R. 8792</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220909">September 9, 2022</action-date><action-desc><sponsor name-id="S001216">Ms. Schrier</sponsor> (for herself and <cosponsor name-id="U000040">Ms. Underwood</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committees on <committee-name committee-id="HED00">Education and Labor</committee-name>, <committee-name committee-id="HWM00">Ways and Means</committee-name>, and <committee-name committee-id="HAS00">Armed Services</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit group health plans, health insurance issuers offering group or individual health insurance coverage, State plans under title XIX of the Social Security Act, State child health plans under title XXI of such Act, and the TRICARE program from applying a deductible to outpatient pediatric services.</official-title></form><legis-body id="H6B1B80E146664996B00B6808D2298C78" style="OLC"><section id="H7DE332B3CD6C42D7A093AEAC626C2F2A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Helping Families Access Pediatric Care Act of 2022</short-title></quote>.</text></section><section id="H1E54BF1CF87445BBB69F8A709C8A9464"><enum>2.</enum><header>Prohibiting certain health plans from applying a deductible to outpatient pediatric services</header><subsection id="HA6211B46E7784FF9AF929FBF891AE7BB"><enum>(a)</enum><header>ERISA</header><paragraph id="HB76CEEC77B1F4336ADF73D9A6215E6B7"><enum>(1)</enum><header>In general</header><text>Subpart B of part 7 of title I of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1185">29 U.S.C. 1185 et seq.</external-xref>) is amended by adding at the end the following new section:</text><quoted-block style="OLC" id="H4AD206BA82D943D8AAF01534FF944C7E" display-inline="no-display-inline"><section id="H2D458808D0DE4CD98B2E1F0399A9463F"><enum>716.</enum><header>Prohibition on application of deductible to outpatient pediatric services</header><subsection id="H1BAB21DBFCDE4B5F9E3E41E63987F70A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A group health plan and a health insurance issuer offering group health insurance coverage may not impose any deductible under such plan or coverage (as applicable) with respect to outpatient pediatric services (as defined in subsection (b)) for which benefits are provided under such plan or coverage.</text></subsection><subsection id="H16DC4A6963E0448DACC76273DC9E913D"><enum>(b)</enum><header>Outpatient pediatric services defined</header><text display-inline="yes-display-inline">For purposes of subsection (a), the term <quote>outpatient pediatric services</quote> means any item or service furnished to an individual under the age of 18 as an outpatient by a health care provider acting within the scope of such provider’s license, regardless of whether such service is furnished in-person or through use of a telecommunications system.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H4D5CEBA219A04E17AE5E8FA7F19B72C0"><enum>(2)</enum><header>Clerical amendment</header><text>The table of contents of the Employee Retirement Income Security Act of 1974 is amended by inserting after the item relating to section 714 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HDCE5294481234C3E81F4E4B5DDCED924"><toc><toc-entry level="section" bold="off">Sec. 715. Additional market reforms.</toc-entry><toc-entry level="section">Sec. 716. Prohibition on application of deductible to outpatient pediatric services.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H532D716215C74FB5B05421CE83283E77"><enum>(b)</enum><header>PHSA</header><text>Subpart II of part A of title XXVII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-11">42 U.S.C. 300gg–11 et seq.</external-xref>) is amended by adding at the end the following new section:</text><quoted-block style="OLC" id="HA23B0398D11341979CE0F2603765F1A1" display-inline="no-display-inline"><section id="H0CE7FFAB69CA4B129026D2F472AE827F"><enum>2730.</enum><header>Prohibition on application of deductible to outpatient pediatric services</header><subsection id="H9F3D0B774F88472D89BB3F55E2C37683"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A group health plan and a health insurance issuer offering group or individual health insurance coverage may not impose any deductible under such plan or coverage (as applicable) with respect to outpatient pediatric services (as defined in subsection (b)) for which benefits are provided under such plan or coverage.</text></subsection><subsection id="H3DBA2153554E41738A88BB21BA0C418D"><enum>(b)</enum><header>Outpatient pediatric services defined</header><text display-inline="yes-display-inline">For purposes of subsection (a), the term <quote>outpatient pediatric services</quote> means any item or service furnished to an individual under the age of 18 as an outpatient by a health care provider acting within the scope of such provider’s license, regardless of whether such service is furnished in-person or through use of a telecommunications system.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H5CAB4065B58E42B6BC44C62D669F6A73"><enum>(c)</enum><header>IRC</header><paragraph id="H6E431DAFAB3442DC8C7846126DECE387"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/100">chapter 100</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new section:</text><quoted-block style="OLC" id="H71A13CD57A5D419A80CF6EAEB011B8AA" display-inline="no-display-inline"><section id="H86EBADBECA4746D0A1175A57DD6AD402"><enum>9816.</enum><header>Prohibition on application of deductible to outpatient pediatric services</header><subsection id="H4BF9FFF79A0F43A9B334A1BFA490A54D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">A group health plan may not impose any deductible under such plan with respect to outpatient pediatric services (as defined in subsection (b)) for which benefits are provided under such plan.</text></subsection><subsection id="H4E565CFAA60B49618CAC3CC46D42318F"><enum>(b)</enum><header>Outpatient pediatric services defined</header><text display-inline="yes-display-inline">For purposes of subsection (a), the term <quote>outpatient pediatric services</quote> means any item or service furnished to an individual under the age of 18 as an outpatient by a health care provider acting within the scope of such provider’s license, regardless of whether such service is furnished in-person or through use of a telecommunications system.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HECAB6F66ACA748D99809210E8D68493B"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections for subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/100">chapter 100</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new items:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HCE828A83B2664366B5864C2E2A4B4D4D"><toc><toc-entry level="section" bold="off">Sec. 9815. Additional market reforms.</toc-entry><toc-entry level="section">Sec. 9816. Prohibition on application of deductible to outpatient pediatric services.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H1734E2C08CE841AE8169F35FC2C0BF1C"><enum>(d)</enum><header>Medicaid</header><text>Section 1916A of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396o-1">42 U.S.C. 1396o–1</external-xref>) is amended—</text><paragraph id="HC849769694D048F99C015931AAFE3EDA"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H1206FBFCA5824BCCA76C3C8CCE0F8C0C"><enum>(A)</enum><text>in paragraph (1), by striking <quote>paragraph (2)</quote> and inserting <quote>paragraphs (2) and (4)</quote>; and</text></subparagraph><subparagraph id="HF3DD1A2FADBA49A49DFFFB8AF5993A00"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="HE3DF7D0499444394A43CBCE1565311F7" display-inline="no-display-inline"><paragraph id="HC42D84DB1A414B48BBD502C7721514EE"><enum>(4)</enum><header>Prohibition on application of deduction to outpatient pediatric services</header><text display-inline="yes-display-inline">A State may not impose a deduction under the plan with respect to outpatient pediatric services (as defined in subsection (f)).</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HEDE875AB74DB4CA5BAD38CE232D50784"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" id="HFA4A716E733B46FFAEF7E751C2B6BB05" display-inline="no-display-inline"><subsection id="H486B5AE5244E4E96A8EFBACC876C4E2C"><enum>(f)</enum><header>Outpatient pediatric services defined</header><text display-inline="yes-display-inline">For purposes of this section, the term <quote>outpatient pediatric services</quote> means any item or service furnished to an individual under the age of 18 as an outpatient by a health care provider acting within the scope of such provider’s license, regardless of whether such service is furnished in-person or through use of a telecommunications system.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H8DC6B856C90C412B962791FF106923DB"><enum>(e)</enum><header>CHIP</header><text>Section 2103(e) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397cc">42 U.S.C. 1397cc</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="HBCC71D04ED73453E900E9C2B33FBBBDE" display-inline="no-display-inline"><paragraph id="HA0A32A547C414E528D981E701E899AA4"><enum>(5)</enum><header>Prohibition on application of deduction to outpatient pediatric services</header><subparagraph id="HCE1A6E22D4944E8FB82C820D08B9C5B5"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The State child health plan may not impose a deductible with respect to outpatient pediatric services (as defined in subparagraph (B)).</text></subparagraph><subparagraph id="H60999BD3C9B64A5C872027E2B292FF2E"><enum>(B)</enum><header>Outpatient pediatric services defined</header><text display-inline="yes-display-inline">For purposes of this paragraph, the term <quote>outpatient pediatric services</quote> means any item or service furnished to an individual under the age of 18 as an outpatient by a health care provider acting within the scope of such provider’s license, regardless of whether such service is furnished in-person or through use of a telecommunications system.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H88264835D946425E8F7B290559E811F2"><enum>(f)</enum><header>First-Dollar coverage allowance for outpatient pediatric services for high deductible plans</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/223">Section 223(c)(2)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="H6893BE572D4A4A62A9C35BE34E39D0BF" display-inline="no-display-inline"><subparagraph id="HE170894C4E6242FB897B694BBC50E675"><enum>(G)</enum><header>Safe harbor for absence of deductible for outpatient pediatric services</header><text display-inline="yes-display-inline">A plan shall not fail to be treated as a high deductible health plan by reason of failing to have a deductible for outpatient pediatric services (as defined in section 9816(b)).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H5B1F5AC12B9B489E9B6FEDC403A7903F"><enum>(g)</enum><header>TRICARE program</header><paragraph id="H22AFC7FE706A4BE8A9FD09C133F858AE"><enum>(1)</enum><header>In general</header><text>Section 1095d of title 10, United States Code, is amended—</text><subparagraph id="H33FB3D80EF1E42E0A2D5EF5F8796B358"><enum>(A)</enum><text>in the section heading, by inserting <quote><header-in-text level="section" style="USC">prohibition on and</header-in-text></quote> before <quote><header-in-text level="section" style="USC">waiver</header-in-text></quote>; </text></subparagraph><subparagraph id="HA07698B1477D4FA9B5204E8D3BA07E8B"><enum>(B)</enum><text>by redesignating subsections (a) and (b) as subsections (b) and (c), respectively;</text></subparagraph><subparagraph id="HA9F9C97EC3A5493BAB949848BB64D7BC"><enum>(C)</enum><text>by inserting before subsection (b), as so redesignated, the following new subsection (a):</text><quoted-block style="USC" id="H410F9058A3AB489C8BCB963E79BD79D3" display-inline="no-display-inline"><subsection id="H73421E7E6C294123A99DA087F99774B2"><enum>(a)</enum><header>Prohibition on application of deductible to outpatient pediatric services</header><text display-inline="yes-display-inline">The Secretary of Defense may not impose any deductible under the TRICARE program for medical care provided to a covered beneficiary who is under the age of 18 as an outpatient, regardless of whether such care is furnished in-person or through use of a telecommunications system.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HE6EECFA0824C462EBC0A71B7D557B470"><enum>(D)</enum><text>in subsection (b), as so redesignated, by striking <quote>The Secretary</quote> and inserting <quote>In addition to the requirement under subsection (a), the Secretary</quote>. </text></subparagraph></paragraph><paragraph id="HECF1B394EA534BB683BDD355EC5FEA83"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/55">chapter 55</external-xref> of title 10, United States Code, is amended by striking the item relating to section 1095d and inserting the following new item:</text><quoted-block style="USC" id="H3327E43752594417B3824595871092A8" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">1095d. TRICARE program: prohibition on and waiver of certain deductibles.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HD0CB0FEF77274E44A4E3F02E3152E7B8"><enum>(3)</enum><header>Conforming amendment</header><text>Section 1075(d) of such title is amended by adding at the end the following new paragraph:</text><quoted-block style="USC" id="H70EF11598D4F439E9D66B36F42F66F79" display-inline="no-display-inline"><paragraph id="H5EE304834B2442FAAFDF8F06C6DE75E3" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">The Secretary may not impose any deductible amounts for outpatient pediatric services pursuant to section 1095d of this title.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H01124A811DAB45D69AD51AC6D221621D"><enum>(h)</enum><header>GAO study</header><text>Not later than 4 years after the date of the enactment of this Act, the Comptroller General of the United States shall conduct a study and submit to Congress a report on the effects of the amendments made by this Act on premiums, deductibles, and copayment and coinsurance requirements with respect to group health plans and group and individual health insurance coverage (as such terms are defined in section 2791 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-91">42 U.S.C. 300gg–91</external-xref>)). </text></subsection><subsection id="HCAFD7FB416444EF6BFD8F0331C3A1693"><enum>(i)</enum><header>Effective date</header><text>The amendment (or amendments) made by—</text><paragraph id="H5DC79BB8384643BA9A435F2FD57A7346"><enum>(1)</enum><text>subsections (a) through (c) and subsections (f) and (g) shall apply with respect to plan years beginning on or after the date that is 2 years after the date of the enactment of this Act;</text></paragraph><paragraph id="H2A2217CA3E95406396F46C25E269FA62"><enum>(2)</enum><text display-inline="yes-display-inline">subsection (d) shall apply with respect to medical assistance furnished in calendar quarters beginning on or after the date that is 2 years after the date of the enactment of this Act; and</text></paragraph><paragraph id="H0789D06708B942B8B1D279D130ACEAD8"><enum>(3)</enum><text>subsection (c) shall apply with respect to child health assistance furnished calendar quarters described in paragraph (2).</text></paragraph></subsection></section></legis-body></bill>
