R. 8941</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220921">September 21, 2022</action-date><action-desc><sponsor name-id="M000687">Mr. Mfume</sponsor> (for himself and <cosponsor name-id="M001204">Mr. Meuser</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HSM00">Committee on Small Business</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Small Business Act to increase, prime contracting opportunities for small business concerns, and for other purposes.</official-title></form><legis-body id="HDD0CF7D73D8F470EA72420523AB9EF58" style="OLC"><section id="H009F9CFC8BC14C30AC9D0344BC3D67AD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preserving Small Business Prime Contracting Opportunities Act of 2022</short-title></quote>.</text></section><section id="H813A9B4746E34EC09D610C9D8837F4CA" section-type="subsequent-section"><enum>2.</enum><header>Increasing prime contracting opportunities for small business concerns</header><text display-inline="no-display-inline">Section 15(a)(4) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/644">15 U.S.C. 644(a)(4)</external-xref>) is amended—</text><paragraph id="H5BA5A975288046CFB2905C43F2C42D45"><enum>(1)</enum><text>in subsection (A)(iii), by striking <quote>an unnecessary or unjustified</quote> and inserting <quote>a</quote>;</text></paragraph><paragraph id="H7C0CF212D2314C90B7502A10AE32E0F6"><enum>(2)</enum><text>in subparagraph (B)—</text><subparagraph id="H1D54B01581EE4F98B2EF08C7AAC86E94"><enum>(A)</enum><text>in the matter preceding clause (i), by striking <quote>With respect to</quote> and all that follows through <quote>issuing a solicitation</quote> and inserting <quote>Not later than 30 days before issuing a solicitation for a proposed procurement,</quote>; and</text></subparagraph><subparagraph id="HFE708D87EDFB4715B431575B4652A628"><enum>(B)</enum><text>by amending clause (i) to read as follows:</text><quoted-block style="OLC" id="H37AE3A9D57394373B0F04523D08ED796" display-inline="no-display-inline"><clause id="HC4225829E15346A796498188812B51FC"><enum>(i)</enum><text display-inline="yes-display-inline">why the proposed procurement cannot be divided into smaller quantities, lots, or tasks to permit offers on less than the total requirement;</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HAE4D82A3BFD843D18DB53126B7F87891" commented="no"><enum>(3)</enum><text>by amending subparagraph (D) to read as follows:</text><quoted-block style="OLC" id="H94580E4E260B4BD9AC4F1B79F2C7D378" display-inline="no-display-inline"><subparagraph id="H325143342FF3464BA7CA4A651FB53B2F" commented="no"><enum>(D)</enum><header>Failure to agree on an alternative procurement method</header><clause id="HB308ECF2FD2B46A987BC3F1252191E82"><enum>(i)</enum><header>Selection</header><text display-inline="yes-display-inline">If the procurement center representative and the contracting agency fail to agree on an alternative procurement method under subparagraph (C), the Administrator shall select an alternative procurement method from the recommendations presented by the procurement center representative under such subparagraph and notify the head of the appropriate Federal agency.</text></clause><clause id="H152798409E0E49C7A84A82FE57B1A842"><enum>(ii)</enum><header>Determination</header><text>Not later than 60 calendar days after receipt of a notification under clause (i), such head shall adopt the selected alternative procurement method unless such head, on a nondelegable basis, issues a determination to the Administrator that includes—</text><subclause id="HF190E96F69AB483D9D06833F407A22AA"><enum>(I)</enum><text> a cost-benefit analysis of the proposed procurement; and</text></subclause><subclause id="H89AA1431A73B49DE9834AEF0ED1DA782"><enum>(II)</enum><text>an explanation of how the benefits of the proposed procurement outweigh the harm to small business concerns compared to the selected alternative procurement method.</text></subclause></clause><clause id="HC0AC3FD9864F4798A70BD1361E456D43"><enum>(iii)</enum><header>Submission</header><text display-inline="yes-display-inline">The Administrator shall submit any determinations issued under clause (ii) along with the report required under subsection (p)(4). </text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
