R. 8701</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220812">August 12, 2022</action-date><action-desc><sponsor name-id="P000599">Mr. Posey</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title XVIII of the Social Security Act to ensure equitable treatment of items and services furnished by chiropractors under the Medicare program.</official-title></form><legis-body id="H30D73431581E4124AB77EDC2002964B4" style="OLC"><section id="HA299C13AC48B4125AEC389077EE8E740" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Chiropractic Act of 2022</short-title></quote>.</text></section><section id="H9E11D1AA502E4A3F9627BCE355836EB5"><enum>2.</enum><header>Ensuring equitable treatment of items and services furnished by chiropractors under the Medicare program</header><subsection id="H53146393ADDB458A990F7C3D41E29724"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1861(r)(5) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(r)(5)</external-xref>) is amended—</text><paragraph id="HD49A9F5FD1BF46C0B747D1CF58ECAB88"><enum>(1)</enum><text>by striking <quote>for the purpose of sections 1861(s)(1) and 1861(s)(2)(A) and only</quote>;</text></paragraph><paragraph id="H0E1E406309EA47B9B4E791FB21E1C534"><enum>(2)</enum><text>by inserting <quote>, evaluation and management services (including examination and imaging services), and such other functions (not including the prescribing of drugs)</quote> after <quote>(to correct a subluxation)</quote>; and</text></paragraph><paragraph id="HBCBFBC376121463EBFA85EC4720E21BA"><enum>(3)</enum><text>by inserting <quote>, service, or function (as applicable)</quote> after <quote>such treatment</quote>. </text></paragraph></subsection><subsection id="H79A07B59D5E541618A95EB8F4B17B593"><enum>(b)</enum><header>Allowing chiropractors To provide items and services through private contracts with Medicare beneficiaries</header><text display-inline="yes-display-inline">Section 1802(b)(6)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395a">42 U.S.C. 1395a(b)(6)(B)</external-xref>) is amended by striking <quote>paragraphs (1), (2), (3), and (4) of</quote>.</text></subsection><subsection id="H98B88BAB68F7401288FEFEF9F90BA5F7"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to items and services furnished on or after the date that is 30 days after the date of the enactment of this Act. </text></subsection></section></legis-body></bill>
