which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HJU00">the Judiciary</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To ensure the right to provide reproductive health care services, and for other purposes.</official-title></form><legis-body id="H4AEF33207BEA4F4881916EA417D63260" style="OLC"><section id="HD8DAB826E0D1415CA41501ACE836D68D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Let Doctors Provide Reproductive Health Care Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="HDF4A38F18F3143DCB706C9CFA27773BE"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H2473AAE34B084347936D3A1EFEEDB39A"><enum>(1)</enum><header>Health care provider</header><text>The term <term>health care provider</term> means any entity, employee of such entity, or individual (including any physician, certified nurse-midwife, nurse practitioner, and physician assistant) that—</text><subparagraph id="H94E8E323B53C49748222F8E3833E15AA"><enum>(A)</enum><text>is engaged or seeks to engage in the delivery of reproductive health care services; and</text></subparagraph><subparagraph id="HB4A305D355C444FF8538C4F43D22712E"><enum>(B)</enum><text>if required by State law to be licensed, certified, or otherwise authorized to engage in the delivery of such services—</text><clause id="HBB08AAA49C274829B89B2D0B28BE9331"><enum>(i)</enum><text>is so licensed, certified, or otherwise authorized; or</text></clause><clause id="HA09FEAA492714A24A90B526EBEE37924"><enum>(ii)</enum><text>would be so licensed, certified, or otherwise authorized, but for their past, present, or potential provision of abortion services. </text></clause></subparagraph></paragraph><paragraph id="H61F354607EFB4A5EAFA0F2D13BC4D46B" commented="no"><enum>(2)</enum><header>Reproductive health care services</header><text>The term <term>reproductive health care services</term> means abortion services, contraception services, in vitro fertilization, or other reproductive care, education, and counseling that—</text><subparagraph id="H861D028CF251498EAD5DEA5E1E8C9214"><enum>(A)</enum><text>is provided in a hospital, clinic, physician’s office, or other service site, or provided via telehealth, intended to provide medical, surgical, counseling, or referral services;</text></subparagraph><subparagraph id="H6642231C93F84BB094F68A69A4667ABC"><enum>(B)</enum><text>is provided in a medically accurate manner; and</text></subparagraph><subparagraph id="H7F1E7ECD6CBD4636986E09DAA8A39B91"><enum>(C)</enum><text>in any way affects commerce over which the United States has jurisdiction. </text></subparagraph></paragraph><paragraph id="HAB59516845564E31B064A0C98BF64763"><enum>(3)</enum><header>State</header><text>The term <term>State</term> means each of the 50 States, the District of Columbia, Puerto Rico, each territory and possession of the United States, and any subdivision of a State, including any unit of local government, such as a county, city, town, village, or other general purpose political subdivision of a State.</text></paragraph></section><section section-type="subsequent-section" id="HC47876C3F78D4AC382A49974372F1F1E"><enum>3.</enum><header>Right to provide reproductive health care services</header><subsection id="H1AF099A673F4483DA8E1DC60D8164EA1"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">No individual, entity, or State may prevent, restrict, impede, or disadvantage—</text><paragraph id="HA458B0AD41CC48A2933E3D951CD371C7"><enum>(1)</enum><text>a health care provider from providing or assisting with reproductive health care services lawful in the State in which the services are to be provided;</text></paragraph><paragraph id="HD86E014A85F14AB98152C3772A508D0C"><enum>(2)</enum><text>any individual or entity from assisting a health care provider in providing or assisting with reproductive health care services lawful in the State in which services are to be provided; or</text></paragraph><paragraph id="H9C07D7AA62D348C38533CD7D0EA13788"><enum>(3)</enum><text>a health care provider or any individual or entity from providing or assisting a health care provider with reproductive health care services for an individual who does not reside in the State in which the services are to be provided. </text></paragraph></subsection><subsection id="H69B53127CD794521985A0CEE8CB9C12C"><enum>(b)</enum><header>Enforcement</header><paragraph id="HBC36AFF6D18D43C4BE7C6EF284C1860A"><enum>(1)</enum><header>Attorney General</header><text>The Attorney General may commence a civil action on behalf of the United States against any State, or against any government official, individual, or entity that enacts, implements, or enforces a limitation or requirement that violates subsection (a). The court shall hold unlawful and set aside the limitation or requirement if it is in violation of subsection (a).</text></paragraph><paragraph id="H482EBD47796746D9B8B78E12DB04E8BA"><enum>(2)</enum><header>Private right of action</header><text>Any individual or entity adversely affected by an alleged violation of subsection (a) may commence a civil action against any State that violates this section or against any government official that enacts, implements, or enforces a limitation or requirement that violates subsection (a). The court shall hold unlawful and enjoin the limitation or requirement if it is in violation of subsection (a).</text></paragraph><paragraph id="HB0D257756A584E158F2C8FE6EE50E5FD"><enum>(3)</enum><header>Health care provider</header><text>A health care provider may commence an action for relief on its own behalf, on behalf of the provider’s staff, and on behalf of the provider’s patients who are or may be adversely affected by an alleged violation of subsection (a).</text></paragraph><paragraph id="H33DC084181D94DF4AE288F3629076D79"><enum>(4)</enum><header>Equitable relief</header><text>In any action under this section, the court may award appropriate equitable relief, including temporary, preliminary, or permanent injunctive relief.</text></paragraph><paragraph id="HBA82F505D23F4BDDB44E9868C64BA1FF"><enum>(5)</enum><header>Costs</header><text>In any action under this section, the court shall award costs of litigation, as well as reasonable attorney’s fees, to any prevailing plaintiff. A plaintiff shall not be liable to a defendant for costs or attorney’s fees in any non-frivolous action under this section.</text></paragraph><paragraph id="H9177F7373AA04D77999A7ECB785D130F"><enum>(6)</enum><header>Jurisdiction</header><text>The district courts of the United States shall have jurisdiction over proceedings under this section and shall exercise the same without regard to whether the party aggrieved shall have exhausted any administrative or other remedies that may be provided for by law.</text></paragraph><paragraph id="H54B32EEBAE1D41BEA38D5564528B458A"><enum>(7)</enum><header>Abrogation of State immunity</header><text>Neither a State that enforces or maintains, nor a government official who is permitted to implement or enforce, any limitation or requirement that violates subsection (a) shall be immune under the Tenth Amendment to the Constitution of the United States, the Eleventh Amendment to the Constitution of the United States, or any other source of law, from an action in a Federal or State court of competent jurisdiction challenging that limitation or requirement.</text></paragraph><paragraph id="H1421376EC0FE419A83BCC59D9B2D8E24"><enum>(8)</enum><header>Right to remove</header><text>Any party shall have a right to remove an action brought under this subsection to the district court of the United States for the district and division embracing the place where such action is pending. An order remanding the case to the State court from which it was removed under this paragraph may be immediately reviewable by appeal or otherwise. </text></paragraph></subsection><subsection id="H2AD76A692DAE408C94ADBEFB7240C14E"><enum>(c)</enum><header>Rules of construction</header><paragraph id="HA5B635DC6F544ABAA7C43A018C6F6A4C"><enum>(1)</enum><header>In general</header><text>Nothing in this section shall be construed to modify, supersede, or otherwise affect the authority of any executive branch agency to promulgate regulations or otherwise implement laws.</text></paragraph><paragraph id="HA38190800ADC423A95AF677A56BFBE03"><enum>(2)</enum><header>Other individuals considered as government officials</header><text>Any person who, by operation of a provision of Federal or State law, is permitted to implement or enforce a limitation or requirement that violates this section shall be considered a government official for purposes of this Act. </text></paragraph></subsection></section><section id="HF046962E13F0464A93C07EFFFC87BF0C"><enum>4.</enum><header>Prohibition on the use of Federal funds</header><text display-inline="no-display-inline"> Notwithstanding any other provision of law, no Federal funds may be used by a State, including through a grant, contract, or cooperative agreement, to pursue legal cases against residents or other individuals or entities, or to take any other enforcement, disciplinary, or adverse licensing proceeding on the basis of such residents or other individuals or entities providing or assisting with reproductive health care services that are lawful in the State in which the services are provided.</text></section><section id="H3E1135D26B6340F680A99445682DF06A"><enum>5.</enum><header>Reproductive health care legal services defense fund grants</header><subsection id="H38DF6A09B0DA457884803F039FB364D4"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H5FE6CC5672D64DEAB762F861A267DD3D"><enum>(1)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means an individual, partnership, firm, corporation, or nonprofit organization that has a specific expertise in providing legal assistance and is licensed to practice law. </text></paragraph><paragraph id="H1651B1A3FC0846389761420E8BE92938"><enum>(2)</enum><header>Eligible provider</header><text>The term <term>eligible provider</term> means a health care provider that—</text><subparagraph id="H172FBE310D634FBF8C4A139B5A8D4FD6"><enum>(A)</enum><text>provides or refers for abortion care services; and</text></subparagraph><subparagraph id="HFB8BB5BCF2044BDE8896B71AEE9E057C"><enum>(B)</enum><text>faces legal issues relating to providing or assisting with reproductive health care services.</text></subparagraph></paragraph></subsection><subsection id="HF7A28B4D18F948BC9A2014382FDEED6C"><enum>(b)</enum><header>Funding</header><text>There is appropriated to the Attorney General, out of amounts in the Treasury not otherwise appropriated, $40,000,000, to remain available until expended, for purposes of awarding grants to eligible entities or consortia of eligible entities to provide legal assistance to eligible providers.</text></subsection><subsection id="H2B5AD1AD34BB40799AE25D02ADB0E454"><enum>(c)</enum><header>Application</header><paragraph id="H8B4F13D9C4B84EB3A4D2CBC68769C57D"><enum>(1)</enum><header>In general</header><text>An eligible entity desiring a grant under this section shall submit an application to the Attorney General at such time, in such manner, and containing such information as the Attorney General may require.</text></paragraph><paragraph id="H44839C9ED9714CABBCAE1DFBECFB7288"><enum>(2)</enum><header>Joint applications</header><text>Multiple eligible entities may submit a joint application that designates a single eligible entity as the lead entity for the purposes of receiving and disbursing funds received through a grant under this section.</text></paragraph></subsection><subsection id="H2F07BF4BC8E9455290BB70236CF338BA"><enum>(d)</enum><header>Use of funds</header><text>An eligible entity may use amounts received under a grant under this section—</text><paragraph id="H9EC530B1E4BB4A9E8E91C39296498C1F"><enum>(1)</enum><text>to provide advice, legal services, or representation to eligible providers, related to providing or assisting with reproductive health care services under Federal, State, and local law; </text></paragraph><paragraph id="HD13932B6F32D43C981E0A7C8932038E7"><enum>(2)</enum><text>to educate eligible providers about the rights and obligations of the eligible provider related to providing or assisting with reproductive health care services under Federal, State, and local law;</text></paragraph><paragraph id="HE72CB9C4C0B54E1BB64701EAB4A886E9"><enum>(3)</enum><text>to monitor compliance by a State with Federal, State, and local laws related to providing or assisting with reproductive health care services; and</text></paragraph><paragraph id="HE3F7A7FE912F45779CC062CCEA006E13"><enum>(4)</enum><text>for any other activity the Attorney General may reasonably prescribe that is related to providing or assisting with reproductive health care services under Federal, State, and local law. </text></paragraph></subsection></section><section id="H1E7588DAE9F346DA9B5E4E42109D9B10"><enum>6.</enum><header>Reproductive health care services security grants</header><subsection id="H6A6C53A0650F4B6F90A0A63CB168C950"><enum>(a)</enum><header>In general</header><text>There is appropriated to the Secretary of Health and Human Services (referred to in this section as the <quote>Secretary</quote>), out of amounts in the Treasury not otherwise appropriated, $40,000,000, for purposes of awarding grants to eligible providers (as defined in section 5(a)(2)(A)) for enhanced security for staff and patients of such providers.</text></subsection><subsection id="H59FB4409438C4AE8A0C82DCE68615A98"><enum>(b)</enum><header>Application</header><text>An eligible provider (as defined in section 5(a)) desiring a grant under this section shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require.</text></subsection><subsection id="H2C66774EC62D4F60BFB00878A80FE8FE"><enum>(c)</enum><header>Use of funds</header><text>A recipient of a grant under this section may use such grant funds for any of the following purposes:</text><paragraph id="H4DD7529D154C475F9D39FB313396F322"><enum>(1)</enum><text>Providing physical upgrades to health care facilities to improve security.</text></paragraph><paragraph id="HF066CBD36470442983B72BCF530F65B6"><enum>(2)</enum><text>Providing training in security to health care staff.</text></paragraph><paragraph id="H7B7716A0C9CF4600BB5AA73E7C08C791"><enum>(3)</enum><text>Improving capabilities to defend against cyberattacks.</text></paragraph><paragraph id="H2446DC9567B9468DA604EA2BE9DD55BB"><enum>(4)</enum><text>Ensuring patient and provider data security.</text></paragraph><paragraph id="H12647709B2684C52B8612D075F025129"><enum>(5)</enum><text>Providing protective services to staff and patients.</text></paragraph><paragraph id="H32A5B152FE6046D38CC5200EFBC994EE"><enum>(6)</enum><text>Any other activity, as the Secretary determines appropriate. </text></paragraph></subsection></section><section id="HC218D4F66C97473EBA7DB4B14CB85D42" commented="no"><enum>7.</enum><header>Fair liability insurance</header><text display-inline="no-display-inline">An issuer of professional liability coverage for health care providers shall not—</text><paragraph id="H032903BFBB984BA4B0E45ABB490360AA" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">deny a health care provider professional liability coverage because that provider offers, supports, provides, or prescribes lawful reproductive health care services; or</text></paragraph><paragraph id="H490EF05CB11D457DBC829E5937F482C2" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">sue a health care provider because that provider provides lawful reproductive health care services.</text></paragraph></section><section id="H13D0CF562A39428690A1B1C5482DB57F"><enum>8.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act, or the application of such provision to any person, entity, government, or circumstance, is held to be unconstitutional, the remainder of this Act, or the application of such provision to all other persons, entities, governments, or circumstances, shall not be affected thereby. </text></section></legis-body></bill>
