which was referred to the <committee-name committee-id="HHA00">Committee on House Administration</committee-name>, and in addition to the Committees on <committee-name committee-id="HWM00">Ways and Means</committee-name>, <committee-name committee-id="HPW00">Transportation and Infrastructure</committee-name>, and <committee-name committee-id="HED00">Education and Labor</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require States to obtain information from Social Security Administration on deaths for purposes of voter registration list maintenance, and for other purposes.</official-title></form><legis-body id="HC8E8870B678A43578F8C8C003DAB08D8" style="OLC"><section id="H6A57A6E75F7441C88C4D29D0F0D6A7C1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>You Must Be Alive To Vote Act of 2021</short-title></quote>. </text></section><section id="HDDE338BF8AA747B79122CB7F8ABE234F"><enum>2.</enum><header>Requiring States to obtain information from Social Security Administration on deaths for purposes of voter registration list maintenance</header><subsection id="H2136FF084D864121953CDBDD3513DF76"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 8(a)(4)(A) of the National Voter Registration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/52/20507">52 U.S.C. 20507(a)(4)(A)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" id="H2CD659E3E22343008C4F7EB31391D60D" display-inline="no-display-inline"><subparagraph id="H8EC227B812B34D23AB8466503BD905D7"><enum>(A)</enum><text display-inline="yes-display-inline">the death of the registrant, as determined on the basis of information obtained through records of the State and of information obtained through ongoing consultation with the Social Security Administration; or</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H02411614C1574AAEBE70F8E15C9F0809"><enum>(b)</enum><header>Authority To match data</header><text>Section 205(r) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/405">42 U.S.C. 405(r)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HBA311379D7124D308E806F03F8D89FC9" display-inline="no-display-inline"><paragraph id="H39E9D09C787949AEBB5DC053E279C980" indent="up1"><enum>(10)</enum><text display-inline="yes-display-inline">The Commissioner of Social Security shall, upon the request of a State pursuant to section 8(a)(4)(A) of the National Voter Registration Act of 1993—</text><subparagraph id="HDE6FC6D88F6740FC8A64F422FB5DCDF0"><enum>(A)</enum><text display-inline="yes-display-inline">enter into an agreement with the State for the purpose of matching data in the records of the Social Security Administration and the official list of eligible voters of the State; and</text></subparagraph><subparagraph id="H85AB24B79173449B81489068EA1153FB"><enum>(B)</enum><text>include in such agreement safeguards to assure the maintenance of the confidentiality of any information disclosed.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H457F5898D9484025B45275484490EF0E"><enum>(c)</enum><header>Annual certification; enforcement</header><paragraph id="H53150F485D194A8989F816FBAE83425D"><enum>(1)</enum><header>Certification</header><text>Each State shall certify, with respect to each calendar year, to the Secretary of Education and the Secretary of Transportation that the State has in place an agreement with the Social Security Administration to share death information for purposes of section 8(a)(4)(A) of the National Voter Registration Act of 1993.</text></paragraph><paragraph id="HF982CBFF606F410B89285444378DFC1E"><enum>(2)</enum><header>Penalties for noncompliance</header><text display-inline="yes-display-inline">With respect to any calendar year in which a State has failed to so certify, the Secretaries of Education and Transportation may not make available any Federal funds to the State, any county within the State, or any resident of the State.</text></paragraph></subsection><subsection id="H385E60179850443E8FBD6329BBEDFBE4" commented="no"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section—</text><paragraph id="H3F8560F4D7BF419C9209B9270AA86930" commented="no"><enum>(1)</enum><text>the term <term>State</term> means a State of the United States and the District of Columbia; and</text></paragraph><paragraph id="H45506719E1CB4401BED45730EE6793F5" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>county</term> means a parish in Louisiana, a borough in Alaska, or a county in the other 48 States. </text></paragraph></subsection><subsection id="H80D5823B6ACC4F609473C58616F17D19"><enum>(e)</enum><header>Effective date</header><text>The amendments made by this section shall take effect 1 year after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
