which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committees on <committee-name committee-id="HED00">Education and Labor</committee-name>, and <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Public Health Service Act, Internal Revenue Code of 1986, and Employee Retirement Income Security Act of 1974 to ensure mental health and substance use disorder benefits are defined pursuant to external benchmarks based on nationally recognized standards.</official-title></form><legis-body id="H692313321D564B82B6CDF6FAA1AC91AD" style="OLC"><section id="H30092FCD69D14FE685F55AD832551457" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting Clarity in Mental Health and Substance Use Disorder Treatment Act</short-title></quote>.</text></section><section id="H58292D766A754489B374F870D11248A1"><enum>2.</enum><header>Ensuring mental health and substance use disorder benefits are defined pursuant to external benchmarks based on nationally recognized standards</header><subsection id="HC8B2D8AEC9BA44C9B76367610A00EB43"><enum>(a)</enum><header>PHSA</header><text display-inline="yes-display-inline">Section 2726(e) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-26">42 U.S.C. 300gg–26(e)</external-xref>) is amended—</text><paragraph id="H2DCEC8E304F34D32BC95E3A074F38007"><enum>(1)</enum><text>in paragraph (4), by adding at the end the following new sentence: <quote>Any definition of the term <quote>mental health condition</quote> applied for purposes of the previous sentence shall include at least the conditions (other than a substance use disorder) that fall under any of the diagnostic categories listed in the mental and behavioral disorders chapter of the most recent edition of the World Health Organization’s International Statistical Classification of Diseases and Related Health Problems, or that is listed in the most recent version of the American Psychiatric Association’s Diagnostic and Statistical Manual of Mental Disorders.</quote>; and</text></paragraph><paragraph id="H8A2B9816D11045968B0778402E1F879F"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (5), by adding at the end the following new sentence: <quote>Any definition of the term <quote>substance use disorder</quote> applied for purposes of the previous sentence shall include at least the disorders that fall under any of the diagnostic categories listed in the mental and behavioral disorders chapter of the most recent edition of the World Health Organization’s International Statistical Classification of Diseases and Related Health Problems as a mental and behavioral disorder due to psychoactive substance use (or equivalent category), or that is listed in the most recent version of the American Psychiatric Association’s Diagnostic and Statistical Manual of Mental Disorders as a substance-related and addictive disorder (or equivalent category).</quote>.</text></paragraph></subsection><subsection id="HAFF63AC728D24CBCB1754DE9662DC0D3"><enum>(b)</enum><header>IRC</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/9812">Section 9812(e)</external-xref> of the Internal Revenue Code of 1986 is amended—</text><paragraph id="H031DF64AAF2E4282A18AAA037E28139C"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (4), by adding at the end the following new sentence: <quote>Any definition of the term <quote>mental health condition</quote> applied for purposes of the previous sentence shall include at least the conditions (other than a substance use disorder) that fall under any of the diagnostic categories listed in the mental and behavioral disorders chapter of the most recent edition of the World Health Organization’s International Statistical Classification of Diseases and Related Health Problems, or that is listed in the most recent version of the American Psychiatric Association’s Diagnostic and Statistical Manual of Mental Disorders.</quote>; and</text></paragraph><paragraph id="H0CD8FA2473C64FC28122FBAE9487A217"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (5), by adding at the end the following new sentence: <quote>Any definition of the term <quote>substance use disorder</quote> applied for purposes of the previous sentence shall include at least the disorders that fall under any of the diagnostic categories listed in the mental and behavioral disorders chapter of the most recent edition of the World Health Organization’s International Statistical Classification of Diseases and Related Health Problems as a mental and behavioral disorder due to psychoactive substance use (or equivalent category), or that is listed in the most recent version of the American Psychiatric Association’s Diagnostic and Statistical Manual of Mental Disorders as a substance-related and addictive disorder (or equivalent category).</quote>.</text></paragraph></subsection><subsection id="H82C10655176C4EA28D5D64B35417D52C"><enum>(c)</enum><header>ERISA</header><text>Section 712(e) of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1185a">29 U.S.C. 1185a(e)</external-xref>) is amended—</text><paragraph id="HF8F650206E134E5DA374313E36481BCC"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (4), by adding at the end the following new sentence: <quote>Any definition of the term <quote>mental health condition</quote> applied for purposes of the previous sentence shall include at least the conditions (other than a substance use disorder) that fall under any of the diagnostic categories listed in the mental and behavioral disorders chapter of the most recent edition of the World Health Organization’s International Statistical Classification of Diseases and Related Health Problems, or that is listed in the most recent version of the American Psychiatric Association’s Diagnostic and Statistical Manual of Mental Disorders.</quote>; and</text></paragraph><paragraph id="HCB550CD416DA44E784C9D4A348DB4D5B"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (5), by adding at the end the following new sentence: <quote>Any definition of the term <quote>substance use disorder</quote> applied for purposes of the previous sentence shall include at least the disorders that fall under any of the diagnostic categories listed in the mental and behavioral disorders chapter of the most recent edition of the World Health Organization’s International Statistical Classification of Diseases and Related Health Problems as a mental and behavioral disorder due to psychoactive substance use (or equivalent category), or that is listed in the most recent version of the American Psychiatric Association’s Diagnostic and Statistical Manual of Mental Disorders as a substance-related and addictive disorder (or equivalent category).</quote>.</text></paragraph></subsection><subsection id="H255F7B6017C94E469D4BD4DECB4C7F31"><enum>(d)</enum><header>Implementation</header><text>The Secretaries of Labor, Health and Human Services, and the Treasury may implement the provisions of, including the amendments made by, this section through interim final rule, sub-regulatory guidance, program instruction, or otherwise. </text></subsection><subsection id="HC3D757BAC0674E1BB75F0003480C225C"><enum>(e)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply with respect to plan years beginning on or after the date that is 6 months after the date of the enactment of this Act. </text></subsection></section></legis-body></bill>
