which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a cause of action with respect to reproductive health services, and for other purposes.</official-title></form><legis-body id="HD0C1E576905242E98BF657B2F076179A" style="OLC"><section id="H7244BF87CC5349588C296C78297E65B2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Saving Abortion Facilities from Extremists for Patients Act</short-title></quote> or the <quote><short-title>SAFE for Patients Act</short-title></quote>. </text></section><section id="HCA26BE42FDB84918931062729158D827"><enum>2.</enum><header>Cause of action with respect to reproductive health services</header><subsection id="H89AF2DF66E284C6C9EFD1294E1FA9658"><enum>(a)</enum><header>Cause of action</header><text display-inline="yes-display-inline">Any person may bring a civil action against any person who—</text><paragraph id="H3163D6F2E8CA48FFBC37FB8EAE9035C0"><enum>(1)</enum><text>intentionally damages or destroys the property of a facility that provides reproductive health services, or attempts to do so, because such facility provides reproductive health services;</text></paragraph><paragraph id="HC30CF62805CB41B290D77B2D1352FA3E"><enum>(2)</enum><text>by force or threat of force or by physical obstruction intentionally harasses, injures, intimidates, or interferes with a person because that person is providing or obtaining reproductive health services; or</text></paragraph><paragraph id="HC3329EEC128C45DAA0A78D8BEC547AAE"><enum>(3)</enum><text>knowingly engages in conduct that aids or abets the performance of an action described pursuant to paragraphs (1) or (2). </text></paragraph></subsection><subsection id="H052EE0CEE8254B499B26700C13D48914"><enum>(b)</enum><header>Award of damages</header><text>If a claimant prevails on an action brought under subsection (a), the court shall award—</text><paragraph id="H1F46AFE3D1A6442CA4BFA48229DFD5A0"><enum>(1)</enum><text>injunctive relief sufficient to prevent the defendant from further violation of subsection (a) or engaging in acts that aid or abet a violation of subsection (a); </text></paragraph><paragraph id="H1FA43EE0F7E74722A52355692B791936"><enum>(2)</enum><text>statutory damages in an amount of not less than $10,000 per violation of subsection (a); and </text></paragraph><paragraph id="H24FEF856963E4CE69DEA231BA623F20B"><enum>(3)</enum><text>costs and attorney’s fees. </text></paragraph></subsection><subsection id="H739310C0ED184A0B997B4C223180F43E"><enum>(c)</enum><header>Not a defense</header><text>Notwithstanding any other law, the following shall not be a defense for a violation of subsection (a):</text><paragraph id="H192D1DB0656C40F6894FCF41CE1CD9B9"><enum>(1)</enum><text>Ignorance or mistake of law. </text></paragraph><paragraph id="H0585DEB402CC4974B89FF018144FBF51"><enum>(2)</enum><text>A defendant’s belief that the requirements of this section are unconstitutional or were unconstitutional. </text></paragraph><paragraph id="H2321622451944736AC6BC18FBF43EBC9"><enum>(3)</enum><text>A defendant’s reliance on any court decision that has been overruled on appeal or by a subsequent court, even if that court decision had not been overruled when the defendant engaged in conduct that violates this section.</text></paragraph><paragraph id="H4A5A9EFD4CB84AA088C8AEF685F40802"><enum>(4)</enum><text>A defendant’s reliance on any State or Federal court decision that is not binding on the court in which the action has been brought. </text></paragraph><paragraph id="HD73C95A2993047D3855077430DBC7CC5"><enum>(5)</enum><text>Non-mutual issue preclusion or non-mutual claim preclusion. </text></paragraph></subsection><subsection id="HE1F0BDC6F14E4330819A53AF6D8A551D"><enum>(d)</enum><header>Statute of limitations</header><text>A person may bring an action under this section not later than the four years after the date on which the violation of subsection (a) occurred.</text></subsection><subsection id="HBAA5DFA83E884783B197834A0342C053"><enum>(e)</enum><header>Reproductive health services defined</header><text display-inline="yes-display-inline">In this section, the term <quote>reproductive health services</quote> shall have the meaning given such term in section 248 of title 18, United States Code. </text></subsection></section></legis-body></bill>
