R. 8831</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220914">September 14, 2022</action-date><action-desc><sponsor name-id="S001175">Ms. Speier</sponsor> (for herself and <cosponsor name-id="D000623">Mr. DeSaulnier</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 10, United States Code, to authorize certain claims for personal injury or death caused by medical malpractice onboard certain naval vessels, and for other purposes.</official-title></form><legis-body id="H65214958413F4800B104049B7B35C0EB" style="OLC"><section id="H3C1DECDD474145EF9415C651A2E6CF4A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Seaman Danyelle Luckey Military Medical Accountability Amendment Act of 2022</short-title></quote>. </text></section><section id="H9401C709637B4D958594096B93EFAA05"><enum>2.</enum><header>Authorization of certain claims for personal injury or death caused by medical malpractice onboard certain naval vessels</header><subsection id="HE346B3CE4D0E42A3809D76A014B9750E"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">Section 2733a of title 10, United States Code, is amended—</text><paragraph id="HA38E58D69E144D559607EE58F2A6D83D"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)(3), by inserting <quote>or onboard a covered naval vessel of the United States that, at the time of such occurrence, was not engaged in combat operations</quote> after <quote>facility</quote>; and</text></paragraph><paragraph id="H56F6DF3C4ED441D68BD5605E838F74C5"><enum>(2)</enum><text>in subsection (i)—</text><subparagraph id="H1C57C614D801456B9818040918FABB06"><enum>(A)</enum><text>by redesignating paragraphs (2) and (3) as paragraphs (3) and (4), respectively; and</text></subparagraph><subparagraph id="HEDD617C9791A4104AEEF13B461CCE1C3"><enum>(B)</enum><text>by inserting after paragraph (1) the following new paragraph:</text><quoted-block style="USC" id="H9FD03B5442C942B39EE977F87FC0C354" display-inline="no-display-inline"><paragraph id="HB1A1B434C523411CBBC6CC1708D70A28"><enum>(2)</enum><header>Covered naval vessel</header><text display-inline="yes-display-inline">The term <quote>covered naval vessel</quote> means an aircraft carrier or amphibious ship.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HDF40A39821ED4522B56A0E33E994106A"><enum>(b)</enum><header>Applicability; filing period for certain claims</header><paragraph id="H210280FA7ACE4BD58DE2330EDBD229D4"><enum>(1)</enum><header>Applicability</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall apply with respect to claims that accrue—</text><subparagraph id="HC29A3E8366874FA387800EA78E15CDA8"><enum>(A)</enum><text>during the period described in paragraph (2)(B); or</text></subparagraph><subparagraph id="HD64C24D34AF54B0DB0328FFC9525DB25"><enum>(B)</enum><text>on or after the date of the enactment of this Act.</text></subparagraph></paragraph><paragraph id="H3996A203E6AA4E38BA11FD5F2916B018"><enum>(2)</enum><header>Filing period</header><subparagraph id="H8DC2D4CF8A6B4B699639C234264CAF1A"><enum>(A)</enum><header>In general</header><text>Any claim regarding an act or omission constituting medical malpractice onboard a navel vessel as specified in section 2733a(b)(3) of title 10, United States Code (as amended by subsection (a)) that accrues during the period described in subparagraph (B) and is filed not later than 90 days after the date of the enactment of this Act—</text><clause id="H870B0CB0FC094185B55218BA6C2FEF24"><enum>(i)</enum><text display-inline="yes-display-inline">shall be deemed to be filed within the time period specified in section 2733a(b)(4) of such title; and</text></clause><clause id="HAAC99317637F4D2097BD071D0B457C50" commented="no"><enum>(ii)</enum><text>notwithstanding section 2735 of such title, may be allowed, settled, and paid under section 2733a(a) of such title.</text></clause></subparagraph><subparagraph id="HEE6D023F4999468C97BCB20762DC4622"><enum>(B)</enum><header>Period described</header><text display-inline="yes-display-inline">The period described in this subparagraph is the period beginning on October 1, 2016, and ending on the day before the date of the enactment of this Act.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
