R. 8915</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220920">September 20, 2022</action-date><action-desc><sponsor name-id="C001104">Mr. Cawthorn</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Immigration and Nationality Act with respect to the apprehension and detention of certain aliens, and for other purposes.</official-title></form><legis-body id="H5AB2FBE1408B4FA4B6469CC4B0F622F7" style="OLC"><section id="HEDD568D23C074B389AF5DB2AEB6CD83B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Buttressing Our National Defense Act of 2022</short-title></quote> or the <quote><short-title>BOND Act of 2022</short-title></quote>.</text></section><section id="H9FAD11F2C36F4FB290F3FE3F1C5DA230"><enum>2.</enum><header>Apprehension and detention of certain aliens</header><text display-inline="no-display-inline">Section 236(a)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1266">8 U.S.C. 1266(a)(2)</external-xref>) is amended by striking subparagraph (A) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H6736E98F41134CBBABC13F693C34D96D"><subparagraph id="HAF0FBA80C2C44B40B1CB7FB81F542E81"><enum>(A)</enum><text display-inline="yes-display-inline">bond of at least $3,000 with security approved by, and containing conditions prescribed by, the Secretary of Homeland Security; or</text></subparagraph><after-quoted-block>. </after-quoted-block></quoted-block></section><section id="H27469BD009194E4F8D1A3FFB9DC58F2A"><enum>3.</enum><header>Mandatory detention of suspected terrorists and members of other criminal organizations</header><text display-inline="no-display-inline">Section 236A(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1226A">8 U.S.C. 1226A(a)</external-xref>) is amended—</text><paragraph id="H6C5790F372CB4C138D3670EE088FD311"><enum>(1)</enum><text>by striking paragraph (2) and inserting the following:</text><quoted-block style="OLC" id="H8B27EDD366CC4399949948F28DBB1DA0" display-inline="no-display-inline"><paragraph id="H2E645236428F40669675DCEE38A5BCD0"><enum>(2)</enum><header>Release</header><text display-inline="yes-display-inline">Except as provided in paragraphs (5) and (6), the Secretary of Homeland Security shall maintain custody of such an alien until the alien is removed from the United States. Except as provided in paragraph (6), such custody shall be maintained irrespective of any relief from removal for which the alien may be eligible, or any relief from removal granted the alien, until the Secretary of Homeland Security determines that the alien is no longer an alien who may be certified under paragraph (3).</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="H06EF8541243F43B193EDFC4BE739757E"><enum>(2)</enum><text display-inline="yes-display-inline">by striking paragraph (5) and inserting the following:</text><quoted-block style="OLC" id="HD89454526A25421AA29CD9FE5B9FA288" display-inline="no-display-inline"><paragraph id="H057681FD2B244ADC909B7C38642DA565"><enum>(5)</enum><header>Commencement of proceedings</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall place an alien detained under paragraph (1) in removal proceedings, or shall charge the alien with a criminal offense, not later than 30 days after the commencement of such detention. If the requirement of the preceding sentence is not satisfied, the Secretary of Homeland Security shall release the alien.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H99D0CC37391F4BD3A0C727087E8003DA"><enum>(3)</enum><text display-inline="yes-display-inline">by striking paragraph (6) and inserting the following new paragraph:</text><quoted-block style="OLC" id="HCFF543AD90564EAD8C03D5E671EF72B6" display-inline="no-display-inline"><paragraph id="HC34D90162D25459393D137E7A622D8E9"><enum>(6)</enum><header>Limitation on indefinite detention</header><text display-inline="yes-display-inline">An alien detained solely under paragraph (1) who has not been removed under section 1231(a)(1)(A) of this title, and whose removal is unlikely in the reasonably foreseeable future for reasons other than the alien’s home country’s refusal to issue appropriate travel documents for the alien or otherwise accept return of the alien, may be detained for additional periods of up to two years.</text></paragraph><after-quoted-block>; and </after-quoted-block></quoted-block></paragraph><paragraph id="H1BD028877A51409BB109A73CC5065839"><enum>(4)</enum><text>in subsection (b)(2)(A)—</text><subparagraph id="HCEDE6820680F4D5D88895417F1F1A109"><enum>(A)</enum><text display-inline="yes-display-inline">in clause (ii), by striking the semicolon and inserting <quote>; or</quote>;</text></subparagraph><subparagraph id="H60420156A63148FC98B58B4DD62D4EC2"><enum>(B)</enum><text>in clause (iii), by striking <quote>; or</quote> and inserting a period; and </text></subparagraph><subparagraph id="HA639CE7224064A5382D7B5059536AA1E"><enum>(C)</enum><text>by striking clause (iv).</text></subparagraph></paragraph></section></legis-body></bill>
