<section id="HA2B459ACB89D43EDB611A8F0765290BF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Storing All Firearms Effectively and Safely Act</short-title></quote> or as the <quote><short-title>SAFES Act</short-title></quote>. </text></section> <section id="H469FF60F990F45169328B6383B05AFC8"><enum>2.</enum><header>Refundable credit for certain gun safes</header> <subsection id="H9A89A0A110E345B09C73F519C3071CD3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subpart C of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new section:</text>

<section id="HF1B845EBAEBB4482B33D6FC6EB82E939"><enum>36C.</enum><header>Credit for certain gun safes</header> 
<subsection id="H7BDAA11BAB474C82AE7AA55370F8CD00"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of an individual, there shall be allowed as a credit against the tax imposed by this subtitle for any taxable year an amount equal to 90 percent of the aggregate amount paid or incurred by the taxpayer during the taxable year for—</text> <paragraph id="H4C94A127415A4DD8A34835089F214735"><enum>(1)</enum><text>in the case of any taxable year beginning before January 1, 2030, any gun safe, and</text></paragraph> 
<paragraph id="H6D6D0A6376554A0F8E8FC0CA31BA74B4"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of any taxable year beginning after December 31, 2029, any gun safe which is of a type which has been determined by the Secretary of Health and Human Services in the report made publicly available under section 3 of the <short-title>SAFES Act</short-title> to be highly effective in preventing unauthorized access.</text></paragraph></subsection> <subsection id="H20B0FF66555E4EAA945D4F143A8DEB0C"><enum>(b)</enum><header>Limitation</header><text>The amount allowed as a credit under subsection (a) with respect to any taxpayer for any taxable year shall not exceed the excess (if any) of—</text> 
<paragraph id="H2F74A5C43F87443D82E5E306CEEA1F24"><enum>(1)</enum><text>$500 ($1,000 in the case of a joint return), over</text></paragraph> <paragraph id="HD9D4E24F0F224B189422F2930D64B851"><enum>(2)</enum><text>the aggregate amount of credits allowed under this section with respect to such taxpayer during the 6 preceding taxable years.</text></paragraph></subsection> 
<subsection id="HE753A73AEA044B0A9F0AC97B9C0D6FE9"><enum>(c)</enum><header>Gun safe</header><text display-inline="yes-display-inline">For purposes of this section—</text> <paragraph id="H14A879AFD77B4BFA9BC93EE6B502C5BE"><enum>(1)</enum><header>In general</header><text>The term <quote>gun safe</quote> means—</text>
<subparagraph id="H27AF8EB93309421097CFAD0EAA5BC5EF"><enum>(A)</enum><text>any device that is designed and marketed for the principal purpose of denying unauthorized access to a firearm or ammunition, and </text></subparagraph> <subparagraph id="H656914110780494FB06C3559BA451AE8"><enum>(B)</enum><text>any safe, gun safe, gun case, lock box, or other device that is secured by a combination lock, key lock, or lock based on biometric information which, once locked, is incapable of being opened without the combination, key, or biometric information, respectively.</text></subparagraph></paragraph>
<paragraph id="HCA0269F98CBE483784CF204F4FEEA5AE"><enum>(2)</enum><header>Exclusion of used safes</header><text>Such term shall not include any property unless the original use of such property begins with the taxpayer.</text></paragraph></subsection> <subsection id="HAFB5E18975FF462CBE6754B423F3A54D"><enum>(d)</enum><header>Prohibition on collection of information regarding firearms</header><text display-inline="yes-display-inline">No taxpayer shall be required, as a condition of the credit allowed under this section, to provide any information with respect to any firearms owned by the taxpayer.</text></subsection> </section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="H6248E5E263CF40E4855FE51496D876CD"><enum>(b)</enum><header>Conforming amendments</header> 
<paragraph id="H64F169316C5049D8ACB7A7D7F5355255"><enum>(1)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/26/6211">Section 6211(b)(4)(A)</external-xref> of the Internal Revenue Code of 1986 is amended by inserting <quote>36C,</quote> after <quote>36B,</quote>.</text></paragraph> <paragraph id="H8D3557B7C35B425C94699D34BF3BFF13"><enum>(2)</enum><text>Paragraph (2) of section 1324(b) of title 31, United States Code, is amended by inserting <quote>36C,</quote> after <quote>36B,</quote>.</text></paragraph> 
<paragraph id="HD0DAD0F578634016B41969CB05304D1C" commented="no"><enum>(3)</enum><text>The table of sections for subpart C of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after the item relating to section 36B the following new item:</text> <quoted-block style="OLC" id="HAAD19D7639D64BBD86855F9EF385B327" display-inline="no-display-inline"> <toc container-level="quoted-block-container" quoted-block="no-quoted-block" lowest-level="section" idref="H16F7494C534F40D0B0B450AE44DE68C6" regeneration="yes-regeneration" lowest-bolded-level="division-lowest-bolded"> <toc-entry idref="HF1B845EBAEBB4482B33D6FC6EB82E939" level="section">Sec. 36C. Credit for certain gun safes.</toc-entry> </toc><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> <subsection id="H5524F5D8AB4E4B11A64FE1745562196A"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after December 31, 2022.</text></subsection></section> 
<section id="H0CAF6FB2BEAD4F6398DB486DCA102857"><enum>3.</enum><header>Report on most effective gun safes</header><text display-inline="no-display-inline">Not later than the date which is 5 years after the date of the enactment of this Act, the Secretary of Health and Human Services shall make publicly available a report indicating which types of gun safes (as defined <external-xref legal-doc="usc" parsable-cite="usc/26/36C">section 36C(c)</external-xref> of the Internal Revenue Code of 1986) are highly effective in preventing unauthorized access.</text> </section> </legis-body></bill>
