which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 18, United States Code, to require a license to acquire or receive an assault weapon, and for other purposes.</official-title></form><legis-body id="H653C4F50217A49A087BC32ADB7073EE6" style="OLC"><section section-type="section-one" id="HF98549FF06DD4028B2DE93EC55BCBE73"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Assault Weapons Licensing Act</short-title></quote>.</text></section><section id="H0E548917ACE742EEA88C0B752A962959"><enum>2.</enum><header>License for the acquisition or receipt of assault weapons</header><subsection id="H97E9C12A806148BDAC908B4B6F1183EA"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">Chapter 44</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="H4D0A4FB85D6F4162B31CD59FD0FE87FE"><section id="H472183334F0A4B058F5C34626476A7AE"><enum>935.</enum><header>License for the acquisition or receipt of assault weapons</header><subsection id="H48DF4ED8984E48479E57E3FE0CB9FEB0"><enum>(a)</enum><header>In general</header><text>Except as provided in subsection (c), it shall be unlawful for any individual to purchase or receive an assault weapon, unless the individual has—</text><paragraph id="H5AA347C8D48B49A2A3E206B90DFC9A39"><enum>(1)</enum><text>an assault weapons license issued under this section; or</text></paragraph><paragraph id="H6F958D017D1948EB987E3F72BD8AB758"><enum>(2)</enum><text>an assault weapons license, or a valid license or permit authorizing the carrying of a concealed firearm, issued by a State, unless the Attorney General has determined that the requirements which must be met for the issuance of such a license or permit are not substantially similar to the requirements of subsection (b).</text></paragraph></subsection><subsection id="HAFCC28DAD60F40A583C4BB8ABBAAB41B"><enum>(b)</enum><header>Establishment of system for issuing Federal assault weapons licenses</header><paragraph id="HE9165657C0E347C191C4ABCA4227D26B"><enum>(1)</enum><header>In general</header><text>The Attorney General shall establish a system for issuing licenses authorizing eligible individuals to acquire and receive assault weapons while the license is in effect.</text></paragraph><paragraph id="H5B245CAAE5B849A3B3239AEE75A1E1F3"><enum>(2)</enum><header>Application requirements</header><text>The system established under paragraph (1) shall provide that—</text><subparagraph id="H848DD252DAC74B248331D73AA7D24F58"><enum>(A)</enum><text>an individual is eligible to receive such a license if the individual—</text><clause id="H875CC09248504567A0773B0EB1156A71"><enum>(i)</enum><text>has completed training in firearms safety, including hands-on testing and firing testing, to demonstrate safe use and sufficient accuracy of a firearm; and</text></clause><clause id="HE020C9257FDF44C0880DE18AC6864B64"><enum>(ii)</enum><text display-inline="yes-display-inline">as part of the process for applying for such a license—</text><subclause id="H0F4BF4D3FDD0412CB856C9D11F39CAFD"><enum>(I)</enum><text>has submitted to a background investigation and criminal history check of the individual in accordance with paragraph (3);</text></subclause><subclause id="HD19AC03C221048C398E4B890350A56AB"><enum>(II)</enum><text>has submitted proof of the identity of the individual;</text></subclause><subclause id="H9587BBA6B36449B89FE20854F459FC19"><enum>(III)</enum><text>has submitted the fingerprints of the individual; and</text></subclause><subclause id="HDE1508FD0A0C458D89C294C353BA472A"><enum>(IV)</enum><text display-inline="yes-display-inline">has paid a fee of $130 for applying for, or renewing, such a license;</text></subclause></clause></subparagraph><subparagraph id="H9CD20E87CDB6400681D9B0BBF3F9BE46"><enum>(B)</enum><text>such a license shall be available at designated local offices, which shall be located in urban and rural areas;</text></subparagraph><subparagraph id="HC3791640B36742DC921F391436CF6639"><enum>(C)</enum><text>the Attorney General shall issue or deny such a license, or return the application without action, not later than 30 days after the date on which the application for the license, or for the renewal of the license, is received;</text></subparagraph><subparagraph id="H3FFBA9C2EFA2413DA7E4590EF20CD8DA"><enum>(D)</enum><text>such a license shall expire on the date that is 5 years after the date on which the license was issued or renewed; and</text></subparagraph><subparagraph id="HFEF4FB06102C4217AD2809FF38819A22"><enum>(E)</enum><text>the Attorney General shall provide notice of an application for such a license to the relevant State and local officials.</text></subparagraph></paragraph><paragraph id="H1E7B15E934664923BA49555490DCD9A8"><enum>(3)</enum><header>Background investigation and criminal history check by the NICS system</header><subparagraph id="HFDEC5B6A0F274CD6B464CA5A8D658E65"><enum>(A)</enum><header>In general</header><text>Before issuing a license under this section, the Attorney General shall—</text><clause id="H9DA86A8557B6492CB82C6880713B536D"><enum>(i)</enum><text display-inline="yes-display-inline">cause the national instant criminal background check system established under section 103 of the Brady Handgun Violence Prevention Act (in this section referred to as the <quote>NICS system</quote>) to conduct a criminal background check of the applicant; and</text></clause><clause id="H62D4CD4536E041F0834B62B95E5D7145"><enum>(ii)</enum><text>deny the license if receipt of a firearm by the applicant would violate subsection (g) or (n) of section 922 or any provision of State law.</text></clause></subparagraph><subparagraph id="H566C6C65299D4B4EAAC300755C0B486F"><enum>(B)</enum><header>Poses a danger of bodily injury</header><clause id="HCA3404C2A7A04D2EA6D5CA7288A37C75"><enum>(i)</enum><header>Information from State and local officials</header><text>After receiving the notice described in paragraph (2)(E), relevant State and local officials may submit to the Attorney General information demonstrating that the individual poses a significant danger of bodily injury to self or others by possessing, purchasing, or receiving a firearm.</text></clause><clause id="HB9A65AB6A58E4F41AC9693382A000612"><enum>(ii)</enum><header>Denial</header><subclause id="H56A8112344B44FEC9770F40AFF83D2CF"><enum>(I)</enum><header>In general</header><text>The Attorney General may deny a license under this section if the Attorney General determines that the applicant poses a significant danger of bodily injury to self or others by possessing, purchasing, or receiving a firearm, after examining factors the Attorney General considers are relevant to the determination, including—</text><item id="H7E8FFA1D6FA545A58583BC6BC0696F57"><enum>(aa)</enum><text>history of threats or acts of violence toward self or others;</text></item><item id="H87E25629139B40E7BAEBDFB7A0831E22"><enum>(bb)</enum><text>history of use, attempted use, or threatened use of physical force by the applicant against another person;</text></item><item id="HB293092937234847B87C50EEE695F86F"><enum>(cc)</enum><text>whether the applicant is the subject of or has violated a domestic violence or stalking restraining order or protection order;</text></item><item id="H8ABF5724626A4F6582F04E7FADC9F30C"><enum>(dd)</enum><text>any prior arrest, pending charge, or conviction for a violent or serious crime or disorderly persons offense, stalking offense, or domestic violence offense;</text></item><item id="H1B8E16B78C8D4368BE8E6B3D7DAB48A5"><enum>(ee)</enum><text>any prior arrest, pending charge, or conviction for an offense involving cruelty to animals;</text></item><item id="H9FFF3EDF208C4891A43BA71564D55357"><enum>(ff)</enum><text>history of drug or alcohol abuse or involvement in drug trafficking;</text></item><item id="H943A765BB58748E68DC65E7043B94C76"><enum>(gg)</enum><text>any recent acquisition of firearms, ammunition, or other deadly weapons;</text></item><item id="H4CFE6E2B7CFF4C56921059D914A52022"><enum>(hh)</enum><text>involvement in firearms trafficking or unlawful firearms transfers; and</text></item><item id="H52AB4409580449B2A66319B984115816"><enum>(ii)</enum><text>history of unsafe storage or handling of firearms.</text></item></subclause><subclause id="H4669B05BCF1A46E9B8D64C41D722CFCA"><enum>(II)</enum><header>Judicial review</header><text>An applicant denied a license under subclause (I) may file an action in the appropriate district court of the United States seeking review of the denial.</text></subclause></clause></subparagraph><subparagraph id="H6750E8D5917F42F9AD03F7271FA7EB94"><enum>(C)</enum><header>Rule of construction</header><text>This paragraph shall not be construed to modify any other requirement for a background investigation relating to the acquisition or receipt of a firearm in effect on the day before the date of the enactment of this section.</text></subparagraph></paragraph><paragraph id="H0FF1FC85B5384D35BE4FDE5DF25F91E6"><enum>(4)</enum><header>Revocation</header><subparagraph id="H031C47675B31451E82F2E40C4112D840"><enum>(A)</enum><header>In general</header><text>The Attorney General shall revoke a license issued under this section if the Attorney General determines—</text><clause id="H47B5550D51754C93BCDBC4B665751DB7"><enum>(i)</enum><text>that the licensee poses a significant danger of bodily injury to self or others by possessing, purchasing, or receiving a firearm; or</text></clause><clause id="HBB0DB219FA354F74AD54B8F6B06C29D8"><enum>(ii)</enum><text>after a criminal background check conducted in accordance with paragraph (3)(A), that the possession of a firearm would violate subsection (g) or (n) of section 922 or any provision of State law.</text></clause></subparagraph><subparagraph id="H2323F275C2E54D06983BDAFE832DE64F"><enum>(B)</enum><header>Notice and opportunity for a hearing</header><clause id="H0B4BF793880D4544B858462086A1E1F4"><enum>(i)</enum><header>Notice</header><text display-inline="yes-display-inline">Upon determining that the licensee should have their license revoked under subparagraph (A), the Attorney General shall provide notice to the licensee and to relevant State and local officials of the determination.</text></clause><clause id="HB3FFC1D451714A4F8F2CAC7D1BC9772D"><enum>(ii)</enum><header>Hearing</header><text>For revocations under subparagraph (A)(i), the Attorney General shall provide a licensee an opportunity for a hearing in the appropriate district court of the United States not later than 30 days after the date on which a license is revoked under this paragraph to appeal the revocation.</text></clause></subparagraph><subparagraph id="H7BB5823531B840ABA5F8459B2F359234"><enum>(C)</enum><header>Procedures</header><text display-inline="yes-display-inline">The Attorney General shall establish procedures to ensure that, when the license issued to an individual is revoked under this paragraph, the individual surrenders any assault weapon owned or possessed by the individual.</text></subparagraph><subparagraph id="H745F01AF1F29452E9A05121507682686"><enum>(D)</enum><header>Return of firearms</header><text>An assault weapon surrendered under the procedures established under subparagraph (C) may be returned to the individual only if the license of the individual under this section is reinstated.</text></subparagraph></paragraph><paragraph id="H0E7AE5DF2A124DEB92D404923DA550E9"><enum>(5)</enum><header>Renewal</header><text>The Attorney General shall establish procedures for the renewal of a license issued under this section, that shall require the licensee to satisfy the requirements of paragraph (2).</text></paragraph></subsection><subsection id="H9A345AF270404C469AE76A0E6F434C68"><enum>(c)</enum><header>Exceptions</header><text>Subsection (a) shall not apply to—</text><paragraph id="H5A9C732D0C2843B2B0FF0ED11BDCCF3F"><enum>(1)</enum><text display-inline="yes-display-inline">a member of the Armed Forces on active duty, a qualified law enforcement officer (as defined in section 926B), a qualified retired law enforcement officer (as defined in section 926C), a corrections officer, or a law enforcement officer;</text></paragraph><paragraph id="H3A938DA3C7404BE0BE85958DDD2F8390"><enum>(2)</enum><text display-inline="yes-display-inline">the owner of an assault weapon who lawfully possessed the weapon continuously since before the date of the enactment of this section;</text></paragraph><paragraph id="H64AACFCE1C0849D0988BE35B1AC9ABAE"><enum>(3)</enum><text>a transfer to an executor, administrator, trustee, or personal representative of an estate or a trust by operation of law upon death;</text></paragraph><paragraph id="H170FB5477C35481A9751B8FB47F8D94A"><enum>(4)</enum><text>a transfer approved by the Attorney General under <external-xref legal-doc="usc" parsable-cite="usc/26/5812">section 5812</external-xref> of the Internal Revenue Code of 1986;</text></paragraph><paragraph id="H18FCFB57C7A94805BC408233687C170B"><enum>(5)</enum><text display-inline="yes-display-inline">a temporary transfer that is necessary to prevent imminent death or great bodily harm, including harm to self or another, domestic violence, dating partner violence, sexual assault, stalking, or domestic abuse, if the possession by the transferee lasts only for so long as is immediately necessary to prevent the imminent death or great bodily harm, domestic violence, dating partner violence, sexual assault, stalking, or domestic abuse, as the case may be; or</text></paragraph><paragraph id="H0A3D9FE3D0A045B3BEBD8470357637BE"><enum>(6)</enum><text>a temporary transfer if the transferor has no reason to believe that the transferee will use or intends to use the firearm in a crime or is prohibited from possessing a firearm under State or Federal law, and the transfer takes place and the transferee's possession of the firearm is exclusively—</text><subparagraph id="H37C0403A86CE4C79B75D6B7B9A0DAB78"><enum>(A)</enum><text>in the presence and under the supervision of the transferor; and</text></subparagraph><subparagraph id="H5DF83F4C76E743C3956B84165E509569"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="HA182A4CAF9FD4F01B6D0CB1398144E18"><enum>(i)</enum><text>at a shooting range or in a shooting gallery or other area designated for the purpose of target shooting; or</text></clause><clause id="H1C9765E6CEBC498E9409AA2CDE473F98" indent="up1"><enum>(ii)</enum><text>while reasonably necessary for the purposes of hunting, trapping, pest control on a farm or ranch, or fishing, if the transferor—</text><subclause id="H3E0A760847DE467B80FB97768D4B818E"><enum>(I)</enum><text>has no reason to believe that the transferee intends to use the firearm unlawfully; and</text></subclause><subclause id="HCCFF7B0E09F540C0A0F5224B59784183"><enum>(II)</enum><text>has reason to believe that the transferee will comply with all licensing and permit requirements for the hunting, trapping, pest control on a farm or ranch, or fishing, as the case may be.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="H30428FBEF9424577B17E863DC70E3FA9"><enum>(d)</enum><header>Retention of application fees</header><text>Amounts collected from application fees paid under this section shall be available, without fiscal year limitation, for processing applications submitted pursuant to this section.</text></subsection><subsection id="HF37CF18413C0496D854CDC298E750674"><enum>(e)</enum><header>Regulations</header><paragraph id="HE15700E5293C49149F1453612291F670"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Attorney General may promulgate such regulations as the Attorney General determines are necessary to carry out this section, which shall include—</text><subparagraph id="H2A15FAB91E734C788555A6ACE71B1DA9"><enum>(A)</enum><text>a requirement that the NICS system prioritize criminal background checks pursuant to this section over criminal background checks pursuant to <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/53">chapter 53</external-xref> of the Internal Revenue Code of 1986; and</text></subparagraph><subparagraph id="HF9B814CDDBF54C79BA1D09619DEB4C33"><enum>(B)</enum><text>a procedure for a person whose application for a license under this section has been returned without action to be informed of the reasons therefor.</text></subparagraph></paragraph><paragraph id="HDAE5996C3B5447B08F83CE32E35E7F12"><enum>(2)</enum><header>Records of license holders</header><subparagraph id="H93995AAB9CF645178A316F0D6FE37D1A"><enum>(A)</enum><header>In general</header><text>Notwithstanding the 2nd sentence of section 926(a) of this title, the Attorney General shall keep a record of the holders of a license issued under this section, and shall enable the NICS system to access the record in conducting criminal background checks pursuant to this section.</text></subparagraph><subparagraph id="H8E1208FE47204F23B7AFF411061475DC"><enum>(B)</enum><header>Limitation on FBI access</header><text>The Director of the Federal Bureau of Investigation may not access the record except for the purpose of—</text><clause id="H1E69D685EE744AF7AB69E514326640DD"><enum>(i)</enum><text>conducting a criminal background check pursuant to this section; or</text></clause><clause id="H8AF672952AA44F06814489E4CE011FF2"><enum>(ii)</enum><text display-inline="yes-display-inline">confiscating a license issued under this section, in the case that the licensee becomes ineligible to receive a firearm under Federal law.</text></clause></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H57483F6D9BDA4DC99F9D6B5924DAB96C"><enum>(b)</enum><header>Definitions</header><text>Section 921(a) of such title is amended—</text><paragraph id="HDE397DF9605F40988BCFD05AFB6BEBF5"><enum>(1)</enum><text>by inserting after paragraph (29) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HAE2ACD0A36D7442D82D0472FCB66BEDA"><paragraph id="H7B046ECEEFD4466999163FE6D3C6391E" indent="up1"><enum>(30)</enum><text>The term <term>semiautomatic pistol</term> means any repeating pistol that—</text><subparagraph id="H820D8D7A0FA04B4C90B51730397C0EA2"><enum>(A)</enum><text>utilizes a portion of the energy of a firing cartridge to extract the fired cartridge case and chamber the next round; and</text></subparagraph><subparagraph id="H42DF3CD7F97C4865B770CB400E5321EA"><enum>(B)</enum><text>requires a separate pull of the trigger to fire each cartridge.</text></subparagraph></paragraph><paragraph id="HAC8E58B35C5F4434858988E94E638958" indent="up1"><enum>(31)</enum><text>The term <term>semiautomatic shotgun</term> means any repeating shotgun that—</text><subparagraph id="H7E7ED47B22714A62A6612BEFFB22447F"><enum>(A)</enum><text>utilizes a portion of the energy of a firing cartridge to extract the fired cartridge case and chamber the next round; and</text></subparagraph><subparagraph id="H285DE180E6684E07AB005FB5147B9CD0"><enum>(B)</enum><text>requires a separate pull of the trigger to fire each cartridge.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H89B2858A3CCA40589405D3A1CDA1910A"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HD1CCADCF7B224C428ACDA9727B4C57A1"><paragraph id="H2B0AFA0E06364015BDA42DD8C2A784DD" indent="up1"><enum>(36)</enum><text>The term <term>assault weapon</term> means any of the following, regardless of country of manufacture or caliber of ammunition accepted:</text><subparagraph id="H4495DA58C785445394FB600381E33D01"><enum>(A)</enum><text>A semiautomatic rifle that has—</text><clause id="HF2AA5D620DC74CA9A83E996D253737A1"><enum>(i)</enum><text>a magazine that is not a fixed magazine; and</text></clause><clause id="HC22E1279E2504CF1A2B9432708A95BD0"><enum>(ii)</enum><text>any of the following:</text><subclause id="H25DF1AAF9A334B0396CF9BA16D286FE8"><enum>(I)</enum><text>A pistol grip.</text></subclause><subclause id="H3F93C5DDC7F54866B7C5BC29E9E320A1"><enum>(II)</enum><text>A forward grip.</text></subclause><subclause id="H53CBF60685504A26B0E5F91E211C8F93"><enum>(III)</enum><text>A folding, telescoping, or detachable stock, or is otherwise foldable or adjustable in a manner that operates to reduce the length, size, or any other dimension, or otherwise enhances the concealability, of the weapon.</text></subclause><subclause id="HBEB1E4983F62445D8F5A7F039284F8FC"><enum>(IV)</enum><text>A grenade launcher.</text></subclause><subclause id="HD4B0062478C04862BB1D5AFF82CB6CA9"><enum>(V)</enum><text>A barrel shroud.</text></subclause></clause></subparagraph><subparagraph id="H6A0C0B89C62445488FCC2AB29FF3AE79"><enum>(B)</enum><text>A semiautomatic rifle that has a fixed magazine with the capacity to accept more than 15 rounds, except for an attached tubular device designed to accept, and capable of operating only with, .22 caliber rimfire ammunition.</text></subparagraph><subparagraph id="H977CF5AC7EB24DE5B9AF71E97BD892EA"><enum>(C)</enum><text>Any part, combination of parts, component, device, attachment, or accessory that is designed or functions to accelerate the rate of fire of a semiautomatic firearm but not convert the semiautomatic firearm into a machinegun.</text></subparagraph><subparagraph id="HAA26E0D5EF4945C8AAF53857EDAF3DE3"><enum>(D)</enum><text>A semiautomatic pistol that has—</text><clause id="H7BCBB97B2CA442A7A99BBF00289EF32F"><enum>(i)</enum><text>a magazine that is not a fixed magazine; and</text></clause><clause id="H18A2E2B7489C436AB8C33CA21A632723"><enum>(ii)</enum><text>any of the following:</text><subclause id="HE0D28DE642564A93BF2A8409455BBD1D"><enum>(I)</enum><text>A second pistol grip.</text></subclause><subclause id="H32DB06C68426489E94D16C24D2E965F8"><enum>(II)</enum><text>A barrel shroud.</text></subclause><subclause id="HB27507D0C9E44EBE8CEF2424F629BB90"><enum>(III)</enum><text>The capacity to accept a detachable magazine at some location outside of the pistol grip.</text></subclause><subclause id="HB3FB1B78541E444B96D42F207797BD94"><enum>(IV)</enum><text>A semiautomatic version of an automatic firearm.</text></subclause><subclause id="H151DD10055D2410187049A1D44A629D2"><enum>(V)</enum><text>A manufactured weight of 50 ounces or more when unloaded.</text></subclause><subclause id="H35CE8B4D664444BEBCCE1AD1B5D34EB8"><enum>(VI)</enum><text>A stabilizing brace or similar component.</text></subclause></clause></subparagraph><subparagraph id="HEFEEF91289BB411EB9453D1DB90A93BA"><enum>(E)</enum><text>A semiautomatic pistol with a fixed magazine that has the capacity to accept more than 15 rounds.</text></subparagraph><subparagraph id="H19C0C46C6FCF4853B9BC3DA84F694673"><enum>(F)</enum><text>A semiautomatic shotgun that has—</text><clause id="HFA619CE6BBBB46E9A775BBB5F33AE536"><enum>(i)</enum><text display-inline="yes-display-inline">the capacity to utilize a magazine that is not a fixed magazine; or</text></clause><clause id="H579F208F75AD43CAB25F9CCE7B5265D6"><enum>(ii)</enum><text>an extension of the stock along the bottom of the barrel which does not encircle or substantially encircle the barrel.</text></clause></subparagraph></paragraph><paragraph id="H9AB8C43BF0F7424BB41887A5C1CAC8BA" indent="up1"><enum>(38)</enum><text>The term <term>detachable magazine</term> means an ammunition feeding device that can be removed from a firearm without disassembly of the firearm action.</text></paragraph><paragraph id="HAC4DF815D57B41C5ADD5A24CDA55ECDB" indent="up1"><enum>(39)</enum><text>The term <term>fixed magazine</term> means an ammunition feeding device that is contained in and not removable from or permanently fixed to the firearm.</text></paragraph><paragraph id="H8B54C7652D07443692DF8E3D5AFB66A9" indent="up1"><enum>(40)</enum><text>The term <term>folding, telescoping, or detachable stock</term> means a stock that folds, telescopes, detaches or otherwise operates to reduce the length, size, or any other dimension, or otherwise enhances the concealability, of a firearm.</text></paragraph><paragraph id="HC956B3F4DBC0411292434FB8CF1EF3EC" indent="up1"><enum>(41)</enum><text>The term <term>forward grip</term> means a grip located forward of the trigger that functions as a pistol grip.</text></paragraph><paragraph id="H72516CF4111040E699122F7555CCC330" indent="up1"><enum>(42)</enum><text>The term <term>grenade launcher</term> means an attachment for use on a firearm that is designed to propel a grenade or other similar destructive device.</text></paragraph><paragraph id="H5D0AD58434C64B888490BFC5C3C3924B" indent="up1"><enum>(43)</enum><text>The term <term>pistol grip</term> means a grip, a thumbhole stock or Thordsen-type grip or stock, or any other characteristic that can function as a grip.</text></paragraph><paragraph id="H99C08F2819E84D17BA7FE0FE75A7903C" indent="up1"><enum>(44)</enum><text>The term <term>belt-fed semiautomatic firearm</term> means any repeating firearm that—</text><subparagraph id="HA41F812C53C2478590A5D5ACBB3A30D1"><enum>(A)</enum><text>utilizes a portion of the energy of a firing cartridge to extract the fired cartridge case and chamber the next round;</text></subparagraph><subparagraph id="HFB3ED48FEEFA466EA391FBA892485B99"><enum>(B)</enum><text>requires a separate pull of the trigger to fire each cartridge; and</text></subparagraph><subparagraph id="HB98898EAA9CC456BB576B0406AC9208A"><enum>(C)</enum><text>has the capacity to accept a belt ammunition feeding device.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H31C0F90BD2D14941B71DA9F6544A1EAF" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Prohibition on transfer to certain unlicensed persons</header><text>Section 922 of such title is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA5FF22BBB1F34F9B9D6FC86EEEDB0606"><subsection commented="no" display-inline="no-display-inline" id="HCD6378192260453BA6971D26D7812DE9"><enum>(aa)</enum><header>Prohibition on transfer to certain unlicensed persons</header><text>It shall be unlawful for any person to—</text><paragraph commented="no" display-inline="no-display-inline" id="H591D69D2BBFF4494A5B071AC77A500C1"><enum>(1)</enum><text>sell or otherwise dispose of an assault weapon to any person if such person does not have a license issued under section 935 or a substantially similar State law, as determined by the Attorney General, during the previous 30 days; or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBE64C26F7A9846529A23B34904EFB708"><enum>(2)</enum><text>fail to report to the relevant law enforcement agencies the sale or disposal described in paragraph (1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF3929A4CD7D74BA4BC11BE689FAA8158"><enum>(d)</enum><header>Penalties</header><text>Section 924(a) of such title is amended by adding at the end the following:</text><quoted-block style="OLC" id="HF637E1ECEE5646B8BB3C2C2CC5C26DBC" display-inline="no-display-inline"><paragraph id="HA0F775C219F84039BA1F10F4E51A9357" indent="up1"><enum>(9)</enum><text display-inline="yes-display-inline">Whoever knowingly violates section 935 or 922(aa) shall—</text><subparagraph id="HABDA57903D624B46B097CBAE426B5D7B"><enum>(A)</enum><text>in the case of the 1st such violation by the person, be fined not more than $5,000, imprisoned not more than 1 year, or both; or</text></subparagraph><subparagraph id="HFE5BE1A363E945649D18F87079992CD0"><enum>(B)</enum><text>in the case of any subsequent such violation by the person, be fined not more than $15,000, imprisoned not more than 5 years, or both.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H1ABA89ADFE0A406F9138D794A9504556"><enum>(e)</enum><header>Clerical amendment</header><text>The table of sections for such chapter is amended by adding at the end the following:</text><toc regeneration="no-regeneration"><toc-entry level="section"><quote>935. License for the acquisition or receipt of assault weapons.</quote>.</toc-entry></toc></subsection><subsection id="HD4E0266D17CE460F924842F2F929A569"><enum>(f)</enum><header>Information-Sharing</header><text display-inline="yes-display-inline">Section 103(e)(1)(C) of the Brady Handgun Violence Prevention Act (<external-xref legal-doc="usc" parsable-cite="usc/34/40901">34 U.S.C. 40901(e)(1)(C)</external-xref>) is amended by adding at the end the following: <quote>If a State or local agency has any record of any person demonstrating that the person falls within one of the categories of prohibition pertinent to the Interstate Identification Index, the National Crime Information Center, or any other index of the system, the head of the department or agency shall, not less frequently than quarterly, provide the pertinent information contained in the record to the Attorney General.</quote>.</text></subsection></section><section commented="no" display-inline="no-display-inline" id="H4876E5436F2A49809809B73A92137440"><enum>3.</enum><header>Point-of-sale background checks</header><subsection id="H58CC241A38374E4EBD699AED64E160F6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 922 of title 18, United States Code, as amended by section 2(c) of this Act, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HECEDC58A74064EC69B06A9C48E5C7273"><subsection commented="no" display-inline="no-display-inline" id="H4C072C136E9445B19922585328FA41C3"><enum>(bb)</enum><header>Point-of-Sale background checks</header><paragraph commented="no" display-inline="no-display-inline" id="H0A08F6BFC2184D31A34E69CABB9D58D4"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">It shall be unlawful for any person who is not a licensed importer, licensed manufacturer, or licensed dealer to transfer an assault weapon to any other person who is not so licensed, unless a licensed importer, licensed manufacturer, or licensed dealer has first taken possession of the assault weapon for the purpose of complying with subsection (t).</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="HBEFBC4D5961445DC9FF29639E6E57387"><enum>(2)</enum><header>Compliance</header><text>Upon taking possession of an assault weapon under paragraph (1), a licensee shall comply with all requirements of this chapter as if the licensee were transferring the assault weapon from the inventory of the licensee to the unlicensed transferee.</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="HAC1D11CA8891497DA7F6E165DCDC0921"><enum>(3)</enum><header>Return</header><text display-inline="yes-display-inline">If a transfer of an assault weapon described in paragraph (1) will not be completed for any reason after a licensee takes possession of the assault weapon (including because the transfer of the assault weapon to, or receipt of the assault weapon by, the transferee would violate this chapter), the return of the assault weapon to the transferor by the licensee shall not constitute the transfer of a firearm for purposes of this chapter.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HA87378CD2EAB46358AC572A9AF62530C"><enum>(b)</enum><header>Penalties</header><paragraph id="H7AD7F91DEA2C41D2A1770D89D3C9370E"><enum>(1)</enum><header>Violations by non-licensees</header><text>Section 924(a) of such title, as amended by section 2(d) of this Act, is amended by adding at the end the following:</text><quoted-block style="OLC" id="H642BCB2D74544ED0AAEB166D31B64854" display-inline="no-display-inline"><paragraph id="HBC5A5A7448C24C78A01BEFB8939B3736" display-inline="no-display-inline" indent="up1"><enum>(10)</enum><header>Penalties for point-of-Sale background check violations by non-Licensees</header><text>Whoever knowingly violates section 922(bb)(1) shall—</text><subparagraph id="H095C94B35CEC4976962A1E218BF64959"><enum>(A)</enum><text>in the case of the 1st such violation by the person, be fined under this title, imprisoned not more than 1 year, or both; or</text></subparagraph><subparagraph id="H60128E7FE8934E0086A12D75D9B3C097"><enum>(B)</enum><text>in the case of any subsequent violation by the person, be fined under this title, imprisoned not more than 5 years, or both.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HBD1139CABE864C21ABB2290E78E265D6"><enum>(2)</enum><header>Violations by licensees</header><text>Section 924(a)(5) of such title is amended by striking <quote>(s) or (t)</quote> and inserting <quote>(s), (t), or (bb)(2)</quote>.</text></paragraph></subsection></section><section id="H7FA7D9E7DBAF4AE4A568A009C73120A9"><enum>4.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall take effect on the date that is 18 months after the date of the enactment of this Act.</text></section></legis-body></bill>
