R. 8696</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20220809">August 9, 2022</action-date><action-desc><sponsor name-id="P000618">Ms. Porter</sponsor> (for herself and <cosponsor name-id="C001120">Mr. Crenshaw</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HHA00">Committee on House Administration</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Federal Election Campaign Act of 1971 to prohibit the misrepresentation of actions on behalf of candidates, political parties, and political committees and organizations, and for other purposes.</official-title></form><legis-body id="HD616725DCBF44A9CA7FD171ECB5F9923" style="OLC"><section id="HFBC434B9D0FB4D4DB19D765A5C154E9E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Scam PACs Act</short-title></quote>. </text></section><section id="H4EF3924BA88849DB893C2778094FC584" section-type="subsequent-section"><enum>2.</enum><header>Prohibiting misrepresentation of action</header><subsection id="H1E5B81CEA8E64B50B08D7CCCDD7128E2"><enum>(a)</enum><header>Coverage of all misrepresentation of action on behalf of candidates, political parties, and political committees and organizations</header><text display-inline="yes-display-inline">Section 322 of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/52/30124">52 U.S.C. 30124</external-xref>) is amended—</text><paragraph id="HAC42512FB83943E693FD2BB01E54FFF9"><enum>(1)</enum><text display-inline="yes-display-inline">in the heading, by striking <quote><header-in-text level="paragraph" style="OLC">Fraudulent</header-in-text></quote>;</text></paragraph><paragraph id="H2B0B432071A445A2A9D952FC184B0AE1"><enum>(2)</enum><text>in subsection (a)—</text><subparagraph id="HF420EA15FC9147049D2DD15714C92D74"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>who is a candidate for Federal office or an employee or agent of such a candidate</quote>; and</text></subparagraph><subparagraph id="H9864BFE83B064B7ABF2CEAD9DEDFF52D"><enum>(B)</enum><text>in paragraph (1)—</text><clause id="H4F11A9C51CCB4757A9A420BE46A4830A"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>fraudulently</quote>; </text></clause><clause id="HB627B4B6033B40A2914879C2B7FBA7FC"><enum>(ii)</enum><text>by striking <quote>under his control</quote>; and</text></clause><clause id="H386195A78478403F8591B989684EA91F"><enum>(iii)</enum><text>by striking <quote>other candidate or political party or employee or agent thereof on a matter which is damaging to such other candidate or political party or employee or agent thereof</quote> and inserting <quote>real, potential, spurious, or non-existent candidate, political party, or political committee or organization, or employee or agent of any such candidate, political party, or political committee or organization</quote>; and</text></clause></subparagraph></paragraph><paragraph id="H918BC0D126C9412ABEED5CC8018DA663"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (b)—</text><subparagraph id="HDC93F0FAD498462C8767DA8A9D30B28D"><enum>(A)</enum><text display-inline="yes-display-inline">in the heading, by striking <quote><header-in-text level="paragraph" style="OLC">Fraudulent</header-in-text></quote>; and</text></subparagraph><subparagraph id="H157D94DB1D5C41AAA2775103BDE7E136"><enum>(B)</enum><text>in paragraph (1)—</text><clause id="H00AC220A4CE8445ABFC9589EBBB39DEE"><enum>(i)</enum><text>by striking <quote>fraudulently</quote>; and </text></clause><clause id="HDC832D2A96394CC58284BEF3824FF8B1"><enum>(ii)</enum><text>by striking <quote>candidate or political party or employee or agent thereof for the purpose of soliciting contributions or donations</quote> and inserting <quote>real, potential, spurious, or non-existent candidate, political party, or political committee or organization, or employee or agent of any such candidate, political party, or political committee or organization when soliciting money or any other thing of value</quote>.</text></clause></subparagraph></paragraph></subsection><subsection id="H8E1813AF7BFE46E89A7C64149DA43C39"><enum>(b)</enum><header>Effective date</header><text>The amendments made by <internal-xref idref="H1E5B81CEA8E64B50B08D7CCCDD7128E2" legis-path="2.(a)">subsection (a)</internal-xref> shall take effect upon the expiration of the 90-day period which begins on the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
