R. 8709</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220812">August 12, 2022</action-date><action-desc><sponsor name-id="N000026">Mr. Nehls</sponsor> (for himself, <cosponsor name-id="G000552">Mr. Gohmert</cosponsor>, and <cosponsor name-id="H001071">Mr. Hice of Georgia</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Homeland Security to prioritize the removal of certain aliens, and for other purposes.</official-title></form><legis-body id="H46410E18ED39484994B66D5C4334E4D9" style="OLC"><section id="H8E1C24DEF8C1479C9B5D15015B2C7189" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prioritizing the Removal of Migrants Act</short-title></quote>.</text></section><section id="H014BEFBD3E074D0189FFB7324E75D746"><enum>2.</enum><header>Prioritizing removal of certain aliens</header><text display-inline="no-display-inline">In executing faithfully the immigration laws (as such term is defined in section 101 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref>)), the Secretary of Homeland Security shall prioritize immigration enforcement actions with respect to the following aliens:</text><paragraph id="H3D3C4C8EABAE4CFBBF1D7E1D9AB3BE1F"><enum>(1)</enum><text display-inline="yes-display-inline">Aliens who are inadmissible under paragraph (2), (3), or (6)(C) of section 212(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(2)</external-xref>, (3), (6)(C)).</text></paragraph><paragraph id="H99A30344AF2C4B58A1466AA1706F42A4"><enum>(2)</enum><text>Aliens who are subject to expedited removal under section 235 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1225">8 U.S.C. 1225</external-xref>).</text></paragraph><paragraph id="H8A136166789C46A2A98D8512CFC23873"><enum>(3)</enum><text>Aliens who are deportable under paragraph (2) or (4) of section 237(a) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(2)</external-xref>, (4)).</text></paragraph><paragraph id="H347FD8FEF7464E4C9572CDC9C66DD510"><enum>(4)</enum><text display-inline="yes-display-inline">Aliens who are otherwise inadmissible under such section 212 or deportable under such section 237, and who—</text><subparagraph id="HB1028E379D504B5AAF7F7F60BB68663C"><enum>(A)</enum><text display-inline="yes-display-inline">have been convicted of any criminal offense;</text></subparagraph><subparagraph id="H9A4EF74B570D4E1C94AFD30737C30685"><enum>(B)</enum><text>have been charged with any criminal offense, which charges are pending;</text></subparagraph><subparagraph id="HF08AF765B6B743B3A0A94F256E1262C2"><enum>(C)</enum><text>have committed acts that constitute a chargeable criminal offense (except an offense under section 275(a) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1325">8 U.S.C. 1325(a)</external-xref>));</text></subparagraph><subparagraph id="HD14BB4C981E143A0B7C07E31721EE3BA"><enum>(D)</enum><text>have engaged in fraud or willful misrepresentation in connection with any official matter or application before a governmental agency;</text></subparagraph><subparagraph id="HE939CF464B12480A9FE154B0A546982B"><enum>(E)</enum><text>have abused any program related to receipt of public benefits; </text></subparagraph><subparagraph id="H0079F9BD18AF4527A25BA0A7DCFFA433"><enum>(F)</enum><text>are subject to a final order of removal, but who have not complied with their legal obligation to depart the United States; or</text></subparagraph><subparagraph id="HE0F39F71ABF14E38A3309A03861B5951"><enum>(G)</enum><text>in the judgment of an immigration officer, otherwise pose a risk to public safety or national security.</text></subparagraph></paragraph><paragraph id="H4ABBD14FDE6D48A9A7E0660ACD8E22FF"><enum>(5)</enum><text>Aliens who are threats to border security, including aliens who—</text><subparagraph id="H2895EE88486C470E844266EF052E61B4"><enum>(A)</enum><text>are apprehended while attempting to unlawfully enter the United States along a border of the United States (whether or not at a designated port of arrival); or</text></subparagraph><subparagraph id="H59C791D04F214386B2F1931A15B4D299"><enum>(B)</enum><text>are apprehended in the United States after entering unlawfully after November 1, 2020. </text></subparagraph></paragraph></section></legis-body></bill>
