which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to establish exceptions for certain physician wellness programs, and for other purposes.</official-title></form><legis-body id="HFDAFCA5DE64E4C82895D8A6B3743227B" style="OLC"><section id="H7D3B24B55E054533A50DC0EA7EF2475B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Physician Wellness Program Act of 2022</short-title></quote>.</text></section><section id="H2D19886E1C004C209716181CDCC15200"><enum>2.</enum><header>Exception for physician wellness programs</header><subsection id="HED6FD1D7B7DB441EAEB549B45E9BC522"><enum>(a)</enum><header>Exception for physician wellness programs</header><paragraph id="HF9B67AB252B645A28EF6D477ECE73DB7"><enum>(1)</enum><header>In general</header><text>Section 1877(e) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395nn">42 U.S.C. 1395nn(e)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HD363153184A944E19C23F965C9CD51E5" display-inline="no-display-inline"><paragraph id="H9D626ADF32174CEA84EAD9876F9308A8"><enum>(9)</enum><header>Physician wellness programs</header><text>A bona fide mental health or behavioral health improvement or maintenance program offered to a physician by an entity, if—</text><subparagraph id="H9F26AC8F972F4350B334D21BEF89E1B8"><enum>(A)</enum><text>such program—</text><clause id="H74A470C54D304B3E960492A68ABDBC45"><enum>(i)</enum><text>consists of counseling, mental health services, a suicide prevention program, or a substance use disorder prevention and treatment program;</text></clause><clause id="H149D71A860A043319C5FB07248CE9C91"><enum>(ii)</enum><text display-inline="yes-display-inline">is made available to a physician for the primary purpose of preventing suicide, improving mental health and resiliency, or providing training in appropriate strategies to promote the mental health and resiliency of such physician;</text></clause><clause id="H66638874C20B4BF895FBABEF9D06FA4E"><enum>(iii)</enum><text display-inline="yes-display-inline">is set out in a written policy, approved in advance of the operation of the program by the governing body of the entity providing such program, that includes—</text><subclause id="H80385F309A914DF9AD0ED01CB962FF37"><enum>(I)</enum><text>a description of the content and duration of the program;</text></subclause><subclause id="H79670DB5B83944238FB1D876E19C17CB"><enum>(II)</enum><text>a description of the evidence-based support for the design of the program;</text></subclause><subclause id="HA44E07896A1340C19B93AEEB80A0F291"><enum>(III)</enum><text>the estimated cost of the program;</text></subclause><subclause id="HF6CCB87486044A16B806C7F222621D0E"><enum>(IV)</enum><text>the personnel (including the qualifications of such personnel) implementing the program; and</text></subclause><subclause id="H1B1BD1AFBB2B48F182BF995755949CAF"><enum>(V)</enum><text>the method by which such entity will evaluate the use and success of the program;</text></subclause></clause><clause id="H2C555EFA9C064C14BC198CF033274B7D"><enum>(iv)</enum><text display-inline="yes-display-inline">is offered by an entity with a formal medical staff to all physicians who practice in the geographic area served by such entity, including physicians who hold bona fide appointments to the medical staff of such entity or otherwise have clinical privileges at such entity;</text></clause><clause id="H5A9DD446D7DE4064A58A42AD6B4B9CD5"><enum>(v)</enum><text display-inline="yes-display-inline">is offered to all such physicians on the same terms and conditions and without regard to the volume or value of referrals or other business generated by a physician for such entity;</text></clause><clause id="HAD07487EEEB344E082E2B1F54A7D0064"><enum>(vi)</enum><text>is evidence-based and conducted by a qualified health professional; and</text></clause><clause id="H53A2108CA315487793A49CEC8AF63B38"><enum>(vii)</enum><text>meets such other requirements the Secretary may impose by regulation as needed to protect against program or patient abuse;</text></clause></subparagraph><subparagraph id="H00BACA14F9B244D2AC9433198687BA6D"><enum>(B)</enum><text>such entity is—</text><clause id="H353ED2CEC60F4AE9A6B532ED70D376FF"><enum>(i)</enum><text>a hospital;</text></clause><clause id="H5DF36B08764B4068B0D7F454E80B9AFD"><enum>(ii)</enum><text>an ambulatory surgical center;</text></clause><clause id="HF149A6C03A0F4399A0A4907E8E220AAE"><enum>(iii)</enum><text>a community health center;</text></clause><clause id="H010DEF9B42344D29A7BC3680F2694F69"><enum>(iv)</enum><text>a rural emergency hospital;</text></clause><clause id="H3EA17EAB080E4E729AF50008E8464257"><enum>(v)</enum><text>a rural health clinic;</text></clause><clause id="H6D1C7DB1A2E64CBC8E0E5956FA688681"><enum>(vi)</enum><text>a skilled nursing facility; or</text></clause><clause id="HAA414AC48CBA45AD905E3B37F84D6F2E"><enum>(vii)</enum><text>a similar entity, as determined by the Secretary; and</text></clause></subparagraph><subparagraph id="H93DE3274D0FC4C83B447D3778845B343"><enum>(C)</enum><text display-inline="yes-display-inline">neither the provision of such program, nor the value of such program, are contingent upon the number or value of referrals made by a physician to such entity.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H8C689C3BE6BC4BDC827C28312CE18AC5"><enum>(2)</enum><header>Regulation</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary of Health and Human Services shall promulgate such regulations as are necessary to carry out the amendment made by paragraph (1).</text></paragraph></subsection><subsection id="HEA666294561D4A48AE86FEC8F40482A8"><enum>(b)</enum><header>Exception under the anti-Kickback statute</header><text display-inline="yes-display-inline">Section 1128B(b)(3) of the Social Security Act (42 U.S.C. 1320a–7b(b)(3)) is amended—</text><paragraph id="HF8A51069A2B543EBA5147C812809D0AD"><enum>(1)</enum><text>in subparagraph (J), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="HF35868597C884E219093DF65EBBA59CD"><enum>(2)</enum><text>in subparagraph (K), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HE816F177F22E4E6285B04B5A2BEB1353"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="traditional" id="H6D849152E4AA48DEBCD93B033D6455E7" display-inline="no-display-inline"><subparagraph id="HBDA8273A2CCA440281495AC73C13D4F0" indent="up1"><enum>(L)</enum><text display-inline="yes-display-inline">a bona fide mental health or behavioral health improvement or maintenance program, if—</text><clause id="H4C54E065D11642C1A5DE1188D71B6959"><enum>(i)</enum><text>such program—</text><subclause id="H45D0F4DFA1B141F79C9123E4E939B06B"><enum>(I)</enum><text>consists of counseling, mental health services, a suicide prevention program, or a substance use disorder prevention and treatment program;</text></subclause><subclause id="H5E89B546AE184429BD631A55CF075CD3"><enum>(II)</enum><text>is made available to a physician and other clinicians for the primary purpose of preventing suicide, improving mental health and resiliency, or providing training in appropriate strategies to promote the mental health and resiliency of such physician;</text></subclause><subclause id="H90023F1BAB9B4E9785D34F22494E467A"><enum>(III)</enum><text>is set out in a written policy, approved in advance of the operation of the program by the governing body of the entity providing such program, that includes—</text><item id="H1A0221806A354FD9B57EF1DC060A5D15"><enum>(aa)</enum><text>a description of the content and duration of the program;</text></item><item id="H8137A00CE5324E1783FAA74D24273563"><enum>(bb)</enum><text>a description of the evidence-based support for the design of the program;</text></item><item id="H90DA790BA8CB4506B204C1E03712EFCD"><enum>(cc)</enum><text>the estimated cost of the program;</text></item><item id="H84FA0301C4214C49B3ED2046FD22FFBB"><enum>(dd)</enum><text>the personnel (including the qualifications of such personnel) implementing the program; and</text></item><item id="H1B26D1D1900D4813BBFD7D1DBDEB9323"><enum>(ee)</enum><text>the method by which such entity will evaluate the use and success of the program;</text></item></subclause><subclause id="HEB32EE9C76F64A8A9E65F0A3264F6C09"><enum>(IV)</enum><text display-inline="yes-display-inline">is offered by an entity with a formal medical staff to all physicians and other clinicians who practice in the geographic area served by such entity, including physicians who hold bona fide appointments to the medical staff of such entity or otherwise have clinical privileges at such entity;</text></subclause><subclause id="HE3A60367FE77440BBDEA1B7AE5605B2A"><enum>(V)</enum><text>is offered to all such physicians and clinicians on the same terms and conditions and without regard to the volume or value of referrals or other business generated by a physician or clinician for such entity;</text></subclause><subclause id="HCA720E368C7441B4B9BEA1945028FB07"><enum>(VI)</enum><text>is evidence-based and conducted by a qualified health professional; and</text></subclause><subclause id="H64ECBC5F0E0E41A3B536A12096197E5C"><enum>(VII)</enum><text>meets such other requirements the Secretary may impose by regulation as needed to protect against program or patient abuse;</text></subclause></clause><clause id="HA95954071C674F9BB3CC0DA19F3C174D"><enum>(ii)</enum><text>such entity is—</text><subclause id="HB1D6F9B8BD8C4514B37C73A6108F5AAA"><enum>(I)</enum><text>a hospital;</text></subclause><subclause id="H292BAA257111413BB3AEA52644C71EC0"><enum>(II)</enum><text>an ambulatory surgical center;</text></subclause><subclause id="H46649A31063F4F0D9DE8AA840D12EBCA"><enum>(III)</enum><text>a community health center;</text></subclause><subclause id="H0680E9312DA147648F38BCA94CAAE085"><enum>(IV)</enum><text>a rural emergency hospital;</text></subclause><subclause id="H8F5386B9F16A4D3A88B76DB2E6FEDE91"><enum>(V)</enum><text>a skilled nursing facility; or</text></subclause><subclause id="H2943202EA25F4E039203F29008C0BEBA"><enum>(VI)</enum><text>any similar entity, as determined by the Secretary; and</text></subclause></clause><clause id="H693A5C7231A24026922C6532A5AC6CA9"><enum>(iii)</enum><text>neither the provision of such program, nor the value of such program, are contingent upon the number or value of referrals made by a physician or other clinician to such entity.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
