ending Catch and Release Act of 2022</short-title></quote>.</text></section><section id="H6E3B84D11F7C422C90255B84F4502E4A"><enum>2.</enum><header> Inspection of applicants for admission</header><text display-inline="no-display-inline">Section 235(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1225">8 U.S.C. 1225(b)</external-xref>) is amended by—</text><paragraph id="H38937F87C737430E8F37E1FC34E6FE10"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="HF8CE76CEBE844210A4C4BC5F12D0C589"><enum>(A)</enum><text>in subparagraph (A)—</text><clause id="HE614976F7E364DE087C3FB13B63CE58F"><enum>(i)</enum><text>in clause (i)—</text><subclause id="H20863CB5026441F68C4CE6ECCE078487"><enum>(I)</enum><text>by striking <quote>section 212(a)(6)(C)</quote> and inserting <quote>section 212(a)(6)(A), 212(a)(6)(C), or</quote>; and </text></subclause><subclause id="H339CFEA0E4C840A887A989F5B07146F0"><enum>(II)</enum><text>by striking the period at the end and inserting <quote>. The Secretary may not parole or otherwise release the alien into the United States.</quote>; and </text></subclause></clause><clause id="H38D100EAC3D8472E9B7AD0219F2B73D4"><enum>(ii)</enum><text>in clause (ii)—</text><subclause id="H3BE639F420D94027B14A3A6AFE7BE012"><enum>(I)</enum><text>by striking <quote>section 212(a)(6)(C)</quote> and inserting <quote>section 212(a)(6)(A), 212(a)(6)(C), or</quote>; and </text></subclause><subclause id="H4BEE91422E4D428E8CEBC1F20D0DD8E9"><enum>(II)</enum><text>by striking the period at the end and inserting <quote>. The Secretary may not parole or otherwise release the alien into the United States.</quote>;</text></subclause></clause></subparagraph><subparagraph id="H63A55CE98CF741079645DF3074FDBD9A"><enum>(B)</enum><text>in subparagraph (B)—</text><clause id="H4AAA8EEE8D6E48CFA6548F32BE418E25"><enum>(i)</enum><text>in clause (i), by striking <quote>Attorney General</quote> and inserting <quote>Secretary</quote>; </text></clause><clause id="HD71916416D2A4888B90FCB539C3E2A4F"><enum>(ii)</enum><text display-inline="yes-display-inline">in clause (ii), by striking <quote>the alien shall be detained for further consideration of the application for asylum</quote> and inserting <quote>the alien shall either be detained for further consideration of the application for asylum by an immigration judge or if the alien arrived on land from a foreign territory contiguous to the United States, be returned to that territory for further consideration of the application for asylum by an immigration judge. The Secretary may not parole or otherwise release the alien into the United States</quote>; </text></clause><clause id="H87853F3F993A430C88D808471D089B23"><enum>(iii)</enum><text>in clause (iii)—</text><subclause id="H6E3C435BB8FC4C0AB514C7BA2DAF2A69"><enum>(I)</enum><text>in subclause (I), by striking the period at the end and adding <quote>. The Secretary shall remove the alien within 72 hours. If the alien cannot be removed, the alien shall be detained until removed. The Secretary may not parole or otherwise release the alien into the United States.</quote>;</text></subclause><subclause id="H60FC31B2FAD9481F94F893B4CDF4D99B"><enum>(II)</enum><text>in subclause (II), by striking <quote>has not</quote> and inserting <quote>has or has not</quote>; and</text></subclause><subclause id="HE0FA0365AA254B398E5D912AA6D763F9"><enum>(III)</enum><text>in subclause (IV), by striking the period at the end and inserting <quote>. The Secretary may not parole or otherwise release the alien into the United States.</quote>; and </text></subclause></clause><clause id="HCE284033342E4558B5E7F75DF97F15E6"><enum>(iv)</enum><text>in clause (v), by striking <quote>there is a significant possibility, taking into account the credibility of the statements made by the alien in support of the alien's claim and such other facts as are known to the officer, that the alien could establish eligibility for asylum under section 208</quote> and inserting <quote>it is more likely than not that the alien will be able to establish eligibility for asylum under section 208</quote>; and </text></clause></subparagraph></paragraph><paragraph id="H6E8D41AEE82747F2855196898EEED1F4"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph id="H34ED9AAF301B42B5BB4CC32BA1B70A64"><enum>(A)</enum><text>in subparagraph (A)—</text><clause id="HB1F4D51A7A474FE4B8008002862D147D"><enum>(i)</enum><text>by striking <quote>and (C)</quote>; and </text></clause><clause id="H47CE5732DBDB4DA8BD08D5322996948B"><enum>(ii)</enum><text>by striking <quote>the alien shall be detained for a proceeding under section 240.</quote> and inserting <quote>the alien shall be either detained for a proceeding under section 240 or if the alien arrived on land from a foreign territory contiguous to the United States, be returned to that territory pending a proceeding under section 240. The Secretary may not parole or otherwise release the alien into the United States.</quote>; and</text></clause></subparagraph><subparagraph id="H6E6F76D9067545318BC95A43606737FF"><enum>(B)</enum><text>by striking subparagraph (C).</text></subparagraph></paragraph></section></legis-body></bill>
