R. 871</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210205">February 5, 2021</action-date><action-desc><sponsor name-id="F000468">Mrs. Fletcher</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XIX of the Social Security Act to provide a temporary increase in FMAP for medical assistance under State Medicaid plans which begin to expend amounts for newly eligible mandatory individuals.</official-title></form><legis-body id="H09C92AC68274455EAF9D3B2981D39450" style="OLC"><section id="H74156369B75B41239895C884220CD2D2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Expand Medicaid Now Act</short-title></quote>. </text></section><section id="HA6E721833C634CF8835CC02485515BB9" section-type="subsequent-section"><enum>2.</enum><header>Temporary increase in FMAP for medical assistance under State Medicaid plans which begin to expend amounts for newly eligible mandatory individuals</header><text display-inline="no-display-inline">Section 1905 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d</external-xref>) is amended—</text><paragraph id="HECC5C22595764478B4579B666A6782D8"><enum>(1)</enum><text>in subsection (b), in the first sentence, by striking <quote>and (ff)</quote> and inserting <quote>(ff), and (hh)</quote>; and</text></paragraph><paragraph id="H35A4E875F5FD498287B57988FFEF10DA"><enum>(2)</enum><text>by adding at the end the following new subsection: </text><quoted-block style="OLC" id="HA7A989EF23DA41BFB41864276BFE7D5B" display-inline="no-display-inline"><subsection id="H8FE84E5D93A84C3B93F26834D93EAEDE"><enum>(hh)</enum><header>Temporary increase in FMAP for medical assistance under State Medicaid plans which begin to expend amounts for all newly eligible mandatory individuals</header><paragraph id="H68A0F751EE8B4CF88367E6A1C8EFB4DA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), for the 8-quarter period beginning with the first calendar quarter during which a qualifying State (as defined in paragraph (4)) expends amounts for all newly eligible individuals described in section 1902(a)(10)(A)(i)(VIII) under the State plan (or waiver of such plan), the Federal medical assistance percentage determined under subsection (b) for such State shall be increased by 5 percentage points.</text></paragraph><paragraph id="HED099E5A96664E068E4FED2967BBE881"><enum>(2)</enum><header>Exception</header><text>In the case of a State that ceases to provide medical assistance to any newly eligible individual under the State plan (or waiver of such plan) during a quarter occurring during the period described in paragraph (1), the increase described in such paragraph shall not apply with respect to such State and such quarter (or any succeeding quarter).</text></paragraph><paragraph id="H4438AE6865574E5A99C977074C4C01E0"><enum>(3)</enum><header>Special application rules</header><text display-inline="yes-display-inline">Any increase described in paragraph (1)—</text><subparagraph id="HC04379F92FB3426EB6924A73377417E3"><enum>(A)</enum><text>shall not apply with respect to disproportionate share hospital payments described in section 1923;</text></subparagraph><subparagraph id="HB4A93F0CA3C3464FBADFB2BBA90F02FC"><enum>(B)</enum><text>shall not be taken into account in calculating the enhanced FMAP of a State under section 2105; and</text></subparagraph><subparagraph id="H1CC480487BBD4C72841A02F41AFB51C8"><enum>(C)</enum><text>shall not be taken into account for purposes of part A, D, or E of title IV.</text></subparagraph></paragraph><paragraph id="H4503078C948447CDBD0A73A5E3553084"><enum>(4)</enum><header>Definition</header><text display-inline="yes-display-inline">For purposes of this subsection, the term <term>qualifying State</term> means a State which has not expended amounts for all newly eligible individuals described in section 1902(a)(10)(A)(i)(VIII) before the date of the enactment of this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
