<section id="HE65DD9CC640442028E6DF7402001ABA7" section-type="section-one"><enum>1.</enum><header>Notification requirement regarding use of nuclear weapons without declaration of war by Congress</header>
<subsection id="H9717F37E3C1B465AB332561E6BD0B679"><enum>(a)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that—</text> <paragraph id="H3CA31D9096644ADAB3FD482053612547"><enum>(1)</enum><text>nuclear deterrence is the bedrock of United States national security;</text></paragraph>
<paragraph id="H1496AC6651454A6580B25029649281F6"><enum>(2)</enum><text display-inline="yes-display-inline">the ability for the United States to quickly and decisively respond to acts of aggression against the United States and the allies and partners of the United States, including nuclear attacks, deters actors from acting against the United States in the first place;</text></paragraph> <paragraph id="H3FEF39BC7E624880A67F8E482AF9B086"><enum>(3)</enum><text>as currently structured, responsibility and authority for the release of nuclear weapons resides solely with the President;</text></paragraph>
<paragraph id="HEFA6261B04184AEC852753953115A10B"><enum>(4)</enum><text display-inline="yes-display-inline">any Presidential order for a nuclear strike must be verified by a senior official of the Department of Defense or military officer to ensure that a lawful order was in fact issued by the President;</text></paragraph> <paragraph id="H354B77055A00475B9F31E8805ACAADA6"><enum>(5)</enum><text display-inline="yes-display-inline">neither a senior official of the Department nor a military officer in the chain of command has veto power and, therefore, must comply with a lawful order or resign;</text></paragraph>
<paragraph id="H16FC5694252E4DE28E8752632F88CECD"><enum>(6)</enum><text>however, entrusting an individual with the authority to order the use of nuclear weapons raises the possibility, however small, of their accidental or inappropriate use that risks catastrophic loss of life and potential escalation into nuclear war; and</text></paragraph> <paragraph id="HAB013208D08145A58EB93AB2A750CA26"><enum>(7)</enum><text display-inline="yes-display-inline">the chain of command established under section 162(b) of title 10, United States Code, applies to Presidential orders regarding the use of nuclear weapons.</text></paragraph></subsection>
<subsection id="H1139F74960034CAC9327140EB7BE6157"><enum>(b)</enum><header>Notification</header>
<paragraph id="HF7D93EA2AD974658AC393C943ABF3636"><enum>(1)</enum><header>Requirement</header><text>Upon the receipt of an order described in paragraph (2) and before carrying out such order, the Secretary of Defense, or any other senior official of the Department of Defense or military officer that is in direct receipt of such order, shall notify the congressional defense committees, the Speaker of the House of Representatives, the majority leader of the Senate, the minority leader of the House of Representatives, and the minority leader of the Senate of such order.</text></paragraph> <paragraph id="H78F8BAE7F44841DEA451B53120DF3DD1"><enum>(2)</enum><header>Order described</header><text display-inline="yes-display-inline">An order described in this paragraph is a verified order by the President to use nuclear weapons without a declaration of war by Congress.</text></paragraph></subsection></section>
