R. 8826</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220914">September 14, 2022</action-date><action-desc><sponsor name-id="J000301">Mr. Johnson of South Dakota</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Fair Labor Standards Act of 1938 to expand working hours for employees between the ages of 14 and 16 years during periods in which schools are in session, and for other purposes.</official-title></form><legis-body id="HB15DC9E6A1C941E1A0F4CE8A0370B2D4" style="OLC"><section id="H49F59AD8915843C3A0F89245762D9AA1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Teenagers Earning Everyday Necessary Skills Act</short-title></quote> or the <quote>TEENS Act</quote>. </text></section><section id="H9E191981BC0247A887DA77128D4C824B"><enum>2.</enum><header>Child labor hours and exemptions</header><text display-inline="no-display-inline">Section 3(l) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(l)</external-xref>) is amended—</text><paragraph id="HEC80A9CDD01246AC85FDA57D19F9AC6F"><enum>(1)</enum><text>by striking <quote>virture</quote> and inserting <quote>virtue</quote>; and</text></paragraph><paragraph id="HF1D1610E484543B9B0E39F9203B784F7"><enum>(2)</enum><text>by striking the period at the end and inserting </text><quoted-block style="OLC" display-inline="yes-display-inline" id="HC398D9688D644E4AA4B9ADC77E7D46E7"><text>, except that in no case may the Secretary provide that employment of such employees is deemed to constitute oppressive child labor due to the number of hours an employee works if such employee—</text><paragraph id="H9D1D4A95335944FD96C6FEF6836D2004"><enum>(1)</enum><text>in a week during any part of which school is in session, works 24 hours or less; and</text></paragraph><paragraph id="HA354B914902E43368520B3C934842779"><enum>(2)</enum><text>begins work at a time that is not earlier than 7:00 a.m. (in the time zone in which the employment is performed) and ends work at a time that is not later than 9:00 p.m. (in such time zone).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
