which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Emergency Planning and Community Right-To-Know Act of 1986 to require an emergency notification meeting in the event of the release of an extremely hazardous substance from a facility, and for other purposes.</official-title></form><legis-body id="H63E5CD0C9AEE42EA8A9FF636641341FB" style="OLC"><section id="H117A97129DC04CFCB25D23BCEC135A5A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Alerting Localities of Environmental Risks and Threats Act of 2021</short-title></quote>. </text></section><section id="H3A6A8847057549BBB60A68A3918A79C3"><enum>2.</enum><header>Public meetings added</header><subsection id="H69541FD1D7A54490B15A94F8D0C3AA64"><enum>(a)</enum><header>Emergency notification meeting</header><text display-inline="yes-display-inline">Section 304(b) of the <short-title>Emergency Planning and Community Right-To-Know Act of 1986</short-title> (<external-xref legal-doc="usc" parsable-cite="usc/42/11004">42 U.S.C. 11004(b)</external-xref>) is amended by adding at the end the following new paragraph: </text><quoted-block style="OLC" id="HC312E19453B94515B4C54797F73B9F41" display-inline="no-display-inline"><paragraph id="H0816ABD6D11F407B95150C058457B553"><enum>(3)</enum><header>Public meeting</header><text display-inline="yes-display-inline">Not later than 72 hours after a release which requires notice under subsection (a), the owner or operator of the applicable facility shall—</text><subparagraph id="H0434A3BBE72C4C6CB81A6691B3846D66"><enum>(A)</enum><text display-inline="yes-display-inline">publish a notice in a local newspaper, and post such notice at a local library and other local government buildings and on the public website for the facility, if any, with at least 24 hours notice, of a public meeting, including—</text><clause id="HD57C58182F6A43678FDDAC65C5E05F20"><enum>(i)</enum><text>the date of such meeting;</text></clause><clause id="H0C87BCC6205B4A4BBD18549253BF2337"><enum>(ii)</enum><text>the time of such meeting; and</text></clause><clause id="H7DE5BA7622D14F85A286F5C126B0015A"><enum>(iii)</enum><text>the location of such meeting; and</text></clause></subparagraph><subparagraph id="HF1FCD0BE98D4434599F496F0E8E29D12"><enum>(B)</enum><text display-inline="yes-display-inline">hold such meeting, providing, consistent with section 322, the information required under paragraph (2), to the extent such information is known at the time of the meeting and so long as no delay in responding to the emergency results.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HCE1EFC1F0F0243BABFBC13582B5F20DC"><enum>(b)</enum><header>Annual public meeting</header><text display-inline="yes-display-inline">Subtitle A of the <short-title>Emergency Planning and Community Right-To-Know Act of 1986</short-title> (<external-xref legal-doc="usc" parsable-cite="usc/42/11001">42 U.S.C. 11001</external-xref> et seq.) is amended by adding at the end the following new section: </text><quoted-block style="OLC" id="HD3A8B28ABFFA4BAFBF48DE0EB13ED81A" display-inline="no-display-inline"><section id="H59B33BD53E8D4BE2B080DB168256AEA9"><enum>306.</enum><header>Annual Public Meeting</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this section, and annually thereafter, the owner or operator of a facility subject to the requirements of this subtitle shall—</text><paragraph id="H4325C98C021C4D39A7D865486AACDDE5"><enum>(1)</enum><text display-inline="yes-display-inline">publish a notice in a local newspaper, at least 7 days in advance, of a public meeting, including—</text><subparagraph id="HCDA9A58A5A7547589C3336EACE91276F"><enum>(A)</enum><text>the date of such meeting;</text></subparagraph><subparagraph id="HF71A168749ED4B6D9F532E2A1D37DD3C"><enum>(B)</enum><text>the time of such meeting; and</text></subparagraph><subparagraph id="HC6842D3A021D4FC9839249DEEB9C322B"><enum>(C)</enum><text>the location of such meeting; and </text></subparagraph></paragraph><paragraph id="H2A09FB8CACEE446DAEA5B0F51926DF01"><enum>(2)</enum><text display-inline="yes-display-inline">hold such meeting, providing, consistent with section 322—</text><subparagraph id="HF545923B48C644C5874C791334788511"><enum>(A)</enum><text display-inline="yes-display-inline">the chemical name of each substance on the list published under section 302(a) that was present at such facility, in an amount in excess of the threshold planning quantity established for such substance under such section, at any time in the preceding calendar year;</text></subparagraph><subparagraph id="H52BA2ACCCFFC44519A91EE00A0080506"><enum>(B)</enum><text>an estimate of the maximum amount of each such substance present at such facility during the preceding calendar year; and </text></subparagraph><subparagraph id="HB0BC4D1DC97943AD9EF9080E3E20CF39"><enum>(C)</enum><text>the details of the methods and procedures to be followed to respond to a release of such a substance pursuant to the applicable emergency plan prepared under section 303(c).</text></subparagraph></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H8B22B9F109E5421A87435C0D93B0D6AF"><enum>(c)</enum><header>Enforcement</header><text display-inline="yes-display-inline">Section 325(c)(1) of the <short-title>Emergency Planning and Community Right-To-Know Act of 1986</short-title> (<external-xref legal-doc="usc" parsable-cite="usc/42/11045">42 U.S.C. 11045(c)(1)</external-xref>) is amended by striking <quote>section 312</quote> and inserting <quote>section 306, 312,</quote>.</text></subsection><subsection id="H101DA4145D5240A9AF4EC885C9E9E86E"><enum>(d)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents in section 300(b) of the <short-title>Emergency Planning and Community Right-To-Know Act of 1986</short-title> is amended by adding after the item relating to section 305 the following: </text><quoted-block style="OLC" id="HFA637C08B55944B28D39BEA8E81D0976" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 306.
