case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish certain requirements relating to TikTok, and for other purposes.</official-title></form><legis-body id="H403B317F30434A43BBD66E48EEBFF11C" style="OLC"><section id="H15C458691FB24EDDA031B5469F8E640E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Block the Tok Act</short-title></quote>.</text></section><section id="H985A19857711486BA1526D595F6DFFD9"><enum>2.</enum><header>Limitation on the access of user data of United States citizens</header><text display-inline="no-display-inline">TikTok may not access user data of United States citizens from within the People’s Republic of China.</text></section><section id="HC35D8988B907446D8A6B8B4F3033C039"><enum>3.</enum><header>Investigation by Commission</header><subsection id="H7FB6A4D0ED484C5EB2F500274B6B68A6"><enum>(a)</enum><header>Investigation</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the Commission shall initiate an investigation to determine if TikTok has engaged in unfair or deceptive acts or practices within the meaning of section 5(a)(1) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45(a)(1)</external-xref>).</text></subsection><subsection id="H0A9771100C9D4F2384717F6C27B4C9A0"><enum>(b)</enum><header>Complaint</header><text display-inline="yes-display-inline">Not later than 30 days after the date on which the Commission completes the investigation described in subsection (a), if the Commission determines TikTok has engaged in unfair or deceptive acts or practices within the meaning of section 5(a)(1) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45(a)(1)</external-xref>) and if the Commission determines that a proceeding by the Commission would be in the interest of the public, the Commission shall issue and serve upon TikTok a complaint stating the charges that contains a notice of a hearing on a fixed date and place at least thirty days after the date on which the complaint is served.</text></subsection></section><section id="H4EE6114A3FDA494BA347575A98A5A8C4"><enum>4.</enum><header>Prohibition on the use of TikTok at military installations and Federal agencies</header><subsection id="H108AB05E91A342BE85DA853BA6E48C61"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Not later than 30 days after the date of the enactment of this Act—</text><paragraph id="H29060A7708984C3FBDF61A17CC5E3441"><enum>(1)</enum><text>TikTok may not be downloaded or used on a personal electronic device at a military installation or a Federal agency; and</text></paragraph><paragraph id="H7C6E1BECA1974A77A370FD1E637FF592"><enum>(2)</enum><text display-inline="yes-display-inline">TikTok, if on a personal electronic device at a military installation or a Federal agency on the date of the enactment of this Act, shall be removed from the personal electronic device.</text></paragraph></subsection><subsection id="HA37D94AFF7A145C9A346664C288B74F1"><enum>(b)</enum><header>Exception</header><text display-inline="yes-display-inline">The head of the relevant Federal agency may authorize an exception to the prohibition described in subsection (a).</text></subsection></section><section id="H525324BF31704D6C9F721C2AB8C0CF5B"><enum>5.</enum><header>Prohibition on the use of TikTok on Federal Government devices</header><subsection id="H8AF4D4F734EF4F4ABFA4CBABB26E0306"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">Not later than 30 days after the date of the enactment of this Act—</text><paragraph id="H13538FF12F024A3E80E307D57407BF7A"><enum>(1)</enum><text>TikTok may not be downloaded or used on information technology; and</text></paragraph><paragraph id="H36D7BC691FED4E0D925D94EDE96F3A56"><enum>(2)</enum><text display-inline="yes-display-inline">TikTok, if on information technology on the date of the enactment of this Act, shall be removed from the information technology.</text></paragraph></subsection><subsection id="HFE283D6448334B1F90F4624389B2E24F"><enum>(b)</enum><header>Exception</header><text display-inline="yes-display-inline">The Chair of the Commission or the head of a Federal agency may authorize an exception to the prohibition described in subsection (a) if the Chair or the head of the relevant Federal agency determines that it is appropriate for the purpose of an investigation to determine if TikTok has engaged in unfair or deceptive acts or practices within the meaning of section 5(a)(1) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45(a)(1)</external-xref>).</text></subsection></section><section id="H3680EB3BB268482BB672BF4160594338"><enum>6.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H9BFAC425DC394EE5B7843C0185D4930C"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph><paragraph id="H1CA49504CA17484BB1C128E8E59DF4C1"><enum>(2)</enum><header>Federal agency</header><text>The term <term>Federal agency</term> includes the following:</text><subparagraph id="H4B46FE7CE45D463F90216C5CB4F8EA59"><enum>(A)</enum><text>Air Force Intelligence, Surveillance and Reconnaissance Agency.</text></subparagraph><subparagraph id="H1AE635FBC5F641BB889C3DAA1ECAF22D"><enum>(B)</enum><text>Army Intelligence and Security Command.</text></subparagraph><subparagraph id="HB2D08CCEA9844BE4918E98FB1E673786"><enum>(C)</enum><text>Central Intelligence Agency.</text></subparagraph><subparagraph id="HF73C8CA9899E4F20ABA5D2A419F24ECC"><enum>(D)</enum><text>Coast Guard Intelligence.</text></subparagraph><subparagraph id="H88B4E75676B1447D932953A2FA15156D"><enum>(E)</enum><text>Defense Intelligence Agency.</text></subparagraph><subparagraph id="HE578266C671640639EABE6D514049282"><enum>(F)</enum><text>Department of Defense.</text></subparagraph><subparagraph id="HE1AD4FF6E72C483C82381A38B9844A98"><enum>(G)</enum><text>Department of Homeland Security.</text></subparagraph><subparagraph id="H9659EFF68A1A4C7BAB84A3B75D49280B"><enum>(H)</enum><text>Department of Justice.</text></subparagraph><subparagraph id="H3CF206677E674DEF99DA8CBE230F1937" commented="no"><enum>(3)</enum><header>Information technology</header><text display-inline="yes-display-inline">The term <term>information technology</term> has the meaning given that term in section 11101 of title 40, United States Code.</text></paragraph><paragraph id="HDEBF979347364F3FAF7CC2B4A8D2B0D4" commented="no"><enum>(4)</enum><header>Military installation</header><text>The term <term>military installation</term> has the meaning given that term in section 2801 of title 10, United States Code.</text></paragraph><paragraph id="H16C72CFD2A4F4879A3E2AC2FAC2C1CBD"><enum>(5)</enum><header>Personal electronic device</header><text>The term <term>personal electronic device</term>, with respect to an employee of a military installation or a Federal agency, means—</text><subparagraph id="HBD6238639F33449F974E73D16F483B4B"><enum>(A)</enum><text display-inline="yes-display-inline">an electronic device that was not provided to the employee by the relevant military installation or Federal agency for the business of such military installation or Federal agency; or</text></subparagraph><subparagraph id="H9BD1BFA0967541B5B702A32B03CC6608"><enum>(B)</enum><text display-inline="yes-display-inline">an electronic device that was provided to the employee by the relevant military installation or Federal agency for the business of such military installation or Federal agency but that was used by such employee for a purpose other than the business of such military installation or Federal agency.</text></subparagraph></paragraph></section></legis-body></bill>
