R. 8755</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220830">August 30, 2022</action-date><action-desc><sponsor name-id="G000061">Mr. Garcia of California</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Fair Labor Standards Act of 1938 to prevent employers from using non-compete agreements in employment contracts for certain non-exempt employees.</official-title></form><legis-body id="H47CE36581D744EBAABCC71E7857403D7" style="OLC"><section section-type="section-one" id="HFF4E2C3DF8D64770882A4D6A7C0A725F"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restoring Workers’ Rights Act of 2022</short-title></quote>.</text></section><section id="H7AA45B0273A14F6DA93D49C673837EAE"><enum>2.</enum><header>Limitation on non-compete agreements</header><subsection id="HB95A51A656B5478283377103C1F509CF"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>) is amended by inserting after section 7 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H1C7E6CE410D0476799AAC33D84B45EFF"><section id="H73AC6AE4AE974F65BF5F5BB1C23F736F"><enum>8.</enum><header>Limitation on non-compete agreements</header><subsection id="HA5A9268B10234CC09EDFF44EB3694F92"><enum>(a)</enum><header>Definition of non-Compete agreement</header><text>In this section, the term <term>non-compete agreement</term> means an agreement, entered into between an employer and an employee, that restricts such employee from performing, after the employment relationship between the employer and the employee terminates, any of the following:</text><paragraph id="HB92A73F20FB54E0291618E4AC723E27E"><enum>(1)</enum><text>Any work for another employer for a specified period of time.</text></paragraph><paragraph id="HDD49DB828B8D4EBB81C49DABBC8E9353"><enum>(2)</enum><text>Any work in a specified geographical area.</text></paragraph><paragraph id="HE4A5081F93C84C6DB8563D2E34A9D240"><enum>(3)</enum><text>Any work for another employer that is similar to such employee’s work for the employer that is a party to such agreement.</text></paragraph></subsection><subsection id="H3D33CBA3528F4B9E9C212076ED095953"><enum>(b)</enum><header>In general</header><paragraph id="H63518675BAED495F8289436A973A5B84"><enum>(1)</enum><header>No enforcement of non-compete agreements</header><text>Any non-compete agreement entered into before the date of enactment of the <short-title>Restoring Workers’ Rights Act of 2022</short-title> shall be void and have no effect. An employer shall not enforce, or threaten to enforce, any non-compete agreement with an employee.</text></paragraph><paragraph id="H8ACAF46755794C3EA7B22A0064F4ECE4"><enum>(2)</enum><header>No new non-compete agreements</header><text>Beginning on the date of enactment of the <short-title>Restoring Workers’ Rights Act of 2022</short-title>, an employer shall not enter into, extend, or renew any non-compete agreement with an employee.</text></paragraph><paragraph id="H81113ACA57AA4AEA86594D56AE9C6D57"><enum>(3)</enum><header>Limit on applicability</header><text display-inline="yes-display-inline">This subsection shall not apply with respect to any employee with respect to which the provisions of section 7 do not apply.</text></paragraph></subsection><subsection id="H17ABC46FC30047E391AF6E19518F9551"><enum>(c)</enum><header>Rule of construction regarding trade secrets</header><text display-inline="yes-display-inline">Nothing in this section shall preclude an employer from entering into an agreement with an employee to not share any information (including after the employee is no longer employed by the employer) regarding the employer or the employment that is a trade secret, as defined in section 1839 of title 18, United States Code.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H3C17949C43F9440281487EE284F0D653"><enum>(b)</enum><header>Enforcement</header><paragraph id="H5EC5128D80E9472F885387A5F89F0DC5"><enum>(1)</enum><header>Prohibited act</header><text>Section 15(a) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/215">29 U.S.C. 215(a)</external-xref>) is amended—</text><subparagraph id="H546CE5DE585B49249B9F96D9942A6C27"><enum>(A)</enum><text>in paragraph (5), by striking the period at the end and inserting a semicolon; and</text></subparagraph><subparagraph id="H2CC8F16D75E9424ABBD3ED5646661D98"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H1EC556FD26864D3AB463614B9D70346D"><paragraph id="HE100F1391E16467FA327259EBF4BCCEE"><enum>(6)</enum><text>to violate any of the provisions of section 8.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HCC9653AA090240DFA1ADAF3FBB976371"><enum>(2)</enum><header>Penalties</header><text>Section 16 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/216">29 U.S.C. 216</external-xref>) is amended—</text><subparagraph id="HC9D78B78642A444894BD20F44E659BDA"><enum>(A)</enum><text>in subsection (a), by inserting <quote>, except that a person convicted of a violation of section 15(a)(6) shall not be subject to imprisonment</quote> after <quote>or both</quote>;</text></subparagraph><subparagraph id="H47BC7FE095F24A698B3A6C24871F64DB"><enum>(B)</enum><text>in subsection (b), by inserting <quote>Any employer who violates the provisions of section 8 shall be liable for such legal or equitable relief as may be appropriate to effectuate the purposes of such section.</quote> after the third sentence;</text></subparagraph><subparagraph id="H6EC4E4B9D1C8451CBF37021C70B46C22"><enum>(C)</enum><text>in subsection (c), by adding at the end the following: <quote>The authority and requirements described in this subsection shall also apply with respect to a violation of section 8, as appropriate, and the employer shall be liable for such legal or equitable relief as may be appropriate to effectuate the purposes of such section.</quote>; and</text></subparagraph><subparagraph id="H6FB9C18A0B54464CB02272EFDBFF5F70"><enum>(D)</enum><text>in subsection (e)(2), by striking <quote>section 6 or 7, relating to wages,</quote> and inserting <quote>section 6, 7, or 8, relating to wages or non-compete agreements,</quote>.</text></subparagraph></paragraph></subsection><subsection id="HB951B0D8E1CE46549D9BED590841BF16"><enum>(c)</enum><header>Conforming amendment</header><text>Section 10 of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/210">29 U.S.C. 210</external-xref>) is repealed.</text></subsection><subsection id="H2941F52F6A1341D4847182CE54432C9C"><enum>(d)</enum><header>Effective date</header><paragraph id="H06778D0DFBC14C37BC37014DDE876FAF"><enum>(1)</enum><header>In general</header><text>The amendments made by this Act shall take effect 180 days after the date of enactment of this Act.</text></paragraph><paragraph id="HD5949816255E42DCBE45D0B03DEEAB74"><enum>(2)</enum><header>Applicability</header><text>This Act, and the amendments made by this Act, shall apply with respect to any dispute or claim for which proceedings commenced on or after the effective date described in paragraph (1).</text></paragraph></subsection></section></legis-body></bill>
