<section id="HB9A3C3DD78994F9F9BCCEB12761F1AC1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rewarding American Investments to Support Employees Act of 2022</short-title></quote> or the <quote><short-title>RAISE Act of 2022</short-title></quote>.</text></section> <section id="H0BE0F2CF499143C583EBEE398B60F264"><enum>2.</enum><header>Employer wage credit</header> <subsection id="H5321C1A4B2B04957A06AD8C0395D7611"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subpart D of part IV of subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H5DC5A12482084D88B68C3F4E2CEA231E" style="OLC"> 
<section id="HF9DECC6560094481B8ACB9222DCF63E5"><enum>45U.</enum><header>Employer wage credit</header> 
<subsection id="HECB1E8A739424B15AF60136C507E5D68"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of section 38, the employer wage credit determined under this section with respect to any employer for any taxable year is an amount equal to 10 percent of the excess (if any) of—</text> <paragraph id="HDD431285A5E248C9A7121BCAA923F8B3"><enum>(1)</enum><text display-inline="yes-display-inline">the aggregate amount of wages paid or incurred to specified employees during the calendar year which ends with or within such taxable year, over</text></paragraph> 
<paragraph id="H12D6064F98204098B112A475B6EB066E"><enum>(2)</enum><text>the aggregate amount of wages paid or incurred to specified employees during the calendar year immediately preceding the calendar year described in paragraph (1).</text></paragraph></subsection> <subsection id="H394B94E3DE684BD2836D3E2040F21615"><enum>(b)</enum><header>Limitations</header> <paragraph id="HA77A3D2CC7B14FD6B049A9595D3585FC"><enum>(1)</enum><header>In general</header><text>The amount of the credit determined under subsection (a) with respect to any employer for any taxable year shall not exceed $500,000.</text></paragraph> 
<paragraph id="H1D029EE1E8E144FAAF2AEC3A15F2622F"><enum>(2)</enum><header>Limitation on increase which may be taken into account with respect to each employee</header><text>The amount of wages taken into account under subsection (a)(1) with respect to any employee shall not exceed the sum of $25,000 plus the amount of wages taken into account under subsection (a)(2) with respect to such employee.</text></paragraph></subsection> <subsection id="H2275F3A3D0EE4B19983E4F287801061B"><enum>(c)</enum><header>Specified employees</header><text>For purposes of this section, the term <quote>specified employee</quote> means any employee who—</text> 
<paragraph id="H0CB2712B25BA48B6BAA1AABEEA6711C3"><enum>(1)</enum><text>was employed continuously in one or more trades or businesses of the employer during both calendar years described in subsection (a), and</text></paragraph> <paragraph id="H29C53C25C90E4E7E8D179031C0A59A52"><enum>(2)</enum><text>earned wages not in excess of $75,000 during the calendar year described in subsection (a)(2).</text></paragraph></subsection> 
<subsection id="H18A547910FB949D3A644467E5ED7B8C7"><enum>(d)</enum><header>Other definitions and special rules</header><text>For purposes of this section—</text> <paragraph id="HE85AAA7ADB114CA99438A6A36046C51C"><enum>(1)</enum><header>Wages</header><text>The term <quote>wages</quote> has the meaning given such term by section 3306(b) (determined without regard to any dollar limitation contained in such section). Such term shall not include any amount taken into account in determining any other credit allowed under this subpart.</text></paragraph> 
<paragraph id="H73CD687508254494BE8A436575ED90C5"><enum>(2)</enum><header>Predecessor and successor</header><text>Any reference in this paragraph to an employer shall include a reference to any predecessor of, or successor to, such employer.</text></paragraph> <paragraph id="H255B991B8E6B48FAB40FFF19B7AAF05D"><enum>(3)</enum><header>Aggregation rule</header><text>All persons treated as a single employer under subsection (b), (c), (m), or (o) of section 414 shall be treated as one employer.</text></paragraph> 
<paragraph id="H13BD13E3CE964A43B7C92C3957423F8F"><enum>(4)</enum><header>Inflation adjustment</header> 
<subparagraph id="HFFD04DC1BC2A4002AF416C7B09AFBE9C"><enum>(A)</enum><header>In general</header><text>In the case of a taxable year beginning after 2022, the $500,000 and $75,000 amounts in subsections (b) and (c) shall each be increased by an amount equal to—</text> <clause id="H2FFFA13C55EE4A5D89F5A03CF29671F7"><enum>(i)</enum><text>such dollar amount, multiplied by</text></clause> 
<clause id="H6F88850DE72749B7BBCEEDCC219BBFD5"><enum>(ii)</enum><text>the cost-of-living adjustment determined under subparagraph (B) for the calendar year in which the taxable year begins.</text></clause></subparagraph> <subparagraph id="H5A25A32EDF4F441FA1EA8EA0151402F8"><enum>(B)</enum><header>Cost-of-living adjustment</header><text display-inline="yes-display-inline">For purposes of this paragraph, the cost-of-living adjustment for any calendar year is the percentage (if any) by which—</text> 
<clause id="H0D252E1D4302402B9F19BEEFA25B52D5"><enum>(i)</enum><text>the CPI for the preceding calendar year, exceeds</text></clause> <clause id="H8C79BBBF789A4F0F81820B4B2C75C45A"><enum>(ii)</enum><text>the CPI for calendar year 2021.</text></clause></subparagraph> 
<subparagraph id="HEACF36ADDE5045528039A89C948D4547"><enum>(C)</enum><header>CPI for any calendar year</header><text>For purposes of this paragraph, the CPI for any calendar year shall be determined as provided in section 1(f)(4).</text></subparagraph> <subparagraph id="HB6985E055E6747B3A99ED8821E23E1EB"><enum>(D)</enum><header>Rounding</header><text>If any amount as adjusted under subparagraph (A) is not a multiple of $1,000, such amount shall be rounded to the next lowest multiple of $1,000.</text></subparagraph></paragraph> 
<paragraph id="HD7610FC641EE4113864CE653B741B261"><enum>(5)</enum><header>Election to have credit not apply</header><text display-inline="yes-display-inline">A taxpayer may elect to have this section not apply for any taxable year. Rules similar to the rules of paragraphs (2) and (3) of section 51(j) shall apply for purposes of this paragraph.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HEB5A30626CF8481CAA20EE49C8FA9713"><enum>(b)</enum><header>Credit To be part of general business credit</header><text display-inline="yes-display-inline">Section 38(b) of such Code is amended by striking <quote>plus</quote> at the end of paragraph (32), by striking the period at the end of paragraph (33) and inserting <quote>, plus</quote>, and by inserting after paragraph (33) the following new paragraph:</text>

<paragraph id="H6FB041FBD42F4AB5B2080F3D446B92F5"><enum>(34)</enum><text display-inline="yes-display-inline">the employer wage credit determined under section 45U.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="H6B4787221AED40D5AD75FDB7F8D23B1F"><enum>(c)</enum><header>Denial of double benefit with deductions</header><text>Section 280C(a) of such Code is amended by inserting <quote>45U(a),</quote> after <quote>45S(a),</quote>.</text></subsection> 
<subsection id="H23541977873B428BAFC7AB5C67FCA160"><enum>(d)</enum><header>Clerical Amendment</header><text display-inline="yes-display-inline">The table of sections for subpart D of part IV of subchapter A of chapter 1 of such Code is amended by adding at the end the following the item:</text> <quoted-block display-inline="no-display-inline" id="H59703CE6357D49C48FF675A91AFB2761" style="OLC"> <toc container-level="quoted-block-container" idref="H5DC5A12482084D88B68C3F4E2CEA231E" lowest-bolded-level="division-lowest-bolded" lowest-level="section" quoted-block="no-quoted-block" regeneration="yes-regeneration"> <toc-entry idref="HF9DECC6560094481B8ACB9222DCF63E5" level="section">Sec. 45U. Employer wage credit.</toc-entry> </toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="HF6A641BE17E440B2B305E84059EBCB69"><enum>(e)</enum><header>Effective date</header><text>The amendments made by this section shall apply to taxable years beginning after December 31, 2021.</text></subsection></section>
