which was referred to the <committee-name committee-id="HII00">Committee on Natural Resources</committee-name>, and in addition to the Committee on <committee-name committee-id="HAG00">Agriculture</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To improve the permitting process for mining on Federal land, and for other purposes.</official-title></form><legis-body id="H2F01894216EC4DD1BDF77E28E63AB2EE" style="OLC"><section id="H349DC34EAE7F491CB0817F858CB45F22" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Permitting for Mining Needs Act of 2022</short-title></quote>.</text></section><section id="HF4AD7FF8D7D74934B98F77F043826E48"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HC37529831D2F412DBBC5004A189EE95C"><enum>(1)</enum><header>Secretary</header><text>Except as otherwise provided, the term <quote>Secretary</quote> means the Secretary of the Interior.</text></paragraph><paragraph id="H0C9C57ECF3F7491FB85C934CD2C1D501"><enum>(2)</enum><header>State</header><text>The term <quote>State</quote> means—</text><subparagraph id="H1177B607635E48ECB0AF371BA9B0FD21"><enum>(A)</enum><text>a State;</text></subparagraph><subparagraph id="HB571CBCFC44B4EE998D8B1079509E08E"><enum>(B)</enum><text>the District of Columbia;</text></subparagraph><subparagraph id="H682C1A75DA3D4A4EBD2BD0836BC9D20A"><enum>(C)</enum><text>the Commonwealth of Puerto Rico;</text></subparagraph><subparagraph id="H5FAC2C7BCFA34AB3BD4A23FA021722EF"><enum>(D)</enum><text>Guam;</text></subparagraph><subparagraph id="HE412D0184E09459B8C4E9307F75F8CCB"><enum>(E)</enum><text>American Samoa;</text></subparagraph><subparagraph id="HDADD5E3E928F4D2BA4CBF3382F48B75D"><enum>(F)</enum><text>the Commonwealth of the Northern Mariana Islands; and</text></subparagraph><subparagraph id="H86071FF105AB4BE8B044659652D70991" commented="no"><enum>(G)</enum><text>the United States Virgin Islands.</text></subparagraph></paragraph><paragraph id="H6E45585E72834320B7689901366A5884"><enum>(3)</enum><header>Lead agency</header><text>The term <quote>lead agency</quote> means the agency with primary responsibility for issuing a mineral exploration or mine permit for a project.</text></paragraph></section><section id="H196C804D6D91468F98051E1D5FFC6F2D" section-type="subsequent-section"><enum>3.</enum><header>Minerals supply chain and reliability</header><text display-inline="no-display-inline">Section 40206 of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="usc" parsable-cite="usc/30/1607">30 U.S.C. 1607</external-xref>) is amended—</text><paragraph id="H44E6143D5E294AD78C2CAB4F5D044983"><enum>(1)</enum><text>in the section heading, by striking <quote>Critical minerals</quote> and inserting <quote>Minerals</quote>;</text></paragraph><paragraph id="H6C5752D63DE94A239354A36D07AF5A22"><enum>(2)</enum><text>in subsection (a)—</text><subparagraph id="H98AA5437EEA64C46A907606A2220171E"><enum>(A)</enum><text>in the heading by striking <quote><header-in-text level="subsection" style="OLC">Definition of Critical Mineral</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Definitions</header-in-text></quote>;</text></subparagraph><subparagraph id="H5EDB7A2BE5C44961A92DD28E40CE1C96"><enum>(B)</enum><text>by striking <quote>section,</quote> and inserting <quote>section:</quote>;</text></subparagraph><subparagraph id="H71CE50CA09E34D29AA71A4A629835851"><enum>(C)</enum><text display-inline="yes-display-inline">by striking <quote>the term <quote>critical mineral</quote> has the meaning given the term in section 7002(a) of the Energy Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/30/1606">30 U.S.C. 1606(a)</external-xref>)</quote> and inserting the following:</text><quoted-block style="OLC" id="HD702463BC7B7489FB64398A04D3FB8D7" display-inline="no-display-inline"><paragraph id="H8DF7C19186A04004B62D61CFD31386B2"><enum>(1)</enum><header>Mineral</header><text display-inline="yes-display-inline">The term <quote>mineral</quote> means any mineral of a kind that is locatable (including such minerals located on lands acquired by the United States, as such term is defined in section 102 of the Mineral Leasing Act for Acquired Lands) under the Act of May 10, 1872 (Chapter 152; 17 Stat. 91).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="H71897C42F4514C5F925F642E18CDCDE9"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H624816B614D840A7BAE88DD706BE1B3C" display-inline="no-display-inline"><paragraph id="H21EA989F9303428C809DD816F8EF0AE3"><enum>(2)</enum><header>Mineral exploration or mine permit</header><text display-inline="yes-display-inline">The term <quote>mineral exploration or mine permit</quote> means—</text><subparagraph id="H32F4AC9D36684EE2B174B6B0B28E2A69" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">an authorization of the Bureau of Land Management or the Forest Service, as applicable, for exploration for minerals that requires analysis under the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>);</text></subparagraph><subparagraph id="H87E07FF41380442B82EFC067C088B67F" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">a plan of operations for a mineral project approved by the Bureau of Land Management or the Forest Service; or</text></subparagraph><subparagraph id="HD6862FF6321E41C8A2F8A858CDBA878B" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">any other permit or authorization for a mineral project.</text></subparagraph></paragraph><paragraph id="H82A3D06960C34B81A37E71B5CE41FA42"><enum>(3)</enum><header>Mineral project</header><text display-inline="yes-display-inline">The term <quote>mineral project</quote> means a project—</text><subparagraph id="H8ABA5EDB66664DACB7118529AE54D7A0"><enum>(A)</enum><text>located on—</text><clause id="H101D6D0079474A82A72DA3D385A8DDE8"><enum>(i)</enum><text display-inline="yes-display-inline">a mining claim, millsite claim, or tunnel site claim for any mineral;</text></clause><clause id="H4919F71DE3E04711B9EFB566A99FAD3A"><enum>(ii)</enum><text display-inline="yes-display-inline">lands open to mineral entry; or</text></clause><clause id="H76663620C0B5438490F1228D4E4B1F22"><enum>(iii)</enum><text display-inline="yes-display-inline">a Federal mineral lease; and</text></clause></subparagraph><subparagraph id="H63495FB8D77C46ADA3E50447941D2B72" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">for the purposes of exploring for or producing minerals.</text></subparagraph></paragraph><paragraph id="H3E7DAE8186FC45B5828B949B02F2A001"><enum>(4)</enum><header>Lead agency</header><text display-inline="yes-display-inline">The term <quote>lead agency</quote> means the Federal agency with primary responsibility for issuing a mineral exploration or mine permit for a mineral project.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HA76A907397064D8595E069E0E167906C"><enum>(3)</enum><text>in subsection (b), by striking <quote>critical</quote> each place it appears;</text></paragraph><paragraph id="H73A5548871814EFFA4CB47E275EC9410"><enum>(4)</enum><text>in subsection (c)—</text><subparagraph id="HD939D45A34104A6095E78BC58004ACD6"><enum>(A)</enum><text>by striking <quote>critical mineral production on Federal land</quote> and inserting <quote>mineral projects</quote>;</text></subparagraph><subparagraph id="H1BA4F09F75CE4056AFBF51A589BF5A2E"><enum>(B)</enum><text>by inserting <quote>, and in accordance with subsection (h)</quote> after <quote>to the maximum extent practicable</quote>;</text></subparagraph><subparagraph id="HA54DBD7586B144D59D1A9565789DC803"><enum>(C)</enum><text>by striking <quote>shall complete the</quote> and inserting <quote>shall complete such</quote>;</text></subparagraph><subparagraph id="HF3ECB255A78245A195FBEE5D91C654C0"><enum>(D)</enum><text>in paragraph (1), by striking <quote>critical mineral-related activities on Federal land</quote> and inserting <quote>mineral projects</quote>;</text></subparagraph><subparagraph id="HA6639623CE3D44058667132406E459C8"><enum>(E)</enum><text>in paragraph (8), by striking the <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H38DB3C988D3748A2A5FADE01924EAE3E"><enum>(F)</enum><text>in paragraph (9), by striking <quote>procedures.</quote> and inserting <quote>procedures; and</quote>; and</text></subparagraph><subparagraph id="H891A296204F442379B18442200CA0C0D"><enum>(G)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HE13B5DEEB6374964BFF31F204318E5A8" display-inline="no-display-inline"><paragraph id="H2E86FB4B5663484AB11418B4E6E85C81"><enum>(10)</enum><text display-inline="yes-display-inline">deferring to and relying on baseline data, analyses, and reviews performed by State agencies with jurisdiction over the environmental or reclamation permits for the proposed mineral project.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H3C3AFBA563A745CDA909624628801E05"><enum>(5)</enum><text>in subsection (d)—</text><subparagraph id="H57D5A20557FD427FA285B19DF349FA85"><enum>(A)</enum><text>by striking <quote>critical</quote> each place it appears; and</text></subparagraph><subparagraph id="HAD378DEB96004A579DDF84917639A101"><enum>(B)</enum><text>in paragraph (3), by striking <quote>mineral-related activities on Federal land</quote> and inserting <quote>mineral projects</quote>;</text></subparagraph></paragraph><paragraph id="H99B59D6034304D8EB08CBD30FAC47186"><enum>(6)</enum><text>in subsection (e), by striking <quote>critical</quote>;</text></paragraph><paragraph id="H11E8DBBD8A364C36B49478A2E6F12D47"><enum>(7)</enum><text>in subsection (f), by striking <quote>critical</quote> each place it appears;</text></paragraph><paragraph id="HF384D58B0EAA486398BB08F869D2FD4D"><enum>(8)</enum><text display-inline="yes-display-inline">in subsection (g), by striking <quote>critical</quote> each place it appears; and</text></paragraph><paragraph id="H729A8F39C36C4A5C808E458078910434"><enum>(9)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H10914154592E4705A248961CD153233C" display-inline="no-display-inline"><subsection id="H4EB3EA05E9A04455A6D831D84B4413BB"><enum>(h)</enum><header>Other requirements</header><paragraph id="H217CBB92FF64450AB3029B558E066F36"><enum>(1)</enum><header>Memorandum of agreement</header><text display-inline="yes-display-inline">For purposes of maximizing efficiency and effectiveness of the Federal permitting and review processes described under subsection (c), the lead agency in the Federal permitting and review processes of a mineral project shall (in consultation with any other Federal agency involved in such Federal permitting and review processes, and upon request of the project applicant, an affected State government, local government, or an Indian Tribe, or other entity such lead agency determines appropriate) enter into a memorandum of agreement to carry out the activities described in subsection (c).</text></paragraph><paragraph id="HF713F40A527B4A7ABF6C24BB3D2F20ED"><enum>(2)</enum><header>Timelines and schedules for NEPA reviews</header><subparagraph id="HE1E7D42B5EC44B408653A12770891CF5"><enum>(A)</enum><header>Deadlines</header><text display-inline="yes-display-inline">Any timelines or schedules established under subsection (c)(1) relating to a review under section 102(2)(C) of the National Environmental Policy Act of 1969 shall require that the review process not exceed—</text><clause id="HD2ED3BFB5A8F4EC18419A5351B141E8E"><enum>(i)</enum><text>18 months for an environmental assessment; and</text></clause><clause id="H4AEDF66CEB2B4BE2BC7557FDBB3E34DE"><enum>(ii)</enum><text display-inline="yes-display-inline">24 months for an environmental impact statement.</text></clause></subparagraph><subparagraph id="H0534A3FDCCC441A588C561BB3C201201"><enum>(B)</enum><header>Extension</header><text>A project applicant may enter into 1 or more agreements with a lead agency to extend the deadlines described in clauses (i) and (ii) of subparagraph (A) by, with respect to each such agreement, not more than 6 months.</text></subparagraph><subparagraph id="H01E93171F4604D44A0CDC62D47E3337E" commented="no"><enum>(C)</enum><header>Adjustment of timelines</header><text display-inline="yes-display-inline">At the request of a project applicant, the lead agency and any other entity which is a signatory to a memorandum of agreement under paragraph (1) may, by unanimous agreement, adjust—</text><clause id="HB10A658688D6449F9F77CC21986CD667"><enum>(i)</enum><text>any deadlines described in subparagraph (A); and</text></clause><clause id="HA2FB5B0ECD0847D9AD306D417FDC5443"><enum>(ii)</enum><text>any deadlines extended under subparagraph (B).</text></clause></subparagraph></paragraph><paragraph id="HF1669C65F8B7416CBB6D585D5A6CC8D6" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header>Effect on pending applications</header><text display-inline="yes-display-inline">Upon a written request by a project applicant, the requirements of this subsection shall apply to any application for a mineral exploration or mine permit that was submitted before the date of enactment of the <short-title>Permitting for Mining Needs Act of 2022</short-title>.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H8A503FF038734C039BE8FCBD8769FFBB"><enum>4.</enum><header>Limitation on judicial review</header><subsection id="H3F5BBCA792654F099CFFA3C914E0787C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, a claim arising under Federal law seeking judicial review of a permit, license, or approval issued by a Federal lead agency for a mining project shall be barred unless it is filed not later than 1 year after the permit, license, or approval is final pursuant to the law under which the agency action is taken, unless a shorter time is specified in the Federal law pursuant to which judicial review is allowed.</text></subsection><subsection id="H9FDB4D208A744EB7934CC814108BBAA6"><enum>(b)</enum><header>Savings clause</header><text>Nothing in this section shall create a right to judicial review or place any limit on filing a claim that a person has violated the terms of a permit, license, or approval.</text></subsection></section><section id="H3E7E5EB6BBD340E88A543432B29CF477"><enum>5.</enum><header>Federal Register process improvement</header><text display-inline="no-display-inline">Section 7002(f) of the Energy Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/30/1606">30 U.S.C. 1606(f)</external-xref>) is amended—</text><paragraph id="HD12F78AE03004A0C8181DD23DFD83FFE"><enum>(1)</enum><text>in paragraph (2), by striking <quote>critical</quote> both places such term appears; and</text></paragraph><paragraph id="HA0042E09268647199B0E1103957496C5"><enum>(2)</enum><text>by striking paragraph (4).</text></paragraph></section><section id="HECBB224FFDD64747AB8F266B536859ED"><enum>6.</enum><header>Treatment of actions under Presidential Determination 2022–11 for Federal permitting improvement purposes</header><subsection id="H7AB2C44380E64490AEDC931F3D8F3ED1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Except as provided by subsection (c), an action described in subsection (b) shall be—</text><paragraph id="HEE780FA9920946F4ABBCF9585F6902B6"><enum>(1)</enum><text display-inline="yes-display-inline">treated as a covered project, as defined in section 41001(6) of the Fixing America’s Surface Transportation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4370m">42 U.S.C. 4370m(6)</external-xref>), without regard to the requirements of that section; and</text></paragraph><paragraph id="HA48A58073DEC4E8593F7F9FB029E9E00"><enum>(2)</enum><text>included in the Permitting Dashboard maintained pursuant to section 41003(b) of that Act (42 <external-xref legal-doc="usc" parsable-cite="usc/13/4370m-2">13 U.S.C. 4370m–2(b)</external-xref>).</text></paragraph></subsection><subsection id="H8968BDDFD30047D6AA96AC3CB755A993"><enum>(b)</enum><header>Actions described</header><text display-inline="yes-display-inline">An action described in this subsection is an action taken by the Secretary of Defense pursuant to Presidential Determination 2022–11 (87 Fed. Reg. 19775; relating to certain actions under section 303 of the Defense Production Act of 1950) to create, maintain, protect, expand, or restore sustainable and responsible domestic production capabilities through—</text><paragraph id="H58EAACD64492450384AE2DEB1CFADB71"><enum>(1)</enum><text display-inline="yes-display-inline">supporting feasibility studies for mature mining, beneficiation, and value-added processing projects; </text></paragraph><paragraph id="H4784890FF50047639ACF49FEFF43CFB9"><enum>(2)</enum><text>by-product and co-product production at existing mining, mine waste reclamation, and other industrial facilities; </text></paragraph><paragraph id="H2CEA8F642ADA4120910878B7AE173253"><enum>(3)</enum><text>modernization of mining, beneficiation, and value-added processing to increase productivity, environmental sustainability, and workforce safety; or </text></paragraph><paragraph id="H813C7B6BA4B545638C34747C66E0A3E3"><enum>(4)</enum><text>any other activity authorized under section 14 303(a)(1) of the Defense Production Act of 1950 15 (<external-xref legal-doc="usc" parsable-cite="usc/50/4533">50 U.S.C. 4533(a)(1)</external-xref>).</text></paragraph></subsection><subsection id="H7F933205F7E24548A259902E809237DC"><enum>(c)</enum><header>Exception</header><text display-inline="yes-display-inline">An action described in subsection (b) may not be treated as a covered project or be included in the Permitting Dashboard under subsection (a) if the project sponsor (as defined in section 41001(18) of the Fixing America’s Surface Transportation Act (42 U.S.C. 21 4370m(18))) requests that the action not be treated as a covered project.</text></subsection></section><section id="HA14AFC6ED396476982EF27D951B86669" commented="no"><enum>7.</enum><header>Mineral exploration activities with limited surface disturbance</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, the Secretary, with respect to lands administered by the Secretary, and the Secretary of Agriculture with respect to National Forest System lands, shall allow mineral exploration activities other than casual use to proceed after receiving a notice in such time, place, and manner as the applicable Secretary determines appropriate, describing the exploration activities and subsequent reclamation activities if—</text><paragraph id="H53F6DA5A8E274557B7FF5DEF9FC1112C"><enum>(1)</enum><text>the surface disturbance on Federal land will not exceed 5 acres;</text></paragraph><paragraph id="HAB4CB4C1DFAB4759AE2D5D5B5D79D581"><enum>(2)</enum><text>the Secretary determines that the notice is complete; and</text></paragraph><paragraph id="H82CE0450D7944E8D951DD4647F2C4EEA"><enum>(3)</enum><text>the exploration activities are not on Federal land that has been previously reclaimed.</text></paragraph></section><section id="H9A1446501F5B4C83A1F29E48DF87B970" commented="no"><enum>8.</enum><header>Use of mining claims for ancillary activities</header><text display-inline="no-display-inline">Section 10101 of the Omnibus Budget Reconciliation Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/30/28f">30 U.S.C. 28f</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H80E947CACC8443F9AA59B4387E1A070B" display-inline="no-display-inline"><subsection id="H146848EDFA574F4C871EEF2D1CA491D6" commented="no"><enum>(e)</enum><header>Security of tenure</header><paragraph id="H3C9AC851A7064A8E9030FB07FB500E42" commented="no"><enum>(1)</enum><header>In general</header><text>A claimant shall have the right to use and occupy public land, before and after the discovery of a valuable mineral deposit, in order to prospect, mine, conduct processing operations, or carry out other activities reasonably incident to such activities if—</text><subparagraph id="H7EF07CDABD3C4F348C6884B4C379C310" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">such claimant makes a timely payment of the location fee required by section 10102(g) and the claim maintenance fee required by subsection (a); or</text></subparagraph><subparagraph id="H5D6725BA8C954913A55071D10AFF87FD" commented="no"><enum>(B)</enum><text>in the case of a claimant who qualifies for a waiver under subsection (d), such claimant makes a timely payment of the location fee and complies with the required assessment work under the general mining laws.</text></subparagraph></paragraph><paragraph id="HECEDF1FE382F4F7D9A3C36E2F4231187" commented="no"><enum>(2)</enum><header>Fulfillment of Federal Land Policy and Management Act</header><text>A claimant that fulfills the requirements of this section and section 10102(g) shall be deemed to satisfy the requirements of any provision of the Federal Land Policy and Management Act that requires the payment of fair market value to the United States for use of public lands and resources relating to use of such lands and resources authorized by the general mining laws.</text></paragraph><paragraph id="HCB20DFB1FDD840D48D6FEA82998F3BF8" commented="no"><enum>(3)</enum><header>Savings clause</header><text>Nothing in this subsection may be construed to diminish—</text><subparagraph id="HDC1AD285A34D483691E141F9ABFF6825" commented="no"><enum>(A)</enum><text>the rights of entry, use, and occupancy of a claimant under the general mining laws; or</text></subparagraph><subparagraph id="H5F162BD7D1844F6DBF18BCBF747D7818" commented="no"><enum>(B)</enum><text>the rights of a claimant under the general mining laws.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
