which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To reauthorize the Court Improvement Program for 5 years, and for other purposes.</official-title></form><legis-body id="H87BD4B362D5347A7B65D607A6FEAB83B" style="OLC"><section id="H1CCF493AB58B41D5B1A880D4C97B46EE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strengthening Courts for Kids and Families Act</short-title></quote>.</text></section><section id="H6878BB0CD4894FFAB8BA751BDC89B370"><enum>2.</enum><header>Clarification of support for legal services that support the stability and permanency of family reunification</header><text display-inline="no-display-inline">Section 431(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/629a">42 U.S.C. 629a(a)</external-xref>) is amended—</text><paragraph id="HB9FEC56E6ACC4DE49CF1AD979FEE7CD6"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="H8C0EFC94F73741A29778950281CF7A36"><enum>(A)</enum><text>by striking <quote>and</quote> at the end of subparagraph (E);</text></subparagraph><subparagraph id="HA0B84AA2D89949E3BD02EFBFE32866E7"><enum>(B)</enum><text>by striking the period at the end of subparagraph (F) and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="H6F6157B921E34188881D50B91539248B"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H5D72955967774627905963769C3739D3" display-inline="no-display-inline"><subparagraph id="H57E70861B5074A4BB74080F502CD4BE4"><enum>(G)</enum><text display-inline="yes-display-inline">civil legal services designed to stabilize and support families and to enable children to safely remain with, or be reunited with, their families.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H068890547B5E49CC943EAE2AA8C09D6F"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H039E05EA0DF34848BE7AA5748E60D522" display-inline="no-display-inline"><paragraph id="HB969E86BFC7E45BC9D8A777A04F61972"><enum>(10)</enum><header>Civil legal services</header><text display-inline="yes-display-inline">The term <term>civil legal services</term> includes—</text><subparagraph id="H41070445FC2A4B189B89E19B50C7F156"><enum>(A)</enum><text>legal representation and related legal services that address barriers to family preservation or reunification or otherwise work to improve the strength and stability of families, such as legal services addressing issues related to domestic violence, housing, identity theft, wage theft or other employment concerns, unfair debt collection, disability rights, and child support; and</text></subparagraph><subparagraph id="H957EB42AE6E8419995A9FCFCA8693272"><enum>(B)</enum><text>legal representation in proceedings mandated under part E but only to the extent that the legal representation is not supported under part E.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HA9759EDEE75C45C5AC61099AD2E7D6F8"><enum>3.</enum><header>Increase in funding for court improvement program</header><text display-inline="no-display-inline">Section 436 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/629f">42 U.S.C. 629f</external-xref>) is amended—</text><paragraph id="HC587CEC5DA0545AE9EE7EEB0104DAF3B"><enum>(1)</enum><text>in subsection (a), by striking <quote>$345,000,000 for each of fiscal years 2017 through 2022</quote> and inserting <quote>$375,000,000 for each of fiscal years 2023 through 2027</quote>; and</text></paragraph><paragraph id="H27A4A90E90574D74A909E96FB8AD288E"><enum>(2)</enum><text>in subsection (b)(2), by striking <quote>$30,000,000</quote> and inserting <quote>$60,000,000</quote>.</text></paragraph></section><section id="HA01D52F63A1F42CAACAADB68A41410AC"><enum>4.</enum><header>Assessment of, and improvement in, handling of proceedings relating to foster care and adoption</header><text display-inline="no-display-inline">Section 438 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/629h">42 U.S.C. 629h</external-xref>) is amended—</text><paragraph id="H4DFE2DCBC1AE43519C9774CD725CDAAF"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(1), by adding at the end the following:</text><quoted-block style="OLC" id="H7D093DFE5D964745B3DA5EE8442C0C6D" display-inline="no-display-inline"><subparagraph id="HF1D9EBFF54C94AFD88762247936C5C4A"><enum>(F)</enum><text display-inline="yes-display-inline">that determine the appropriateness, and best practices for use, of technology to allow conduct of remote hearings, including to ensure maximum participation of individuals involved in proceedings and to enable courts to maintain operations in times of public health or other emergencies;</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="HA9B161811C334391BB6DD2C510E0100F"><enum>(2)</enum><text>in subsection (a)(2)(C), by striking <quote>by training judges, attorneys, and other legal personnel</quote> and inserting <quote>through support for civil legal services and high-quality legal representation for children and their parents, and agencies</quote>;</text></paragraph><paragraph id="H1F7DBCE080EB4294AC7379D01B91E49D"><enum>(3)</enum><text>in subsection (a)(2)—</text><subparagraph id="H096CB6ADB639485C88BE901F2DF63513"><enum>(A)</enum><text>by striking <quote>and</quote> at the end of subparagraph (B);</text></subparagraph><subparagraph id="H818AF9C3049E42CBB29514E9DBE904CD"><enum>(B)</enum><text>by striking the period at the end of subparagraph (C) and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="HADFF732823344D03AF4B9775173F69A3"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HC2ABCFE1945541A7AC8E926EE6B75E93" display-inline="no-display-inline"><subparagraph id="HD1B9FD452148420198E450B6D45CEB6A"><enum>(D)</enum><text display-inline="yes-display-inline">to provide for training of judges, attorneys, and other legal personnel to improve parent, family, and youth engagement in child welfare proceedings, to support optimal use of remote hearing technology, to support implementation of the Family First Prevention Services Act to reduce unnecessary use of congregate care for children in foster care and to reduce unnecessary entry of children into foster care, and for other purposes that improve the conduct of child welfare proceedings.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H295DA9567B4E4B63B5C3623A6474F30E"><enum>(4)</enum><text>in subsection (b)—</text><subparagraph id="HF81331B27625474A8AB926AEEA476782"><enum>(A)</enum><text>by striking <quote>(C)</quote> and inserting <quote>(3)</quote>; and</text></subparagraph><subparagraph id="HF5F33252C7174F7897CD64563F047016"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HBA772B2881064EF19C7A6CD44E4A6298" display-inline="no-display-inline"><paragraph id="H02607AF917CE4AA9A8D9A01D40449148"><enum>(4)</enum><text display-inline="yes-display-inline">a description of how the court will work with State and local child welfare agencies to improve the availability of civil legal services, and support for high quality legal representation for children and parents, including whenever possible with support provided under part E.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H4E27DDAE8CE540ACA29638C6A290D668"><enum>(5)</enum><text>in subsection (c)(3), by striking <quote>$1,000,000</quote> and inserting <quote>$2,000,000</quote>.</text></paragraph></section><section id="H07C5C115F6FA46A3BD35FC76BA0C16D7"><enum>5.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall take effect on October 1, 2022.</text></section></legis-body></bill>
