R. 893</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210205">February 5, 2021</action-date><action-desc><sponsor name-id="R000612">Mr. Rose</sponsor> (for himself, <cosponsor name-id="B001274">Mr. Brooks</cosponsor>, <cosponsor name-id="F000459">Mr. Fleischmann</cosponsor>, <cosponsor name-id="D000616">Mr. DesJarlais</cosponsor>, <cosponsor name-id="B001302">Mr. Biggs</cosponsor>, <cosponsor name-id="B001309">Mr. Burchett</cosponsor>, and <cosponsor name-id="S001214">Mr. Steube</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 28, United States Code, to provide that an appeal of an order granting a nationwide injunction issued by a district court of the United States shall lie to the Supreme Court.</official-title></form><legis-body id="HDE177A3378F344DAB6C75ED54823A811" style="OLC"><section id="H60C5F0BC15994FF886E2D3F06B9CDA97" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Court Shopping Deterrence Act</short-title></quote>.</text></section><section id="HA91F7BA94C954C61BA66F879300F3912" section-type="subsequent-section"><enum>2.</enum><header>Appeal of order granting a nationwide injunction</header><subsection id="H8D7DE068D75846A38F45E57319FC780C"><enum>(a)</enum><header> In General</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/155">Chapter 155</external-xref> of title 28, United States Code, is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H682F49765DE945A397D8CA99F6723C79" style="USC"><section id="HC4E04D4FC8394ABCBEC0BA47D0924D6C"><enum>2285.</enum><header>Appeal of order granting a nationwide injunction</header><subsection id="HC702434658054DD9A3F3B31E409F7964"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In the case that a district court of the United States grants a nationwide injunction, the appeal from the order granting such injunction shall lie to the Supreme Court.</text></subsection><subsection id="H8664B4C3D479444BAB7133E5693C4574"><enum>(b)</enum><header>Definition</header><text display-inline="yes-display-inline">In this section, the term <term>nationwide injunction</term> means an order issued by a Federal court that purports to restrain the enforcement of a Federal statute, regulation, order, or similar authority against a non-party, unless the non-party is represented by a party acting in a representative capacity pursuant to the Federal Rules of Civil Procedure.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HCF75AF543F9144CDABEAF654E934CB95"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/28/155">chapter 155</external-xref> of title 28, United States Code is amended by inserting after the item relating to section 2285 the following:</text><quoted-block display-inline="no-display-inline" id="HF7833B5677AD4A34A678F71E9EE02AB8" style="USC"><toc regeneration="no-regeneration"><toc-entry level="section">2285.
