R. 8665</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20221215">December 15, 2022</action-date><action-desc>Received</action-desc></action><legis-type>AN ACT</legis-type><official-title display="yes">To amend title 44, United States Code, to remove pronouns from such title that reference the Archivist, and for other purposes.</official-title></form><legis-body id="H16A05C449BEA42FA96B42ED5AB3667ED" style="OLC"><pagebreak></pagebreak><section id="HB5342D7540C84BB5BB2365A280764577" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Archives and Records Administration (NARA) Modernization Act</short-title></quote>.</text></section><section id="H4903F518D3314226B0DD7EB9EA5E9CEC"><enum>2.</enum><header>Amendments</header><text display-inline="no-display-inline">Title 44, United States Code, is amended—</text><paragraph id="HB0C5D8A9680944498C5D2C0CC986A3D0"><enum>(1)</enum><text display-inline="yes-display-inline">in section 710, by striking <quote>his approval</quote> and inserting <quote>approval by the President</quote>;</text></paragraph><paragraph id="H6F86F1FC5184473DBBA6F6E55318A0F3"><enum>(2)</enum><text display-inline="yes-display-inline">in section 711, by striking <quote>he shall</quote> and inserting <quote>the Director shall</quote>;</text></paragraph><paragraph id="HC35C3371848A4E5ABDF4EBBFF9FBDD32"><enum>(3)</enum><text>in section 2108—</text><subparagraph id="H00AB546390284F5CA3A03A0A5806AD5C"><enum>(A)</enum><text>by striking <quote>transferred to him</quote> and inserting <quote>transferred to the Archivist</quote>;</text></subparagraph><subparagraph id="HA79B7D9BA5E74B369C65662359D9964C"><enum>(B)</enum><text>by striking <quote>appear to him</quote> and inserting <quote>appear to the head of the Federal agency</quote>;</text></subparagraph><subparagraph id="H0A417B33535B4CD9806191C622088EF8"><enum>(C)</enum><text>by striking <quote>his custody</quote> and inserting <quote>the custody of the head of the Federal agency</quote>;</text></subparagraph><subparagraph id="HA997432D49574FDC9D3A6752A68CF742"><enum>(D)</enum><text>by striking <quote>he concurs,</quote> and inserting <quote>the Archivist concurs</quote>; </text></subparagraph><subparagraph id="HF072EA15CD99431FA3C67B64AA7F0526"><enum>(E)</enum><text>by striking <quote>his successor in function</quote>, each place it appears, and inserting <quote>the successor in function of the head of the agency</quote>; and</text></subparagraph><subparagraph id="H16D102982DE54A46899F3A7CB54FB0D2"><enum>(F)</enum><text>by striking <quote>he determines</quote> and inserting <quote>the Archivist determines</quote>; </text></subparagraph></paragraph><paragraph id="H9D3131A7FD5446F4A9F71DDF23C9ED2A"><enum>(4)</enum><text>in section 2109—</text><subparagraph id="H93E20D07921545348B7ABB6F0AE5E139"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>to him</quote> and inserting <quote>to the Archivist</quote>; and</text></subparagraph><subparagraph id="H62137467AE8F4331BEF6B96EA71D3D61"><enum>(B)</enum><text>by striking <quote>He may</quote> and inserting <quote>The Archivist may</quote>;</text></subparagraph></paragraph><paragraph id="H3A4C1AF26DB048998C6D9B02C284B9A6"><enum>(5)</enum><text>in section 2110—</text><subparagraph id="H54E0BD8288F34A75812D1BDC1DA9AF8A"><enum>(A)</enum><text>by striking <quote>he considers</quote> and inserting <quote>the Archivist considers</quote>; and</text></subparagraph><subparagraph id="H08E505CF098D4E20A970B0AFE021E27D"><enum>(D)</enum><text>by striking <quote>his control</quote> and inserting <quote>the control of the Archivist</quote>;</text></subparagraph></paragraph><paragraph id="H6416493583CB4A6FBBF42623973E8447"><enum>(7)</enum><text>in section 2307, by striking <quote>his designee</quote> and inserting <quote>the designee of the Archivist</quote>;</text></paragraph><paragraph id="H9BA544AF8D3C455FB33885071D5038FC"><enum>(8)</enum><text>in section 2903, by striking <quote>by him</quote> and inserting <quote>by the Archivist</quote>;</text></paragraph><paragraph id="H489F9343222C423798DA834B4A65AD53"><enum>(9)</enum><text>in section 3308, by striking <quote>he may</quote> and inserting <quote>the Archivist may</quote>;</text></paragraph><paragraph id="H290F46C091E34775981438D37EC01FCB"><enum>(10)</enum><text>in section 3310, by striking <quote>he considers</quote> and inserting <quote>the Archivist considers</quote>;
