which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committees on <committee-name committee-id="HWM00">Ways and Means</committee-name>, and <committee-name committee-id="HED00">Education and Labor</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend part B of title XVIII of the Social Security Act to provide for a special enrollment period under Medicare for individuals enrolled in COBRA continuation coverage, and for other purposes.</official-title></form><legis-body id="H39E0A632F1274533B0BB22E68D031ABC" style="OLC"><section id="H798B1230DD6F4429A676253FA4364D5A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medicare Enrollment Protection Act of 2022</short-title></quote>.</text></section><section id="H1902BDF4F13F4B3F966CEE0BCA7709A7"><enum>2.</enum><header>Treatment under Medicare of individuals transitioning from COBRA continuation coverage</header><subsection id="HDE819963660C4B43B4053A79B10920D1" display-inline="no-display-inline" commented="no"><enum>(a)</enum><header>Special enrollment period for individuals enrolled in COBRA continuation coverage</header><text>Section 1837(i) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395p">42 U.S.C. 1395p(i)</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block id="H4F0AE65AAAD24105AE947FB29FB6B059" style="OLC"><paragraph id="HF5E757D915AA43EAAC135C10629A0FA8" commented="no"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H8F7BAD13345046FAA174A18BEF2981F3"><enum>(A)</enum><text>In the case of an individual who—</text><clause id="H1C5B671B9429481491295D04E5A2E2A3" indent="up1" commented="no"><enum>(i)</enum><text>at the time the individual first satisfies paragraph (1) or (2) of section 1836(a), is enrolled in COBRA continuation coverage (as defined in subparagraph (D)); or</text></clause><clause id="HB2BAD3FB7FCD41098311A75BF11568AE" indent="up1" commented="no"><enum>(ii)</enum><text>is enrolled in COBRA continuation coverage and immediately prior to such enrollment was an individual described in paragraph (1) or (2) of this subsection,</text><continuation-text continuation-text-level="clause" commented="no">there shall be a special enrollment period described in subparagraph (B).</continuation-text></clause></subparagraph><subparagraph id="H2AEDB1A091B74CE1AFA77F5790B8A420" indent="up1" commented="no"><enum>(B)</enum><text>The special enrollment period referred to in subparagraph (A) is the period that includes—</text><clause id="H6186CBEF55514A35BA16A6AD86EF666F" commented="no"><enum>(i)</enum><text display-inline="yes-display-inline">each month during any part of which the individual is enrolled in COBRA continuation coverage; and</text></clause><clause id="H601F9A66657F4D8395C18CBD20E865D3" commented="no"><enum>(ii)</enum><text>the 3-month period beginning with the first month following the last month during any part of which such individual is so enrolled.</text></clause></subparagraph><subparagraph id="H25D53744C45B4F0EB2FFE63C8613D44A" indent="up1" commented="no"><enum>(C)</enum><text>An individual may only enroll during the special enrollment period provided under subparagraph (A) one time during the individual’s lifetime.</text></subparagraph><subparagraph id="H32C0C090BE604FBDBDC174C3518F8174" indent="up1" commented="no"><enum>(D)</enum><text>For purposes of this paragraph, the term <term>COBRA continuation coverage</term> means continuation coverage beginning on or after January 1, 2023—</text><clause id="H7186791CC38E4F8795FCE7A59FEB914B" commented="no"><enum>(i)</enum><text>under a COBRA continuation provision (as defined in section 2791(d)(4) of the Public Health Service Act);</text></clause><clause id="H027FFE55F36D4EDD9BB1270C8F82C376" commented="no"><enum>(ii)</enum><text>pursuant to section 8905a of title 5, United States Code; or</text></clause><clause id="H9304F1C9F2FC4CEBBAE28999E3132C6F" commented="no"><enum>(iii)</enum><text>under a similar State law that provides comparable continuation of group health plan coverage.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HD92B825BA9DB407DB1D3605E30D0BD19"><enum>(b)</enum><header>Coverage period for certain eligible individuals</header><text>Section 1838(e) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395q">42 U.S.C. 1395q(e)</external-xref>) is amended—</text><paragraph id="H4F0F54E0496C43C098C5DD04F95C1C51"><enum>(1)</enum><text>by striking <quote>pursuant to section 1837(i)(3) or 1837(i)(4)(B)</quote> and inserting the following:</text><quoted-block display-inline="yes-display-inline" id="HFC3C329BA54349EBB87460F816DEDEEB" style="OLC"><text>pursuant to—</text><paragraph id="H6EECCBFEDA93481785B6B0493F3AD6AB"><enum>(1)</enum><text>section 1837(i)(3) or 1837(i)(4)(B)—</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H674FF649A2AA48F8B75995BAEE4AEDAD"><enum>(2)</enum><text>by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively, and moving the indentation of each such subparagraph 2 ems to the right;</text></paragraph><paragraph id="H6330D898090747C2B6AFE0227365941F"><enum>(3)</enum><text>by striking the period at the end of subparagraph (B), as so redesignated, and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="HFF62F0DDFEA84FE08A43FE3EA1565041"><enum>(4)</enum><text>by adding at the end the following new paragraph:</text><quoted-block id="HE94BE26880B24A7D9FB24CD5D77BB4AE" style="OLC"><paragraph id="H917CF65B35C6445E8D9A9D67AEBC713A"><enum>(2)</enum><text>section 1837(i)(5), the coverage period shall begin on the first day of the month following the month in which the individual so enrolls.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HBEC8E6173FB94CAF9E9A1C99E728C3AE"><enum>(c)</enum><header>No increase in premium</header><text>Section 1839(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395r">42 U.S.C. 1395r(b)</external-xref>) is amended—</text><paragraph id="H05DCC72736584C12A829A68BA5263763"><enum>(1)</enum><text>in the first sentence, by inserting <quote>, (i)(5)</quote> after <quote>subsection (i)(4)</quote>; </text></paragraph><paragraph id="H57EF345206E84FDE9ECBAD2F46D2B1CC"><enum>(2)</enum><text>in the second sentence, by inserting before the period at the end the following: <quote>or months for which the individual can demonstrate that the individual was enrolled in COBRA continuation coverage (as such term is defined in section 1837(i)(5)(D))</quote>.</text></paragraph></subsection><subsection id="H9F43174F799C4B968DCBC6423E8FDF50"><enum>(d)</enum><header>Coordination of benefits</header><paragraph id="H36B048AAC847420DB7180C6AEF39CCD6"><enum>(1)</enum><header>ERISA</header><text display-inline="yes-display-inline">Section 607 of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1167">29 U.S.C. 1167</external-xref>)) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H412E5E35291341798C8266208DE586B3" display-inline="no-display-inline"><paragraph id="H0C86A246FC694EEF90A2F912892EB826"><enum>(6)</enum><header>Coordination of benefits</header><text>Notwithstanding any other provision of law, in the case that an individual is enrolled in COBRA continuation coverage (as defined in section 1837(i)(5)(D) of the Social Security Act) and the individual is eligible for but not enrolled in coverage under part B of title XVIII of the Social Security Act, such COBRA continuation coverage shall not reduce or terminate benefits under such COBRA continuation coverage with respect to the individual on the basis that the individual is eligible for coverage under such part B or otherwise take into account such eligibility. Such benefits under such COBRA continuation coverage shall be provided to such an individual as if such individual were not so eligible for coverage under such part B. Nothing in the preceding two sentences shall require the provision of such COBRA continuation coverage to an individual enrolled in coverage under such part B or prohibit the termination of such continuation coverage or reduction of benefits under such continuation coverage in the case of an individual who enrolls under such part B.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H1A02FBF852434C588A5A7D2AE16EE7AC"><enum>(2)</enum><header>PHSA</header><text display-inline="yes-display-inline">Section 2208 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300bb-8">42 U.S.C. 300bb–8</external-xref>) is amended—</text><subparagraph id="H435BA30912D1481B8EFBCF2727CBDDD1"><enum>(A)</enum><text>by striking <quote><header-in-text level="section" style="OLC">Definitions</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">Definitions and special rules</header-in-text></quote>; and</text></subparagraph><subparagraph id="HB87FE101D3FA4A09A6021F56B4AC6961"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="HAEED8DE54FD845AF92B70DEFFB32FA78" display-inline="no-display-inline"><paragraph id="H24584D2163BE4A0B9E5718B7BDA29A07"><enum>(5)</enum><header>Special rule for coordination of benefits</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, in the case that an individual is enrolled in COBRA continuation coverage (as defined in section 1837(i)(5)(D) of the Social Security Act) and the individual is eligible for but not enrolled in coverage under part B of title XVIII of the Social Security Act, such COBRA continuation coverage shall not reduce or terminate benefits under such COBRA continuation coverage with respect to the individual on the basis that the individual is eligible for coverage under such part B or otherwise take into account such eligibility. Such benefits under such COBRA continuation coverage shall be provided to such an individual as if such individual were not so eligible for coverage under such part B. Nothing in the preceding two sentences shall require the provision of such COBRA continuation coverage to an individual enrolled in coverage under such part B or prohibit the termination of such continuation coverage or reduction of benefits under such continuation coverage in the case of an individual who enrolls under such part B.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H40D4304DD45047EE8305B48F7F0E5E79"><enum>(3)</enum><header>IRC</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/4980B">Section 4980B(g)</external-xref> of the Internal Revenue Code of 1986 is amended—</text><subparagraph id="H9F424CC810104B9DAF25D062F33C6A61"><enum>(A)</enum><text>by striking <quote><header-in-text level="subsection" style="OLC">Definitions</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Definitions and special rules</header-in-text></quote>; and</text></subparagraph><subparagraph id="H885079EBF8B5456D96AA7FBC05C8AA37"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" id="H2C5732A94DFB4E939A723D1B9B850C04" display-inline="no-display-inline"><paragraph id="H226566FBD85D426CB824E0771B9FC64E"><enum>(5)</enum><header>Special rule for coordination of benefits</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, in the case that an individual is enrolled in COBRA continuation coverage (as defined in section 1837(i)(5)(D) of the Social Security Act) and the individual is eligible for but not enrolled in coverage under part B of title XVIII of the Social Security Act, such COBRA continuation coverage shall not reduce or terminate benefits under such COBRA continuation coverage with respect to the individual on the basis that the individual is eligible for coverage under such part B or otherwise take into account such eligibility. Such benefits under such COBRA continuation coverage shall be provided to such an individual as if such individual were not so eligible for coverage under such part B. Nothing in the preceding two sentences shall require the provision of such COBRA continuation coverage to an individual enrolled in coverage under such part B or prohibit the termination of such continuation coverage or reduction of benefits under such continuation coverage in the case of an individual who enrolls under such part B.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="H50DCD9E7FA0849E88DC6DF69A29F8E49"><enum>(e)</enum><header>Updating COBRA continuation coverage notifications</header><text display-inline="yes-display-inline">Not later than January 1, 2023, the Secretary of Labor, in consultation with the Secretary of Health and Human Services, shall update the written notices required under section 606 of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1166">29 U.S.C. 1166</external-xref>) to include an explanation of the full scope of the Medicare secondary payer rules under section 1862(b) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395y">42 U.S.C. 1395y(b)</external-xref>), including how such rules apply with respect to COBRA continuation coverage (as defined in section 1837(i)(5)(D) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395p">42 U.S.C. 1395p(i)(5)(D)</external-xref>)).</text></subsection></section></legis-body></bill>
