<section section-type="section-one" id="H3B1A09371C4C49518890270CCEEACF39"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Require Evaluation before Implementing Executive Wishlists Act of 2022</short-title></quote> or the <quote><short-title>REVIEW Act of 2022</short-title></quote>.</text></section> <section id="H0E632D5B04C64232AE18B230063A20B3"><enum>2.</enum><header>Relief pending review</header><text display-inline="no-display-inline">Section 705 of title 5, United States Code, is amended—</text>
<paragraph id="HF02FF9CACB9C477CAA3C440C132ABC0C"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>When</quote> and inserting the following:</text> <quoted-block style="USC" display-inline="no-display-inline" id="HFFA19ABCD1F34D7CA3868DED7C700CF3"> <subsection id="H508118898BC4436EB1C4012BEF4C2421"><enum>(a)</enum><header>In general</header><text>When</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph>
<paragraph id="H47B37E0024674853BCF750B565CF5D5F"><enum>(2)</enum><text>by adding at the end the following:</text> <quoted-block style="USC" display-inline="no-display-inline" id="HBF9C410F67CD4970AA5D24C54EC1C079"> <subsection id="H77BC51AC9AC2429AB4F77213905A1592"><enum>(b)</enum><header>High-Impact rules</header> <paragraph id="HB9001C0077DB45B9B10D246B8685133F"><enum>(1)</enum><header>Definitions</header><text>In this subsection—</text>
<subparagraph id="HE0F8610D79CA46598E738E1F03D16668"><enum>(A)</enum><text display-inline="yes-display-inline">the term <term>Administrator</term> means the Administrator of the Office of Information and Regulatory Affairs of the Office of Management and Budget; and</text></subparagraph> <subparagraph id="H9754647612DE4AF5B21641E008F3E09F"><enum>(B)</enum><text>the term <term>high-impact rule</term> means any rule that the Administrator determines may impose an annual cost on the economy of not less than $1,000,000,000.</text></subparagraph></paragraph>
<paragraph display-inline="no-display-inline" id="HC8EA39C716CF49B193B0E6544A8C1E8B"><enum>(2)</enum><header>Identification</header><text display-inline="yes-display-inline">A final rule may not be published or take effect until—</text> <subparagraph display-inline="no-display-inline" id="H090DB01468794E19B69977BCDFF2DBFC"><enum>(A)</enum><text display-inline="yes-display-inline">the agency making the rule submits the rule to the Administrator; and</text></subparagraph>
<subparagraph display-inline="no-display-inline" id="H900251C05C2E4F1FBEF1621869384AFF"><enum>(B)</enum><text display-inline="yes-display-inline">the Administrator makes a determination as to whether the rule is a high-impact rule, which shall be published by the agency with the final rule.</text></subparagraph></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HB9EF650BB1344ECA895D599050D8AD7E"><enum>(3)</enum><header>Relief</header> <subparagraph commented="no" display-inline="no-display-inline" id="H78C1FD74C84B4E1886683F7ED6853189"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), an agency shall postpone the effective date of a high-impact rule of the agency until the final disposition of all actions seeking judicial review of the rule.</text></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="H59DC8A4A4A8943A1A0D87B4D8A03F628"><enum>(B)</enum><header>Failure to timely seek judicial review</header><text>Notwithstanding section 553(d), if no person seeks judicial review of a high-impact rule—</text> <clause id="HE3B762E075614CE3B2020A870F3FF486"><enum>(i)</enum><text>during any period explicitly provided for judicial review under the statute authorizing the making of the rule; or</text></clause>
<clause id="HE6AF18CDBA334BE187B160F7EE13FFF4"><enum>(ii)</enum><text>if no such period is explicitly provided for, during the 60-day period beginning on the date on which the high-impact rule is published in the Federal Register,</text></clause><continuation-text continuation-text-level="subparagraph">the high-impact rule may take effect as early as the date on which the applicable period ends.</continuation-text></subparagraph></paragraph> <paragraph display-inline="no-display-inline" id="H5DA75795787B4CB6BA0BB70F91A4E3D8"><enum>(4)</enum><header>Rule of construction</header><text>Nothing in this subsection may be construed to impose any limitation under law on any court against the issuance of any order enjoining the implementation of any rule.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
