<official-title display="yes">To amend the Internal Revenue Code of 1986 to provide tax credits for personal protective equipment to small businesses, non-profits, independent contractors, veterans’ organizations, and farmers, among other entities, in any year in which the President declares a national emergency relating to COVID–19.</official-title>

<section id="H8393A1EFD7DF42B4AC5C3985BE104B03" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Small Business PPE Tax Credit Act</short-title></quote>. </text></section> <section id="H870E76A25596433DB85F0D52BD1D034E"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
<paragraph id="H01BE57DAC683408DAEE6B0CE395C76AF"><enum>(1)</enum><text display-inline="yes-display-inline">On January 21, 2020, the United States confirmed the Nation’s first case of the 2019 novel coronavirus, which presents as the disease COVID–19. </text></paragraph> <paragraph id="H574D9EB96F9E4957A264C37006AA5BD2"><enum>(2)</enum><text>On March 11, 2020, the World Health Organization upgraded the COVID–19 outbreak from global health emergency status to a pandemic. </text></paragraph>
<paragraph id="H7908764BAA71418FAA2486D5F9F8F591"><enum>(3)</enum><text>On March 15, 2020, the Centers for Disease Control and Prevention recommended a restriction on gatherings of 50 or more people in the United States. </text></paragraph> <paragraph id="H23BBAB802C654C378FEC4CA3AE09218B"><enum>(4)</enum><text>Beginning in mid-March, the administration issued new guidelines on the pandemic and called for nationwide social distancing, among other precautions, to slow the spread of COVID–19.</text></paragraph>
<paragraph id="HDDAB1CBF17CC43B3BFCE8B4AC556C0BC"><enum>(5)</enum><text>On March 17, 2020, Dr. Anthony Fauci, in his capacity as Director of the National Institute of Allergy and Infectious Diseases, explained that <quote>social distancing is really physical separation of people, wherein circumstances where there are crowds, you remove yourself from very close contact.</quote></text></paragraph> <paragraph id="HAB7F3493077B41E4923DE41B132114F7"><enum>(6)</enum><text>Most Governors executed orders in States across the country to close or restrict operations of business across various industries on a temporary basis, in an effort to promote social distancing, stymie the rapid spread of the coronavirus, and flatten the curve so as not to overwhelm the Nation’s health care system’s capacity. </text></paragraph>
<paragraph id="HCFB01E8A856242BD8E11868CBF48B1D0"><enum>(7)</enum><text>Those closures or operating limitations have caused significant strain on America’s small businesses in the interest of public health. </text></paragraph> <paragraph id="HB93705C5240A4AD7830D34AF9BDB26B2"><enum>(8)</enum><text>Small businesses are the engine of the United States economy, comprising 99 percent of all business ventures in the United States and accounting for half of the United States economy. </text></paragraph>
<paragraph id="HED143D6B9ED04BBD9394D4E20E8C8764"><enum>(9)</enum><text>In order to safely resume full operations, these small businesses need access to personal protective equipment; in some cases, States are requiring employers and employees use this personal protective equipment in order to allow public entry.</text></paragraph> <paragraph id="HB7BD7C79F1334E13A096681C05198CA2"><enum>(10)</enum><text>Due to the fiscal strain of pandemic-related losses on these small businesses, they cannot and should not bear the financial burden of acquiring personal protective equipment without relief. </text></paragraph>
<paragraph id="HEE3A08C395464C1693EAEBC038CBD91D"><enum>(11)</enum><text>Providing relief through a tax credit for the purchase and use of personal protective equipment will directly support small businesses returning to and exceeding pre-COVID-19 pandemic production levels.</text></paragraph> <paragraph id="H6704BA9BDC384AC580B5F690D76F51A0"><enum>(12)</enum><text>At a Small Business Committee forum on May 28, 2020, Mr. Charles “Tee” Rowe, President and Chief Executive Officer of America’s SBDC, testified to the potential value of such credits. </text></paragraph>
<paragraph id="HC0AB7580D92E46F0BAD0EEB798F3BE5C"><enum>(13)</enum><text>Personal protective equipment tax credits will be instrumental in safely and responsibly restarting the engine of the United States economy.</text></paragraph></section> <section id="HA1DBF568F5E0417A9C17C20D60266606"><enum>3.</enum><header>Personal Protective Equipment Tax Credit</header> <subsection id="HDE45850A483841B88184B2D6A58605C2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subpart D of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new section:</text>

<section id="HDA5FD0F71DD248249597D6B7A15CEBB2"><enum>45U.</enum><header>Personal Protective Equipment Credit</header>
<subsection id="H1D147D6356924F29ACE621536E60B2EE"><enum>(a)</enum><header>Allowance of credit</header><text display-inline="yes-display-inline">For purposes of section 38, the personal protective equipment credit determined under this section for the taxable year is an amount equal to the amount paid by an eligible taxpayer in carrying on any trade or business for qualified personal protective equipment expenses during such year.</text></subsection> <subsection id="H3C9900952D6C4C7AB4A099F28BE2CD7C"><enum>(b)</enum><header>Maximum credit</header><text>The credit determined under this section with respect to any eligible taxpayer for any taxable year shall not exceed $25,000.</text></subsection>
<subsection id="H01CC3D87CA894330863355B6BD0B7C02"><enum>(c)</enum><header>Definition and special rules</header><text display-inline="yes-display-inline">For purposes of this section—</text> <paragraph id="H5D710EDE72F44294B8DB6DA46AC24E8E"><enum>(1)</enum><header>Eligible taxpayer</header> <subparagraph id="H82BAC518CDA5415D977D1BC5A490163E"><enum>(A)</enum><header>In general</header><text>The term <term>eligible taxpayer</term> means—</text>
<clause id="H0CF1FD529FD04644A41934B3CF9BDBC9"><enum>(i)</enum><text>a small business concern, </text></clause> <clause id="H2064F829AB644E4EB257A8F29C7BCE5E"><enum>(ii)</enum><text display-inline="yes-display-inline">any business concern (including an enterprise that is engaged in the business of production of food and fiber, ranching and raising of livestock, aquaculture, and all other farming and agricultural related industries), or Tribal business concern that employs not more than the greater of—</text>
<subclause id="H55EDC176712647B7A21B72764811E1B6"><enum>(I)</enum><text>500 employees, or</text></subclause> <subclause id="H4FB887D604C54B79B5C0D5C86F9A2794"><enum>(II)</enum><text>if applicable, the size standard in number of employees established by the Small Business Administration for the industry in which such business concern, veterans organization, or Tribal business concern operates, or</text></subclause></clause>
<clause id="HCE49D246FCD6479C9D664EB0CD8551AD"><enum>(iii)</enum><text display-inline="yes-display-inline">an individual who operates under a sole proprietorship, as an independent contractor, or as a self-employed individual.</text></clause></subparagraph> <subparagraph id="H7AA9990EA7534A84A6E4F79EFE34FF21"><enum>(B)</enum><header>Small business concern</header><text display-inline="yes-display-inline">The term <term>small business concern</term> has the meaning given such term under section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>), and also includes—</text>
<clause id="H2A59C60EF78A46EB81E9C0850B348331"><enum>(i)</enum><text>any business concern that employs not more than 500 employees per physical location of such business concern and that is assigned a North American Industry Classification System code beginning with 72,</text></clause> <clause id="HA4F1941DCFD84EFD81AC6AF3A8E57D47"><enum>(ii)</enum><text display-inline="yes-display-inline">any business concern operating as a franchise that is assigned a franchise identifier code by the Small Business Administration, and</text></clause>
<clause id="H8DBD8308A2854D82BE4293EC961BA9C5"><enum>(iii)</enum><text display-inline="yes-display-inline">any business concern that receives financial assistance from a company licensed under section 301 of the Small Business Investment Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/15/681">15 U.S.C. 681</external-xref>).</text></clause></subparagraph> <subparagraph id="H33DBCEF51B054A80842FB671AE799F0C"><enum>(C)</enum><header>Documentation requirements</header><text>The Secretary may establish such documentation requirements as are necessary to determine eligibility for a credit under this section. </text></subparagraph></paragraph>
<paragraph id="H2E071836C4274D829F3E079BE679B3D1"><enum>(2)</enum><header>Qualified personal protective equipment expenses</header><text>The term <term>qualified personal protective equipment expenses</term> includes amounts paid or incurred—</text> <subparagraph id="HF7581CC611ED4AF5B77E3E3F91BD3A0F"><enum>(A)</enum><text display-inline="yes-display-inline">for the purpose of reducing the risk of Coronavirus Disease 2019 (COVID–19) transmission between people on the premises of the business of the taxpayer, including—</text>
<clause id="H71B76196695E4C8E8D926B35DBDF767F"><enum>(i)</enum><text display-inline="yes-display-inline">gloves, medical masks, N–95 respirators, eye protection, gowns and aprons, boots or closed-toe work shoes, cleaning detergents, hand sanitizers, cleaning products and tools,</text></clause> <clause id="HBF034B3CD7ED450397837436A69DDAC3"><enum>(ii)</enum><text>retrofitting or installation of equipment, and </text></clause>
<clause id="H4636634D2988466CAF0B7E82054D7678"><enum>(iii)</enum><text display-inline="yes-display-inline">any other relevant expense the Secretary, in consultation with the Secretary of Health and Human Services, determines necessary, and</text></clause></subparagraph> <subparagraph id="HC26E49621EB34F149BBC8B2B59CC5838"><enum>(B)</enum><text display-inline="yes-display-inline">at any time during a year in which, with respect to COVID–19—</text>
<clause id="HDD9EC15474D04CBA862E101AA562A008"><enum>(i)</enum><text display-inline="yes-display-inline">the President declares a national emergency under the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601</external-xref> et seq.), or</text></clause> <clause id="HF468B970A8CB439F9C2DEA344B66CEBD"><enum>(ii)</enum><text display-inline="yes-display-inline">an emergency involving Federal primary responsibility is determined to exist by the President under the section 501(b) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5191">42 U.S.C. 5191(b)</external-xref>).</text></clause></subparagraph></paragraph></subsection>
<subsection id="H6D0AB220E200466AA7C244AD068EC4F4"><enum>(d)</enum><header>Denial of double benefit</header><text display-inline="yes-display-inline">No deduction shall be allowed under this chapter for any amount taken into account in determining the credit under this section.</text></subsection> <subsection id="HDA3ED0C0ADCE4496BC306C8D5581AA2B"><enum>(e)</enum><header>Denial of credit for counterfeit items</header><text>No credit shall be allowed under this section with respect to any item if the Secretary determines such item to be counterfeit or sold or distributed in bad faith.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H4A8B2C18EF6945D583B19F1DEEEE291B" display-inline="no-display-inline"><enum>(b)</enum><header>Credit made part of general business credit</header><text>Subsection (b) of section 38 of such Code is amended by striking <quote>plus</quote> at the end of paragraph (32), by striking the period at the end of paragraph (33) and inserting <quote>, plus</quote>, and by adding at the end the following new paragraph:</text> <quoted-block style="OLC" id="HE33D5FFED0254B4284180447CA141982" display-inline="no-display-inline"> <paragraph id="HE1C34EBC6869420BA6A6FD2E2B998575"><enum>(34)</enum><text display-inline="yes-display-inline">the personal protective equipment credit determined under section 45U.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H341C2443629E4892B44CC4B75EC15FD5" display-inline="no-display-inline"><enum>(c)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for subpart D of part IV of subchapter A of chapter 1 is amended by adding at the end the following new item:</text> <quoted-block style="OLC" id="HC9B784B2A5994DBB9CD74FC35E3C151E" display-inline="no-display-inline"> <toc container-level="quoted-block-container" quoted-block="no-quoted-block" lowest-level="section" idref="HB48B1D770702431B9546567BE0EB3B49" regeneration="yes-regeneration" lowest-bolded-level="division-lowest-bolded"> <toc-entry idref="HDA5FD0F71DD248249597D6B7A15CEBB2" level="section">Sec. 45U. Personal Protective Equipment Credit.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H37385AF1AA45414BB6C2470A21165FE3"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to expenses made or incurred after December 31, 2020, in taxable years ending after such date.</text></subsection></section>
